The site manager insisted that this road is private, and I know that it's not. I have been coming down this road for years. My Grandad used to come down here when he worked at the pit during WW2 and that was a real long time ago.

I remember in my childhood being fascinated watching whenever they resurfaced roads where I lived. Kind of similar to what's going on here. It always reminds me of how you make flapjacks! I would imagine that the road that runs along the centre of where they're building is a public road. Whether it actually leads anywhere, I don't know, but even if it doesn't, it's still open to public access. I understand his concerns, however, from a legal point of view, there's nothing to stop anyone traversing the road in question, as long as they don't cross over onto the building sites, (that are clearly marked off, anyway.) I've always had an interest in how houses and new properties are built, but generally, they're cordoned off and hidden behind high, solid fences, so you don't see anything. As there's a road going through this one, with no access, they've largely forgone that process, which gives us an opportunity to see a bit of what's going on. It's the whole, 'health and safety', excuse that generally gets rolled out in such situations, when in reality, they just don't want to have to deal with, 'non-workers', having a look around.

Love the History lesson found it very interesting. Never knew so much went into Tarmacking a road and those lads are so professional and that fellow Jason is brill, explaining what the tarmac machine and how it works. Can you imagine doing it by hand using rakes and levels, it’s well technical now and it looks brilliant. 2 brilliant men explaining how much goes in laying a new road it’s a right eye opener. Where is that bloke’s HI Vis, oh and where is the security and i the site manager he looks like a bloke walking his dog. Well done PJ and thanks for the history lesson. Stay safe Fella.

When the show homes are ready for viewing the developer will have a show home, brochures etc etc. Ignorants like you have no idea about private land, you think you can just walk onto private land and do what you want. Got news for you, you can't. He was trespassing. The owner of the owners agent can ask someone to leave that private land. If they refuse to leave reasonable force can be used to get them to leave. If there is any resistance to being moved that resistance turns from being a civil offense, i.e trespass, to a criminal offense, i.e aggravated trespass. Simple as .

Another site manager with superpowers. He can repeal laws like section 33 of the criminal justice act 1972 which states: “For the definition of “public place” in section 9(1) of the M1 Public Order Act 1936 there shall be substituted- “Public place” includes any highway and any other premises or place to which at the material time the public HAVE or are permitted to have access, whether on payment or otherwise ”. SO, basically we if there is no door, gate or barrier between you and the place that you want to go to, then you do indeed HAVE access. Legally. If the site manager wants to keep that road private then he would have a barrier at the front of the road with a security guard checking people in and out. However the reason that he hasn’t done that is because he CAN’T do it, because it is a road for which public access IS allowed. And if the site manager is correct in stating that PJ was in the middle of a building site then why is it that the site manager was not wearing a high visibility jacket, hardhat and steel toe cat boots??

don't get fobbed off about his claim that it's a private road. Builders as part of their obligation and planning permission often have to resurface public roads due to the wear and tear of the plant vehicles and their obligation to get planning. With all due respect you have absolutely no right to be where you are filming.. Do you have a basic cscs card... you're over stepping your mark.. It's not public, it's a construction site/project.. If it is a public road he has every right to be there. The developers should provide a safe means of access. If a traffic order has been made to close the road they should have installed a gate. If you look at the site entrance on street view there are no signs saying that the road is closed, therefore it is still open.
@briancooper4232
@briancooper4232 2 жыл бұрын
@@johnclements6614 As the site manager explained it is private property, once the road is finished if the local council adopt it it then becomes a public road, they are then responsible for its upkeep, until then if not adopted the cost of maintenance is shared by the residents as it is collectively their property A road can be publically accessible but it remains private property unless adopted.the council or road department didn't pay for that road the developer did that's why it is private

@@PJAudits Completely understand your point, however if the developer has purchased the land from the local authority for development at this present moment in time it becomes private property until adopted . @briancooper4232 2 жыл бұрын
@@PJAudits Another way to look at is, once that road is finished and if you have permission you can drive as fast as you want on it and the police can do nothing about it as it is a private road ..once adopted then standard road legislation applies.
