You know, I'm thankful that I am at an age where I barely know half the "celebrities" that Mutahar and Charlie often highlight whenever drama strikes and I am much happier for not knowing any of them. I just hate how some travelers don't realize that when you're in a foreign country, you have practically zero legal protections because the local constitution doesn't apply to you. You should be at your best behavior. That streamer in Japan was doubly annoying because Japan has very strict substantive and procedural criminal laws even if you ARE a citizen--for starters the cops can interrogate you without an attorney for a certain number of hours depending on the charge. Lord, you're a guest whenever you travel. Your existence hinges on the tolerance of the people around you. Your freedoms don't exist. Act like a civilized human being because no one is obliged to do the same to you and it's only reciprocal morality that keeps you safe.

My tinfoil conspiracy is because Kick is so intertwined with the gambling industry, they managed to prevent the hammer coming down onto them. Sports betting is one of the biggest sponsors for the NFL, after all. It's irrelevant where the site is hosted. If an industry that has billions of dollars pumping through wants someone to fry, someone's going to fry.

@@thegrimharvest not at all. An adult is doing something legal that it is for him to do and he is streaming a gambling game on a platform that is supported by that. The streamer is not a babysitter. That is on the parents. As far as P goes. The age verification process is up to site to monitor not the streamer. He is just entertaining. The responsibility is on the parents to make sure kids don’t watch adin ross. The responsibility to age gate his stream for gambling and p is on the platform.

@@AnDr3w066 Agree the platform should have some form of age verification, fair point. Didn't cross my mind that the end user could be required to age verify. If the site uses an age verification system more substantial than "what year were you born in? Are you sure you were born in 1927? Promise? Ok. Good enough." Then, yes, under those circumstances, I would agree the streamer doesn't have the obligation to make sure his stream isn't being viewed by minors. It would be reasonable to expect that the website had done the basic due diligence to prevent such a problem. And if minors were able to get around the site's good faith reasonable attempt to prevent access, then the fault lies 100% on the parents. If the age verification is "Are you 18 yes no? Is it legal to view this in your location yes no?" and we're going with "the honor system", sure, it's still largely the parents' fault, but Id say that the streamer still holds some accountability. 80/20 split parents/streamer, even 90/10, but the streamer still ought to bear some small part of it. Just my take. Granted, the site itself would/should bear responsibility too, but they might be able to legalese their way out of responsibility by dumping the blame onto the individual streamer, and odds are they almost certainly would, if they could. What I find interesting, from the clip provided, is him asking for everyone's ages involved. To be fair, that might've been a joke on his part, and I simply didn't pick up on it. Because what it looked like, at least to me, was that he was uncertain about the age range of his audience and was trying to CYA. I still find it absurd to claim not to support something, then turn around and ask your audience if they want you to engage in or interact with that exact same thing, but that's just me trying to be consistent. I'm not in the position of a streamer being dependent on keeping an audience. But even if I was, I still wouldn't livestream "gently caressing" videos, especially if there's any chance a minor was watching my stream. I wouldn't want to get invited with a no knock Party Van surprise mechanic and have to deal with the possible legal consequences. I especially wouldn't want to try my luck in court with "but the kid clicked yes twice, your honor!" defense. That, and the fact I don't support or endorse it, and even if I did, I still wouldn't be livestreaming it for an audience of people I know absolutely nothing about. That's asking for trouble and seems entirely unnecessary, especially if I was making my bank from promoting gambling to crypto bros and addicts (arbitrary Patrick Star "what's the difference?" joke)

The streamer has no responsibility to what age verification methods that a platform should implement. That is the responsibility of the platform since its their platform. I see the potential with Kick, but I had this exact thought earlier today. I think they could potentially have the money to sustain things for quite a while, honestly depending how far in the red they're willing to go. But the bad apples are going to end up spoiling the bunch. Adin Ross is picking some insanely weird hills to die on, I wouldn't be surprised if he ends up banned on Kick too at some point.

He can already be banned on Kick for streaming adult content, live sports is also banned..... they just don't enforce it becausae they need an audience so they can go to advertisers and say "look how many viewers you can advertise to" and then the advertisers will say "you need rules against XYZ, then we're in" This is EXACTLY what YT did. They built a "lawless" environment to attract people, and then once they had them, they started killing off competitors before they get get started, while simultaneously eliminating the "bad apples" that interfere with advertiser money. Except now they have a market share that's so large that they switched to Phase 2: transforming YT into the next "host body" for MSM, hollywood, and elite-controlled entertainment. The entire point of Google buying YT those years ago was to eventually turn it into the next tv where they get to decide who gets famous, when, for what reasons, and just generally control the "fame apparatus". Independent creators was NOT the actual intent, and is in fact the WORST thing to have in Google's YT, because they can't control information or the spreading of "unapproved knowledge". While Stake isn't google, and they might not have the "phase 2" they will still need to take on advertisers OR peddle gambling to literal children in order to maintain the "95/5" split... which is unsustainable otherwise. And peddling gambling to children is something they WILL be answering to governments for (and so that won't last).

Any new service will immediately be swarmed by people banned off the last platform unless they enact the same stuff that kicked off those banned people and fail to distinguish themselves in the process. I think the only think you may have missed is the fact some 'advertisers' just don't care; I can honestly see kick getting filled with adverts for random shady start-ups and and popups saying 'horny women are in your area'. If they don't care about what content is being shown on their platform, why would they care who they advertise? Money is money, and as long as it doesn't directly compete with Stake there's no reason to worry about what the mainstream advertisers would want.

Had a radio host make the decision to move from twitch to kick because of the financial push and 95% and same day incentive. And even went as far as trying to convince me to stream there. Saying that you could stream whatever you want to kick as well. Eventually I gave up just trying to illustrate the point when they not only the radio host but the entire subset of creator's he was pulling were roasting me because I was an idiot for not moving to kick. I just prefer to not put all my eggs in one basket for it to drop out of said basket. History repeats itself after mixer.

If Kick is really taking such a laissez faire approach to moderation on copyrighted materials, there's a good chance that its not running out of money from investors/sponsors that does it in. I can see them being done in by being stripped of their section 230 protections for failing to moderate in good faith, thus opening the floodgates to being sued alongside their streamers.

This is mainly a problem with DMCA and ridiculous copyright around music. Twitch would get a crazy amoutn of DMCA notices so they mute your vods if you play copyrighted music.

But in all seriousness, isn't it kind of stupid that streamers have to rely on Twitch or KZbin. Why maintain the status quo of advertisers being spooked by loose canons? Why not push for a world where newer brands come through on these platforms with minimal amounts of censorship and hopefully overtake the big brands. Isn't that the point? To not let bigger corporations tell us what is good, safe and what isn't? I really want to state that I feel disappointed going online today. I've deleted Instagram, Facebook and Twitter. And I've never really used Twitch either. Content creators on KZbin get strikes for no reason and they are always in fear for their livelihoods. I want to live in a world where Gillette has no choice but to advertise on a platform even if the content is risky because otherwise Manscape can take away its market share. I dont want to live in a world where KZbin is controlled by what Gillette's PR team agrees with and disagrees with.

The major advantage for those platforms is Economy of Scale, as media encoding and distributing (especially video and real-time streaming in various qualities and resolutions) is costly (KZbin was still a net lose for Google for years). Nobody can afford these costs (Google could support as it helped increasing advertising business and stuff), making it almost impossible for newer brands to survive for at least a year! The same goes for moderation, as announcers will still prefer not advertising than advertising on risky markets (philosophy of association...).

The only issue is copyright lawsuits is bound to happen. There's going to have to be a TOS at some point to prevent copyright issues and loss of money caused by lawsuits. I get that people want Twitch to have competition (and they do need it), but I really wish they kept that same energy while Mixer was around. It was far superior to Twitch in every way but sheer numbers. For a brief moment, Twitch seemed to have a fire under their ass with the Ninja buyout. Sadly, not much has changed since Mixer went under almost 3 years ago... Now we have Kick and...who thought this was a good idea? It's just Twitch but worse. Even if the revenue split is better, it won't matter if you can't find revenue in the first place.

The funny part of Adin breaking TOS on kick by going to the hub is he is breaking more then one form of TOS because most if not all the videos on the hub are copyrighted works lol. Unless he is pausing the video and providing commentary lol. Also as Critikal pointed out he knowingly streamed porn knowing kids are watching his stream. That is breaking laws on showing inappropriate material to kids. The question comes in is that it was reported he had his stream titled as 18+, so could he be legally held liable. I don't know much on kick but do they have an age setting for streams so under 18 wouldn't be able to access or an age requirement 18 or above ( because from how Critikal described the sight you apparently can just get blasted with porn on the front page lol). If not then I think Kick itself can be legally held liable for a lawsuit.

Will be looking forward to Train's response to this. Superbowl watch party was because he was watching the broadcast through Stake as they had the rights for their sports betting. The initial motivation for the site was due to Twitch coming down on the slots section but the reasoning for it is a lot more than merely funneling more leads to Stake. Train isn't just lying through his teeth about wanting to make a decent alternative to Twitch that offers better revenue splits and clearer terms of service, so he can twirl his villain moustache with casino crypto money. He himself has said the site is still growing and in beta. Streamers breaking TOS or exploiting Kick as they're growing isn't the fault of the website.

Why do these people never have any self awareness? I've never seen anyone who got kicked off a platform saying they know why they got kicked off. I've never seen anyone who got kicked off of KZbin or twitch it Twitter or anything come out and basically said 'oops my bad shouldn't have said/did that stuff'. It's always other people. Other people are woke or can't deal with the 'realness' or whatever.

The only thing I do disagree with is the "private company free speech" argument, I believe major sites like KZbin, Google, Twitter etc with millions of daily users SHOULD be more lenient on free speech, as the internet turns more into an essential tool in our lives. Obviously banning the extremes, but free speech is necessary. An example would be the bans on KZbin videos relating with COVID information not aligning with CDC's guidelines when their "guidelines" and research changed so much since 2020
