UPDATE: As of Sept 2022, the DJI Mini 3 Pro is on the list of drones approved for flying Advanced Operations (controlled airspace and near people; not over people). Obviously this applies only when you are flying with the 'Plus' battery or other payload taking it over 250g.

@DonJoyce, thanks for the video. To confirm, sub-250g, what's the rule about near people? You said over is ok if safe. Just read your comment about Advanced operations permitting near people, so no near people for sub250?

This is another really helpful video for all those people who are buying the latest sub 250g drone on the scene. Nicely done. The value of Drone Pilot Canada to every drone flier, certified or not, is very clear. When we make the point that there's no distinction between recreational and commercial in Canada, I just hope that we're not encouraging Transport Canada to engage in a revenue-raising exercise.

Spot on Don and timely. You raise an important point about not being able to fly in controlled airspace with the heavier version even if registered and flown by an Advanced pilot because the drone is not listed in the Drone Selection tool. A very keen observation. Excellent video.

Great information, Don. I had planned to do my commercial rating based on what I had read at TCs website but it appears for my purposes I don't need to do so. Your video was so useful! I was planning on getting the mini 24 hrs ago thinking I could fly in my area (safely of course) but when I went to the Nav Tool site and kept seeing red I had to dash those hopes. Only until seeing your video I realized I needed to input that it was a micro drone category and it showed that I could once I took precautions like you mentioned! For some reason it didn’t hit me that it was speaking to the 250g plus category. Now I know! Thank you so much! My son will be glad to know. Can’t say my wallet will be as happy with you though 😎

Hey Don, Amazing video. Very savvy! I just bought a mini 3 pro. I live in a city in Alberta. I am not downtown or near heliport or airport. Am I allowed to stand in my back yard and send the drone up to 400 feet, point the camera straight down & take a photo of my property? What about if people are out on the street in front of my house, etc? Does the 90 meter rule away from bystanders apply? Also, can I use the mini 3 above secondary highways out in the country where there is hardly any traffic? Thanks, I appreciate your insights.

Thanks for your great content Don! It certainly helped me pass my advanced written exam and prep for my upcoming flight review. Question about Pilot logs & mRPAS. Do flights of a mRPAS (sub 250g drone) need to be recorded in my pilot log or just those flights of registered 250g->25Kg drones?

Thanks, Jim! Personally, I'm not worried about longer flight times. I find that by the time my drone is getting tired...so am I!! And, while I have my Advanced, the potential for additional restrictions with the heavier battery sounds not worth it...for me anyways.

Again .. Awesome INFO ℹ️ .. Great .. Love the way you simply explain it .. I'm doing ALL of what you say already .. Direct line of sight 👀 .. I use the NAV drone app .. and only fly in accepted area's .. actually I only use my Mavic Mini (original) .. as I have not opened my Mavic Mini 3 PRO (still in original packaging) .. waiting for my FLY more kit to arrive .. and I have purchased 2 (47 min) battery 🔋.. Therefore it brings the weight over 250 grams .. My motivation is the following .. I will only inbox my Mavic Mini 3 PRO once I pass the advanced course .. I use it for play & work ☑️

Thanks! Glad you found the video helpful! BTW, I had to wait to receive my Mini 3 fly-more kit as well, but thoroughly enjoyed the Mini 3 Pro with just the one battery. It helped to fly it, get used to the controls and characteristics. I had my Kovol PD charger, so the battery was back up and ready in 45 minutes! Just curious about Advertised Events and the Mini's (any sub 250) My Municipality wants me to compile some local events this summer and I'm wondering how the rules apply to this. It's by their request and obviously not over people. Is this allowed without an SFOC? Thanks :)

Thanks, Jake! As long as you are under 250g, the Advertised Events rule does not apply. Take the time to consider all the potential risks and plan for them before your flight! Sounds like a great opportunity!

Thank you, very useful video. What is your advice on flying over highways? My view is that it should be ok to cross over a highway at a relatively high altitude, but I won't follow a highway for a long distance. What do you think?

That's a very complicated question, Dominique! But a good one! Some risk factors to consider: traffic volume on the highway...and the probability that there would be 'unprotected' people in convertibles or motorcycles; would the drone be a distraction for the drivers? Is this a two-lane highway or a divided, 4-lane highway? Best practice would be to avoid being directly over the lanes for any length of time...travel nearby instead.

Would you advice a hobbyist drone flyer of sub 250g still do Basic Test. I know it’s not required, just love learning more about any equipment I use.

Unfortunately, the Basic Exam has so little to do with drones and safe drone flight, you would not learn much that way. You may wish to watch some of my study material for the exam...how drones work, the theory of flight, weather, for example.

Thanks for such informative video. I have a question. I checked many locations within Jasper National Park in NAV Drone app and those show as Allowed for micro drones. What is the catch here? How come NAV Drone app is showing Jasper National Park as allowed for micro-drones?

You really should ask Nav Drone Support that question, not me! Nav Drone focuses 100% on airports and airspace, and is woefully inadequate otherwise for real drone pilots. Honestly, Drone Pilot Canada is far superior and provides everything you need to fly your drone safely and legally. The only thing missing, which Nav Canada has not yet opened up, is the ability to file a flight authorization request for controlled airspace: they did not provide an API for 3rd parties to use.

Thank you very much Don. I’m a nooby drone pilot with a brand new Mini 3. Have been nervous taking it out for my first test flights. Your video is highly recommended viewing for everyone like me. The RC controller pops up cautionary messages if I wandered too high and I need to know what’s it all about. Flying a sub 250gm drone does not mean a free for all license. 👍 and subbed. @@DonJoyce thanks for the encouragement Don. There’s a highway bridge under construction alongside the existing one and I’d like to video the build as it progresses. There’s a hospital about a km to the East and a small airport further to the east(Pitt Meadows). I’m trying to figure out what would be a reasonable altitude to fly that’s below the flight path yet high enough to avoid the bridge towers. Can I rely on the Fly app to warn me if I encroach into the restricted spaces? Is there a department at NAV Can that can answer direct queries?

You CANNOT rely upon the DJI Fly App to warn you about Canadian airspace restrictions. You can use my Drone Pilot Canada app to accurately see controlled airspace and airport/heliport restricted areas. When flying a sub250g drone like the Mini 3, you are permitted in those areas as long as you are not flying recklessly. Generally, if you stay low (30m AGL maximum) and near obstacles like bridge towers, you will not encounter manned aircraft...although helicopters can come in quite low...so keep your ears open.

Thanks for all the info, Don! I have a question though. I'm coming to Canada this month (Toronto to be specific) and planned on purchasing the DJI mini 3. But after doing some research I realized that all the nice places with landscapes and scenery are located in provincial or national parks. So, my question is, will I find nice places to fly the drone in Toronto? :D Thanks in advance!

Hi Nourhan! A very good choice to fly a sub-250g drone if you are visiting Canada! Fortunately, Canada is a VERY large country with TONS of good scenery. Only a small percent is tucked away in parks. I don't live in the Toronto area so I can't recommend anywhere in particular, but I'm sure a bit of googling will help you out! Enjoy your visit...safe and happy flying!

So, I am in Ottawa. About 30 km south of the International air port. But there is a gliding club nearby (yellow on the map). Am I okay to fly under about 10 meters or so? Tree top height?

If you are referring to Rideau Valley Soaring, their flight area is CYA528. CYA zones are advisory zones where you are required to fly with extreme caution...especially since gliders can be very quiet! You are ok to fly in these areas as long as you stay well clear of manned aircraft. Flying below 10m or hugging the tree tops would be one way to stay safe. Great video! I am planning to visit Banff/Jasper National Parks. I understand that flying within the national parks is illegal. But you can fly over provincial parks as long as you take off outside of them? If so, I'm trying to figure out if it's even worth taking my Mini 3 Pro since so much of the area is National Park or provincial park. I cannot find clear maps that show the boarders of all provincial parks in the area to ensure I am following the laws. It looks like almost everything is some sort of park and want to be sure to follow the laws. I do not see an option on the drone site selection tool to include provincial parks. What would be your advice for this situation? Also, I am trying to find where it states that drones can fly in provincial parks, but just can't take off from them? From the BC Parks Act, it seems that they can't fly there? Thanks!

Hi Georgio! You have the rules correct. You can fly over provincial parks, but require permission to launch from them. Also, you cannot disturb wildlife or park users. The Drone Pilot Canada app shows all Provincial Park boundaries precisely, and gives basic information about who to contact.

Thanks, Eddy! Transport Canada does not require drones or drone pilots to be covered by insurance. That said, as you say, a commercial venture should certainly consider liability insurance. And no, I don't have any recommendations. :-)

Hi Don, I'm considering buying a DJI mini two or three in the coming weeks/months. I'm new to drones but I've done lots of research on KZbin using videos such as yours. Listening to your video it gave me a lot of confidence that Canada seems to have gotten it right. They seem like reasonable regulations to me. However, as clear as these are at the federal level, I'm concerned about the provincial and municipal level and how many constraints these might apply. Is there anything you can say that would relieve my concerns that I will be met with several bylaws and provincial regulations in addition to the Federal ones? I live in Ottawa Canada.

Thanks, Brian! There are MANY unreasonable drone regulations for larger drones and the exams are just ridiculous, BUT for sub-250g drones, the simple rules are sensible and easy to follow. The only provincial thing to worry about is Provincial Parks...but that's a simple ask-the-superintendent thing. Municipal by-laws can be very archaic and overly strict...and they certainly can be in Ottawa. But if you follow the golden rule of staying away from people and not bothering people or animals, you will be fine. Enjoy!

If you are in the United States, yes, you need a Part 107 license to make money with a sub250g drone. In Canada, you do not need any level of certification to make money with a sub250g drone.

Class D (like Class C and E) indicates it is part of the control zone of a major airport. It is legal for a sub250g drone like the Mini 2 to fly there, but you need to be exceptionally careful since there is a high probability of manned aircraft in the area. Stay on the lookout and stay low (30m for example).

Thanks for the excellent video. I have a question about the Nav Can drone app. I fly in the alta vista area of Ottawa, about a Km from CHEO. the drone app says that I can fly at 400m ! The DJI app says much less than that. I generally keep it lower than 25m and always listen for aircraft, but could I really legally fly at 400m?

I can't vouch for anything the Nav Drone app says. As stated in this video, you can legally fly a sub250g drone at any altitude, pretty much anywhere (restrictions as stated in the video)....but generally flying that high would be considered reckless. If you are anywhere near a hospital heliport, I strongly recommend (as stated in this video) that you fly below 30m and keep a close eye/ear out for approaching aircraft. The DJI app does not reflect Canadian regulations and does not show all heliports...use it as a guideline only.

Hey Don, I brought my Mini 3 Pro to a local street festival today and took about 15 shots or so before some local police told me I could not fly there because there was a helipad (on a hospital) within 5km away. Was I actually okay to fly my M3P since it’s under 250? I was about 2km from the helipad. What should I tell the officers if that occurs again? Thanks in advance! Your videos are quite helpful

It's obviously tricky when dealing with the police, and it must be difficult for them to understand all the intricacies of the rules. I recommend you land before discussing anything. Then explain politely that the drone is below 250g and exempt from most regulations as long as you are not endangering aircraft or people on the ground. Make a few comments about how you are ensuring that. Don't argue, but some gentle assertions may help.

Hi Tom! If you are flying a sub250g drone like your Mini 2, then you do NOT need an SFOC or anything....just fly safely per the guidelines in this video. If you want to fly your Air 2S, which is over 250g, you will need your Basic and apply for an SFOC. Unless you REALLY REALLY have a good reason to do this, I wouldn't recommend even trying an SFOC. I had a tough time with the form they send you after applying for an SFOC and they wouldn't answer my questions....hence no video.

The Drone Pilot Canada app is a one-time purchase, including automatic aerodrome and airspace updates per the 56-day NAV CANADA update cycle, as well as new features as they roll out. My nav drone app paints all of Montreal in various red and pink zones, the yellow you depict at 7:56 specifically are almost exactly the same shape and distribution, the only yellow are way out in the suburbs? At 9:50 when you show Ottawa, same thing. Has his changed recently?

Please watch the video again. I very specifically say that Drone Pilot Canada and the NRC Drone Site Selection Tool have sub250g drone map views, and THAT is what I am showing. The NAV Drone app is designed to show the airspace, then they leave it to you to figure out what it means. Drone Pilot Canada is the only tool that offers the full suite of information, and does so in a simple and easy to understand way...in plain language.

If you are flying with the Plus battery, your drone is over 250g, so you DO need to register it and follow all the 'small RPAS' regular rules. The update meant that you could, assuming you were an Advanced pilot, fly advanced operations with the Plus battery.

Hi Tom! Having flown both the Mini 2 and Mini 3, I would say the Mini 3 is the better drone without any doubt: better camera, better wind resistance, better controller (the one with the built in display), obstacle avoidance (don't discount these!!!!), and slightly better battery life even without the extended battery. If you are new to the hobby and keeping to a budget, the Mini 2 is still a great drone, and certainly $500 is a great deal.

Hi Don, Not sure if this was already previously asked but can you fly a sub 250g drone over a highway if their is no restricted airspace? And I'm thinking flying it more like 100-400 meters to get a nice bird eye view of different highway patterns crossing each other. It is recomended you don't fly over people so I'm assuming moving cars falls into this. Thank you :)

Uncovered vehicles count as bystanders...convertibles and motorcycles, for example. But a sub250g drone doesn't have that restriction anyways. I am quite concerned that you want to fly so far over 120m (400 ft). I recommend you NOT do this....you are into the realm of manned aircraft, and high wind.

I’m getting such conflicting information on flying within Canadian National Parks. On the NAV Drone app, if I select a drone over 250g and pick a National Park area, I get an explicit message saying that flight is prohibited. But if I choose a sub-250g drone, I don’t get that same message. Is the NAV Drone app just glitched?

Hi Domnic! Unfortunately, just saying 'red zone' isn't enough, and Nav Drone isn't super clear about restrictions for sub250g drones. If it is red due to it being a Class F Restricted Zone (eg, Parliament Hill), you CANNOT fly there. Same for NOTAM temporary no fly zones. I recommend you use my Drone Pilot Canada app or the NRC Drone Site Selection Tool...both of which have map views explicitly for sub250g drones, making it crystal clear where you can or cannot fly. BTW, it makes no difference whether you are flying recreationally or commercially...in Canada, the rules are the same.

Hello @@DonJoyce, Sorry I should have been more specific about the red zone. There are a couple of red zone in my area which over lap. The first red zone says CZ CLASS C Second is CZ Class E Third one say “Part of the selected shape overlaps with a Control Zone, and a Certified Airport/Heliport. Basic RPAS operations are not permitted in those areas And Airport.Basic drone operations are not permitted within the 3 nautical mile zone indicated by the red circle.” Thanks

As long as you are not harassing anyone or interfering with manned aircraft, and not in a no-fly-zone, yes you can fly over people at any altitude with a drone under 250g.

@@DonJoyce It's bad practice to fly over people, started FPV in 2014, never fly over anything living hundreds of logged hours. 250 grams can hurt if at speed even a 240g Cinepro, Emax Baby hawk quad will cut a person or distract a driver. The camera "drone" fad ruined the hobby for personal vanity. LOL! People fly Mavic minis in Coal Harbor beside airplanes it's so out of control, too many novices. Toothpick drones are about limit sub 150g may not take an eye out.

G'day, sir! I have a question, as I catch up on a couple vids I missed. Referencing 7:52 in the video, specifically the Drone Pilot Canada app's "Sub 250" selection on the map screen- I don't have this! Any idea why? My app shows version 2.9.1 Build 1124. When I visit Google play, it appears the available version is also 2.9.1, with no build number shown. I also have not spotted an "Update" option within the app. As I fly both sub250 (DJI Mavic mini) as well as 250+ (Yuneec Typhoon H), I like the idea of having this option. Easy:. The sub250g map option appears only if you denote one your aircraft as being sub260g. Go to hamburger / aircraft and set the toggle for your smaller drone.

Technically, you only need the permission of the landowner of the place you take off and land. Since you are flying a sub250g drone, you do not need controlled airspace authorization nor permission from the Billy Bishop (island) airport. That said, you should be VERY careful. Stay close to the tower (within 60m) and be aware that the wind at higher altitudes is MUCH stronger than on the ground.

I tried to fly my drone near by the CN Tower last night but the drone couldn't even take off since it was near by the Billy Bishop airport but it was at least a km away and I just wanted to film one building (it was a rooftop party, taking BTS videos). As I was setting up my drone, one of the girls there was asking me, "did you hack your drone? I don't think you can fly here without hacking it" and she was right, I couldn't lift off. This was very inconvenient since that drone shot would've been so epic. Is there a way to "hack" the drone without losing its warranty?

@@danielmok3762 No, yo cannot hack it, and don't need to. If you were in the red DJI zone, you are too close to the airport. If you are in the blue zone, you can easily do a self unlock. I have a video about this.

So I’m confused, if i get the mini 3 pro with the heavier battery. I have to pay the 5$ registration + 10$ exam) and i have to pass the exam? Can i just register the drone?

If you buy the Plus battery, you need to follow all the standard 'small RPAS' rules, including both registering the drone and having at least the Basic pilot certificate. The price appears to be the same everywhere. I went with BrstBuy...July 15 shipping...which may or may not come true.

Since the Mini 3 Pro is the first sub 250g drone to have extensive "follow me" features like Active Track, is this something that's technically legal under the Canadian regulations? I know with Basic or advanced operations, you're required to have someone at the controls at all times ready to react in the event of any issues. But how does this apply to the Mini 3? Could I theoretically put the controller in my backpack and have the drone follow me on my bike without breaking the rules?

Yep! AS LONG AS YOU AREN'T DOING ANYTHING STUPID....like doing that through a crowd or near an airport etc etc.

Don, do you know where the regulation saying you can't fly over national parks is? "National Parks of Canada Aircraft Access Regulations" only seems to regulate take-off and landing. Also, do you know if this applies to Parks Canada historic sites, or just the actual parks?

The National Park airspace is specified in the full CARs. And the AIM document provides a good explanation. As I understand it, the rule applies to parks only, not historic sites managed by Parks Canada.

@@DonJoyce Ah, I found it in AIM 1.10.3, saying to stay above 2000' AGL, although that's a "should", not a "shall". Although disregarding a "should" could still get you in trouble with the "don't be stupid" rule. Didn't find anything in the CARs.
