The lower courts have already found that. It should be an easy case. That said, you’re probably right. That they’re even taking up the case is a bad sign. And we’ve already seen some horrendously shortsighted decisions in Trump’s favor that will fundamentally alter presidential authority going forward. The Supreme Court ruled that a Democratic President could declare a national emergency, seize money from the military and use it to saaay, tear down Trump’s wall. Or based on the recent lower court decision, a future president could demand all cities be “sanctuary cities” and withhold federal grants if law enforcement doesn’t follow his wishes. Everything they’re celebrating has the potential to be turned right around on them because the courts are granting the office too much power.

They are not challenging what the word, “shall” means in this or any context. It’s what comes AFTER the word shall in that law where the legal battle will be fought. If there ends up being a straight party-line vote at the Supreme Court for this, that will mean a very brazen bias hit job was done on behalf of the President. It will be all the more obvious because this isn’t a standard republican or democratic stance issue on the table here(for example abortion). It’s a simple interpretation question. If it ends up a “no” on the taxes then so be it, but for our country’s sake they better get at least one of the conservative judges votes. If not it just looks bad for all Americans.
