On the contrary - you are at liberty to use “reasonable force” to defend yourself. And that is reasonable *in the stress of the moment*, but only sufficient to stop/neutralise the attack; you aren’t allowed to retaliate or punish. @blackbeltbarrister is a good source of info on this point.

@@captainbeaky Ah, yes. What reasonable force would that be? If a 6'0 man, or even several of them, are coming after me when I'm just trying to walk to work, what kind of super-powered "reasonable force" should I muster out of my 5'2 120lb body? My stick is hazel. It has a hook on the end. There is literally a whole martial art for walking sticks lol. If you are going to carry a stick look into striking techniques and some moves you can practice. The first rule is you must not lose the stick. if your assailant gets hold of it you are going to regret carrying a stick for sure. 🤕 you can fit a wrist lanyard but this restricts some stick moves, as one end is then attached to you. Sticks are legal. You don't even need a disability. It can be a fashionable affectation 😎

Czech Republic, Poland etc. have much lower crime than in the UK. at the same time, the right to self-defense is much less restrictive. However, I cannot imagine that the same legal rules would apply in the UK, I mean social differences. I can already see, in my mind's eye, young shits with masks on their faces, running around with knives and pepper spray because the law allows them. What works in some European countries will not necessarily work in the UK. besides, this peace will soon end with the influx of illegal immigration from third world countries to our countries, which the EU forced us to do

I believe that the reason crime is so prevalent, today in the U.K, is the fact that assailants know that an individual cannot and probably will not, fight back effectively. Criminals are cowardly and opportunistic; they hunt in packs but have no loyalty. The appalling murder rate notwithstanding, a citizen is very limited in that which he may carry. Personally, if it is a matter of saving my life and protecting family, i will use whatever force i see fit at the time. I truly believe that if some scumbag is considering an attack, he will most certainly think twice if he has good reason to think that you may retaliate. It is high time that the victim was protected and law enforcement stopped kow-towing to thugs.

You miss the point entirely. The law is fine, most people are just too clueless to figure out what it means. Defence is about intent. What you carry is about the intent you carry it for. Walking stick for example. Intent is to aid in mobility. If it is used as a defensive weapon then that is outside of the intent for having it in your possession in the first place. If your intent is to carry something for defence you are screwed legally as your intent was always to use that object as a weapon if attacked. Simple really.

@@nospoon4799 We do know the law and we think it is a shamefull law. Lets say the attacker has a dog without a leash and his plan is to rob you. His dog is a weapon and he may have another weapon with him. What the fack you supposed to do? Give away everything you worked hard for because it ain't worth your life or maybe run away but almost no way you will be able to outrun the dog and last option is fight back at a huge disadvantage. Don't know about you but I work hard to earn money. I dont wanna just give it up or my belongings. Also this situation happened to me and I went with last option not because I wanted to choose last option but because my body is trained that way. In a fight or flight response I automatically choose fight. Welp almost died and the police did not show up as they thought I am at a safe place after I went inside the house. Sometimes those thugs just want a fight to gain street credit amongst their dumb group. In those kind of situation what are you supposed to do? Just die by your simplistic mindset. Life is not that simple. You may not feel like it now because your life has never been in danger but once you do you will change your view and will probably break the dumb law and carry something.

You should try the self-defence umbrella,worth £100. Very difficult to prosecute that as a weapon, as its a reinforced umbrella pole,no different to any other umbrella. Its like a extendable baton in strength, but the Law doesn't recognise this.
@nospoon4799
@nospoon4799 7 ай бұрын
The law is that you can carry anything you want (within the confines of the law) as long as you don't carry it for protection. At that point it becomes a weapon. So a self defence umbrella would be seen as a weapon as it is marketed as a self defence weapon. Just the label self defence implies an intent, and British law is all about intent. If I carry a walking stick for defence it is illegal, if I carry a walking stick because my knees are wrecked and it helps me walk then that is my intent for carrying my stick. If it is then used as a defensive weapon then that would be legal as the item was not being carried as a defence weapon.
@mikesmith8313

@@nospoon4799It's not marketed as such, it is manufactured and sold as unbreakable umbrella, as a car can run over it, unscathed. More of an extra strong, wind resistant umbrella. So fully legal, nothing to break my balls with. If you hit someone with it, their fault , not ours.

@@mikesmith8313 Preaching to the choir. My point was in British law intent is everything. Meaning intent to defend is an intent to violence. So just make sure you say it was an umbrella not a special martial arts umbrella. Then all will be good. For example if the sun was shining and we were in the middle of a drought then what intent would you have to be carrying an umbrella? I mean thrash away but it had better be raining.

@@nospoon4799No, it's common sense, no one criticises an umbrella, you buffoon. Umbrella's wether they are £1 shop bragains or reinforced £100 are all the same, in the eyes of the Law. There are no martial arts umbrellas with spikes, nothing like that. Some clever idea to spend £100 on a exceptionally resilient umbrella, ideas to break someone's will power to steal from you, or an excellent defence against a knife. This is what the law states about self defense here in the U.K : "In the UK, anyone can use reasonable force to protect themselves or others if a crime is taking place. This includes fighting back in self-defence if you're attacked or tackling an intruder to the ground. If someone else is being attacked, you can use force to stop the assault and defend yourself in the process." You can use any reasonable force to defend yourself or others from attack, the force has to be proportionate to the threat, that is the key , for example if someone gets to close to you you can push them away to avoid getting attacked, if they punch you you can use a punch to stop the attack, the force used has to be equal to the force of the attack, so if someone comes at you with a knife and the only way for you to escape is to kill that person that would be seen as reasonable force. What gets most people in trouble regarding self defense is carrying on the attack after the threat has be neutralized, so incapacitating your attacker then kicking them whilst on the ground. the law allows you to use reasonable force to allow you to neutralize the threat and escape, so people in the U.K are not defenseless you just have to know the law. I will add you are not allowed to carry anything that can be use as an offensive weapon in the U.K, that includes anything modified that could potentially be used as an offensive weapon. BUT if you should pick up a piece of wood whilst being attacked by an armed attacker that would be classed as reasonable force in that situation so long as you don't continue the attack after the threat is neutralized, a good technique is to issue warnings of to stay back whilst backing off, this proves you where ever only in a defensive posture should you need to use force, RECORD EVERYTHING IF YOU CAN !
@adamfreeman2348
@adamfreeman2348 Жыл бұрын
that is all true on paper. but the reality of a real threat and attack does not fall in easily with this so called legal definition. so most actual self defence or self protection is likely to get redefined by the police during interview to make it look like you committed an assault, in order to get a conviction out of you. furthermore if you even say you were defending yourself then you have more or less admitted that you potentially committed a crime. so it is more about what you say when it comes to the police and the CPS, rather than what really happened. they couldn't care less about the latter. the reality is this: if you do get pulled for defending yourself against an attacker, too well let us say, then my advice is keep your mouth shut and wait for a lawyer. when you are in a real situation, the fear, adrenaline, and urgency of the situation, where your life may be on the line and rapid response is required, what you are forced to do will more than likely not satisfy the requirements of the law. furthermore a doubt any judge understands anything about street violence and most police have never been attacked on the street. so they haven't got a clue.

Wow didn't know this ... Are those weapons and self defense laws federal laws, valid in every state of Germany or does it vary by state? Also, do you have anything similar to stand your ground laws? Whereby if someone enters your home or has you backed in a corner and threatening your life, you can legally use equal force to defend yourself? Ie. If someone kicks your door in and brandishing a knife, you could stab the intruder and not be convicted?
@kkldsofkoskodf
@kkldsofkoskodf Жыл бұрын
@@MoAli-wm4of That are federal laws, so it is valid in whole Germany. We have the "Notwehrrecht" that means, if someone breaks into your home you can use everything to stop him. If you have a gun, you can use it. But, you have to warn the intruder and then shooting a warning shot and if the intruder does not flee and is going to walk to you aggressively, you can shoot him. But, you need to know that you always must use the mildest ability for defense. That means: If someone walks up to you and will attack you with just his fist, than a gun would be too much for defense, unless he is beating you and you fall down, then it would be legit. A pepper spray would be better, because of non lethal. But if he walks up to you with a knife or a baton or so you can do use the weapon but you have to warn before using. Unless you can't act otherwise. Like: He stands infront of you around 2m apart, then he pulls a knife or something else out then you could shoot him. etc. All in all, yes we have the right to defend ourself, family, strangers and property.

You’re pushing it with the torch as well, it’s got a tactical bezel on the end, also known as a DNA catcher, it’s designed to pierce / scrape the flesh so will be classed as offensive. Some of the tactical pens also have a similar feature, the copper might not know what they’re looking at, but I wouldn’t buy an expensive torch with that feature because there’s a good chance you won’t be getting it back.
@sbomorse

Totally agree. Anything that you use which can be used as a weapon can and probably will be treated as carrying a weapon if you cause injury, especially those torches and pens. Even these UV marker sprays, my local Police say that despite them not being illegal if you cause injury by spraying it in someone's face it's assault and therefore a criminal offence.

One look at the thumbnail of this video reveals the absolutely PITIFUL state of Britain today. A country which has disarmed its own law abiding citizens, not punishing the wrongdoer, but punishing the LAW ABIDING with blanket bans across every type of thing that a law abiding person may carry to defend themselves with. It’s illegal to carry ANY item for the ‘purpose’ of defending yourself. You are literally, if attacked, supposed to ‘look around you’ and utilise something that’s lying around on the street where you are being attacked, and use that item, if you are lucky enough to FIND anything while you’re being attacked, to use ONLY ‘reasonable force’ against your attacker. What a bloody sad state of affairs.
@5688gamble
@5688gamble 3 жыл бұрын
Self defence in this country is laughable! What constitutes reasonable force? How do you prove it was reasonable? An alarm? If I heard an alarm right now, I'd probably ignore it, there are so many things it could be, you aren't likely being attacked on a busy street, to be honest shouting would be more effective, I mean even late at night in my room if I heard someone yelling, "Help!" I'd take notice. Having pepper spray,a stun gun, a knife or brass knuckles is far more likely to disable an attacker, at the point you intend to take away my right to safety, you forfeit yours, proportionate force is irrelevant, however much it takes to disable you, if you die, it was your own fault, it's hard to determine what level of force will be employed during an attack and if you successfully defuse the situation and avoid injury, how do you even prove it was ever a risk? I've been stabbed, had a stanley blade pulled on me and slashed with a torn can (still have a scar on my face) anything can be a weapon! You COULD order a one finger brass knuckle, or you could just wear a big heavy ring with a suitable shape to concentrate the force of a punch! I could wear 4 big chunky rings everywhere I go no bother, with the added benefit I'm not reaching into my pocket if I get caught off-guard. Of course running is always going to be preferred, but in a situation where I am forced to fight, I don't want to be at any more of a disadvantage and believe me, criminals carry weapons! As an ex heroin addict, I met a few people who swore by carrying a blade or brass knuckles wherever they went. A criminal by definition breaks the law, why would they care about that when deciding on whether to take a weapon or not? Essentially advice on self-defence amounts to, "be physically fit so you can run or fight, hope they don't have a weapon and yell and hope someone actually calls the police." and on that note, my partner and I had someone kicking the door. 50 minutes! That's how long the police took to show up, guy was well gone by then, had he been intent on getting in, he could have raped her, stabbed us both AND had a good rifle through our belongings and made his escape before they were near!

That way...if stopped be the local constabulary, my "cover story" was that I hadn't made it back to my motel room yet. I'm 68 now, and still have a drawer full of switch blades, daggers and sheath knives of every shape and size.

I was researching about the telescopic sticks and i found a " tactical whip " as a great defense tool.. of course in Spain, or in any other EU Country this thing is illegal... but i have an idea.. I could carry a Water Supply Line or - this braided metal hose that we have in our bathrooms behind the sink.. you can get them quite long and they are so heavy and durable, that thing should have a good grip also.. And if it happens that i had to use it - well .. then i had it with me because I wanted to change one in my apartment.. It has a ball-like end just like a tactical whip. And another one on the other end - for your arm preventing it from slipping. Also - it can be coiled and it will not take much space in your backpack or something.. actually I'm looking for something against big aggressive dogs that we have running around loose.. for an attack from humans we probably need something more immediate, something that fits into a pocket

(resisting a lawful arrest by a citizen is a crime and is a potential indictable charge ) the courts also ruled that there is a general duty "among citizens to prevent felony" ( The Queen vs Duffy 1963)

If you break into y house and we are in bed, I will stand at the top of the stairs and shout that the police are on the way so you'd better take that TV quick. You can use self defence, but you can't throw the first punch/kick/hit with rolling pin ect. So taking weapons with you is going equipped for a crime, because it looks like you want to start a fight. It's mostly to stop kids, because if you're an adult your more likely to have a sensible reason why you have that thing. If they touch you, swing at you, or threaten you with a weapon; you are allowed to defend yourself. You are also allow to help someone who is less able to defend themselves, and are being attacked by that person. You just can't be the aggressor. It's also important to explain that there is a crime called verbal assault (in the UK and most of the world). You can be arrested for it if you threaten someone, or use aggressive language, or use hate speech. You can't hit someone for doing this to you. But I know some Americans have gotten in trouble before for swearing at the police, because they think everyone has the same free speech laws. The police also don't need a reason to stop you, and they have the right to search you, your car, and your bags here.

There is no legal self defensive items for civilians under English law. Any item that you carry with the intention to harm others is illegal, even for self defense purposes. The act of self defence might, depends on the particular circumstance, legal but carrying an item for the purpose of self defense in itself is illegal. I`d rather punch their ugly face than fiddle around with a pen,only had to do it once about 30 years ago and it worked fine.

Some karate classes teach these things when you've trained enough to show you not a numbty. 🙂 My local one does specific self defence aimed at women, and people with smaller builds. The Sensei's favourite one to teach is batton training with a small cheep umbrella. It's pretty easy to translate the katta for syth, to a umbrella instead. That way you can practice till like the punch's, kicks and sweeps, it becomes second nature.

Even though I'm in the U.S., my employer won't allow me to carry my pistol at work, so I carry a tactical pen and a small flashlight when I am there, which I am right now.

On the cctv course that I went to the instructor was promoting the spray, so now that is also illegal?

Did a CCTV and doing door supervisor... and yes. Everything is illegal or "technically legal" except the rape alarm. To be honest I'm scared to shit.

Once they take your guns away, the slippery slope steepens. I show this video to all my American friends followed by the words, "Don't give an inch, or this will follow."

If you are carrying an item for self defense it has premeditation, not just grabbing the nearest object to protect yourself, you're open to prosecution in the UK.

wrong! self defence and weapon law are seperate and totally different why cant people get this through their heads ? the prevention of crime act 1953 makes it a crime to carry anything to CAUSE INJURY its DOES NOT EFFECT YOU RIGHT TO SELF DEFENCE you will not lose your right to self defence just because you used an offensive weapon ! if the force used is reasonable then you will not be charged with any assault but you will face offensive weapon charges instead see R vs Fagan 1973 also the prevention of crime act DOES NOT apply in a private place , the keeping of a baseball bat etc for self defence is legal as well !
