Man this is so bizarre, its like one of those 1 in a million chance occurrences. Very sad, she seemed like a strong member of the community. My respects to her friends and family.

As a resident and mtn. biker of the area for 20 years i can attest that 'arbitrary' threats and harms here are the least of your worries. 110+ degree temps, exposure, getting lost, snakes, scorpions, massive canyons and little water are just a few pitfalls that become everyday life. Having camped at Moab when a rainstorm seemingly brewed up out of nowhere was scary. The gullies filled up so fast. If you are at the bottom one of the slot canyons, this could be a problem.

RIP, Essie. I went to Arches back in 2017, and I remember that entrance gate. It's unbelievable how something so seemingly innocuous could result in such a tragedy. The chances of this happening are astronomical, yet it did happen.

The chances are only low if people do their jobs properly to keep people safe. If they don’t do that, then chances of people getting hurt can be pretty high.

The only good thing I can think of is that she didn't suffer, but her poor husband, parents, and other family on the other hand. I wasn't surprised to hear about the problems her husband suffered from, after the accident.

It is not the family member who push multimillion dollar figures, ......it the law firms who set the amounts. You can be certain, the law firm got their huge cut first, and idled on paying the family members. Then comes the taxes due in their home state or country. Law firms are slow to do the pay-outs, they keep the large amount for as long as possible to gain the interest off those millions they garner off lawsuits. I stayed far from civil litigations, and stuck to criminal law (have my principals, greed ain't one). Ret.

It wouldn't normally, but the car was driving (presumably fast) down a road. At car speed something soft like a deer or a wooden plank can smash through your windshield, metal will be worse

Unfortunate, abnormally strong gust of wind suddenly coming the opposite way to meet an oncoming vehicle equals quite a force I’d imagine, tying in both wind and vehicle speeds.

So sad, they seemed like such a wholesome couple. Met on tinder, married quickly, he took her to his favorite spot in his new country, they clearly adored each other, then everything comes crashing down. Unbelievable. Him moving back to France says a lot, poor guy will have to deal with this for the rest of his life. I don’t believe 240 million is fair, but those lawsuits always cite such astronomical figures because the judge will just lower it to the highest fair sum.

The story of Essie is so so tragic. Her husband's devastation is tangible. My heart goes out him and Essie's family. Essie was a beautiful giving woman who's life was cut short by negligence.

She was an amazing woman. Maybe she wouldn't have made a lot of money on a career in philanthropy, but she would definitely have made a big difference in the world. She most certainly already had, both in her life and unfortunately in death. I hope the Arches National Park Have padlocked all those gates now. I hope her husband is doing well in his therapy and that both families and friends are understanding and supportive.

My dad's company lawyer was killed in a similar freak accident, driving behind a landscaping truck, a large boulder bounced out of the truck and straight through the windshield, killing him instantly and not touching his wife, who was driving. That's why loads always need to be covered.

I remember this one... it truly boggles the mind & is beyond tragic. I can't imagine the horror of looking over at your passenger & seeing that, let alone seeing your wife like that. It's staggering that _anyone_ who worked for the park would leave that type of gate unchained... a latch is never going to be sufficient. I've driven through gates like that hundreds of times and they are notorious for either swinging too easily or getting stuck. I've been knocked over by one _and_ had a headlight shattered - both times the gate was blown out of the person's hand. So I find it hard to believe parks employees haven't had similar experiences. Absolutely tragic... RIP Essie 🤍

I lived in Southern Utah for five years and O can attest that the winds out there are nothing to joke about. My cousin once put her car in neutral and let the winds push her car down a backroad. The State has no excuse for not having the proper lock on that gate. I hope Essie's loved ones can someday find peace. 😢

You do such a great job covering these tragic events in an informative but respectful manner. As part of my job I secure two doors that enclosed a dumpster after it is emptied. The end of these doors have a sturdy metal tube in which I insert a long metal rod with a T at the top which goes down through the tube into a deep hole drilled in the concrete underneath. Pushing the bar till the T and turning it, locks it in place. The wind can't hardly even wiggle it. Takes me like a minute. Are you telling me trash doors at an old apartment building have a better system than a National Park?

Yes... Worse than that, I've been to Moab and the Arches, back in the 90's, and I know the latch mentioned. It was in sh*t condition THEN... There's no conceivable way they can blame the Pandemic and Social Distancing for their reckless disregard. You've seen those cheap-o "Gate Latches" sold at places like Lowe's? This is a sort of solid version, where you physically lift the end of the gate a little bit to slid it into the notch to hold the gate shut... and there's a couple holes that line up for a padlock... both for the post where it secures the gate shut, and on the other post where it secures (or should secure) the gate "open"... BUT the metal of that little "tab" that fits in the notch is so rounded, you don't have to lift anything to slip it out. Just a push will do it, and it was that bad in the 90's... No chain to wrap around it... Not even a rope to tie the thing off so it won't do more than wiggle a little bit... AND yes, those winds are FIERCE from time to time throughout the day. It's a pretty funny AND sad commentary that we do more to protect GARBAGE in the middle of a city that doesn't even want it around, than we do to protect entryways and tourists at National Parks and Monuments in this country... Frankly, it's downright shameful. ;o)

Just so awful. So sorry for Him. She sounds like a wonderful person. And being only 25 and having accomplished what she had, I would think pointing that out could only underscore her value (monetary and otherwise) not equate to less in damages as the NPS would want.

It wasn't the pipe, it was the stop sign that done the damage. The stop sign also acted as a sail for the wind to grab onto.

My dad got lost in arches in 2010. I’m going to start by spoiling the story and telling you all he was rescued and is completely fine (and still regularly goes solo hiking lol). We had all gone out on a family hike together in the late afternoon (I was a kid and I don’t remember which trail) because my sister and I were under 10, we and our mom turned around around mile 2 to go have snacks and wait in the car at the trailhead. My dad is a very experienced hiker and distance runner so he decided to go on ahead for a couple more miles. I was around 9 so my memories of the night itself are a bit hazy, I just remember sitting in the parked car listening to an audiobook and sitting at a picnic table drawing in a coloring book while the sun set and watching it get darker and darker outside, and watching my mom get more and more concerned. I remember her trying to call him multiple times but her calls weren’t going through because of how bad the cell reception was but she was able to get a few texts to go through. It took while but he finally replied to her and told her what we were all assuming: he was lost and had no idea where he was, it was dark, call the park rangers and get help. By this point there was no hiding what was happening from myself and my sister and we were hysterical. I don’t remember all the specifics of how they tracked him down but I do remember that the rangers phone’ had better service than ours and they were able to call him for a few minutes before the call disconnected itself. It was pitch dark but he was able to describe some key details of where he was from what he could see with his headlamp. I remember them setting off down the trail at around 9pm, they were gone for several hours and it was well past midnight when they came back with him. According to what he told us in the car on the way back to the hotel, the trail forked and he had accidentally taken the wrong branch and got himself lost; he tried to turn back around but by that point the sun had set and it was dark out and he ended up meandering off the trail and walked up onto a sloping rock face \/outcropping. When the park rangers found him they had much brighter lights with them; as they were leading him down back to the trail, one of them suddenly stopped him and said something like “Wait. you’re gonna need to watch your step from here.” With the ranger’s more powerful headlamps he could see that the rock face they were walking on was broken up by several deep, narrow, slot canyons. He realized if they hadn’t come and found him he likely would have fallen into one if he had attempted to go back the way he came that night. He likes to downplay this story now over a decade later and “Yeah, well you got lost in arches!” Has kind of become a family joke/comeback. But at the time it was thoroughly terrifying tbh.

Chills of horror. This is not the first time I hear this story, but it still freaks me out. This reminds me of the guy who dove down to the underwater hotel room he and his girlfriend had rented, to propose, only to drown after she has said yes. It's so devastating when newlyweds or otherwise devoted people both die on happy occasions like this. You feel like you have found your person, are madly in love and then something unexpected like this happens which ends it all in an instant. It feels so unfair.

9:51 The results were made public two or three days ago (end of January 2023): family who asked for 30 million got 1 million. Husband who asked for 240 million got 9.5 million. And you were wrong when you said the state was arguing for 4.5 million. They wanted it to be 3.5, not 4.5 million.

I can't believe people think 88° is warm in Phoenix it gets 30° hotter than that in our summer times for weeks at a time!! 115-120° The asphalt alone is 175° I've checked it b4. Usually it's in that 160s but I've seen it as hot as 175°

I can’t even begin to imagine how horrific it must have been for her husband to see his wife decapitated right next to him. Only seconds earlier they were on their way to get ice cream and celebrating their honeymoon.

Wow this truly sad and random, RIP Essie. You just never know when something crazy can happen. I had a basketball roll out into the street riding a motorcycle at 50 mph and I ran over it. You can’t predict these kinds of things

I'm failing to see how someone inside the car was killed while the front end of the auto and the windshield don't have any damage? Wouldn't the gate need to destroy the front in order to harm an occupant sitting inside? It only looks like the car door was struck. Could Essie have had her heading resting on the car door hanging outside a bit?

"She was young!" ... My dude. That is a reason to pay more, not less. People really should be extra accountable the younger someone is. Not to say an old person has less value, it just needs to be enforced how important it is to be vigilant the younger someone is. And honestly supervisors should always receive some kind of punishment for employee caused workplace accidents in most cases. Watching them to make sure they don't screw up, and kill somebody is literally in your job description. >3>

I don't think anyone would disagree with that, but also that there's more loss of potential the younger you are, so the harder people should work to look after someone the smaller they are. Kids especially are stupid, young adults are reckless, and us older people know that, and know better so it's up to us to be a little more responsible to make sure stuff doesn't happen to them. Like would you tell a mom of a newborn baby that she should be happy with her 20$ Starbucks gift card, because the baby was only a few minutes old when the doctor screwed up? Because otherwise I really don't understand what this judge was even on about, it's so messed up. But they also lost their only child, they already look in their 50's, too late for more kids even if they adopted! That's way too old to be chasing down kids, I certainly wouldn't want to, it's different when you can hand them back to mom. So that's it, any dreams they may have had for their daughter, any dreams for their own life with kids, possible grandkids, even getting to experience her do anything again is just not possible, and for a fixable reason which is even worse!

So in this first Pic it shows the car intact, the hood windshield and grill seems undamaged. So I'm confused. How did the gate hit the car as it blew open, but not hurt the front grill, the hood and windshield, but decapitate the front passenger, such a weird accident. Photos don't fit the accident, very crazy and fluke accident, bless her family and widow, RIP.

I would've argued that yes, the park was right... those earnings are "speculative" and ínfact they could've actually been *much higher!!* And the fact they pointed out "she was only 25" means she realistically had a whole *60 years* of earning potential ahead of her!! Which = more losses as opposed to if she had been 50 years old and only had like 20ish years of potential earnings ahead... And more importantly, how do you put a figure on the years of living hell for the husband! Being terrified of innocuous things everyone passes by multiple times a day *every single day!* 💯

To blame this oversight on covid lockdowns and social distancing, is absolutely ridiculous. But it is a thing at this point in time. You'd have to be fucking goofy to accept that as a reason for this death.

It is tragic, but it is a freak accident. My family farm has gates very similar to those shown. They are chained to poles when open to prevent an accident. I can tell you that I never would have thought in a million years that someone could be decapitated by them swinging open. I'm sure that the park's employees had not realized that a swinging gate would cause death either. The sad part is the park can't control human error if someone working there was at fault. People make mistakes that cost lives...it's the sad truth, that's why it's called an accident. The park accepted fault and offered a reasonable amount. Most people deal with deaths of loved ones and receive nothing but sadness. Although, I really feel for the husband witnessing that and it's beyond horrific, no amount of money will take that horror away.

I hate that this happened. Tragic, senseless loss. I wanna see the Interior Dept report as to why a better locking mechanism wasn't installed, or why a cheap lock was used.. esp being a repeat instance. Was this a budget issue? Did it fall through the cracks bc of a backlog of maintenance tasks? Was there an NPS bulletin to alert Rangers & Staff to the need to replace it? (Like NTSB will do for aircraft issues.) If not, maybe they should consider creating s system for that. The park system is one of the few programs I don't mind spending money on; whether entrance fees or taxes, the NPS is worth it... but not if all the funding goes to lawsuits. They don't have Qualified Immunity, so whoever is responsible needs to be held accountable. And there IS someone to point a finger at. Whether Arches Director, maintenence or IntSec...

Part of me thinks that with all of the good she had done, that maybe she had fulfilled the Lord's plans for her and it was her time to come home. I just can't fathom the exact timing of a car passing by and the gate being blown open at JUST the right moment as to skewer the side of the car and the passenger seat alone the way it did. That was some 1 in a billion kind of odds to happen to a person, and even greater odds to happen to a very specific person who had accomplished so much at such a young age.

Well this is just insanely unlikely and yet it happened. Arches is my favorite national park. Red sunsets are spectacular and the natural formations are just incredible. I know people do get into big trouble here. I mountain bike and I’ve run into tourist who got lost with a single bottle of water. You can die out there for real but many things. This event is some cosmic cluster of some seriously mental event. Geeesh I assumed this was a lost without water issue. This is just something else .

I was there just last week and as you exit the park, the last 1.5 miles are pretty steep down hill. You take a sharp left hairpin turn right before you hit the straight away where the gates are located. Speed limit is 25mph, but even at that speed and a steel gate swinging open will cause serious damage.

I disagree - it's sending a message. Like the lawsuit said, for what should have only been an $8 fix someone who was making a significant impact on the world was horrifically killed. Completely preventable, and their 'oh it was staffing. oh it was the pandemic': bullshit. Whether or not they will actually be paid out or not, I think it was exactly the ask it needed to be in order to send a message and make an impact on what otherwise would be brushed under the table as 'a tragic accident but oops oh well'. There needs to be a massive domino effect of 'we need to make sure our shit is in gear, these things are actually dangerous and need to be better designed and better latched'.

Wow, that is properly tragic and horifying 😳 But asking hubdreds of millions of a national park sounds kind of unrealistic 🤔 It’s not like it is a massive for profit company that can pay such amounts. Park was definately at fault though and should pay at least for all the therapy and loss of income due to the trauma the husband experienced. But what monetary value can you put on a human’s life really 🤷‍♀️ It will never be enough.

I know this death is shocking and the park were negligent, but I find it distasteful when the immediate thoughts turn to how much money people can make out of the incident. How’s money going to help? Beyond funeral and other costs associated directly with a death, the fact that people argue over what someone’s life is worth in an attempt to get as big a payout as possible doesn’t sit well with me. I’m sure if one of my family was killed in this way, the very last thing I’d be thinking about was how much cash I could get. I bet in 1980 it was viewed very differently as this litigation society seems to be a recent thing. Maybe I find it strange as I don’t live in the U.S., but I think the park were right to say the figure should have been nearer $4.5m. Ultimately the judges are to blame for awarding such sums in the first place. $230m! Where will it end? 😳
