One of a soldier's duties is to *refuse* illegal orders. If your commanding officer orders you to commit a war crime, it is your job to say no. If you do it, you AND the commander who ordered it are guilty. This principle dates back to the Nuremberg Trials after WWII. Nazi soldiers who carried out atrocities during the Holocaust attempted what is now called the Nuremberg Defense ("I was just following orders") and the international court ruled that they were still just as guilty. However, Amestris is heavily based on pre-WWII Europe (esp. Germany and Britain), so it's not clear whether the law would work the same way there.

Before WW2 there was no War Crimes because there was no War Law, it was the Geneva Convention rather than international law. Also there is no Supernational Organisation in FMAB unlike the UN irl. If your State orders you to do something "*illegal*" and you refuse, and there is no Authority above your Country, then well you'd probably be put on court martial

Agreed, that episode is SO deeply emotional. Definitely one of the best, especially with how they spliced Scar's flashbacks with Winry's discovering what he did; it was such a powerful juxtaposition, so we empathise with both sides rather than just being one-sided... of course, the manga didn't show the backstory of Scar yet, but I think it works better here in context. This is definitely the show at its best.

Mustang being considered a sacrifice was Lust's plan. From what I understand, she wanted havoc to bleed to death and force mustangs hand to do human transmutation. But it backfired, and given in the future episodes Mustang does human transmutation makes him a perfect candidate.

I think that scene with doc was giving clues to that him and Mustang worked together to let some Ishavalans escape by Mustang transmuting the bodies and burning them, while Nox examining them and reporting them as actual bodies. One example of this being the case is how Mustang was able to jot down the ingredients needed for making those fakes in such a short duration.

It's entirely possible they have without knowing specifics. For what it's worth, Nuremberg Principle 4 is, "The fact that a person acted pursuant to order of his Government or of a superior does not relieve him from responsibility under international law, provided a moral choice was in fact possible to him". That said, this was a precedent set during the Nuremberg Trials less than a century ago. Before that Superior Orders was considered a perfectly valid defense, and even in modern courts lawfully given orders are considered to lessen guilt.
