Did you fine Tesco for employing a student for full time ??? They also breach the law. You can’t just call Tesco for someone to confirm their job and hours . Where the data parotection law ??? How Tesco know is he a border force officer or someone else ?? As he didn’t send them email via official email ID.

Shakeel Ahmed you didn’t see the full call lmao 😂 Tesco can employ students full time, but they can’t employ students who are not British citizens or citizens of a EU country who are staying in Britain under a student visa, they would need a work visa.

Archany the restaurant got fined because they had illegal workers working for them. Before you hire someone you need to check documents that confirm their identity, the restaurant knew some of their workers were illegal immigrants, but hired them anyway because they paid them under minimum wage. Tesco did their checks on the man, and he was legally in the UK, and legally allowed to work. It is t their responsibility to check his allowances for his hours, he told them he wanted to do 36 hours and they let him, they were probably un-aware of the terms of his visa as it can vary.

Yeah your right, but I would say it is still their responsibilty to not give someone more than 20 hours if it is illegal for him to work, I assume he would have had to show his visa or something to get the job in the first place. To be honest he could also be doing other shifts at restaurants and takeaways without any paperwork.

It’s their choice to immigrate to the UK they shouldn’t automatically get free money I don’t personally believe in the benefits system the taxpayers have to pay so people don’t have to and claim benefits they don’t deserve it unless they have a disability that prohibits them from working

What's even your point? There is a massive difference between being an asylum seeker whose life is probably in danger, and being a student who had the privilege to be able to afford a plane ticket and a visa, all while being perfectly aware what the rules are...

Yes, but then apply for a working visa. He basically was working not "some over-time", he was working very short from the whole week. When did he study then? I know some students in the Netherlands, who barely manage the max 20 hours, due to lectures, classes, and assignments.

It's a fault of tesco too for giving more than 20 Hours for a student to work. Because it's rule for the company to check the visa conditions before they employ anyone. Shame on officers

I really feel for Mr. Singh, who is studying in the U.K. and has been thrown under the bus by that Tesco store, who claimed that he was working nights on 36.5 hours there, when they knew perfectly well that he was only allowed to work 20 hours a week, as per the conditions of his visa while studying and where they obviously forced him to work more hours because of “needs of store” not just because he needed more money - I’ve worked for Tesco for 17 years so I know only too well how horrible they are, especially towards anyone who is trying to improve themselves and improve thier lives, which they feel threatened by - I’ve tried to do courses outside of work and as soon as they became aware of it, they did everything possible to put a spanner in the works, first with a computer course they caused a series of events that ultimately led to bankruptcy and later on, an attempt to change careers to become cabin crew by doing a course, aside from the usual ridicule and mocking led to other far more serious attempts behind the scenes to prevent it from happening, same happened with a transfer attempt to another store, ultimately leading to redundancy - and all because they hid behind both “disciplinary procedures”, “procedures” of all other kinds, they felt threatened by anyone other than thier cronies getting ahead in life, because they themselves were going nowhere in life, motivated by nothing else other than jealousy and resentment while pretending otherwise and trying to make it look otherwise, same with thier bullying behaviour

Tesco didn't force him to do anything. I was an intl student. Told the company straight up, I can only work for 20hrs a week. During one of the weeks, a supervisor tried to make me work more. I said no and walked off the job. In the end, I quit and looked for another job that understood my needs. A few extra bucks ain't worth risking your life.

It is all relative, based on right now (it would have been similar at the time though) he would be taking home around £1330 per month. That is not far off the average yearly salary in India.

Tesco's scapegoats the customers and pays the employee my friend gets loads of freebies end of the day. I know many who use their employee benefits to get alcohol cigarettes at discounts to sell outside.

It wasn’t proved that he was a student though, there was a few letters from a college that he supposedly attended. 36 hours is a lot, and most of the time the education they are in, isn’t even real.

He should have gotten a UK sponsor who would take care of lodging and would take payments for the classes. He could have been remunerated by the sponsor a one time "fee" before his trip. It was simply poor planning.

I feel bad for the sikh guy too but lets face it. Rules are rules, you want to break a rule you have to be ready to face the consequences. But i believe its the stores fault as well even the store owner or manager should be held accountable for allowing him to eork for more than 20hrs. Ignorance of a rule is not an excuse.

If he wants to work more than 20 hours a week then he should apply for a work visas, which there are plenty of different options for. He willingly tried to cheat the system and got caught. As an immigrant myself who had to work long and hard to obtain full working rights in the UK, I don't feel sorry at all for him. It's exactly because of people like him that the visa criteria and process gets harsher every year, making it harder for all other honest migrants.

I'm an immigrant. Visas to work legally and permanently are usually very hard and expensive to get. I find it extremely unfair that other migrants get to breach their visa conditions and work illegally without any consequences when others like myself have had to fight for years and sometimes spend our life savings to comply with the law, play by the rules, and regularize our working rights. Not only is it unfair to us lawful migrants, it's also mostly very unfair to British job seekers who end up facing tougher competition on the employment market. I agree visa laws are tough and sometimes dehumanizing, but there are very good reasons why they exist.

Instead he decided to breach his student visa conditions and work longer hours. It's probably not completely innocent either, student visas are much easier to get and he knew that very well. You can't defend someone's right to better their lives when they voluntarily try to cheat the system and shoot themselves in the foot. If this guy cared so much about bettering his life, like I did a few years ago after years of struggles, he would not take ANY risks that could jeopardize his future chances because there is too much to lose. But that's exactly what he did, so I can't believe that he genuinely wanted/needed to better his life.

Love Muffin i understand, but he didnt work like extra 20 hrs every week, his employer said he worked extra couple hours more than his required, which means his definitely not taking advantage of the system, he prolly just had an o.t + not all people are capable of speaking proper english just cause they go to an english school, it takes time depending on the person.

Feel bad for the first Indian Student.. Officer already had it out to get him. He realized hes an actual student but then got the chance to reject him because of the work hours... Shame the guy loses out on his studies & even though I understand it's the law, majority of the money hes earning at work is being spent inside the UK for school/rent/living expenses any way.

Yes however it was the students decision to come to the UK to study so obviously it would involve huge costs regardless of getting any type of support should have thought about the logistics and costs beforehand further there is a business between UK government and universities colleges they put them on the sponsor list then they remove them then they put them again this goes on till they totally disappear off the map any student could easily study in their own country at fraction of the cost no need to travel so far like the UK USA Canada Australia NZ Europe but it's the economic social political war environment in their own countries and part time work paying in pounds dollars euros and eventually a better life and permanent residence in a foreign land that usually draws them. Ask me 99% international students aren't genuine just economic social migrants and the government knows this but they need the easy money too.

Usually the fake ones have some clothing and can't tell you one small detail of their chosen profession or what they're going to school for. I was impressed this guy actually had books!

I was a registrar at an online university about 10 years ago and we used to get our paper from Office Depot or OfficeMax. We didn't use fancy paper unless it was for graduation or some sort of certification that would be framed.

It is unfortunate, and I don't like the fact my country treats foreigners this way. Although, other countries treat British citizens the same way. I suppose, it's tit for tat. I am an expat living in Thailand, and I've had my fair share of immigration occurrences. Fortunately, my documents are always in order, as I proactively stay on top of it all. Once, I was almost denied entry on suspicion of abusing the system, but they came to the conclusion I was not. Note: I was not featured on a Thai immigration documentary.

I feel sympathy for him but on the other hand him working more hours is a win-win for him and Tesco so they'll stick with it but some parents in need might not have the chance to get that job instead which would be so helpful for them, so one must also consider the other side of the story or the UK as a nation in this case. You don’t need a marriage visa or fiancé visa if you aren’t marrying someone from the country. You can just marry there like a destination wedding, proposal. You only need a marriage visa if you intend on living in the country with your spouse (national of that country) .... even so, the fiancé visa just makes the marriage residence easier to get in the future. It’s not mandatory. It’s an option. But of what I understand, they do not need it because neither are from that country.

@Darius Kang Sure there has to be consequences for breaking laws. As a law abiding citizen, I understand. But in this case he was a student, studying a pretty specialized field. The fee alone is 4 times more than what Brits and EU students pay. Do you realize how hard is it to study a specialist field and work at the same time. He probably was earning money to support his daily needs, its 9 or less pounds an hour... its not like he can buy a duplex in London with those earnings, now is it? Most of the Indian foreign students work, sometimes a little more so they can take care of bills, housing etc. There is a fine line mate, in this case the officer could've let go off the student with a warning. The student probably paid 18k to 22k on his tuition fee for crying out loud.

@Darius Kang I am not supporting a person because of his nationality. I would stand up for anyone who is being denied education based on baseless laws. I did both my Masters in UK and worked part time as well. Yes, i couldn't work longer hours as I was focused on me course works. But I had mates who worked 2 or 3 jobs a week. The money was spent on homeless people and various other works. Both in Oxford and Manchester. All I am saying is there are genuine cases and it doesn't necessarily have to be a bogus college or student. If he indeed is a full time working student without attending lectures or is studying in a bogus university, I wouldn't give a flying rat's bottom about him. Cheers !!

@Darius Kang Mate, I am not saying that people should violate laws. I will never say so. Like I said earlier, I followed all the rules and regulations set forth in my visa. Its just in certain cases, certain laws have to be softened, especially if it comes to students working night shifts and all. All I am saying is, in certain cases, especially if the students are genuine, they could be let off with a warning. Cancelling visas of genuine students who may have worked a bit longer than they should've is a bit extreme. I do not know if this particular case was genuine or not, if it aint, he deserves the cancellation and on the other hand if he was a genuine student, then cancellation of his visa seems a bit harsh.

Why? He wasn't a student. That letter was fake, there is an entire industry surrounding the generation of those fake "universities" to the point that they have three or four of them located in the same building at times (as shown on other episodes). They denied entry on the work violation because it was easily proven on the spot, while an investigation into the fake school would have taken days.

I've known students from China living in HMO's for 40/per week and cooking together to save up even more. Contrary to the popular belief, a student does not go partying each day or eat in restaurants. Those that do aren't students, their spoiled snowflakes leeching off their parents.

Students are allowed to work as much as they want, however non EU citizens who are staying in Britain with a student visa can’t work for more than 20 hours, they need a work visa to do so.

his mistake was that he mentioned he wanted to get married in the UK on his visit. that's a big no no for his visa. i get stopped all the time because i visit my gf in australia and have a house there with her but i travel on a year visitor visa. if i was to say im gonna get married to her that would reject me instantly as i'd need a relationship visa at that point.

At least these ppl were righteous enough to let the guy from Chicago into the UK to see his fiance. No doubt the guy was being honest, or trying to run game on the UK officials. As a Chicagoan myself, I can attest that theres a high probability that there were murders committed against his family members. This is a very dangerous city. I hope him & his fiance are able to get this situation sorted out so that they can go ahead with their lives.

Why someone would think it smart to leave the country when he knows he's breaking his visa conditions is beyond all comprehension. I don't support breaking student visa rules, I followed them strictly myself as a student in the UK years ago, but if someone chooses to break those rules why then risk "going on holiday" and put himself in a position to be found out? The problem is that he is not too much different from those who are coming to the UK illegally - he is also breaking the law by breaching his visa conditions. Most likely his"university" is not really teaching him anything, it's a total bull that there are no universities or PG programs in India - even if we take into account that this show was filmed back in 2009.

I don't think it is fair to blame the agent who is just doing his job. It sounds like these rules are hard and fast to prevent those who apply for a student visa whose real intent is to work full time rather than study or to use full time employment to fund their education. Nothing personal against Mr. Singh but it is important to remember that he was working a full time position that could have been filled by a UK resident/citizen, who could have used that position to fund his/her further education. I sincerely hope that he can find a way to complete his education. BTW while I don't know anything about Tesco, it should be taken into consideration that he may not have informed them of his situation and his limited work hour availability because he wanted the extra hours or was afraid, he wouldn't be hired. Regardless, they had no choice but to tell the agent the truth about his hours because it is a matter of record and had they not been honest they could have been hit was a considerable fine. In this situation nobody wins.

Agents have the ability to exercise their discretion, and they do so often depending on who they’re talking to, or like or dislike. Perhaps this is the problem. And injustice relies on people ‘just doing their jobs.’ I thought you people figured that out in 1945…apparently not…

I'm always a bit puzzled by the marriage ones, they seem to be making the leap always from wanting to get married to wanting to get married now. He didn't say he scheduled his marriage for two weeks from now or something... so it doesn't seem like getting married is the reason for the trip and may not be expected to happen during the time period of the trip. I don't know, I guess there must be more chatting off camera since the people coming over don't seem to object to this logical leap.

yeah, sometimes those don't work or make you go to the immigration desk. Me as someone who has done that 6 times in the last 2 years and been interrogated 6 times knows quite well that they disable your passport's ability to use those if they want. (granted it was to australia)

Shareen Hussain what he did was wrong, but I’m not blaming him for it directly. He did it because he had to, and it was the only option for him. The British immigration and allowances are some of the best, they allow a lot of people to stay. He probably wouldn’t have been allowed to work there, but if he actually went to school, and also wanted to work it would be possible for them to allow him to enter.

They work so hard making sure people that were born on some other patch of dirt somewhere else in the world don't get to put their feet on THEIR patch of dirt that THEY own. It's all bullshit. The main factor that is considered, before everything else, by immigration officers in the UK and USA is the issuing country of the traveler's passport. That's it. If you're coming from a poor country, you've already got a strike against you right from the start.

The immigrants have to be so desperate to come to the UK to risk travelling in lorries like that. I don't understand why we don't try to help them build a life and actually let them contribute to society! They'd probably be willing to work harder than most unemployed British people anyway. I mean, I agree we have to control numbers to ensure that it doesn't become out of hand, but seriously! One of my friends is Syrian who came here in a way that was technically illegal, and he is now perusing further education here in order to gain more knowledge after previously working as a chef here (and paying taxes). Furthermore, he has more of a moral compass than anyone that I've ever met and he forgives everyone, no matter how much they have harmed him in the past.

Everyone pays tax but a lot of international students send money out the economy to their countries! Might as well be on a working visa ! Wrong. It is estimated that 20% of the “students” maintain a minimal course load so that they can work full time and send money back home. They are not students who work; they are workers who take classes to try to gain the system.
