The treaty governing the transfer of the Panama Canal from the United States to Panama is the Torrijos-Carter Treaties, signed on September 7, 1977. The Treaty Concerning the Permanent Neutrality and Operation of the Panama Canal: Guaranteed that the canal would remain neutral and open to vessels of all nations in times of peace and war. The U.S. and Panama agreed that the canal must remain neutral, meaning it would be open to ships from all nations, regardless of peace or war, without discrimination. The treaty granted the United States the right to take military action if necessary to defend the canal and ensure its uninterrupted operation and neutrality. After December 31, 1999, all U.S. military bases in the zone were dismantled, and Panama assumed full control over the operation, maintenance, and sovereignty of the canal and its surrounding area. While the U.S. no longer maintains a presence in the canal zone, the right to act in defense of the canal’s neutrality remains a formal, treaty-based commitment. This arrangement reflects a compromise: Panama achieved full sovereignty over the canal and surrounding territory, while the U.S. retained a safeguard for protecting global commerce and strategic interests. China has significantly increased its presence around the Panama Canal through various infrastructure investments and construction projects. Notable developments include: Port Facilities: Chinese companies control two of Panama's five principal ports. Hong Kong-based Hutchison Ports operates the ports of Balboa on the Pacific side and Cristobal on the Atlantic side, both strategically located at the canal's entrances. Margarita Island Port: In 2016, China-based Landbridge Group acquired Panama's largest port on the Atlantic side, Margarita Island, for $900 million. This port serves as a critical hub for maritime traffic through the canal. As of December 2024, China does not maintain a formal military presence around the Panama Canal. However, Chinese investments in critical infrastructure near the canal have raised concerns about potential strategic implications. China's growing economic footprint in Latin America, including Panama, is viewed by some U.S. officials as a strategic maneuver to expand its influence in the Western Hemisphere.
