Chickens don't have fingers so it makes that sense nobody would expect to get actual "Chicken Fingers". However if I get served "Boneless" wings, I expect no bones, because of the existence of "bone in" wings. If I would have wanted the bone, I would have ordered it with the bone. The same can't be said for if I wanted "chicken fingers".

i work in a wing restaraunt and i dont know how this is a "cooking style". we cut chicken tenders into wing sized peices, and those tenders are cut from breasts which are seperated from the breast bone. Theres no way there should be a bone in a boneless wing. Bone in and boneless dont even come from the same part of the chicken.

Redbull did not have to pay up for that. It was for pretending Redbull is a health-improving drink, which it is not. Their motto was not the issue by itself, but it did attribute to the image of the product. They still use the motto, but they stopped pretending that Redbull makes you healthier. Using the motto by itself is not unlawful as long as it does not convey the message that it will improve your health. Similarly, I think this case was just a terrible headline of a news article. Media often portray judgments in the least nuanced way possible. I have not read the judgment but I'm almost certain that is the case here. EDIT: I should add that it could be a bad judgment. But still, I cannot imagine that it is as black-white as portrayed here. On the other hand; Ohio.

it's not so much that the U.S. won't allow a food product with something inedible inside of it, it's that so many Americans weren't aware that you're NOT supposed to eat the clearly inedible egg inside of the chocolate to the point where it became a serious problem, as well as American parents not teaching about choking hazards or watching their young children within choking hazard age while they ate/assembled the kinder toy, so they decided it would just be best to not have it in the U.S. anymore.

This is going to the United States supreme court. The highest court in the country. And it's going to be 6-3 in favor of choking on bones in boneless chicken. This means every state, not just Ohio, will have people become deceased via boneless chicken. And nobody can do anything about it. Should the guy have chewed his food? Yes, given that that is standard operating procedure for human ingestion. He also, somehow, didn't notice said bone lodged in his esophagus for days. I'm kinda surprised that the guy hasn't already died from choking on food by this point.

Yes, your wings should be “boneless” as the cooking technique includes “deboning” - but you should take care, as there may have been an issue in the deboning process. A bone in a wing is a reasonable expectation. You shouldn’t swallow wings while with the assumption they have been accurately deboned.

It's not even a "cooking style". Deboning is part of food preparation. Preparing food in unsanitary conditions to make it safe to consume is not a cooking style either and you cannot guarantee that there is zero bacteria in the food, but if someone gets food poisoning and the food preparation was found to be subpar, then they should be liable. It should be the process of how this was deboned that should be examined, at least from now on.

There literally are regulations for the amount of fecal matter you can reasonably have in food (and it is obviously very very little). I don't understand how can people say "Imagine this, imagine that" When there indeed are laws dictating how much of anything can be in anything! Turns out it is within reason to occasionally find a piece of chicken bone in a chicken dish. The lawsuit tried to leverage a point about the name "boneless" because they had no other strategy, but it ended up being fruitless.

Talked about this with my law professor. He explained that calling the product “Boneless Chicken Wings” is an express warranty that promises this product are the boneless wings of a chicken, and if they aren’t, money back guaranteed. Of course, he explained that doesn’t really matter. What matters is what the jury decides and the jury decided that boneless chicken wings don’t need to be boneless which is really unnecessarily messing up how express warranties are going to work in the law going forward

Except that’s not correct. Boneless wings are a misnomer. They’re just nuggets made with breast meat.

I think the only reason this got thrown out was because most every industry has something called a "margin of error". So like regulations give very minimal leeway for products, as long as it doesn't go past like a certain percentage/threshold. Possibly something like that exists for food products, when it comes to natural obstruction/objects. My only grind with this issue is that the boneless wings were from some mom n pops restaurant, so it wasn't like an industry/companies margin of error, but more so human error. Unless they order a shipment of boneless wings from some 3rd party producer. We have other terms that need better regulations tbh.
