You are so right. But if I was innocent I would want so badly for the police to know and believe I was innocent and not hiding anything that my intuition would be to talk and talk. Just knowing that I’m innocent and also knowing that they firmly believe that I’m not would eat at me.

Also never convict somebody just on feelings or if you believe them or not, you have to have evidence!! That's were the reasonable doubt comes in!! These two would 100% have been convicted!! Makes you wonder 🤔

I read everywhere to NEVER talk to the police and lawyer up immediately! but if your father just got killed and you have important information about it, isn't normal that you would like to talk to the police and help them to solve the case?

It reminds me of those guys that would break in and after doing it multiple times and the cops not believing the victims they actually contacted them to say the police were incompetent and they actually were doing the crimes lol

The truly scary part of this story besides the fact that anyone can end up murdering you is that you could quite easily end up spending the rest of your life in prison for a crime you didn't commit and better yet, a crime you were also a victim of.

It happened to me. It was obvious, 7 of them 1 of me, ( and I'm over 50), but bcuz these rats were drug rats, snitches, they arrested me. It was another cop vs little guy shite show. I had never been so confused or scared.. poor kids. Some cops, tunnel vision and just frikkin lazy. Alot of cops actually right. I could tell they, especially son with brain injury, were innocent. Stupid stupid cops.

That happens so often. The prisons have many innocent people forcefully living in them and the police force has many officers that got ahead by pinning crimes on anyone that fits well enough.

my jaw dropped when the son and daughter-in-law were found to be truly innocent. I 100% thought their story was absurd and their delivery of the events beyond sus. Had I been the detective I wouldn’t have believed them either. This one humbled me for sure.

Absolutely man. Even I was thinking, "yeah that story is total BS, that kind of thing just doesn't happen in real life!"... But it's a great reminder that even things that have a crazy small chance of ever happening, DO actually happen every once in a while; and that extremely small odds of something happening are NOT evidence that it didn't happen. So often I see cops in interrogation videos and other material just completely ruling out the possibility of something because the likelihood of it having happened was pretty low (not even extremely low, just kinda low), but that kinda crap is how innocent people end up behind bars 🫤 weird stuff does happen!

I fell asleep listening to your recent podcast (not bc it was boring, but bc I was listening to it at 2am) and ended up having a dream where I hired you as a Private Investigator because someone was trying to kill me. You asked me if my husband might've taken out some life insurance on me (& you did the dance as you asked!) then you said you'd "give it a go" finding out who was trying to do me in. I woke up when my cat jumped on my bed, so I didn't find out who was. The podcast was still playing, also. Too weird lol

I say it makes sense because it was rehearsed in a sense with the couple being unsure to tell the real story or the one the perps told them to say under threat. Thing is, either one is hard to believe. Hence I can't come down on the police too hard in this case. Just sucks all around until the outcome. And we still have a dead person. Humans are screwed up.

That's some real tragic irony that the guns meant to keep him safe were basically the incentive for two psychos with guns to rob and murder him with (of all things) a knife. It goes to show that a lot of the time cops actually give killers too much credit. "It doesn't make sense to kill one victim but not the other two." Killers do lots of dumb shit that makes no sense all the time.

@Dino Cism the killers came up with a good plan tell the survivors to make up a ridiculous story to the point the cops don't believe it. If he didn't open his mouth the sad part he would of got away it. N the whole argument about guns protecting you that you need so much of them always end up being useless if a killer wants to kill you.

I'm a brain injury survivor, so when it was mentioned that that guy was as well, I had a feeling what was going to happen. People like us can sound too rehearsed just talking about our day, because we often really do rehearse those things. Our lives are already confusing, but add stress and grief to the mix and things get truly fucked up. And the lie detectors! Even under the best circumstances, TBI survivors might easily read as lying on those things. I couldn't be paid to take a lie detector test.

The worst part about this whole story is the fact that their families blamed them because it appeared they needed the money and obviously that's not something that is easy to just go back on and say, "oh, no worries, I understand, you blamed me for killing our dad....which I never did....its water under the bridge old buddy" pretty sure the holidays are a bit less crowded since this happened

According to some leaked Facebook posts several family members STILL think it was them. Calling it an injustice that two innocent men were sent to prison. Personally I think they are just salty that their share of estate is significantly smaller now that Roger and Pam were released.

The Truth about a Couples or Persons Debt is often highly exaggerated by LE and the Prosecution! Or what Juors and just us regular folks not savvy to the average American debt if a Couple or Family with a Mortgage and the average credit card debt depending on a single person or a couple, and their age bracket truly is? It was difficult finding all the Statistics for the Years 2009-2011. However, the average increase is approximately 13% yearly. (One exception is the National Avg. credit card debt. In one year between 2022 and 2023 the avg. credit card debt in America was $20,461 and rose to over $24,000 due to an interest increase.) The average household debt for a Couple between ages 35-44 with a mortgage is between $188,680 - $191080. Being the average mortgage is $220,310. That's cheap! From what I recall, in 2009 the average credit card debt for a couple 35-44 ranged between $6,800- $22,130 To the best of my recollection? I am not an expert in economics nor a CPA? IMO, as long as the couple was making their payments, and made them on time and their credit ratio was okay, the couple was fine. I was shocked to find that a financial institution even mentioned a Ratio number of 43% which is outrageously high and wrote as much! However, there was no mention of what ratio was considered average? Mine is 13%. I've seen too many cases where Defendants are raked over their financials as being in a mountain of debt! When in fact they're your everyday more than average American. I will have to agree with the statistics that state 80% of America is in some form of financial debt?

Mega props to Rachel for turning in her ex. 👏 With such a wild story, i don't think anything less than a witness like this would have saved them. Even if the cops had followed through tracking down the stolen guns & found them, with someone already going to trial, would finding out Kay knew the thief since he was a kid have been enough to drop the charges against Roger & Pam.

Wow. Tragic story with an insane twist that I absolutely didn’t see coming. If it wasn’t for the ex-wife coming forward, that family would have suffered even more. It’s nice to know there are still good people out there. Just when you think it couldn’t get any crazier.

I know! Already about 06.30 in the story,he told dispatcher about the cut was from a butcher knife. I mean , how can you see it was a butcher knife... Or is that what they say,when the cut is devestating? I was so confused... But , the language barriere add to the confusion. Makes it even more exiting 😜

Imagine your elderly father outsmarting a homeinvader looking to rob him making you a suspect, and due to your disability, you arouse further police suspicion and end up in prison. The literal murders had more sympathy for the son and daughter in law than the police did!!

It's easy to blame the police with the benefit of hindsight. I'm guessing that you too initially thought that the son and his wife were guilty, until the twist came at the end. The police could only go on what the evidence was pointing to, and they rightly concluded that the couple's story was false/rehearsed, and that there wasn't a break-in

Don't flatter yourself. You only act like you would've done better now because of hindsight and confirmation bias. Because we know who the real killers are. If those two murderers weren't exposed, you would've thought it was the wife and husband, too. Wow. It took a while for me to even believe they didn’t do it! I thought for sure they had put that woman up to go in there and verify their story to frame her ex! Incredible how easy it is to go down for something even if you’re innocent. That really was a crazy story, all of it. Great coverage and video!

It's easier than that. They had a motive as to why they could have killed him. Money and the guns missing wheren't worth that much. Plus the story is very very odd. So not really that wild that it was that easy for them to not be believed. What is scary is that there are people who are in prison for murder and the only thing the cops have on them is they were close to the crime scene. No motive, no murder weapon, no connection, no blood on them anywhere, and even more messed up, the DNA found at the scene did not match theirs and yet, they were still found guilty and are in prison. Mike has covered 2 stories maybe 3 of this very thing.

They could've spilled the beans at anytime, especially during their 5 month stint in prison. I'm guessing that they wanted to protect other members of their family from the real suspects. Even if they had told the police, there wasn't any evidence to go after the actual criminals. God speed to that couple!

Holy hell, I am so glad the ex-wife of the real perpetrator came forward! This case is also a great example of why you should NEVER speak without an attorney present. The two who were originally accused didn't do a great job defending themselves and seemed sketchy and guilty, when they were actually just stressed and scared. Meanwhile, the actual criminals were out there having a grand old time! I'm so glad the family got closure and the innocent people didn't end up in jail for something they didn't do! Such a fascinating case!

Fun fact.. that matters in america But in many places, like where i live, it Doesnt matter What Youve said to the police because its not their job to convict you. That is the prosecutors job, only. And police cant be a witness either I believe. A bit odd But also makes the police job less attractive I think since you Are just a person who brings potential suspects in 😅

I literally would have NEVER expected that twist.. Like Mike said, it makes you wonder how common this whole "convicting the wrong person/people" thing really is 🤔 It's easy to be convinced of someones guilt if they (the police and prosecutors) do a good job of putting the pieces together and have them fall in line with a feasible story.. That's scary to think about 😐

I'm just trying to figure out what evidence the grand jury had where they thought it was convincing enough for a trial lol. Other than them being there, I saw zero evidence. They cut a guys throat, and stabbed him, but didn't get any blood on themselves? No prints on the knife? In most cases there's usually enough evidence to leave little doubt about who's guilty.

Thousands of people every year are convicted with less than conclusive evidence. Most of these people did in fact do the crime. However I can only imagine the shear number of innocent people in prison today. We have known for decades the trouble with eye witness testimony between strangers, yet it's still treated as solid evidence.

How sad and insane it would be to be arrested after being tied up, almost die and find someone dead like that. Cops had no leads so they were just going to put away innocent people? Wow!! Imagine how many innocent people these "detectives" put away for life without a care in the world.. Just wow!

Luckily Roger and Pam were released after 5 months which is still a long time to be locked up for a crime that you didn't commit but there's been cases of innocent people in prison for decades before being found to be innocent so it certainly could have ended up being far worse for them than it ended up being

Plenty of other cases of people wrongfully convicted and locked away for decades. I saw one story the other day though where a man was wrongfully imprisoned for 18 years because the cops went to a guy's house who had the same first and last name as the suspect, and that was that. How horrifying and scary!!! Hope he is suing the shit out of the PD, seeing they couldn't be bothered to do an ounce of work/real investigation.

If I miss a couple weeks of work I might lose my housing, the stuff in my apartment and storage unit would eventually be trashed or sold off etc. You can't just take people for several months

Have known a couple ppl who got locked up- one was even for an excessive amount of tickets/warrant fees that couldnt pay & no one to keep her kids. Took her a good year to get her kids back after getting out of jail because of course she lost her job, apt etc so had to get all that back first & maintain it for x amount of months before the state would give her kids back

I feel so bad for Roger and Pam… I couldn’t even imagine 😔 especially Roger! He lost his dad and got accused of murdering him, and even spent time behind bars because of it.

At least you have a justice system. Where I come from (Bulgaria) there is no such thing. A drug dealer high as a kite killed 3 women with his car driving with 150 km per hour in the centre of the capital. The guy had police officers help him escape the scene and they even gave him a ladder to climb to his apartment as he lost his keys....He paid them and nothin happened. On the other hand a poor boy in the country side stole 2 chickens as he was starving for days, he got 6 years of prison. So you have no idea how blessed you guys are over there... You don't even have the slightest idea of how corruption ruins peoples lives in the poor countries

I think it’s like bigotry & exists everywhere to some degree,but obviously to a chronic degree in many places-3rd World & Communist Nations are the most vulnerable.

I like that part where the cops used a polygraph to almost send a couple to prison before someone DID THEIR ENTIRE JOB FOR THEM and handed them the guilty party wrapped up with a bow.

Timothy Evans was hanged in 1950 for the murder of his baby daughter, only for the real killer to confess three years later - Timothy Evans and many other innocent men and women death lead to the UK government abolishing the death penalty in 1965. People in UK do understand the need for the death penalty, it`s just the justice system cannot guarantee 0% failure. A innocent life is priceless especially when it`s your life on death row.

Happened to my mom , she was somewhere else , called to come check on my grandfather ,found he had been shot , the local law kept her hours to push her into false confession ,she didn't but it really took a toll on her to go through that with no cause to believe she did it , corrupt law enforcement mainly , there's much more needless to say it was to pin it on the first person possible

I remember this vividly because Kay’s son, Roger and daughter in law, Pam were persecuted by law enforcement and media alike. Martin’s ex wife could’ve been too afraid to come forward for her safety, but she sure did the right thing here!!! I hope Roger and Pam are healing and blessed ❤

Was hard for me to believe. They just didn't seem like they had it in them to slit someone's throat. The son gave me the impression of being too weak. Physically and mentally. Then the killer confirmed that when he said he was crying the whole time.

Nice story telling. You held the secret twist well and it completely caught me by surprise. I thought the case was done and dusted up to that point. Thank God the real truth came out. I hope the son and his wife were compensated, and a proper apology given. I hope they are doing ok now. The Police are human and as we all know humans can and do make mistakes.

My husband and I both do not have typical reactions to stressful situations. I could see us being in Roger and Pam’s situation, and that’s scary. Detectives often don’t consider the effects of brain injury or autism or mental illness when investigating unless they’re associating it with motive. They’re just looking to see if you sound innocent enough. ALWAYS get a lawyer, folks. ESPECIALLY if you’re innocent

So. Roger and Pam was too calm for the police's taste and they had a couple of unpaid bills, so police decide right there it's them. It is so scary to think innocent people can be jailed. My husband is in a texas prison for a crime he did not commit. This case hits really close to home. Sometimes the authorities are more corrupt than the people they're supposed to be protecting. As long as they throw someone in prison they don't care whether you're guilty or innocent.

For sure. And you can SO easily be convicted with purely circumstantial evidence. Or one "eyewitness" account, which is the least reliable thing out there. Literally try it yourself, ask a table of people/friends to recount what just happened or something. You'll get as many different stories and details as the people present. Remember the game where kids sit in a circle and whisper a funny phrase to each other and see how different it is by time it comes back around to beginning of the circle? Samething. It's nuts.

@@fearofaflatearth Well, I mean that I'd assume there'd be some circumstantial evidence in the case too. Not JUST a single eyewitness account. Though, I wouldn't be so sure that hasn't happened before. And like you said, it does all the time with police officers. That'll shut a case and get a conviction right there and they're no less susceptible to the way our brains process and remember information.

What a nightmare. Thank God the ex-wife came forward! As soon as the brain injury with Roger was mentioned I knew that would work against him. I've known two people who have brain damage and while one is worse, both are....different. Not just from how they were before, but from most people in general. Especially in emotional response. I feel so bad for these two. And it must be absolutely, painstakingly awkward around other family members now. How do you make up for suspicion like that? How do you forgive those suspicions? Ugh. I almost feel it's impossible to do either. 😩

my bf has a brain injury, he got hit with a brick during a fight. barely missed his temple, and he's incredibly lucky to have survived it. he gets really upset sometimes because his brain doesn't work the same as before, and it breaks my heart. he's so intelligent but his brain takes a second to catch up sometimes, and makes him feel stupid 🥺

I was just thinking this, witnesses aren’t reliable as it is, adding a brain injury would make them even more unreliable. Idk if the investigators knew this or just didn’t care, I would like to think a jury would see this but it could have gone both ways if the state would have said something like, he doesn’t know the degree of his crime nonetheless he did it. It’s just a no win situation. Glad everything was found out in the end.

You should look up the trial with Gwenith Paltrow right now and the guy who says she hit him on a slope says he has a brain injury and isn't the same now and they're saying it's not the case.... Suffering a TBI myself I can say for sure it's the case.

But if you know you're innocent and are a witness to a crime, you wouldn't think to get one. It's like would you get an attorney if you witnessed a burglar break into someone else's home? Probably not. Plus you have to pay lawyers for their time. So most wouldn't want to insure that expense if they didn't think they had to.

This really scares me because my sisters boyfriend died tragically a few years ago. It was later ruled to be an accidental gun discharge that happened while he was up and about and she was asleep. but in the hours/days after the incident they were interrogating her hard and we really thought she was going to be wrongfully arrested...they later found the gun under his body and started to realize she hadnt done anything but its terrifying to witness how easily it can happen

Right. Born & raised. No, I'm not LDS either, not everyone fromnUtahnis Morman... & not all Mormans are bad. I have alot of Morman friends who are great. Almost 42 years. I haven't heard of this case. But we do have alot of home invasions. My family had a home invasion... 6 hours of torment. It involved Michael Angel Martinez, who had killed Matthew Moya the year before our home invasion. Sandy Resgraph from Fox 13, did the News break on our home invasion.

Unbelievably scary that innocent people can so easily be indicted for murder. I have no doubt that if they went to trial, they could have been convicted too. A suspicious story and a plausible motive could have landed them in prison for forever, if that lady hadn't come forward with the truth. This story should scare us all.

The key evidence that we lack, stated by the police, led to the framing of two innocent individuals. Under intense life-threatening pressure, people tend to forget and perceive reality imperfectly. For example, in a car accident scenario, if someone is near me, we may both perceive what happened differently.

9/10 times when the cops say "you're not under arrest, and you can stop and leave at any time" it is likely the Only point they'll be truthful with you. If you are in a room with cop's, camera's and a microphone... Stop Talking, leave and/or contact a GOOD lawyer!!!! Because if they're going to arrest you, it is also likely they do not yet have a warrant signed by a judge. And if you are seriously being considered a suspect, you Do Not want to try and defend yourself after the cuffs go on, or at minimum, try and retain a lawyer. COP'S ARE NOT YOUR FRIENDS! Period!!

Imagine the *incredible* luck of surviving this. Two guys have just stolen a load of guns and brutally murdered your father, and they somehow decide not to kill you for being a witness. And then you walk out and are immediately accused of the murder.

No shit. Literally lots of people have staged home invasions to cover up murder. Its not suprising they were suspicious of them. Especially when their stories kept changing and not lining up.

That's what sucks about these murderer investigators. If you found the body of a family member or friend, and you're totally innocent, but can't prove you DIDN'T do it, you're totally going down for it. Even though the burden of proof is supposed to be on the state that you're guilty, not on you that you're innocent.

Those are just myths. They are out there to charge someone. The easiest is the best for them. Get a lawyer. Don't trust anything they say even when they're trying to help your family. Anyone with experience with cops knows theys lie, they cheat and do anything for that freaking promotion

Best advice I’ve heard while listening to true crime, REMAIN SILENT!!! They couldn’t say anything right, staying silent, and asking for an attorney was their only hope. Good thing it didn’t go before a jury, I didn’t believe them. 😰

@@TurboNutterBastard They can't use their right to remain silent as evidence against them... It's a fundamental right. However, you'll notice in the Miranda warning that "anything you say, can be used AGAINST you in a court of law." Trust the lawyers. Note: it was in fact, their best recalling of the events to professional confession extractors that made them look guilty, not their invocation of 5th amendment.

It’s absolutely scary how easily you can be locked up and have the key tossed! I’ve watched more than a few Forensic Files episodes to know that if the police need a murder solved you will be arrested and take charges that you had nothing to do with! Some of these people have done 10, 20 & more years before they finally were exonerated.

I was wondering when listening to the son because of his extra needs, if he wasn't able to describe it as well and seeming guilty because of it. Glad they are out now. I remember seeing a breakdown on 'micro expressions' and realized that a lot of the 'signs' someone is guilty are just what some people do when they panic. Like how you can't really tell what kind of pup a pup is gonna be when you're seeing them in a cage before adopting them.

Micro expression is crap honestly. It’s fun to watch and Maybee it’s useful as a gut feeling to let investigator dig further, but not evidence of anything. Everyone is so different. I’m autistic and I’ve never looked emotional when a close family member died, despite being broken inside.

This is a very scary story of how we can all end up in prison for life just by turning up at the scene if a crime by mistake. And all the circumstantial evidence, like unpaid bills, used against them. Was very disturbing. Thank god for the ex wife.

This is my uncle and cousin. He had 3 living children. One daughter passed in 1988. Roger WAS in an ATV accident. This is a tragedy, still, not "bullshit "!! He spent a lot of time in jail until the scumbags got caught!

He was sympathizing with your family, saying what happened to Roger and Pam after the crime was "pure shite." I don't see how that could be perceived any other way. Mike never makes fun of victims.

Wow 😳 I’m shocked to hear you tell this story, especially because I’m from the area and we ride our horses up Payson canyon (Mortensen home) all the time. This story had all of us locals questioning whether or not his son and daughter in-law actually committed this murder. Mike, you have done an excellent job with this one… your AMAZING! 👍🏼👏🏼❤️

OK, as a local, can you tell me - was that news report for real? Both reporters were odd, but that one guy looked like he was doing a Python sketch from the 70's. It was so surreal, I lost focus on the story and stared slack jawed at the reporter. Are they still on the air? Man, if I lived there, I'd never miss an episode!

Regarding the reporters…🤣 I’ve never seen them before but they are Journalism students from BYU (Brigham Young University) and their Broadcast wasn’t shown on the any of the local stations. If they don’t make it in journalism maybe they should try out for Saturday night live 🥴 JK. I personally never saw this report until now and I don’t know how Mike got the clip, however, that’s why I said he did a amazing job. Maybe he has a Mormon insider. 🤔🤫🤣

It really goes to show that you can’t judge someone’s guilt by their reaction to the crime. I’ve seen hundreds of videos and so many reactions and it’s all the way across the board. You never know how someone will behave until it happens
