It's fishy when the cops say "you almost hit me" then the trespassing claim gets brought out much later. If they thought it was trespassing, then be professional, ID yourselves properly as officers, and clearly state what the problem is. These cops were just hung up on "give me the ID" and lacked the common sense to state any reasonable basis for the stop until well after they had lied, threatened, and behaved unprofessionally. They seem like children not community servants.

@@mcraig2237 from what i understand his grades are based on their behavior in relation to the law rather than in relation to being nice or something , a cop could be hostile but following the law and they are technically in the right but the fact that they were hostile would not matter as much as the fact that they followed the law, the comments are for determining grades and opinions that are based on different things that what AtA uses to determine his grades

@@catlord539 Well, did he miss the part where one cop literally said he hadn't done anything wrong or broken any laws. That they just ID EVERYONE who goes back there? I wish ATA would show me where that's at in the constitution. Or how he could give the man a C when the LITERAL information he was receiving was there wasn't any crime. I guess he's strung a bit too thin doing the content farm thing on KZbin these days.

You're comparing apples and oranges. An officer fatally shooting a person to death is a homicide. It is always unlawful for one person to kill another person without due process. However, some homicides are excusable. For example, a soldier fatally shooting an enemy combatant during a war is excusable homicide. A soldier fatally shooting an innocent civilian is not. In both the cases of the soldier and the police officer, while a law may be violated those violations within the scope of their authority (or for self-defense where we are guilty of a crime but that crime is excused for self-defense) is excused. The apple, breaking the law, is not related or comparable to being excused for breaking the law. Qualified immunity is a doctrine that does not excuse violations of the law by government agents but shields them from litigation.

For real though, I noticed that right off the hop too. It was NEVER mentioned again during the entire interaction, nor acknowledged by the other officers about him nearly "hitting" the chief with his car. That should be grounds for investigation when law enforcement lie like that regardless of intent.

Here's how this was supposed to go: -Chief see someone trespassing. He politely introduces himself and letsdriver know the area is not open to the public and trespass signs are posted -Driver say's he didn't see them. Small chat about why they are there if they want and leaves the area. -The end

According to the guys own words he refused to stop for the unmarked vehicle in the beginning. So there's a reason the chiefs already hostile. The rest of the behavior isn't good but 1 he's in an area he shouldn't be. 2 he refused to stop for a police officer. 3 he's refusing to identify. 4 he's refusing to obey a lawful command on a lawful traffic stop. Etc etc.

@M Craig I agree with you. The chief and the aggressive cop should have been graded separately. The black cop seemed to be the only one trying to reason with the man, but he quickly got overrun by the other two officers. The cop had a blatant misunderstanding regarding the total scope of his power.

He declined to provide ID when they clearly stated that he had committed no crime. Once the Major said he was criminally Trespassing, he followed all commands and provided ID. It really was straight forward.

You trespass you get asked to leave. Your not forced to ID. Not to mention the “chief” wasn’t in uniform. I totally understand why he didn’t believe he was a cop. Plus his story changed from you almost hit me to trespassing. Everyone after didn’t help and just said, because we are police you do what I say.

Thing is, the sign technically already constitutes that “ask to leave.” So he was still there after having been informed he wasn’t allowed. That is a crime, and so obviously they can detain you and ID you at that point. SHOULD they, though? Of course not. They freaked out for no reason. The signs were not clear or prominent, and he was clearly not aware he wasn’t allowed there.

In another video (on a different channel) a similar situation occurred and it was suggested to call 911 and verify that a real cop was pulling you over if you are stopped by an unmarked car or are otherwise unsure.

I swear, cops need to learn to better communicate. All he had to do was pull up to him and say “hey, this area is actually not a public area. It’s currently under a no trespassing zone. Can I ask you to just leave this park, thank you.” I can almost guarantee that the driver would have been totally fine with that but instead he chose to aggravate the situation.

I watch Code Blue Cam to help remind myself that some cops are cool. Every Wisconsin cop seems like an extremely chill, law-abiding, non-power-tripping, professional employee. It helps not completely give up on an entire profession.

I feel the same way. The number of bad encounters is alarming. The number of good encounters is negligible. But 99% of people are not going to upload videos of uneventful encounters.

The motorist is not an expert. So, why does the professional who is supposed to know better get a higher grade than the misinformed citizen? BOTH of them were wrong about the law, and yet the cop, the professional, got a "B-" and the citizen got a "C". That's biased, unfair, and illogical. And THAT is the point. @M Craig in all reality, these thugs did everything within the law. It is a sad place that this behavior is lawful, and that is what needs to change. The "tough on crime" has not worked for over 2000 years. Look over in Northern European countries that help people who commit crimes back into society. Crime rates are low and same with recidivism. Wouldn't the "For Lease" sign implicitly be an invitation beyond the trespassing signs? A store can have a No Trespassing sign in its window but that its open for business negates the sign and wouldnt let them instantly arrest anyone who walked in.

@@Not_Ciel He wasn’t trespassing. By displaying a for lease sign, you’re inviting individuals to contact the property owner for inquiry. That bypasses your no trespassing sign. I can’t post a sign saying all visitors welcome while also displaying a no trespassing sign then pick and choose who each one applies to.

When they told him it was closed to the public "you cant be here" he repeated tried to leave they forced him to stay because they wanted his ID and when they couldn't get it they trespassed him he did try to leave when he found out he was trespassing.

This would be accurate if 1) the signs were not clearly posted and 2) if he had not been driving a car. As the driver of the car he has to provide I.D. and the police COULD let him go but are well within their rights to arrest him if he won't identify himself.

As well as the car NOT being turned on - only if the keys are in the ignition and/or the engine is running, can he be legally held to be in control of a car. When the engine is off and stationary, you can do whatever you want in the car.

The officer in uniform was being so nice and polite and helpful and doing everything an officer should, listening to the guy's complaints that the police chief was rude to him, deescalating, and then the second shows up and just immediately starts being rude and undoing all of that. Also Jesse definitely gets at least a B+ in my book. He made it perfectly clear that he didn't trust the random man being rude to him was police, and was perfectly ok with giving his ID to them when he didn't think they had the right, so long as they made it clear he was under the threat of arrest if he refused. Citizens can't be expected to know all the laws, including the times a person must ID themselves or is in their right to refuse to ID themselves, so stating that he doesn't think it's correct but will do so anyway if they force him to is the right thing to do.

Yeah it was a backwards rating. Jesse might have been wrong about certain facts, but he's a citizen and was acting reasonably and in good faith. The chef and major on the other hand are supposed to be not just cops but senior ones who should know better and handle the encounter professionally, instead they did as most cops do and just act like the hammer who sees a nail.

He was in the right to not give his ID being suspicious isn't cause to ID though the cause did exist to ID and once a less angry more rational officer arrived and actual explained he was trespassing. You can make an argument an officer tried to violate his rights but its very flimsy since hew was in the wrong and that officer didnt end up doing anything and called for the backup that sorted the situation out

That "No Trespassing" sign looks like it referred to the PROPERTY, not the road in which he as driving. Unless the road was blocked off via pylons or something else, It's hard to believe and entire public road can be considered off limits by a single 'No Trespassing" sign posted in the way it was.

Their claim that he had no legitimate reason for being on a property that was marked by signs posting it for lease went right out the window the moment that entered the conversation. The appropriate response would have been for the cops to turn tail and walk away at that moment. But instead they doubled down on their stupidity by claiming that the authoritay of anyone in plain clothes claiming to be a cop must be respected without question. The "Chief" could have been a rent-a-cop (security guard) on a power trip for all the driver he was harassing knew, or even just some groundskeeper trying to flex. Like the driver said, GTFOH!

When I was a teenager, a plainclothes man approached my boyfriend, showed him a badge, and said he had to go with him. The next day, my boyfriend's body was found in a pond a dozen miles away. The man who had approached him was a serial killer. There is no way in hell anyone is getting anything out of me unless they're in a uniform and a marked car. @@mcraig2237 AtA very rarely gives a higher grade to cops than the citizens.. I don't know what you're on about. Check out more of their vids. More often than not, I see more cops getting F's than A's compared to the citizen equivalent. In fact, I don't think I've seen a single citizen acquire an F on this channel. Maybe there's 1, but there's at least a huge handful of instances where the cops get an F. He was driving a vehicle, so technically that's one reason for asking to ID themselves. It was handled poorly on both sides.

Why do you always have to squeeze out of them what this is about? They're always immediately personally offended. Just say it. The law is on your side officer. Nothing to hide here. Just say what this is about. No we have to get personal, we have to get in your face, we have to threaten violence or arrest or worse, we have to escalate. SMH The aggression is the reason why we are reluctant: "If police says jump you say how high, sir?" That's their attitude. They were right but the escalation was unnecessary.

Saw this covered on another channel months ago, can't remember where. Cops openly admit initially that they didn't stop or detain him for violating any law but based solely on him looking suspicious. Law enforcement had no legal justification to demand ID, and depending on where the trespass sign was posted and how visible it was, no right to stop him in the first place

A person who was pulled over that was inside a horrible arson incident and was trespassed out of the public and had a weapon does warrant a higher response especially if they aren’t cooperating with police officers. It really could of turned out differently if it was someone who was more on edge than this citizen and not for the better.

You’re assuming they’re doing it to get lazy arrears but they clearly stated they had a lot of problems with people being in that area before. Without more context we don’t know if someone got stabbed to death there or just trespassed there before. Furthermore, only one cop was there until he called backup. After the second time we invested in more deterrence like cameras etc and since then no problems. I’ve lived in both the US and Europe and can guarantee you the US is over-policed.

What about the "Lease" sign that he spoke about in the beginning? I like how the police never responded to that aspect of his reason for being there. What if there was not a phone number on the property lease sign to call and he thought that there would be a building to check in at to inquire about leasing the area? I feel like this whole interaction could've been handled better by the police chief if he had just said: "Oh, you're interested in leasing an area of the park? Here's the phone number for _____" or "If you go to this place, you can set up an appointment to visit. But at this time, this location is closed to the general public without a permit." And sent him on his way. After all, he had verbalized that, because it wasn't gated/blocked off, he thought that it was still open and that with the knowledge that it wasn't, that he would leave. But when an officer starts barking orders without expressing a reason why (especially when said officer has no markings or badges showing that he's an officer), the "suspect" in question might not believe him and become defensive. Police are supposed to have "thicker skin", and when a citizen isn't showing any hostility towards an officer like this guy wasn't, this police "Chief" could've easily just made this a calm and cordial interaction. But he had to go and treat him as if he was a criminal right from the start. The old saying goes "In order to get respect, you have to give respect." And so many officers nowadays seem to feel entitled to receive respect no matter what because they have the uniform and badge.

If he had provided his I.D. as legally required, that would likely have been the end of it. But I don't deny that the chief of police here was escalating things because he felt disrespected. However, he had the legal right to demand ID.

The only part i agree with the driver on is obeying the commands of the police chief. The chief had no identifying stuff saying he was a cop. I would hope no judge would uphold any arrest for refusing to obey a non uniformed officer without proof of a badge. That seems like VERY dangerous precedent.

The purpose of the channel is to discuss the legality of police/citizen interactions, but you want the final grade to be based not on the law, but personal perception. The grades are more useful as they are objectively defined. Ultimately, a grade can't fully encompass any interaction, so perhaps you should listen to the reasoning surrounding the grade and ignore the letter of it. Did you disagree with the summary of the interaction?

This illustrates one of the biggest problems with law enforcement- these cops may well have been acting within their legal authority, but showed no judgment in escalating a situation where it was perfectly clear no real crime was being committed. How hard would it have been to simply tell their “suspect” he was ACCIDENTALLY trespassing and then send him on his way. If identifying him was so important they could easily have noted his plate number. Cops have too much power and too many of them don’t know how to exercise it.

I wouldn't have identified myself to the Chief either. I wouldn't have even acknowledged them. I would have immediately called 911 to report that a vehicle with no official markings and a man in plainclothes was claiming to be law enforcement. I would ask them to confirm whether this person was actually law enforcement or just impersonating them. It's fairly common for criminals to put flashing blue lights on a vehicle to impersonate officers for nefarious purposes, and this chief should have properly identified themselves with a badge, which would have cleared up the situation immediately. Instead, he got hotheaded and belligerent when asked to provide his credentials. I give the Morrow police a D- and ATA's grading an F.

the younger officer, despite being incorrect about the law, was trying to be kind and respectful and seems to be aware that the behavior of his superiors is unacceptable and looks uncomfortable with them. hopefully this will serve as a lesson to him and the next generation of officers on how NOT to behave.

In reference to your asking of citizens to better educate themselves on the law, how the hell does one go about that education??? With how long & drawn out the laws are, & with the sometimes ridiculous language used therein, how is any normal person supposed to have time to read the MILES & MILES of paperwork, let alone have the education necessary to understand it?? Laws should be plain languaged & as straightforward as possible, & also should stop using tes like "reasonable" that have to be *interpreted* .We need to hire some legal geniuses (such as yourself? Maybe..?) to sit down in groups & start scaling these things back so normal, public high school educated people can actually understand what the law is & how to deal with situations like the ones we see on this channel.

No, absolutely not. The person in the wrong in each of these cases should by default have the lower letter grade. A “B” grade is fine. I don’t understand why people get so upset when cops raise their voices, I have a feeling most of you live sheltered lives.

If employees of private companies are supposed to be professional then cops absolutely should be required to be professional. If you have the power to strip someone of their freedoms and even use force, then you have no business being in the role unless you can conduct yourself calmly and professionally at all times.

Unlawful detainment, RAS and/or PC did not exist of Trespass. No opportunity was given to leave. AtA got this one blatantly wrong per the very law cited in video. Trespass is when someone who has been told to leave stays or comes back after being told to leave or signs are posted.

not defending the Chief of Police at all, but he was wearing a polo shirt with their department insignia and was also in an unmarked patrol vehicle which is quite common. I do believe that if they are dressed in that capacity, they should have their badge immediately visible to a driver upon a traffic stop. That being said, he still refused to provide ID when the other cops showed up and confirmed that the original officer was, in fact, the Chief of Police. This guy made shit 100x harder for himself and there's a reason that no attorney will pick up his civil case and that's because he was 100% in the wrong with how he conducted himself in the stop. The CoP and his 2nd In Command though were super aggro and escalating shit way more than was necessary for a simple trespassing stop.
