That's super funny that I was mentioned in this video. Yes. I absolutely did have to ultimately create my own game as a way to not get copyright striked by malicious developers. The most infuriating thing is that there's no repercussions or penalties for false claims, unless it gets dragged to court (which oftentimes is financially out of reach of the small guy). If there's no penalty or risk hanging over submitting false claims, it leaves the door open for abuse.

unfortunately that's a consequence of the ground rules. This system is a trade-off, a way for KZbin to exist without any big rights management company or music label suing them to kingdom come. If they start messing with it, a company might get fed up and go to court, and KZbin might well lose. That's how the current copyright system works, and in a way they're absolutely right, thry might be assholes but they're right The copyright system definitely needs reworking, not because it's unfair in what you can do, I think that's completely ok, the problem is it's so expensive that youccan bully people into settlements unless it's at the level of Disney vs Jukin Media. Small claims kind of seal would be great, just that people on KZbin especially have an incredible sense of entitlement regarding copyright law. I, for one, think fair use as it is is enough, react content is absolutely in the red if it's a watch party, less so it's carefully scripted and cut and doesn't use more of the original than necessary, weighing if you're replacing the market product you're using fairly, etc. Since that's not black and white, you need courts, and we do desperately need a less financially detrimental way to rule these things the way they're intended (in court or something similar)

I like how you're addressing why the copyright system is the way it is, because I notice a lot of people don't understand that part about it. It *has* to be this way for KZbin to exist at all. There definitely needs to be better moderation however and less threatening warnings about how us creators can receive a channel strike for falsely disputing claims. Lots of room for improvement still, but the current groundwork is unfortunately mandatory.

just like you said, the problem with moderating what is essentially copyright court lite is that this is all an agreement that keeps the big dogs happy by giving them what they want, and in return they abstain from suing KZbin into the 7th dimension. So, when you start encroaching on these systems, as right as you might be, as a platform you face the very real possibility of at least one of these companies saying they're done, and suing you into narnia with the rightful argument that KZbin was not taking sufficient precautions as to prevent their content getting uploaded without licensing. It's just like a youngling making a website and getting some mail from pixsy: they might be right, they might not be, but that doesn't matter, because paying the (in a way) bully $500 to keep the lawyers away is much cheaper than even thinking about going to court, where you also face the possibility of losing and squeezing your wallet even further

Why has KZbin still not implemented the most BASIC feature to be able to use ANY content ID and copyright claim systems? PROOF OF OWNERSHIP! To be able to use any of these systems, you have to provide a legal document showing you own that EXACT piece of content. As well as, if you want to claim something really specific, like a character, sound, logo, image, etc. You have to provide a document proving you own IP ownership. Not only that but to even begin to be able to use these systems in the first place, you need to provide KZbin ALL business and personal information, including it’s a real business and your personal ID. Which will be sent to the person you are claiming content from. Then if you are proven to miss use these systems, all your provided information will be added to a KZbin blacklist, which will block your current and ANY future accounts you make with ANY of the provided information from using these systems EVER again. This means you are giving KZbin and ANYBODY on KZbin the freedom to do with your actual content WHATEVER they want! This will be the end of content trolls and content creators that can’t take criticism, no matter valid or not, and any company that claims things that fall clearly under fair use. I’m just going to keep dreaming of a system that is fair to EVERYONE....

It's strange that the people striking these videos don't have to prove that the "stolen" content is being used improperly. Why does it fall entirely on the creator to make a case for themselves when the Adin Rosses of the internet can blatantly abuse the system.
