I disagree. I had an online trainer from another country and I often had to send him videos of my training so he could assess if I'm doing them correctly.

There are multiple ways around this. If you want to film, you either angle the camera towards a wall, etc, or you have to set up a privacy screen. The gym makes two available for those who absolutely must film themselves. But, ultimately, I think anyone filming should have the responsibility to ensure there is no incidental intrusion into the privacy of others. Remembering that anyone who publishes a video is then making that available for anyone else to use. Another option is to say it's fine for personal use but anyone who is found to be publishing is liable to a mahooooosive penalty charge.

Just put up a sign saying there is a £600 filming fee and say they have to make an application. It will put most people off. Then you can turn down those who will be a problem. Probably no one will film.

Women filming themselves in the gym to promote their OF is bad enough, but shaming others while doing so, or accusing men of behaving in an inappropriate way, is clearly a no-go. Imo they should ban cameras, maybe they can have an area, where filming is allowed, that's up to the gym, but they should protect their customers better from being filmed during workout. It's more, than just annoying. Some men got accused of being a creep, and it caused them serious trouble...

There are now laws on the books to deal with "creeps", whether its sex-based harassment in public or online safety. A lot of the complaints boil down to "an unattractive man is in my presence or has spoken to men and this makes me feel offended and caused me alarm". The law hasn't been tested in a court of law yet to my knowledge but it's only a matter of when, not if.

My mother made that a habit, goodness knows how many third party holiday pics she is in, she wasn't deliberate however just oblivious. I remember a particular "god darn it" when she ambled across the line of a chap photographing his family, now plus my mother, in front of the Statue of Liberty.

Gyms are not just for got getting "fit" they're a necessity for many people dealing with and recovering from health conditions not just physical but mental health issues like depression. You expect a level of privacy, to have your images taken just to knock your ability would be heart-breaking even to the strongest willed person, let a lone someone with significant issues. I would say Gyms are also failing to protect their customers, I would also be interested to see if Gyms are ever challenged on their ability to protect customers from private filming.

This is more common than anyone thinks. I've quit 2 gyms now, over the past 4 years(I wont name these well known big brand gyms that are opened 24/7. Im in the UK btw.), just because tik tok'ers have set 2 tripods with their filming equipment, so they can live stream their workout. No one is given any warning, or any heads up by staff to say, "There's someone filming back there." The members have just assumed they can do this. Thing is, I dont want my face plastered over the background of a tik tok'ers vid - or used by them to get clicks and likes.

@DeuxNyx. Hopefully as you quit those 2 gyms, you told the Management WHY you were quitting. I've never been in a gym in my life and I hope I never do enter one, HOWEVER it seems to me that any filming should be organised in advance with permission from the gym management and some form of warning by the entrance. eg "Please note Video/Audio recording from 10am-11am in the SouthWest corner around the NeckSnapper 5000 machine". I have attended conventions where in the fine print, the management reserve the right to make recordings, for use for their own publicity purposes.

During my chemo treatments in hospital a man was documenting his wife during her entire treatment. The oncology nurses told him he must ensure to not be be capturing any other patients or goings on on the floor. They had to chastise him a few times as he turned his camera. Filming should not be permitted unless they were in an enclosed space 100% alone. The nurses are there to administer care to patients, not to feed the needs of one couple re filming and having to keep on eye on him (non patient).

Very poor and selfish behaviour. Having accompanied my partner to her Chemo appts I know how vulnerable patients are at that point in their treatment. I still hope she makes a full recovery as it’s a long journey.

There are notices up on the wall in my gym which expressly say “NO VIDEOING”. It’s a rule which should be enforced, and is in my gym. Most youngsters (mainly girls) just can’t get through a day without videoing themselves or taking a pouting selfie. It’s an addiction.

A gym is supposed to be a safe space, not a filming stuidio. One of the main reasons for people not going to gym's is the fear of ridicule, which is exactly what is happening here. You also pay a membership, which means it is not a public space. If this individual has given them permission then they should specifically state this, otherwise they might as well say "come to the gym to be ridiculed". Sick.

Gyms hardly do anything to stop this. I asked the gyms in my place here in Norway and I even got told they can not ban filming. So I invested in a home gym and many men do. The gyms are in self destruction mode by not acting against this.

@@trueriver1950 The over-sized water bottle with unnamed liquid is a trend thing. See it at my work even. Mostly fatties and the unfit walking round with them. They probably think I'm "boring" for re-using an old Evian bottle lol. But I run a sub 40 10k and they struggle to bend down.

Then the manager needs to be reported as their own rules state: 'Please, no paparazzi! You must not capture any photos or videos of other members in the gym without their consent.' Additionally, to the best of my knowledge filming in the changing room is illegal, as you have an expectation of privacy.

Social media people I think ruin it for everyone else. I record myself and only share it with my trainer to improve form (and try super hard to make sure no one else is in the shot). I think recording yourself can be super helpful for building good form as I often notice I'm doing things that I don't from a first person view. People like this though... If someone's got bad technique why wouldn't you go up to them and help them out? wtf is with all this shaming, people already feel self-concious enough.

Yea it's not public, it's a private business. you should have permission to film inside and I can't wait till all gyms make ppl ask for permission. I'm so sick of women ruining the gym. I'm 100% fine and happy with women in the gym unless they think it's time to make movies and not just come work out then leave. For one it slows down their workouts and they take up stations MUCH longer than is normal and it makes us ALL have to be at the gym longer.

A couple years ago I bought a professional CCTV hard drive recorder and cameras from a guy at a car boot sale . He said he was a shop fitter and all the stuff would’ve gone in the skip normally. He had loads of similar stuff . I’m sure he was genuine and it wasn’t stolen. When I set it up it had been used in a Gym . Quite a large gym and there was hours and hours of stuff of people doing what they do in gyms . At multiple camera angles and close ups .It just goes to show what happens to videos and pictures. The contents got wiped when I set it up in my own home..

I bought a second hand Dedicated micros cctv DVR and again when I fired it up it had all the camera angles and footage from a Cash handling facility!! (think Securicor or Wells Fargo)

It can still be classed as a public place even if payment/subs are required, as members of the public have access or permission to access. What matters is that it is still private property, and the owner can apply rules.

My local gym has signs up everywhere saying no camera use, no phone zone etc.. Women bring their phones into sauna / spa area and stream or FaceTime in there with scant regard for others. I’ve asked someone calmly and reasonably to stop using their phone and was subjected to vile aggressive abuse. This was a woman in her 30’s. Another member, a woman, went and got staff to intervene. The woman with her phone had no shame whatsoever.

I work out in a crappy looking gym - very old. People rarely film there because it doesn't look great. It is one thing I like about my old, worn out gym. But legally in America they are not breaking the law by filming in the background in public but the gym may have a policy regarding filming like this and it could get you banned.

If you need to be a member to use a particular gym ... then it is NOT a public space and you WILL need permission to film. A private club is not a public place.

Legally, no one is allowed to be filmed or monitored without their permission and consent as this is a violation of one’s right to privy! A fundamental human value, such “first world” 🌍 countries pride themselves on (by)!

However, this isn’t universal because parents aren’t allowed to photograph or vid record children on Sports Day or special assemblies due to safeguarding concerns, for example. In one’s home (domestic sphere) equates a total breach and violation of one’s right to privy! It opens up an entire debate and moreover who has access to this video footage… GDPR and confidentiality comes to play here!

GDPR applies in the workplace, for example, those unauthorised to access (public/patient - in the case of medical notes) records and documents, shouldn’t be! Some, have accessed my records and those of my children in The Home Office (alluding to Passport records)! My HMRC records were accessed by a Richard!!! I shan’t name and shame or expose individuals guilty of such practices on SM! However, I wasn’t born yesterday and am aware of the sneaky practices that occur! Moreover, some forward certain docs to others in a covert capacity, using the mantra, “Watch or look at how she does it and do it like her!” This also has the potential for identity fraud!?!? What checks and balances are in place in the electronic age to ascertain the individual is who they state they are!?! None, whatsoever! Serious loopholes in the system!

Same as car parks you pay and are covered by terms and conditions, if the gym has not got photography covered in their terms and conditions then they should have it added if you request it. You are paying for that privilege 😊

In theory you CAN film anything from the outside, from a public area. It's on the business owners to make sure that the "sensitive" areas inside cannot be seen / filmed.

I found your presentation on this a bit strange, forgive me, because while I totally agree this kind of filming is unpleasant and antisocial, mostly on your channel you've covered - very helpfully - what the LAW says, rather than just saying "you can't" do this. I think a lot of public filming is potentially inappropriate and intrusive but sadly the law says "you can" in many cases.

I may be wrong, but from a legal point my understanding is you can film in a public place, such as the street, although it is rude to film someone without them agreeing. However, the gym isn't a public space- it's private property where you have to pay for membership and in most private spaces you don't have the right to film. Happy to be corrected, but that's my understanding.

@@billyhowlett4541 no, I don't think that's correct. Public space means publicly owned, not that you find members of the public there. A gym is a private property, owned by a company, open to paying members. You're not a member of the public, you're a member at that point.

Same as stores, restaurants etc. They are considered public spaces, but, rules of the owners apply, not of a public space like the streets. Filming should be banned in gym. Should be allowed the use of devices if want to watch online trainers. Or, how many trainers do, record after hours.That woman could have recorded herself doing what she calls wrong, then what she calls right..not recording someone else. That is what many do when posting online

The gym isn't a public space as you say. It is a private property whereby you're invited to use the gym. You can be removed from the gym for any reason whatsoever.

Can you cite specific statues and case law here? I'm genuinely curious because while I've been following Joey forever and agree that this is reprehensible, I'm American (but live in the UK), and gym terms aside, most of the videos like this aren't illegal in the US. You're in public and while the property owner can kick you out, as an individual you would have no cause of action for someone using your likeness and technique in a video. This would be quintessential fair use. I'm really curious why, specifically, that would be different in the UK.

Well he's not really saying it's illegal. He says it might be against terms of service of the actual Gym but even if it isn't then this is unacceptable behaviour. Also depending on what they do with your image in their video there might be something you can do but it fully depends on a case by case basis and depends on what they do exactly in the video to your image. As he said some gyms have cancelled memberships over behaviour like this.

No, this is a channel with barrister in the name talking about how they haven't signed a release. I'm not looking for opinions here, I'm curious about the law. If you're unfamiliar with the law and just want to vent about how people shouldn't do this (I agree), but there are plenty of other comments to go reply to. Mine is about the law as that's clearly what's being implied here.

I quit a gym because there were some young women filming in the changing rooms, a guy walked into me because he was on his phone and not looking where he was going, and constantly having to watch out for not being in the background of someone's live stream. Other gym goers are not your sources of personal validation or Instagram fodder.

I'd ban phones from Gyms. I'm sick of waiting to get on a machine or bench while three idiots are texting then gawping at themselves in the mirror and occasionally lifting something. Gyms have gone from a place to train and then go to hang around and preen themselves.

Hang on, if you can see it in public then you can record it period. Private places are quite different. A gym is not generally owned by the public, more privately owned.

A gym is not a public space, it is a private space. When you join a gym you sign a contract, gyms can make no filming as part of the contract.

Video in gyms is a private business policy. Yes, each gym has to establish their rules of service/membership to include their video policy. If they want to make them clear, as they should, it will eliminate plausible deniability as a defense. "I didn't know I couldn't video" despite the signs at the entry, at the sign in desk, on the walls, etc. saying: "No Video". Violations of policy lead to removal from the premises. Repeat offenders can be denied service. If it's allowed, don't train there if you don't want to be accidentally (you were just in the background of the frame) or "accidentally" (recorded on the sly to be commented on and posted) recorded.

For an actor that is part of your production, you may need a Talent Release Form. Which is free to download from the BFI (British Film Institute). For models in still images, you need a model release form. Which is free to download from RPS (Royal Photography Society). But of cause you can have your own forms drawn up.

You guys won’t believe this. At my gym some guy was video calling someone in the gym and he was showing him around the gym and he even showed the guy the changing rooms during the video call. I wish I could’ve complained but I go to a cheap commercial gym and so many people at commercial gyms are inconsiderate toward other members and the staff do not care. I think commercial gyms are just interested in overcrowding gyms and do not care about other gym members and the facilities.

As soon as I see someone take their phone out to 'check something' I know that they probably take 7-8 minutes between sets and hog a piece of equipment for way too long. Yesterday I did arms. Did 7 exercises total - 3 sets each. Meanwhile someone was doing crossovers for 50 minutes and did about 4 sets.

OK, I get that gym membership comes with terms and conditions, and that this might violate those terms and conditions, but it's not really a public place, is it? If you can't go inside without being a member, then would the premises not be considered a private club or something along those lines?

i see people commenting how gyms should ban cameras, recording etc. the fact is they dont need to because gyms are not public places, they are private property (unless in the unlikely event they are owned by the council) and as such, permission must first be sought in order to film in the first place. people mistakenly believe that because a private premesis such as a shop or gym allows access to the public that it is therefore a public place - this is not true, its still private because it is privately owned and the person filming should not be filming in the first place because it is private property. no member of public has any legal right to film on private property

In a HMO / shared accommodation (apartment with totally unrelated people renting a room and sharing communal areas) is it allowed to film with the phone in the shared communal areas (corridor, kitchen)? The police can authorize one of the flatmates to record videos in the communal areas for months / permanently "because she feels unsafe" (with no real reason to feel unsafe)?

There is another problem that is not helped by all the camera's and videos, I used my ability to use a gym in another area, Bradford UK, There were not many in there with my light coloured skin and it seemed that the females had to use a separate area behind wooden screens ! If a female influencer did appear in the gym it was like a wild nature program with a large herd following her about. I was glad to get back to my home gym where males and females could exercise in safety.

I was in the gym I belong to ,I was there about 45 mins and in that time a young lady spent most of that time sat on the floor in the squat rack on texting etc on her phone ,I think she did about 3 sets in that time.....everytime I go people are spending more time on their phones then actually working out ...

Filming yourself anywhere for likes, and including others just for content, seems to me, to be very childish and shows an extremely insecure person in need of validation. Joey Swoll is doing a commendable job calling these people out. Ban the cameras and leave the gyms for those who wish to train.

Idea for a video:- Many auditors are saying that it is the law for the police to immediately disclose that their body cam is recording. Is this the law with regards to GDPR etc or just their policy? What is the ramifications of failing to tell someone and relying on that evidence in court?

Question. Could you do a video about Pre charge bail and the process as it relates to the procedure if the bail period expires and police have not applied for extension? The reason I ask is that as I understand it, if no extension authorised before the current APB has expired, then I've read that there are two possible outcomes. The first is that upon expiry without extension or charge, then there no longer a case to answer. The second seems counter intuitive in that if Bail period expires with no extension or charge, it simply switches by default to RUI. The reason I say counter intuitive is that pre charge bail is there, among other things, to ensure that investigations are carried out in an expeditious manner and that seems pointless if let's say, after 6 months of being subject to pre charge with or without conditions the police simply let the bail expire just to revert to RUI where your now, potentially, subject to be under investigation indefinitely. This is open to abuse by police imo because if they have seized your property then Bail limits the time they have to charge or no further action and if charged you'll have a court date so you will at least know that your property will be returned after the court finalised the matter, or CPS say no further action. In the scenario where you on bail for 3/6/9 months and police decide they just want to be awkward and keep your property for another 4 years (if the offence is either way or indictable only) then what is stopping them just letting the bail expire to switch you to RUI so they have no time constraint? Cheers. Hope you would consider a short video on this to explain the process as I feel it's very open to abuse by police.

There are also people who are overweight or not trained and want to start going to the gym. It would put them off if everybody is walking around with a camera. And then even those who are well trained may not want to be filmed. It's not a public place but a place you pay to go to.

Most gyms have a no photography policy. Even without one, you would have a legitimate expectation of privacy. With one, that is cast iron. This is particularly an issue for women, but applies to everyone. It’s a clear GDPR breach as well.

Question, if you are in a private gym and are filming for your KZbin channel which is monetised does this not fall under GDPR in anyway in that your business (monetised KZbin channel) holds personal data of the subjects within the content? Would those KZbinrs be subject to GDPR policy or is it a stretch.
