I feel fortunate that the family farm is finally divided equally among 4 siblings without any complaints from anyone. As executer the lawyer warned me that money matters can turn ugly among the most stable of families. It took 18 months to get to this point and would have been easier to divide earlier but my mother didn’t want to lose control even at 97. I felt a tad put out that as the only girl, parents care fell on me and hassling with land deeds, etc consumed a lot of space in my head but it’s done and we’re all still friends.

Whoa !!! NEVER gift a house before you die!! Your kids will lose the step up in basis !! If your parents paid $100k for the house and gift it, when you sell it for $1m, you pay taxes on those $900k of capital gains. If the house is passed in a trust, then the kids benefit from the step up in basis. So if the FMV (fair market value of house taken at time of death) is now $1m and you sell for $1m, your capital gains is ZERO !! NEVER EVER gift or transfer a house before death !

I love the way he describes everthing in a way that anyone can understand/ Most of all, I respect and give him credit for his belief in God. In some states you can modify the deed to your house into a Transfer on Death Deed that has all the benefits of doing it through a will or trust but with no probate or involvement of lawyers.

Something else to consider, is any property tax abatements, or rebates, that you may be receiving due to being elderly, disabled, a veteran, or a retired government worker, that your city, county or state may be offering, that your children won't qualify for if you transfer title of your home now. If you're completely exempt from property taxes, for whatever reason, transferring title out of your name could leave them with a huge tax liability that they will have to pay for years until you pass on. If they can't afford to pay it, they could conceivably lose the home to a tax sale.

In some states, you can file a special deed upon death it turns over the house to whoever is mentioned on the deed. Check with your local Register of Deeds.

Cheaper to go quick claim deed just make sure your name is on it and whoever else you're giving it to his name or her name on it and make sure you get it recorded..at the court sooo much cheaper you can put the Quick claim deed away and the other person don't even have to know his name was on it or her name was on it can you give it to them when you're ready
