@@caleb8695 Hopefully. She seemed solid in the hearings, but she definitely doesn't have the charisma. Not that charisma is necessary for the court, but that was one of the unique things about Scalia

@@jz8377 She clerked for Judge Laurence Silberman of the United States Court of Appeals for the District of Columbia Circuit, followed by a year in the same capacity for Supreme Court Associate Justice Scalia. She then joined the Washington, D.C., law firm of Miller, Cassidy, Larroca & Lewin in, before making way to academia in with a stint as the John M. Olin Fellow at Law at George Washington University Law School. And in 2017 she was appointed to the Seventh circuit appeal court where she served for 3 years. What else do you want?

Imagine Colbert in that room where he absolutely destroyed the president and media ruthlessly at such a tense time. At the end, he had to want to run out of the room but luckily Scalia came up and talked to him. It's in those moments where a person's true color shows. One of the few Republicans who could take a joke and it's sad how his death quickly became political.

While I don't agree with everything Scalia did, I have the utmost respect for his protection of our constitutional rights and public security. He was also a man of true heart and character. Anyone who disrespects the man just because he believed in creationism is a loon and is everything wrong with this country.

There is nothing wrong with not respecting Scalia, but I suppose for civility sake, we could refrain from saying mean things for his family to see. +daarrkmatter I feel Colbert kinda got forced into this new role taking over this show from Letterman, you can see he is not really comfortable forcibly interacting with the audience and/or the music guys. They saw Colbert and saw that it was good, but then forced him..oh im sorry I mean "asked" him to be letterman 2.0. But you still see old Colbert every now and then.

***** He's definitely softer, but I mean let's be fair here. Unlike Stewart, he's no activist. That's not a thing I think he'd want to do for the rest of his life. I don't see a problem with him taking it easy and goofing around on a talk show, especially since he's more political than any other talk show host has ever been, and his persistence in getting not only politicians but other major players in government on his show has been a good thing. If that's what serving the corporate overlords looks like, I wanna see more of it!

It seems like a conscious decision on his part. He took the gig of hosting a talk show, it's kind of a given that means easing up on the politics part a bit. I don't hold it against him, particularly since when he does go into politics, he churns out some great stuff (The Hungry for Power Games!).

He was a powerful jurist and a man of firm principle (which I totally disagreed with but had to respect). This showed he also had the single most important trait of a person with true power (and he did have this), he could and did laugh at himself. If this man was the enemy of my beliefs then I will say he was an enemy of the highest quality that I could respect. RIP

Therefore, I'll do the slightly less courageous thing instead, which is stating I agree with you, "like" your comment, and thank you for making it in the first place. Firm principle? The dude said it was okay to put an innocent man to death. He also flipped flopped like a fish on states rights, if you did something he liked state rights all around, if you did something he hated fuck you supremacy clause. He said it was okay for states to ban homosexual sex and sodomy. He one case he was against cops taking a DNA sample without a warrant but in another he said cops can strip searched without one. He was also responsible for the Citizens United ruling which corrupted politics.

Pifacedude Principles we don't agree with, or even principles that are, or are applied in, despicable ways, can still be firm principles. The only one of your examples that is a counterexample is the "flip-floppiness on state rights" one, and I don't have enough knowledge to go on to verify the validity of that one. Could you provide some examples (with sources obviously), say 6 -- three of each -- of rulings where Scalia voted respectively for and against the Supremacy Clause?

+lionthieves IT's sad, but the people attacking him are just low lives that spend their days attacking people on the internet because they have failed in their own lives. Scalia lived a great life, he was himself. It's sad that as a nation that just because a person believes differently than you that it makes them a bad person. I'm sure the same people will be on opposite sides of the argument when Ginsberg passes away, the right will say she's evil and glad she's gone and the left will say its classless to go after and make politics out of someone who just died.. I've become so politically neutral because of this left right struggle in the nation that it makes me not want to vote.

Scalia was a man that could separate someone’s political ideology from their personality the man should be an idol to everyone because of this people shouldn’t be separated on their political believes everyone should watch how Scalia acted and treated people that he disagreed with this man was a truly respectful man and should be remembered for a long time to come

Justice Scalia's grandson Chris goes to my high school and I can only imagine how he's taking all the jokes about his granddad's death. Many think he was a great man and even if you don't agree, you can at least give him and his family the respect they deserve in this tough time.

Justice Antonin Scalia did his job according to his beliefs. That people here judge him so callously for his beliefs speaks of their own intolerance and ignorance. I disagreed with many of his rulings, however a powerful, judicious, man, one who stuck to his principles, passed away, and should be respected. In addition, that's a misinterpretation of a quote. Scalia was remarking on how, based on the Constitution (of which he swore to uphold and defend for his lifetime as a Supreme Court Justice), if he received a fair and full trial then the sentence would be Constitutional. That doesn't mean that he thinks it's right, and he himself said that he wouldn't be surprised if the death penalty is ruled unconstitutional. This is the full quote, from a dissenting opinion on the retrial of Troy Anthony Davis. "This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is “actually” innocent. Quite to the contrary, we have repeatedly left that question unresolved, while expressing considerable doubt that any claim based on alleged “actual innocence” is constitutionally cognizable." The fact is, Scalia was a conservative justice. By that, I mean that he would uphold exactly how he believes the Constitution and past courts have voted, and he would very rarely try to re-interpret or challenge a past court. He wouldn't twist the court for progressive issues, if he believed in them or not. You can agree with him sticking to the Constitution, or you can disagree, but either way, you must respect him for sticking to his beliefs and fulfilling his duty as he saw it.

That White House Correspondence speech from Stephen is legitimately one of the most ballsy, greatest comedic performances I've ever seen. Cutting, intelligent, and brilliant. Seeing Scalia laugh at Stephen's joke was nice, as so many of the politicians there had no sense of humor at all while Colbert savaged them.

His difference of opinion effect every American and his difference of opinion have many negative implications unlike some guy venting at a dive bar. Respect is not something automatically granted upon death. If you dislike him before death, then his death should change nothing. I would say that for civility sake, one can always choose to not say something mean, but don't ask people to morn or pay respect to someone they didn't respect in the first place.

People aren't celebrating his death. They are celebrating the fact that he can no longer use his position of great power to harm many of the most vulnerable groups of Americans. Many people believe Scalia had a negative influence on the country. In a similar way want conservatives will be happy when Obama leaves office. I am sorry for his family because I would imagine they cared for him. But I am not sorry that he is no longer a justice. He was a terrible justice. He probably believed in what he was doing... But then again so did the justices who decided plessy or dred scot and look how that turned out.

That's how I feel too, but the taboo of never speaking ill of the dead has a strong hold still on many. I'm not glad and relieved he's dead as much as that he is finally off the court. If I didn't have such a low opinion of Clarence Thomas, I'd almost pity him in his grief, for what will he do now without Nino to follow like an eager puppy? The disingenuousness of claiming to be an originalist, as if that's naturally admirable, as a cover for his prejudicially driven decisions, was reprehensible.

I disagreed with Scalia on so many issues, but I was very sad when he died. The man knew how to judge. He was funny and was a good person.

I am a Canadian and, most of you think correctly, that we are more to the left. But I have to say that prior to 1982 (adoption of our Charter), Justice Scalia would have felt at home in Canada (and the UK). Judges in Canada were much more restrained than in the USA.

I'm a law student in Europe but even here we recognize that Scalia, whether you agreed with him, was a very competent judge. It's just too bad the Supreme Court is so political in the US

+rymdalkis I am also a law student in Europe and I can tell you that the common opinion, as I have understood it, is that a judge per definition is not competent if he can't put his personal beliefs aside when taking a stance on a judicial matter. Neather is he competent if he does not rule without a political bias, which seems to be a difficult thing to do when the system is working against you and you are being nominated on a political basis. The judicial system itself isn't independet which undermine it's legitimacy. It's a sort of judicial-political hybrid system.

Bravo. This is what we need more of. I admit that my first thought on hearing about his death was,a certain song from The Wizard of Oz. But perhaps if more people were willing to take this kind of effort to see the humanity in people they disagree with, maybe the world would be a better place.

This was a very honorable thing to do. I am, admittedly, a liberal (gasps), but when I heard of Scalia's passing I was shocked and disgusted at the amount of disrespect, both in the form of insensitive jokes and flat-out hostility and hatred. I don't care what people's politics are or what disagreements they may have with the opposing side; every person deserves dignity and respect at their passing...particularly for a position as important and honorable as a United States Supreme Court Justice. Thank you for being so cordial and respectful, Stephen. You are a true Patriot.

In no way did I agree with a majority of what Scalia believed, but he was a human being who lost his life and left behind family and friends that are now in mourning, so RIP Scalia

If I were Stephen, I wouldn't have said anything. I would go with the mom-ism of 'if you don't have anything nice to say about someone....". I am not Stephen and that's why he's got a show and I don't. Stephen is a gentleman.

Scalia was truly a great man and I dont even like you so I'm pleased you didnt make jokes at his expense. He did have a wonderful sense of humor and he understood the constitution and had a way of explaining in true layman term. He will be missed.
