@@brookiegremlin6660 Got this article from Jacksonville's website. Here's the answers to your unwarranted suspicions. "Jacksonville man agrees to lesser sentence for killing accused pedophile First Coast News Berrios A man who was a teenage runaway when he killed a suspected pedophile received a new sentence Monday after serving 23 years of a life sentence behind bars. Mark Berrios, now 38, agreed to cut his deal to 30 years stemming from the death of Olen Lee Hepler. Berrios, from Jacksonville, was 14 when he first encountered Hepler in Daytona Beach. Four months after his 15th birthday, officials arrested him for the shooting death of Hepler. Berrios’ defense argues the teen was sexually abused and held captive by Hepler. The gun belonged to Hepler, and the defense said Berrios seized a moment when the gun was within his grasp and shot Hepler in the head and fled with his wallet and vehicle. Berrios’ case received scrutiny from the public due to Hepler’s reputation as a sexual predator of boys. According to court documents, at the time of his death Hepler was under state investigation for sexual crimes against young males. The Volusia County jury did not hear these details about Hepler during the 1995 trial. Prosecutors successfully suppressed the victim’s ‘prior bad acts’ on the grounds that self-defense was not an issue. Hepler’s stolen ATM card and his stolen Chevy Blazer Berrios used to drive back to Jacksonville gave state attorneys the evidence they needed to prove the crime was one of a calculated armed robber, not an abuse victim. CASE-CHANGING DECISION Sixteen years after Berrios’ sentence, a U.S. Supreme Court ruling on an Alabama case made life without parole for juveniles unconstitutional. The 2012 case, Miller vs. Alabama, was a legal turning point for Berrios and his supporters. The decision would apply retroactively to juveniles already serving life without parole, giving them an opportunity for their case to be reviewed by a judge. In the summer of 2012, Berrios’ attorney asked the court for a new sentencing hearing based on the Miller decision. DARK SECRETS Berrios’ witness list looks different than it did over 20 years ago. Loring’s petition and public pleas for her son’s life garnered national attention. One man in Connecticut discovered Berrios’ story while researching information about his own past. Eric Levy said in a social media video, he immediately recognized Hepler’s name from his own time in Daytona Beach 30 years earlier. Levy called Hepler ‘the worst’ of a ring of people he said trafficked children in Florida. Levy said he was one of those children and has pledged to help free Berrios by testifying in court. Loring told First Coast News an attorney who represented Hepler agreed to testify to crimes Hepler admitted to during his life. Berrios’ team hopes these factors that he never got to argue will convince a judge to set him free. “We are all horrified that a death occurred,” Lording said. “I can truly say this could’ve ended up very differently for my son."

As a survivor, I can definitely say that I wish that I was strong enough to fight back against my abuser. I experienced physical abuse from both parents from an extremely young. Then after my mother remarried, my stepfather began physically abusing me. After about a year after he and my mother married, the sexual molestation started. Then two months before I turned 15, my atepfather attempted to rape me. I was able to get away and hide until my stepfather went to work. That was the day I was taken from mother's custody. He called me on the phone from work after I called the police. I told him that I had called the police and he promised never to touch me again if I didn't tell the police what he did. I never got justice despite finding the courage to tell my story. My stepfather was only sentenced to 15 months of weekend jail. Absolutely disgusting. This is the reason why some abuse victims kill their abusers. They know nothing is going to happen if they do speak up about abuse which is appalling.

what do you mean he didn't know he was a pedophile at the time? are they he ABSOLUTELY knew he was a pedophile....how? because he groomed, S. assaulted and molested him. if that's not being a chomo then what do you call that? the fact that he didn't know about the chomos past actually gives credit to his story

This is the male version of the Cyntoia Brown case. He deserves to be pardoned and let go.

At what point does it advance to rape? The first interaction was rape. He was a minor 😡😡😡

1st Case: the man should be free. 2nd Case: I'm surprised that CWD aired those unfounded accusations against the boyfriend. This segment basically convicted him of murder and kidnapping without any evidence. If the police do not have enough evidence to charge him, then why destroy this man's life with hearsay? He is presumed innocent until proven guilty. It's pretty farfetched to think the man murdered his girlfriend, kidnapped his daughter, raised her until adulthood without anyone knowing anything about it.

Mark don't be embarrassed. It wasn't your fault. I hope you go free. I'm praying for you.

I. Couldn’t agree more with the reply before me. Shame on that judge…who probably is a ped himself

what a horrible way to question an abuse victim.. “you let him touch you?” “why should anyone belief you..?” …really??😭

Take this time to heal, Eric. You got this. It wasn't your fault. Your parents fell short and you weren't able to stop what happened to you, being so young. It wasn't personal, it was a scumbag targeting anyone.

They should do a polygraph test on Mark.

It is absolutely shocking to see that rape victims are still treated and questioned as if they are the perpetrators. Abby is a very brave young lady.

These prosecutors should be charged with child-neglect, punishing CHILD of 15 for doing exactly what any right-thinking adult SHOULD have done.

The "he started rubbing on my shoulders" triggered me. That's how all the older men who tried to touch me started. They seem to do the same thing. Now I hate when people rub my shoulders or stand behind me.

This is crazy. He was only 15! The judge who kept out the sa story should be ashamed of himself.
