I use UPS for most of my notary work because they have security cameras, witnesses and they they log the process in some DB they manage. Question, can a Florida Notary not only be used to confirm the person signing is who they say they are but also that they were in possession of the said document and have mailed it to a stated address?

Hello. Florida Notaries are not authorized to certify that an individual possesses an item or mailed an item. Florida Notaries are authorized to perform the following notarial acts (FS 117.03 and 117.04): Take acknowledgments; Administer oaths and affirmations, as when executing jurats for affidavits and depositions; Attest copies (FS 117.05[12]); Solemnize marriages (FS 117.045); Verify vehicle identification numbers (FS 319.23[3][a]); Certify contents of safe deposit boxes (FS 655.94).

No signature witnessing in California. We do signature by mark.

A signature by Mark and a signature witnessing are completely different things though. A signature witnessing is just an acknowledgment but where the signature must be actually signed in front of the notary. A signature by Mark is for somebody who is not able to actually sign their name due to some kind of a impairment so they only make a line or an X or whatever.

*I have a question: why would some states not allow a “signature witnessing“ but those same states I presume would allow a “acknowledgment“? That’s perplexing because a “signature witnessing” is better overall.* I say that because if someone were to fake an identification (like have a fake ID or use their brothers ID who they resemble a lot) then at least the signature wouldn’t necessarily match. Because with an acknowledgment maybe the forger photocopies someone’s real signature onto a document, then they come to the notary and have it notarized, so it’s more secure if the person actually signs the paper in front of the notary public.

Hello. Each state’s Notary laws are determined by state legislators. If your state does not authorize signature witnessing and you think it would be helpful for you as a Notary, your best option would be to contact the state legislator for your area and share your feedback with them on why you think it would be helpful to Notaries in your state.

I believe a jurat is more powerful than an acknowledgment because it encompasses everything in a knowledge of it is plus more. So I don’t know that you actually do them both.

Hello. If the signer isn’t sure what notarial act is needed, they can contact the agency that issued or is receiving the document or an attorney for instructions. They will tell you what notarial act is needed, and you can attach and complete the appropriate certificate form.

NNA can correct me if I’m wrong, but I believe every jurat must been accompanied by an oath or affirmation. So every time you notarize a jurat you have to have the signer swear that they are telling the truth out loud.

@@iMatti00 The purpose of a jurat is for a signer to swear or affirm that the contents of a document are true. Depending on the jurisdiction, it also can be known as an affidavit or a verification on oath or affirmation. However, in some cases, a client may simply need you to administer an oath or affirmation orally, rather than as part of a jurat, affidavit or other written document. The purpose of administering a verbal oath or affirmation is, again, to compel a client to truthfulness.

Any advice to a Ohio Notary for certified copies of passports! Never done one before! Do I need a specific stamp or certificate to do? Can the signer hand write on it instead?

@@NationalNotary- Actually I believe this question was answered incorrectly. I ran across some articles which state that you absolutely can notarize a passport for a certified copy in most states. It is not considered a vital record like a birth certificate, marriage certificate, death certificate yes. I don’t know what makes it different where it’s not considered a vital record, but it’s not. In fact I think the article actually said a passport can be copied and notarized as a certified copy in any state That allows a notary to certify copies. But I will say that I understand why the employee that answer this question would answer it the way they did. It just seems like common sense to love a passport in with all the other birth certificate and other things. So I have no clue why it’s different. Maybe NNA can look into this situation and comment back or write a article.

You are correct-a passport is not a vital record, and some states do permit copy certification of passports. However, Ohio Notaries are not authorized to certify copies of documents, and the previous response should have mentioned that. Please see the following: “A notary public shall not … [c]ertify that a document is either of the following: “(a) An original document; “(b) A true copy of another record” (ORC 147.141[A][5]). However, “Division (A)(5) of [ORC 147.141] shall not be construed as prohibiting a notary from notarizing the signature of a holder of a document on a written statement certifying that the document is a true copy of an original document” (ORC 147.141[B]). So while an Ohio Notary may not certify a copy of a document, as an alternative, Ohio Notaries are permitted to notarize the signature of a document holder who makes a written, signed statement that the document is a true copy. I'm in NJ what would a handwritten or typed document such as a lease be considered, an acknowledgement? If the landlord and (tenant) both signed the document before bringing to you to notorize, is this legal? I work in education and sometimes parents need a document (ex: handwritten/typed lease) notorized, do I need to attach a affidavit to the document?
