So you did a google search and read what the associated press said and that’s it? Case closed? I’m not saying she’s innocent, but the whole point in cases of wrongful conviction is that the “evidence” ends up being flawed or inaccurate. Of course if you just do a google search you’re going to see the accepted narrative. Thank god there’s actual attorneys who spend hundreds of hours digging through the case and don’t just say “well google says she’s guilty so she must be” 🙄
@deelowe32 жыл бұрын
@@UncleRicoOSU The only evidence that exists is evidence against her. She had tons of kids, multiple instances of DFCS getting involved, a major issue with drug abuse, she was a prostitute, the child in question had bite marks, a broken arm that had been neglected for over a week, and a major injury to it's head. Given all of this evidence, we're supposed to believe this yahoo on Rogan who can't even get the cause of death correct because he gave a sob story about her childhood? The child wasn't strangled at all. In Melissa's own words, the cause of death was the child falling down the stairs (which isn't supported by the pathology report which stated the child was struck on the head). I had a tough childhood as well. Does that mean I should be able to neglect my kids as well? The more I read up on the innocent project, the more I see stuff like this. They are not a credible group in my opinion and I say this as someone who is completely opposed to the death penalty.

CPS had taken her children away from her on multiple occasions. All her kids were hungry and dirty. There was no food in their house! This case is a DUMPSTER FIRE. This was a poor family, 9 or more kids in a 1-bedroom apartment, she was addicted to drugs, possibly sexually abused herself as a child, and an abusive husband. I'm not sure of this woman's mental state, but I'd stay there was a high probability she snapped. The kids had previously been removed from the home, due to neglect. The autopsy showed the little girl had a broken untreated arm. There were also bites and bruises allover her. Also marks from pinching on her vagina. (I'm not sure how you can tell them are pinch marks) I agree that this woman should not have been allowed to have all these kids in those conditions. The only questionable thing is the 5-hour interrogation after losing her child. I think she already had a retrial based off that. Same result. NOW, she says that one of the daughters was the one that was abusing the younger one that died. IDK if I believe her, but there are 9 potential witnesses that could confirm what happened. I don't which is more believable a mother beating and killing her child or a sister doing that to her younger sister. Which is worse? With a dozen people living in on apartment like that, either one could have snapped.

An autopsy showed the girl had been beaten on her head and the injuries were not caused by a fall down some stairs.” Now there are issues with the prosecutors and the DA, as well as her children not being allowed to testify in the woman’s defense - so perhaps there’s an issue with the trial itself, but it’s pretty evident that she probably did it.

"bite marks" raises a big red flag for me. Biting is something that one tends to do when they are so overpowered they dont see any other means of inflicting damage. Typically biting is done by children toward adults, or each other not by adults toward children excepting the whole 'bite them back' means of teaching a child that biting hurts when/if they go through a biting phase. (note you arent supposed to bite hard) at any rate. this strikes me as sus. why would she bite a child? of all means of inflicting damage, why biting? its not the easiest thing to do by far, we arent even anatomically configured for ease of biting things. Seems far more likely to me one of the other children inflicted these particular wounds.

"On February 17, 2007, paramedics were called to the Lucio residence because two-year-old Mariah was unresponsive and not breathing. According to the Cameron County District Attorney's Office, Mariah was found at the home with signs of abuse on her body. She reportedly had scattered bruising, bite marks on her back, patches of hair that had been pulled out, and a broken arm. According to Lucio, two days earlier Mariah had fallen down a set of stairs, leading to her injuries. Mariah was pronounced dead upon arrival at a local hospital. It was later determined that Mariah's arm had been broken two to seven weeks before her death, and an autopsy also showed a head injury and bruising of the kidneys, lungs and spinal cord." So, we have two scenarios'. The first is a horribly abusing and negligent mother who allowed a critically injured child to suffer and die over the course of days in her home rather than seek medical attention, or, a murderer who allowed her victim to suffer and die under her roof rather than call medical attention which would have revealed her crime. Either way, not a woman who moves me to sympathy.

That's kind of the point. He doesn't know that she's innocent. What's he trying to say is, how do we know she's guilty? By a possible forced confession or false admission? They've happened countless times before. Wrongful convictions are a real thing. People have been wrongfully sent to prison and deathrow by people who were 100% certain they were guilty. Who knows, maybe she's innocent. Maybe she's guilty. I don't know. You don't know. That guy doesn't know. The people on the jury didn't know. All they had were their thoughts and beliefs and made a judgment on it. In truth, no one knows, and will probably never know. In most cases, all we can do is guess and hope that we're right. Sometimes we are, and sometimes we're not. Honestly, I think the whole fourteen minutes was him basically trying to say: "Hey, our entire judicial system is screwed up, and here's one example and some statistics to explain why. I have doubted the innocence project for years. This man acts the social, emotional development of people living in poor communities are what caused this tragedy. All types of abuse happens in all areas of society and that history of abuse should not excuse a victim of abuse of any crimes committed by them in their future. People should take responsibility for their actions because they are responsible for their actions. This doesn’t seem legitimate.
@BoyBlue72952 жыл бұрын
He clearly states the only reason he’s pointing out her abuse is to show her susceptibility to cracking and committing “social suicide“, and under pressure just going along and admitting guilt to something that she may even think she WAS responsible for .. you don’t understand if you’ve ever been in that situation the pressure is unbelievable.
@BoyBlue72952 жыл бұрын
He is not trying to excuse her of the crime because she was abused. He’s saying there’s very little evidence to believe she even did it .. and on top of it rich kids in Texas who kill four people while drunk and speeding through heavy traffic get off Scott free
@dmacrolens2 жыл бұрын
Have either of you researched the facts of the case?
@BoyBlue72952 жыл бұрын
@@dmacrolens admittedly no I have not .. but it’s not the main point here .. often people are pointing to the abuse of an abuser as a reason for their behavior, but I was just pointing out that that is not in fact what Josh Dubin is doing here .. And the “facts” are often subjective themselves, where are they coming from, how do I know that these are the “facts”, I believe this guy when he says there is scant physical evidence. I think it’s a moot point because I think the governor is going to commute this one
@BoyBlue72952 жыл бұрын
But unbelievably horrific for her if she is innocent. And the fact that we just don’t know one way or the other is the basis For the saying “proven guilty”, andhow the system is supposed to work, and this guy is explaining how it most often doesn’t .. but we are fucking know that. And we all fucking know that you can buy your way out most of the time

He is declaring that Melissa Lucio is the vulnerable one in this scenario? And he lies in saying that there was no evidence of the child being abused - there was LOTS of evidence; not to mention that she had suffered a broken arm weeks earlier that had never been medically seen. I have no pity for a parent that abuses their own child simply because they themselves were a victim of abuse. Life is simply a series of choices. She made horrible ones. And her child died.

The fact that he mentioned Rodney Reed in a positive way says all I need to know about this guy and his “due diligence”. Rodney Reed is beyond guilty, and anyone who closely monitored the details of that case knows this.... Only let off because of mob pressure from people like this clown.

no physical evidence of abuse apart from " bruises covering her body, bite marks on her back, an arm that had been broken weeks earlier and was missing hair that had been pulled by the roots from her head. An autopsy showed the girl had been beaten on her head and the injuries were not caused by a fall down some stairs."

@7:59 He says he doesn't know enough about the details of the case. She admitted to abusing the child, the autopsy photos, the ones you can see show horrendous abuse of 2 year old Mariah Lucio. However, 2 year old Mariah did fall down a long set of wooden stairs that are located on the outside of the building leading to a 2nd story apartment, her family members report that she fell all the way from the top to the bottom, Melissa Lucio(mother/on death row) was not present the day 2 year old Mariah fell. The fact that she admitted to abusing 2 year old Mariah is what allowed the prosecution to go after her, nonetheless the death penalty was an over reach. If anyone fell down those steps and died two days later from a brain hemorrhage there is enough reasonable doubt to conclude that was sufficient cause for the injury that caused 2 year old Mariah's passing. A Federal Court turned over the conviction, citing "an injury cannot lead to a capital punishment.". The only argument presented by the Prosecution which argued for the death penalty but against life in prison came about because she was attacked in a woman's prison multiple times. The Prosecution used the attacks to highlight that Melissa is a 'disruption', therefore she should be executed. Melissa Lucio's been in prison for over 15+ years, if she's been a model prisoner that should negate the Prosecution's argument against life in prison. kzbin.info/www/bejne/nn-VlHqNfLRsbpY The stairway 2 year old Mariah fell down kzbin.info/www/bejne/p2KkZadnaLSSf9E Confession with autopsy pics inside of video
