Even as a kid this lawsuit puzzled me. The characters in both games are stereotypes, and I don't see any clone characters. The funny thing is that Capcom later released Darkstalkers which is basically the same idea as the Universal Monsters, so it would seem that they learned from this.

I think Capcom actually wanted to use Universal's monsters for a fighting game, but apparently either they couldn't get the rights or thought they were in the public domain, which they weren't, and decided to make their own monsters that resembled Universal's. I may have to look that up again, it's been a while since I looked up Darkstalkers.

In 1991, Game developer Capcom released Street Fighter II. Its popularity led to an explosion of interest in the fighting game genre. Other companies rushed to capitalize, and Data East released their own one-on-one fighting game called Fighter's History 2 years later in 1993. Even compared to other fighting games, there were many similarities between Fighter's History and Street Fighter II, with both games having similar character designs and artwork, as well as similar special moves and controls. As it was later revealed, Data East created design documents that referred to Street Fighter II several times. Several people noticed the similarities and raised the issue with Capcom, reaching the president, Kenzo Tsujimoto. Capcom soon sued Data East for copyright infringements, in both America and Japan. Capcom also sought a preliminary injunction to stop Data East from distributing Fighter's History. Data East Corp.'s largest objection in court was that their 1984 arcade game Karate Champ was the true originator of the competitive fighting game genre, which predated the original Street Fighter by 3 years. Judge Orrick set an Halloween October 31, 1994 trial date, stating that he could not deny "the strong evidence that it set out to copy Street Fighter's success", noting similarities such as a "Chun-Li clone" (referring to Feilin) and several comparable special moves. The court noted that "of the eight pairs of characters and twenty-seven special moves at issue, three characters and five special moves in Fighter’s History are similar to protectable characters and special moves in Street Fighter II". Even noting the similarities between several moves, the court also noted that "Street Fighter II has a total universe of twelve characters and six hundred and fifty moves. Capcom concedes, as it must, that the vast majority of the moves are unprotectable because they are commonplace kicks and punches."However, Capcom U.S.A. lost the case on grounds that the copied elements were scenes a faire and thus excluded from copyright.

I’ve never understood why Capcom went after this game for copyright infringement, when the first Art of Fighting is much closer an infringement with characters like Ryo Sakazaki and John Crawley. Hell, Crawley’s stage is a straight rip off of Guile’s Air Force base stage.

I agree, and sadly the modern era with it's infinite possibilities of communication hasn't alleviated the issue, rather on the contrary. I just find it interesting how personal some of the issues seem to become - generally, if a group of gamers like Cuphead, you'd think we'd be thrilled to get a similar experience to try out, rather than starting a tempest in teapot, downvoting and spreading negative word of mouth. Laws are in place, regardless of twitter-campaigns, to protect the original devs and their IP. The industry never would've gone anywhere without - as you point out in the video - the Space Invaders, Pac-man, Mario, Sonic, Doom, Halo etc. clones.

Capcom probably sued Data East, because Fighter's History's has similar 6 button setting that Street Fighter 2 uses. Karnov's Revenge(the sequel to Fighter's History) only has 4 button setting. Those middle punches and kicks were gone. So Karnov's Revenge emulated SNK's 4 button setting.

Fighter's History Dynamite (Karnov's Revenge) was, as I said in the video, a Neo-Geo game. It has to have a 4-button control scheme, because the Neo-Geo only had four buttons. Also, their lawsuit had failed by the time Dynamite came out, so they would have been pretty dumb to attempt another lawsuit after the first one had already failed.

The irony here! It was Data East that personally introduced myself to the genre via Karate Champ.. When I first noticed the SF1 cabinet I thought it was just a KC or Yie Ar knock off.. Yet I was still intrigued.. Word on the street was the SF series was directly inspired by the both of those titles.. No pun intended..

Same Name, Different Game True as it seemingly caused the 2nd arcade craze wave.. The first being stuff like Galaga, MS Pac Man Time Pilot etc.. In hindsight in having lived through it I really don’t remember any sudden awe at least in my neighborhood.. It took maybe a year or so to grow on people a bit from what I do recall in addition to its peers like MK.. Still all in all both the 80’s and 90’s were massively hopping as far as gaming in virtually all respects..

It would be hard to make a case for Final Fight, since that wasn't the first (or even the first popular) belt-scroller. Something like Fatal Fury would have been an easier case, I guess, but they still could have backed that down with stuff like having only three playable fighters and a linear story mode, which SF2 didn't have.

Thanks for the video! One note tho... Fighter's History was not mediocre - not even close. In fact, in many way better that Street Fighter 2 (in some cases even in frames per second). They just didn't have Capcom money to promote their product. I wish the game was more popular!

It was a good attempt at a clone. It wasn’t as good as SF2 by any measure. Character design, music, gameplay, presentation, bells and whistles, and legacy. SF2 changed the gaming industry. Fighter’s History is a footnote.

The most ironic thing about Fighters' History is that it has waaay more fighting in the actual streets than the original Street Fighter II does. SFII's only street level is Chun-Li's, the game should have been called Public Place Fighter (and even then, Guile's and Zangief's levels are off limits to the general public).

You may have mentioned it in the video and I spaced out and missed it, but why did a Japanese company take another Japanese company to court in the USA? One lawsuit over copying that stands out to me (because both the movie that was copied and the movie that copied it are now considered classics) was Toho suing Sergio Leone for copying Kurosawa's samurai film "Yojombo" and turning it into the Clint Eastwood spaghetti Western "A Fistful of Dollars." Toho won the lawsuit and got a 15% share of the profits from Leone's film

Finally dude! Omg! I've been looking for this game for years dude.(fighters history) remember playing it at the arcade. To it looked cooler when copy cat ryu did the hadoken and a tiger came out. And the dragon punch was better. In my opinion of course.

Nice video. I played fighters history for a bit and went right back to street fighter. Played fighters history dynamite and went right back to samurai showdown 2. Yeah fighters history was a homage to street fighter. Sega suing devs of Simpson’s hit and run over the arrow game feature was sillier than this.

So: Recently, a game was announced that baffled the world to its' core: Foamstars. A bold-faced ripoff of Splatoon made by Square Enix. Rather unfortunately, I think this video and the resulting copyright decisions made from it will mean there's no way for Nintendo to try and slap Good old Square with any sort of copyright. Even though there's also clear evidence that square was lifting ideas directly from splatoon (it's really easy to find comparisons that are almost comically similar), The fact that there is something of a substantial difference between the 2 and that that Square was definitely not lifting any code from Splatoon means that Foamstars will exist. With that being said: This is a squar Enix Multiplayer game I'm talking about - Nintendo's not going to need to lift so much as a finger for that game to have its' bubble burst and be down within 1 year. Unless Square Enix is actually allowing their developers to make it a good game - OOOOOOH BOY, Do I see things going badly for it.

Recently tried this and its sequel and in all honesty they aren't too bad, they're not as good as street fighter 2 but perfectly playable and has aged better than games like mortal kombat and the original fatal fury. For anyone looking to play the series on the switch I recommend skipping the first one and going straight to karnov's revenge, the original is part of the johnny turbo arcade line of releases which are just awful. Just avoid that line in general since you can't do basic things like selecting the difficulty or button map, which is especially terrible since they choose some of the worst button placements for games, yet expect you pay as much as an arcade archives release.

Another fighting game that I thought of was Dragon Master created by a (defunct, perhaps) company called Unico. This game blatantly bit off Street Fighter II from jump as far as sprites and attack moves (the whole game is hot trash juice), so curiosity has me questioning why Capcom didn't sue the brakes off Unico instead of Data East 🤔

Obviously, I don't know, but my guess would be that they didn't think Unico had anything to take. Also, part of suing in the US is showing damages, and a game that a lot of folks never played/wasn't making much money would be hard to show damaged them in any meaningful way. But, again, just a guess.

I always ask myself, why capcom only went for this particular game. I mean look at snk, they had or have dozens of street fighter clones, specially world heroes.

The input & combo system was transplanted from Capcom to Fighters History. The judge clearly wasn't a street fighter 2 fan, else he would've understood the situation.

No, you cant copyright imputs or gameplay systems, the judge was right.

The Judge's ruling in Capcom vs Data East was flawed as Fighter's History clearly plagiarized Street Fighter II and got away with it based on an argument that "copied elements like mechanics, 6-button layout and character archetypes were a standard for the genre and cannot be copyrighted.", resulting in Capcom losing. To let Data East get away with plagiarizing Capcom's Street Fighter II is the same as allowing Meghan Trainor to plagiarize Phish's Contact and Koyote's Happy Mode with her "All About That Bass" single, or Johnny Cash plagiarizing Gordon Jenkins' "Folsom Prison Blues" with "Crescent City Blues". Lessons learned, when you have legal issues, get it settled in your base country, such as Japan in the case of Capcom and Data East, not in another one like USA.

Uhhh No The game has some original ideas and mechanics and is about as similar to SF2 as any other 6 button arcade fighter
