A lot of these people that sign these NDAs don’t know the law when it comes to NDAs, and don’t bother looking into their rights when it comes to NDAs, but once illegal activity is involved, these NDAs go out the window and do not hold up in court. That’s why you mainly hear about NDAs being used by celebrities and other influencers when it comes to cheating on their significant other, so they can’t be black mailed. Cheating is not considered illegal activity so the NDA will hold up. There are people that will use NDAs to be able to engage in illegal activity, so their business won’t be told, and honestly I think some of these people that have people sign these NDAs are just as clueless, and actually think NDAs will protect their business from being told, no matter what it is. Sadly, a lot of the time they get away with it, because so many of these people they get to sign NDAs are also clueless when it comes to NDA laws, and are too scared to speak, because they’ve been threatened or they just don’t want to risk any chance of getting sued, or both. They also know a lot of these people that are willing to sign NDAs, will do anything to be able to hangout with certain people, so they don’t hesitate when it comes to signing, or they agree to hush money.
