I have been in Corrections for 12 years and met 2 guys like this. The first one said he doesn't have any family or friends outside of prison. He doesn't really mind being in prison. He had a point. If you have nothing, why not? The second didn't have the money for house arrest (Apparently in the US you need to pay a bunch of fees to get arrest). He didn't have the money to and figured he was going to go out in style. He walked from his parole officers office to the liquor store across the street and stole 1 beer. He then slammed it in front of the PO and went back to prison.

No, no, house arrest is something different here. Regular arrest lands you in jail; conviction lands you back in jail or prison. For some crimes and offenders, there's an option for house arrest while you're waiting for trial, where they put an ankle shackle on you that monitors your whereabouts AND requires a bigger bail. You're confined to your home and can't leave, and your communications are limited. They've also started using this for certain non-violent crimes, too, as an alternative to prison or jail. That also costs $$$, not only for the ankle monitor but also as an additional deterrent to just going on the lam.

The benefits to this are obvious; the person gets all the comforts of home, everything from food to blankets are all miles better than what they would have in jail. They can sleep when they want, shower when they want, eat when they want. So nearly everyone would prefer to do house arrest over serving time in jail, but there's many, many fees that come with it, and financial resources are often the deciding factor for who can actually do it (rather than who should morally or ethically be able to do it). And this is all referring to the U.S. system, different countries have very different forms of house arrest , and even in the states, the specifics vary a lot from state to state.

While I don’t know why he keeps reoffending, it’s possible he also recognizes the fallacy that all authority is based on so he simply refuses to participate in the false construct that is the “legal system”. Just to point out the police in the UK can't lie to you in the same way they can lie in the US. The Police and Criminal Evidence Act 1984 makes it illegal for the police to mislead a suspect. Lies of omission are not illegal however. For example: Police find your hand print on a window. They are under no obligation to tell you they found the print even if you ask. They can lie and say they haven't found prints. Lie of omission. If instead they lie and say they found the prints on the murder weapon they have just committed a crime and your entire case is being thrown out, with the interviewing officer most likely losing their job and going to jail themselves.

I know of a man who was released after years in prison. Within a week, he decided he wanted back in. He robbed a gas station apologized to the clerk. Then stepped out the door, sat on the curb, and never said a word to the authorities. Free food, free medical, and structure. If you're at the bottom, modern prisons are at least a couple steps up, if not more.

Some homeless people just want to be left alone, without having to pay for anything except the bare minimum required by law. Doesn't work so well when the law still pertains to them for basic human liberties like not getting stabbed because someone just felt like stabbing someone, resulting in homeless camps being broken up overnight from one person's actions, because a police presence in most homeless camps is simply dangerous and unwelcomed. Others are actual people who're struggling and can't find legitimate help, slipping through the cracks where it's better to sell of their freedom to a prison or commit crimes because legitimate work barely pays enough to rent an apartment, let alone even having a home.

His brother’s conclusion was the exact one I came to as well. For someone who has absolutely NOTHING in their life it’s often a better place than their normal day to day. Free food and lodging is more than a lot of people have. There’s been documented cases of people who will “rob” a bank by passing a note, receiving the money, and then sitting down in the lobby waiting for the police to arrive just so they can go to prison. It’s honestly very sad. At the very least he’s being non-violent about it.

The problem is once a person goes to jail. No one wants to hire them, no one wants to live with them, and only the drug dealers want to do anything with them. Its just endless hardship to really never succeed without a prior wealthy family. Society has a difficult time accepting someone once they are excluded from the machine. So the logical thing is to just go back to jail and resume being the somebody you created in the prison eco system. I was in Corrections for seven years in the US. Like Rusty mentioned, this condition of wanting to return to prison to be taken care of. Is actually pretty common. The running joke, is to say, see you again in six months when an inmate releases that then gets tired of starving in the streets. So they commit a crime to be intentionally caught and sent to prison again. Its fear of society really. You live in a box, get comfortable with its daily routine, and then one day you get tossed into the big open skies unsure where to go. People rather return to their box. Sadly, you can see the same thing with people who leave the military that fail to adapt to civilian life. Personally, I know of three people who committed murder to return to prison. Of which, they said such would happen if they were released many many times before leaving. The state is simply not allowed to imprison without evidence I was told. (though people get placed in prison purely from words all the time) Then you see the person back in six to eight months for another 15-30 year run with a sad piece on the news how they broke into a family home sleeping visiting their kids. The convicts, didnt like that story either and that person lasted about a month behind the walls before he was found left laying in the same way he did the family. Maybe silent man standing in traffic is not a bad alternative. A parting true story, one of the best reasons I ever heard for someone wanting to break out of prison. The warden would not approve the person to attend his mother's funeral. (the family had a restraining order on him) The guy breaks out, travels some 40 miles invading police, attends funeral, and then basically wonders around aimlessly because no cash. When he came back I asked why he escaped when he only had a few months left. That was pretty much his answer. He said escaping is the easy part. After escaping there really is no where to go when you are by yourself and broke.

Sure, the US is a vast nation with many variables and being homeless in Miami is not the same as being homeless in Chicago. But at the end of the day, US prisons have roofs and they serve prisoners food. As long as you aren't put in prisons with violent gangs and serial rapists etc then you are just going to have a bad time, but not necessarily a horrible one. Being homeless can be worse than bad.

More weight would be added until they finally pled one way or another. This was called "peine forte et dure" and was abolished in 1772. Reminds me of a German case described by a famous German lawyer. A bold man in a suit was attacked by two armed men at a train station. He blocked their attacks and made them stab themselves precisely, cutting their main arteries, killing them instantly. He did not run, just sat until he got arrested without resisting. He had no ID, couldn't be identified, did not talk. All he had was a card with set lawyer information. He had not talked to anyone. Since he did only defend himself appropriately, nothing happened, and he just got released. Ferdinand von Schürach is the lawyer and auther. Great book with very odd cases.

I'm little saddened about how many people don't know of the "Housing first" policy. It is used effectively all around Europe (and in very tiny parts of the US) to combat homelessness, and to avoid these exact scenarios! In basic summary (if you can't go look it up on Wikipedia), a homeless person is given a permanent apartment, no matter what they have done in the past. They are then given help to get into a job, and 30% or so of their salary is used to pay for the apartment, until they are ready to move on. The effectiveness of this policy lies in how unrestricted the access is, and that it keeps money from being wasted on an useless prison sentence.

While this policy is effictive and great there is no such guarantee. The homeless shelters I've seen were dangerous and kinda disgusting and I'm in a wealthy country. And if the shelters become humane then tens of thousands will look to relocate there due to unavailable and unaffordable housing in the same areas where you have homelessness (seems to go hand in hand).

@@アマ-p2lOP mentioned a permanent apartment, not a shelter. I am sure there are requirements like a maximum allowed time to live there without a job and other limiting factors. Personally, I use to live out of a truck until I couldn't stand how uncomfortable it was in the temperature extremes and called 411. (everything after this applies to New Jersey)I was given an emergency voucher to a hotel and worked on getting semi-permanent residence at said hotel through the state. It's a lot of calling and paperwork, but you CAN find housing. I was also given weekly groceries through a non-profit on Thursdays, even after I obtained EBT and cash assistance. For any of those struggling with homelessness or in immediate danger of BECOMING homeless in NJ... Call 411 and speak to someone about your situation. At the very least, you should be able to get into a hotel voucher during days below freezing.

Haha, this reminds me of an acquaintance back in uni. Him and his friends would hang out drinking and playing music, apparently disturbing the peace, and when the police were called, and while his friends ran away, he would just lay down on the street and tell the police officers "try to lift me", it is worth mentioning that he was a very big man. Some police officers tried, but they eventually just left him alone.

There was a (I think) Korean man who did a fake bank heist with the same goal of going to prison because he was homeless iirc. He didn't end up going to prison because of that (prolly out of spite), but still there are absolutely people who are willing to go to prison if it means having a roof over their head, and I think Qxir was a little too quick to doubt David's brother.

he might not be mute due to mental illness, but David is clearly going through it to some degree and deserves help to get out of this pattern. It would almost certainly be cheaper for the government to provide him with an apartment and food stipend than imprisonment, which has a much higher overhead. i hope he is okay.

I was in the mental hospital for ideation. There was a dude there. He pulled me aside and said he “wasn’t crazy”, he was just there to not be homeless. I respect the guy for it. He wasn’t THE silent man but essentially playing his game and if it works out for him, then it works out I suppose

If people are worried about him doing something potentially dangerous to get into prison, maybe lead him towards something that will get him a lot of prison time and at least not harm people. I had a friend in highschool who went to jail after his parents kicked him out for not going to school, which got him banned from school, and then he spent all his time as school getting arrested for being in school. The next time I saw him he said he just wants to go back to jail because it gives him a routine, roof over his head and 3 meals a day. He then took of all his clothes and said "get naked guys, I'm feeling that energy"(he fried his brain on COPIOUS amounts of mushrooms)

This behavior is actually pretty common in the USA in particular. It's nearly impossible get gainful employment and housing as a broke felon. Prison is sometimes seen as the preferable option.

So, that is recidivism, not what this guy is doing. What this guy is doing, is he CAN get employment and work and whatnot, he just doesn’t want to. Which, fair enough. I suppose if you really wanted to be pedantic you could tie that in with recidivism but I think it’s unfair when you look at why the majority reoffend. Recidivism is when for some concrete reason people decide to return to crime. It may be our broken system making getting a job hard after being a felon, or it may be that the recently released has no skills in this new world so they default back to what they knew. Most of the time, these people WANT AND TRY to do better, but the world crushes them and forced them back into the cycle.

Speaking as someone who has family with felony records, most people are outright unwilling to hire felons. I’m glad YOU don’t discriminate, but most people do.

I did several years as an officer in a UK prison. Offenders are often released with absolutely no support network or safety nets. They come back because (in a well run prison), they have safety, food, and support. This is not the fault of the prison system, it's a fault of the social system. We need to make the outside better than the inside.

I read a news article about reoffending. They interviewed one prisoner who said he used to be a qualified builder, but when he got a criminal record nobody would employ him. Banks wouldn’t even give him a bank account. He had no home to go to when he was released from prison. The probation and rehabilitation service let him down and the only option left to him was crime.

Some people do want to live in prison. I knew a guy, Rick Killaman, ironically, did 20 years for killing a man. When he got out, I met him. He'd been in prison since the 90s and it was like 2012. Things had changed so much, he couldn't adjust. It was like being put into a different, less appealing, world. So, he got drunk and crashed a moped into a semi, to not hurt anyone but himself. He wanted to borrow my dad's gun, to say he stole it, and "Rob a store". By Rob a store I mean Rob them, and wait for the police, to return their money and go to prison. My dad, obviously, said, fk that. So, he came up with the moped plan. He bout died, obviously. His eye was straight red, red as blood, the entire thing aside from the pupil.
