Taking Advantage of Kindness

The plaintiff used to be close friends with the defendant’s mother. She added the defendant to her cell phone plan, but he never paid, so then her phone got cut off. The plaintiff also let the defendant live with her in exchange for looking after her son. She’s suing for the cost of the phone bill. The defendant agues everything was fine between them until she argued with him about chores. He doesn’t think he owes.

I was hoping JM would’ve went on her soapbox a little about “ruining” a 30+ year friendship. Although the defendant was 100% wrong for not paying his phone bill as a grown adult, his helping with the plaintiff’s sick son is pretty huge imo. Schizophrenia is a debilitating disease for the patient and any caregivers involved, and if she lost that familial support because of this lawsuit, I’d imagine that would be pretty devastating.

I understand that he was staying at her house, but I think for him to offer to come there to help her with her son she should have shown a little more appreciation. She said herself she hadn’t been able to sleep for four years before he came, and not only that he would take her son with him to the studio to get him out of the house. She also said she told him to help out with the chores as if she was doing him a favor for being there, in all reality he was helping her. Then she didn’t pay her own portion of the bill and tried to sue him for the whole bill. She just seems to be a hard person to get along with , and I’m glad the judge saw through her trying to be slick to get him to pay it all

Exactly. Some states have the free phone through Medicaid. I pay $120 a month for 4 phones. No contracts. If you don't pay then it shuts off. When signing up, All free phones or you can pay to upgrade or also have upgrades available I think every 2 years. If anyone wants a iPhone or something fancy they can go buy it. Not on my plan. Lol.

We know JM doesn’t write the checks for her own bills (or pay them late!) because the average American knows that any money you pay on a bill goes to the past due balance, and not a specific part of the bill. Imagine skipping a month on your electric bill and then expecting the light company to take a new payment and say “thanks for paying March, now can we have February?” Had the plaintiff paid their portion, it would have gone to the defendant’s cancellation fee (the older charge) and plaintiff’s phone lines would have absolutely been disconnected for nonpayment. I think the defendant should have had to pay at least part of the other cancellation fees.

Defendant's mother did not get him a phone for the same reason, he is a bum and not working a job. That is what is wrong today the twenty somethings, mother or parents are allowing the adult children to not and mooch on them. Plaintiff did not really think this was working for her either but got snookered by the friend's son that he was helping her son, NOT! And he was helping himself to her generosity and got her to get him a phone. A grown-up lazy bum. Mooching on others now.

I pay $35 a month for unlimited everything on a phone that I bought for $15 at UScellular. If people make more than $500 a week and keeping up with the latest and greatest devices makes them happy, it's their money and none of my business.....but if you make less than 30K a year, I think having a more expensive phone is a foolish waste of money. There's no reason to pay more than $500 a year to have a working phone/internet access.

People used to put money on cards but carriers like UScellular (and T-Mobile, etc - not AT+T though - they only have $700 or more for a phone/$100 a month for service).....the carriers that I mentioned are into being competitive with their rates, so why bother with phone cards when it's $35 a month unlimited on a phone that you can buy for less than $20? They used to have phones for a penny and that's why I switched to UScellular.

She shows no appreciation for him coming there and helping her.

I had a Galaxy Note 7, ALL carriers were paid by Samsung to accept returns for the devices and you could exchange for a new device OR you could return it and call it a day!! Samsung spent millions if not billions on covering return, restocking, and exchange fees!
