As if white people aren’t the majority of the poor, and many have the SAME broken families, same relationship issues, drug problems, but in order to be pushed up the list you need to be trans, gay, not white. And then we get to sit and wait for 8hr at the hospital to even see a doctor. In the black communities where they flood money to people because they’re poor and have been for a long time, THERE IS THE LARGER POOR WHITE POPULATION LIVING ACROSS THE STREET. TD Bank, as a gesture of goodwill, should have offered to cancel all debts taken without your consent. Also, you don't just show up to a branch with a different gender identity to take out large loans without raising red flags.

I'm pretty sure the loan is already paid off for the bank. I'm not 100 percent sure, but when a bank provides a loan, instead of waiting for you to pay it back, they instead go to a third party company that buys debt off those banks. This allows the third party company to gain interest of the payments and creates a zero risk situation for the banks.

Equality means we should all be treated the same. No matter gender, race, sex, or creed. It is crazy we have reverted as a society. If employees were not fearful or reprimands or getting fired, they probably would have spoken up about it. It sucks for actual trans people but that's part of the battle. My friend went through it, and she is now a happier better self after going through all the hoops and trials. My aunt deposited a multi thousand dollar bank draft from BMO into a newly opened TD investing account to start investing into her retirement. She was told it will take a 1-2 weeks to clear. Two weeks later still 0 dollars in the account. They do an investigation and a week later they tell her they lost it and are doing another "investigation". Another week passes and they found it. It apparently was sent to the wrong department in downtown Toronto. Another 2 weeks pass and they money finally shows up in the account. That's 6 weeks after the initial deposit. She planned to buy S&P500 stocks during that time and basically lost hundreds of dollars in growth during a bull run that happened during those 6 weeks. When she complained, TD gave her a $20 Tim Hortons gift card for the loss. What a joke.

This guy thought everything was being dealt with as both TD and the RCMP made it seem like they were working on getting the issue fixed and by the time he finally talked to a lawyer it was already too late to go after TD as the 2 years had passed... If he had a lawyer take TD to court any time within the 2 years I think this would have been an open and shut case.

Absolutely INSANE I went to TD as a legal trustee on behalf of my Mom who ended up incurring a life changing brain injury at age 50. I had the proper legal paperwork after talking and paying $5000+ to a trusteeship / power of attorney lawyer. She provided me with a “Notarial of trusteeship” which is equivalent to power of attorney in my Moms situation. These GENIUSES at TD refused to recognize a 100% legit (and expensive as hell) legal document because they thought they knew more then my lawyer???? It took 6months to close her accounts down after setting up meetings with THREE DIFFERENT managers at the same branch????? Every other bank I had to do the same business with helped me out within 1 day. TD should stand for Totally Demented lol!

The hero in this whole situation was the car dealer who noticed red flags and immediately did the right thing to inform the victim, asked if he wanted to get the police involved, victim said yes and the police set up a sting op to catch the criminal. Police acted accordingly in service of the public. Anything that happens with the criminal now is up to the courts, these days judges are pathologically leniant to criminals, so expect nothing much. The main gripe is with the banking institution which apparently doesn't know how to safeguard anything and is off the hook from any legal recourse. @Wernerbrandes8088 No offense intended, laws are in place. The problem is the laws are not enforced unless one presents them in court to have them addressed. The court system is representative of an elitist society. One needs cash and time to access the court system to petition them to address a "perceived infraction". I say perceived infraction because justice is supposedly blind and it is up to the plaintiff to justify their position and ask for restitution. The plaintiff must pay to access the court system, pay to prove wrong doing, regardless of what any law states or who witnesses an infraction. I hope I've successfully illustrated that in Canada justice is not equal for all but is paid for and exists only for those with the most resources and not on written laws or morality. Any corporation or person can get away with a crime by simply outlasting the funds of their opposition. We as a society can outlast deep pockets by collectively and publicly boycotting an offender, holding them publicly accountable until restitution is made. Without customers TD will lose money quickly and attract the negative attention of their shareholders. If we do nothing then we by default show TD that they are right and innocent of any wrongdoing. The law, like freedom is only as powerful as the number of people willing to stand up for it or the amount of money that can purchase it.

I had a similar issue at BMO. My card was eaten at an ATM. Minutes later the branch, which was closed, started racking up charges to my account. I was getting notifications of $400 transactions every couple of minutes. I went to my home branch when they opened the next day. They all but accused ME of making the withdrawals… It was clearly an inside job as the ATM was only accessible to employees. It took weeks to resolve the issue, despite my being in THEIR camera when the card was taken by the ATM. A little while later I closed my account. I didn’t appreciate being treated like a criminal on top of their many mistakes. Shortly after that my regular credit monitoring showed me I had a “negative” notation next to my closed BMO account… BMO had reported me as closing my account improperly and it out a negative remark on my credit score. Took a year to clear it….. Big banks blow chunks.

Actually, it makes sense they were asking. But not for the reason you probably figure I am about to bring up. Usually people figure it's just because of security reasons, etc. In this case, it's because the big banks are on life support right now from the BoC, with them receiving huge payments to help keep them afloat. They are scared of a run on the bank, and are trying to keep any and all assets in their holdings as much as possible. They've been worried for a while now, but it's only been getting worse and worse. I heavily suggest anyone reading this to consider switching banks. Away from the big ones. They need to fail, but it needs to happen after everyone smart enough to listen does exactly that and switches before it is too late. Doesn't matter if there is insurance covering your savings like the CIDC for instance. It is what they are meant for, but if the banks fail badly enough it will require being bailed out. That's the result we do not want as a society. They need to fail after everyone has left their service, so that the bail out isn't necessary. Go look at cooperative banks in the mean time, or some other bank of some other form. Basically any other bank that isn't TD, or Scotia, or RBC, etc. And make sure they aren't a subsidiary of them. Tangerine for instance is Scotiabank.

The bottom line is the lady there handed out your password, when she was not supposed to. She breached company protocol. They have camera footage of the person going in with your card. All the evidence is there. Based on the money you lost and time you had to deal with this you should be sueing them. There are many lawyers of you bring them a case like this they will work free until a settlement is paid and then they will take there cut. But that's good a lawyer will look at the case and say, "yes this is a good case", which it is. Even if they take 50percent, there's no pressure on you because if they don't succeed you don't pay. They are also driven to work as hard as they can be cause the more they get the more there payed. I think it's called working pro bono. I think a lot of these banks think they can do stuff like this because you won't fight back. But then when you do, there go into panic mode. And from what I understand they'll will try and settle the matter out of court and fast. Let's say they offer a settlement of 200k and you get 100k. I think that's pretty fair, and would likely compensate at least for a portion of this screw up. Definatly leave a bunch of messages for some lawyers or write a general email and send it off bulk style. I believe you should definitely be compensated for this. You may have to meet with a bunch of lawyers but most of them will do a free 30 min intake I think. They don't want to potentially have to pay millions, and it could mean a really fast settlement.

It goes far beyond just Canadian banks. ALL of Canada's federal institutions utilize the exact same bogus "resolution process" as detailed in my comment here. In a nutshell, "...internal remedies for such complaints are ineffective because they are dependent upon the 'chain of command,' which is often made up of those who were either responsible for the offending behaviour or acted to protect others ... this chain of command perpetuated a toxic work climate, characterized by abuses of power." The system is designed so that the house always wins. Period. Anyone who has been through the complaint process with Canada's federal banks, police, healthcare, or other institutions will have experienced this firsthand.

There is no statute of limitations with PIPEDA, or with the Financial Ombudsman. If found in violation, then the statute of limitations with respect to civil litigation will be reset. It's a bit ironic that people say you should only trust your banker when they are probably the least trustworthy. They directly benefit from your financial investments in their institution and are pushy with shoving unwanted unsolicited offers down your throat. They would happily bury you in high interest rate lines of credit without properly explaining how any of it works. They would then pat themselves on the back as your home gets foreclosed and all your belongings get repossessed. They are worse than a car salesman, at least the car salesman has an excuse and didn't study for a finance-related degree. I was in hospital for 6 months with a spinal cord injury and in the chaos that follows such an injury I let the 1 year time period to claim my insurance on my mortgage and line of credit expire. This is how banks screw you out of your coverage, this should not be allowed. I paid for that insurance and just because my health delayed my application is no reason not to pay out. Banks are crooked in general but Td screwed me also😢

Thank you,it’s not just banks it’s the insurance companies as well, you think you have coverage until you don’t. I also wasn’t paid out on a disability insurance claim for $500,000 because my SCI has to be “permanent and irreversible” and I have “limited” return of some use of my legs. The whole system is corrupt

They prey on people like you , because you are a nice person and even after THEY defrauded you, you still want to be a responsible adult. As soon as you realize , not only the banks, but the whole system is against you, you can have a change of heart and play a game that is more tough with them .

@@GarixDover so basically now the criminal gal (or guy) is still using your identity ? i feel like there would be a way to start at a government clerical level, maybe sin number etc, then continue with an equifax request and Transunion, get them to revert your account to the date previous to the attack. if that fails, maybe a more aggressive lawyer (a Jimmy McGill type) combined with a direct action to the media outlets, especially investigative journalists. I hate to say , but if all fails, think about an insolvency trustee, you'll be a brand new fresh and clean persona 3 years later.

I didn’t realize it was gone till I got home. Then I went and got a new card. However the person also went after me to another branch and got a new card. This was the day before I went out of town with work for a week. Had zero reason to use or check card for that time. And at the time I was more concerned with getting my life back rather then suing

I am so sorry this happened to you.., I have this fear for me too because someone got a hold of my passport copy long ago pretending to be an agent (I wasn't educated enough on the matter), so I had to put alerts in place with the 2 credit unions and also filed a report for fraud alert. Banking today feels like a scam, this country is in a very different place than it was 5 years ago

Im 17, when I was a young lad growing up in southern ontario, I was sold the canadian dream, that as long as I worked hard, saved money, did my best, I would survive just fine. To me it seems like it was all a lie, it seems like every year that passes Canada gets worse, and life gets harder. Why would anybody want to live here? We are practically ruled by an autocrat 😮‍💨 I hope SOMEBODY can help you resolve this, someone actually opened a WESTconsin credit union account with my email so I kind of relate to this unfortunately 😢

It doesn't matter whether someone opened an account fraudulently. You should be able to prove your identity, undo the mess created, and be off the hook for someone else's actions. The bank failed to properly identify their client. It's their responsibility and their loss if they incur expenses due to the results.

Surely there is a legal remedy for this fraud over two years later. That's a bizarre statute of limitations. If not, we need to petition our political leaders to redress this dysfunctional limitation.

The vast majority of modern banking is trying to figure out how to siphon as much money from you as possible or even trap you in financial slavery so they can put you into crippling avalanching debt after they repossess the majority of your belongings. There is a reason why there are enacted laws that protect certain assets from repossession, they would bleed you dry if they could.

The Limitations Act (which sets the 2 year rule) includes also the discoverability rule. This rule means the limitation period starts when you discover or should have discovered the injury, loss, or damage. So time starts ticking not when TD made the error, but rather when you realized they did. Consider this when calculating your two year limitation period, you may still have a chance to pursue TD. Check with your lawyer.

Usually, when some assclown says "literally", I zone out, but I decided to listen to this story anyway and TD literally ruined his life. The sad truth is that all banks would likely react in this way to a situation like this, despite the fault being on the teller. I wish you the best. You have a deeper understanding than most about how all banks, by nature, operate, which will only serve you better moving forward. I hope this story spreads like wildfire and benefits you in the end.

Its crazy how they wont just rectify it because there are other frauds like fake cheques that cause lots of losses too and thats just part of operating a bank. The teller definitely wasn't following the proper procedure, but in this case the bank is supposed to pay you back the funds and usually takes disciplinary action against the teller. If I was them id tell the person to go get a new ID. But the fact you can't at least get it off your credit and go to another bank is crazy too.
