My wife really wanted an Acadia. I strongly recommended against it or any GM car, but she bought it anyway. First problem was the car wouldn't let her shut it off because it didn't believe it was in Park. Dealer replaced the shift assembly under warranty. Now that it's out of warranty, the sun roof leaks and it has some weird, intermittent electronics problems. Time for it to be stolen, I guess, but no one seems interested ;)

The appropriate judgement in court would be that, in addition to jail time, the thief must pay restitution to the victim for anything insurance doesn’t cover.
@iffracem
@iffracem Жыл бұрын
In a perfect world, but how would the thief pay the restitution? They won't have a job, being in jail, or have much chance of getting one as a convicted felon, so how? By stealing other peoples stuff once they get out, selling it and handing over part of the proceeds? Maybe we need "penal corporations" run by governments that can do all the shit work that nobody else wants to do, and these arsehats can work for them, with part of their pay sequestered and given to the victim? But then private industry would probably bitch that they're being denied the chance to get rich.

Most criminal courts can't force the suspect/defendant to pay back what was stolen/lost from the victim. After criminal charges are filed and prosecuted and they're convicted, they have to sue civilly. And then to top that off, most civil courts will order you to pay it back, but they won't actually force you to do so

Called Supply And Demand. Courts need criminals to stay in business, make money. A criminal in jail is lost wages for the court, get them out on the street ASAP, back to work commiting crime. My neighbor is a bail bondsman, his regulars have a running account with him. Every week or month they add to their account so when ( not If ) they're arrested they can get out just as soon as they see the judge and bail is set. A short list of those directly / indirectly feeding off crime are: Criminal Justice college professors, Police, Judges, Court reporters, Defense Counsel, Jailers, Court LEO, Insurance agents, Court Recorders, Prosecuters, Court Appointed Head Shrinks, Bail Bondsmen, et al ad nauseum. ☆ The Legal System: "Crime is OUR business, and business is GOOD !"

@@twinku1 This is why criminals will run in California. They know that the police will not pursue them if there if there is some chance of danger to the public. A good example, a silver Corvette is reported on multiple days as going a very high rate of speed on city streets. Police do not pursue them because they cannot pursue them per rules of pursuit. The final report of a silver Corvette going at a very high rate of speed ended and said silver Corvette running a red light and hitting a log truck. The silver Corvette splits in half leaving the passenger side with passengers pinned under the trailer, and the driver's side with the driver catching fire and rolling into a gas station. Just last night in the same city a stolen car was recognized by an officer who initiated a stop and the car took off at a very high rate of speed. Police officer did not pursue them because of said policy. That stolen car 1 mile down the road ran a red light and was T-boned by a another driver. The good thing is the driver of the stolen car was killed in the accident the bad thing was the driver of the other car was sent to the hospital with serious injuries.

So MANY stolen cars from folks that work to pay for them. Authorities should change this protocol to protect the property of the owner. If it was my car, I would rather law enforcement be authorized to shoot through its windows to eliminate the threat to society. Of course, I would replace the glass, but at least its not totaled. Might even keep a couple bullet holes and brag about the great result. Car is in good shape, thief not so much :)

I'm not a cop, but it seems that following them for ~7 minutes total, and letting them get onto the highway, was poor management of this situation. After 1-2 mins, pull alongside so there is 99% proof they see you. If they still don't pull over, coordinate with the 2nd trooper to try to box/pin them at low speed. If unsuccessful, should've pitted them on that highway entrance ramp. *Allowing* a suspect to get on the highway like this was a significant public safety risk.
@1AXMRDR

Yeah it seemed dangerous to me to let them get on the freeway where speeds can go up considerably. He had a backup unit behind him, seems like he could have passed her and boxed her in. I'm sure there is a policy about how to handle this situation. He was just following it. Blows my mind that she didn't pull over, it's not like she stood any chance of out running them doing the speed limits.

I feel for the victims of these thefts, especially if it ends in the vehicle being totaled. I bought a car in 1999 I worked for it during summer and after school. My parents met me halfway on the cost. I had to put a little more in for repairs and getting it road worthy. I kept it all the way till 2016. Ex-wife totaled it. Insurance wouldn't give me a dime as the car was so old. I took care of that thing. overhauled the engine at 200,000 and upgraded individual parts to keep it as efficient as possible. I STILL don't have a car. I haven't been able to save up the funds, COVID lockdown and subsequent job loss just makes it even more of a difficult financial hit to recover from.
