I've got a DA that not only engaged in malicious prosecution but provably, aided and abetted a "victim" in his attempts to commit insurance fraud.., as unbelievable as that sounds.

Hello Steve I’ve recently ran across a term or law called “ conditions precedent” the Supreme Court has ruled that an abuse of process encompasses the entire range of malicious prosecution. So if the prosecution is derived from a constitutional wrong such as abuse or due process I don’t believe the law requires you to prevail in the criminal case first?

Also in my divorce case there are over 17 forgeries of opposing counsels signature on motions. I objected to each one accordingly. My objections were granted. My objections were as follows: Perjury Fraud Fraud upon the court Vexatious litigation And deprivation of rights and liberties. What can I sue for concerning the forgeries? Also on an official certified court order the judges signature is forged. Another attorney told me it's not a big deal and there is nothing I can do. Forgery is a felony in Ohio. I don't believe that to be true. Is it? What causes of action can I do?

Sorry to hear about the corruption you discovered. Seems rampant in family court. Courts are preying on the people because they know people will do anything for their kids and if they are self represented and trying to maintain their lives while in a state of legal ignorance, they'll be able to get money out of them and the federal laws that bring child support dollars to the court, so I'm learning. They think were stupid and don't know our rights, not the same as not knowing the mechanisms of the legal game. Sad state of affairs. Know you're not alone.

What would be the legal term be called when you challenge Subject Matter Jurisdiction, the judge reviewing the petition knows she can't show that the court has jurisdiction but ignores your Petition and does not present a legal argument?

Sounds like I could sue for Abuse of Process and Malicious Prosecution. I understand the difference, but I see that both occurred in my case. Is that possible? Which one can be used against the lawyer, not just the original Petitioner.

I was charged with false allegations of violating a protection order multiple times. I proved to the prosecutor that it was all lies utilizing phone records, Facebook posts (that proved with dated timestamp I was not at the accused crime location), and witnesses. The prosecutor nolle prosequi each case. There was no further prosecution after dismissal. Is that cause for abuse of process claim?

The witness whose testimony brought a lawsuit upon said person was found to have perjured him or herself, and this person and testimony was the sole cause ("based solely") on that perjured witness (whose testimony, I assume, is what caused the witness to be found to have committed perjury?). How would a case not be thrown out if the sole basis was found to be based upon a known perjury by the sole witness?

That’s exactly what I thought. This witness is a person whom I had to get an harassment order against that is currently being n the process of being extended. The witness has been hell bent to assassinate my character along with my best friend’s on social media since 2013 . That’s why I had to get the harassment order over 2yrs ago & hoping for a longer extension. The plaintiff is the one that told me about some of the posts WITH pictures she took off our FB account me any chance she can. During this litigation the witness filed a restraining order against my Bff & I that was based on lies that I proved with documentation, pics & video at the hearing. I was awarded attorney fees for that . She was caught lying just to get the temporary order approved which shows up on court records. The plaintiffs attorney was told at the beginning when I got the papers saying I’m being sued for undue influence, elder abuse, elder financial abuse by the the same person that first told me about the posts that the witness put online. My attorney & I told the plaintiff & her attorney I know Dena is the one that instigated & continues to stoke. They CONTINUED to use the witness’s testimony even after she admitted in deposition all the accusations WERE LIES! Now I don’t have a trial date because the plaintiffs attorney submitted to the court that we settled. Don’t BOTH PARTIES HAVE TO SIGN AN AGREEMENT? He had 45 days to file the final settlement which never happened. This litigation has cost me WELL OVER $100,000.00 which isn’t much compared to the mental abuse I’ve gone through defending myself against a malicious person that’s a known perjurer but what makes this that much worse is her abuse is being carried out by the plaintiff and her attorney as well. That is more than wrong it’s ILLEGAL, & UNETHICAL on many levels. I’m not an attorney but I DO KNOW RIGHT FROM WRONG! I know it sounds dumb to say that I wanted my day in court to prove I’m innocent. I feel like they should reimburse me for all the attorney fees, court fees ect.. NOT TO MENTION MY PAIN AND SUFFERING. This case NEVER should’ve went into litigation IF THE PLAINTIFFS ATTORNEY DID HIS HOMEWORK ON IS WITNESS. It would’ve SAVED ALL OF US TIME, MONEY & MOSTLY THE STRESS IT HAS BROUGHT TO MY FAMILY & I. My attorney told me they have 5 year to try and take me to court. WTF so I just put my life on hold & wait 5 years longer?? I’ve been going through this litigation since November 2017 that’s based on PERJURY from A PERSON I HAVE BEEN HARASSED BY SINCE “2013”! I’m pretty sure that if we did go to court that the outcome would go in my favor once the judge heard where all the allegations came from.

That monster vacated her contempt motion because I proved 5 counts of perjury on her affidavit but it took 4 months more of suffering on my part for no damn reason. Oh wait I get to sue her and two lawyers because the first got his license suspended after a month so she got a new one. bahshaa

Penny, who brought forth the criminal matter? How were they malicious, and were they successful? Was that because of their position of power or because there was no other evidence to justify an acquittal or dismissal or was this a larger conspiracy involving many people working collaboratively in malice to pursue and prose Ute a criminal matter? How many people were received by the one (or how many?) people who maliciously caused a criminal charge and I'm assuming, a prosecution of such? If this is actual and not theoretical, then the answers are important, and may help either you, the person who was victim to a malicious criminal complaint, or future people who may fall victim to such. If this is referencing a larger conspiracy, I hope you've sought out investigative journalists and other detectives to help in the matter.

Great explanation, but my question would be, as an officer of the court, how can you feel comfortable discussing this online, and if the other party knows you have an online presence, that you will sue them for malicious prosecution? How can you be so fearless?
