My husbands grandfather was 20 years and 8 months when his father naturalized in 1943 making my husband and our children ineligible based on these guidelines. To say we are disappointed is an understatement. Wish we had started this journey years ago.

He said you can pursue it through the court system, is it true? My wife’s grandmother naturalized in 1949, but her daughter was born a US citizen in Italy (her dad was a GI, also Italian-American), so we’re not sure how these minor issue guidelines work for us either. I read a new opinion today from the Bologna circuit court basically saying that jure sanguinis applicants are not exactly Italians as they don’t belong to the body politic! Ridiculous, since my wife’s family kept their connections to Italy and traveled there frequently. They still have relatives in their hometown!

Yes unfortunately. A 1948 case is still part of JS, so the so called "minor issue" still applies. It depends on how the courts rule, and that is basically a 50/50 at best right now from the few lawyers I spoke to.

You can go through the maternal side since most women were never naturalized at the time.This is why I am now switching my demand for citizenship from vicenonno to vicenonna at my municipality.My great grandmother was never ever naturalized. Never give up, I find this change of attitude sad and typically Italian but being Italian descent bring it on.

I was told by an Italian lawyer that the wives never naturalized because when their husband's (head of the house) naturalized the wife automatically became American citizens . Both my grandmothers never naturalized on their on and was told that's because they didn't have to, their husband's did it for them

Does annyone have any information regarding those of us that received an approval at the consulate but have not yet completed the entire process? My application was approved on 10/10/2024 in Detroit prior to the memo being communicated.

I suggest that you email the citizenship department at Detroit and ask specifically if your application will be affected by the circular of October 3, 2024 regarding the minor issue. Be sure to give the date that your application was submitted.

I would try to contact them and ask that exact question. Since it was already approved, you shouldn't have any issues but given how things seem to be very up in the air lately, it would be good to get confirmation that it's all good.

Now I'm confused. I was born in Canada (1959) before my parents naturalized as Canadian citizens. I would like to become an Italian citizen. Does this new guidance preclude me?

It depends on how old you were when they naturalized. If the naturalized before you were 21, then the line was cut.

I don’t understand…. My grandparents naturalized in the 50’s to Canada. My mother was 4 years old. I don’t qualify for citizenship. Or do I? Both my parents were minors when their parents naturalized in the 50’s. I was refused citizenship in 1992 because I was 19. Can I go through the courts or the only way is to move to Italy for 3 years?

You still can you just have to go through the court system. My cousin applied in Palermo via an attorney in court as a minor case and he just received the approval via the court last week and is just waiting for the paper work and such. It cost him €5,200 and was well worth it. I will be going via the same path as he did

The law needs to change. Italy needs people! The Trentino and Sud Tirol question must be fairly addressed! It is an injustice.

It's a sovereign country. It can do what it wants. Furthermore you can still get citizenship more quickly than practically anyone else if you have Italian ancestry (3 years versus 10 I believe).

My understanding is that you would have to renew via the local consulate where you reside as your primary residence, unless that consulate becomes unresponsive and you cannot get an appointment. I don't think you can renew in Italy unless you plan on moving there and making that your primary residence.

Don’t worry about losing your citizenship if it’s already been granted. It is done. You are recognized if you’ve had your passport already!
