A handful of missing samples: My Turned-Off Phone: - "Space" from Captain Toad: Treasure Tracker (on Wii U, since the album came out before the Switch re-release) - "Beast in the Village" from the Legend of Zelda: Twilight Princess - "Breezy" by Nobuo Uematsu (from Final Fantasy VIII). This was also used in "あなたの腕の中で ☯Ȑ Ŵ♄ @ †≣⊽≣Ȑ" from SEAWRLD. CD Player IV: DiC logo (also used in Loving Is Easy from I'll Try Living Like This)

very late addition to this however, Pennington Acres has four samples the sample missing in this video is Style by Taylor Swift (specifically the chorus of Style) the other sample is yet to be found from what i seen

There’s actually a sample between the Final Fantasy and Star Trek samples of CD Player IV from Empire Strikes Back. You can head it in the scene where Yoda lifts Luke’s X-Wing out of the swamp.

hbh is up on streaming services too, and yeah this is pretty interesting (especially with the recent itllt repress which has a drake sample) i feel like since they arent massively mainstream this kind of thing just slid under the rug. but honestly idk - i feel like if one of their songs made it to the billboard top 100 they’d be in a lot more trouble

@@synthi true, not mainstream per se but prettty well known in its own bubble and the underground. i've done work with independent distro services myself and I see they use CDbaby, this stuff is usually supposed to use an automated recognition software to find samples in the music. because the distro services do not want to be found liable if any of their users release copyrighted material they preemptively try to take it down they obviously have some sort of secret here, possibly that they pay for like the premium service offered by CDbaby kinda like distrokid where they take more faith in you and do not use the recognition software. however you still have to accept an agreement that you own or licensed all the material in the album before it can be released. so yeah guess they probably just decided to walk on thin ice here because vaporwave is pretty insular and they prob don't expect to see enough numbers to warrant copyright action. really interesting thing though since vaporwave/sample-based music is very difficult to release beyond bandcamp let alone even make a living off of

I’ve heard differing opinions on what kind of remixes are protected under fair use, but I think it has something to do with how much you add to or build upon the sample. Since death’s dynamic shroud’s samples are sometimes heavily layered onto each other, distorted, or chopped, a lot of the songs are so different from the original ones that they get away with it
