40 years as a software engineer, I have seen H1Bs used to replace Americans, most of whom were more skilled than the H1B, just cheaper, time and time again. IBM brought in two Indian workers that sat behind an American for 6 weeks then they fired the American. The stipulation that they can’t find Americans is patently false. It has more to do with getting a salary that is higher than entry level and then the company gets cost cutting pressure. The easy answer is to get a company that hold a lot of the H1B permits like IBM to come in and replace the more expensive Americans. If you are mediocre engineer, yes, you will have no sustainability in tech industry. If you are a top talent, have great work ethics and commitment to the employer's vision, a team player and stay on top of the learning curve, your job is guaranteed. H1Bs replace mediocre employees who do repetitive not much value added jobs, yes, at a lower cost. Why would employers pay higher salary if you are easily replaceable? I have seen no critical talent getting replaced in my 30 years of high tech positions. It is delusional to say, H1B visa replaces highly skilled great talent America possess.

35 years as a Software Engineer. In my roles as Tech Lead and Dev Manager I had the responsibility of mentoring many H-1B newbies. They're a mixed bag at best. Some are highly motivated and impressive while others are complete duds. One thing is for sure, the H-1B system isn't the "top-talent" factory we're all supposed to believe it is. I'm in favor of judiciously importing top talent but the current H-1B program needs to be stopped cold and then reformed. If we fail to shut it down first, it'll never be reformed and so-called Tech will be nothing but an un-integrated immigrant underbelly in America. There is a non-trivial amount of gatekeeping that goes on when the H-1B'ers get into the hiring loop and it's getting worse. After the layoff carnage that's gone on in Tech over the past few years, we can afford to press pause the H1-B for a little while. Far too many native-born tech workers are currently unemployed.

There are different type of STEM jobs you’re speaking specifically about Information Technology (IT)… With IT most Indians are hired straight out of India via 3rd parties at 10% the cost. Why even bring them on H1-B… For scientists, physicists, engineers, mathematicians etc. (Real STEM) there is absolutely a lack of talent in the US.

When I graduated with my degree in Physics, I saw people fighting and clawing to get a $35K job WITH A PHD!! I mean, I can go be a manager at McDonalds and make more. H1Bs are just cheap foreign labor. Any time companies say "Americans aren't smart enough, are too lazy, won't do these jobs" - it's usually because companies want to bring in CHEAP foreign workers.

You are totally wrong there. H1Bs who are hired in the US as international students who graduate from US universities earn equal or more than any American citizen. H1Bs brought from India by consulting companies do not. So get rid of the consultancies or mandate a higher salary for H1Bs who are not graduates from US schools. Hiring H1B is a pain, 10K to hire, 20k to file a green card. Why would an employer go through all that? They can easily hire an American. You have to make that their pay matches the prevailing wage. So you cannot hire an H1B and pay 70k for a job that an American would have done for 140k.

Most of the H-1B foreign workers are very mediocre and below the talent of American here. The different is that H-1B workers are very willing to do everything the employer wants. As a immigrant I would say just needs reform and us needs to control how many h1b and f1 are approved. That would automatically reduce your problem . When you give out huge amounts of visa. You should expect huge workforce being immigrated. Rather, Limit the visa given. Which in turn creates less jobs for immigrants and keeps it balanced.

I absolutely hate the H1B program. I lost my job in December of 2001 from my former employer back then. Was replaced by one of these workers. Took me 18 months to find another job in my field and at a much lower salary. Took me 10 years to get on track. I hope to God we don't go down this path again. And BTW I hold a Master's degree in Electrical Engineering. You all talk about how we need more STEM grads, but employers SHIT on us in the field. I told my son don't go in the field.

@@schnneh8302 In 2001 to 2003 IT was bad and I was forced to move back to my hometown (Davenport, IA). It was really horrible back then and IT was oversaturted. I was very very lucky I found a job in my field back, just at a much lower salary and in a part of the country that was and still is repressed. I also had to raise my son by myself thus couldn't leave until he was old enough. Don't want to go through that again.

I don’t agree with work visas period. I am in STEM for 30 years. I notice that India workers generally do not hire Americans. A Indian manager will only hire Indians. Ok fine? Why not pay American kids to major in STEM? Pay for their education for free and you will see the STEM grads to fuel the need. I don’t believe for a second we can’t focus on America 1st. Education is out of reach due to cost and scholarships are not available much anymore. My kids are in STEM with straight 3.8 GPA and can’t get a scholarship. Don’t get me started on H-1B and education.

My nephew was honor roll his entire school life. He went to private schools which are much harder than government schools which we went to. I know. I saw the homework and the classes he and his sister took years before they were offered in government schools. He took ALL accelerated classes and graduated with a 4.0. He did not even get a full ride to college. Yet a government school kid who took all easy classes and made a 4.1 would qualify before he. You tell me that is fair. So much for working the hardest.

H-1B is a short term solution to a long term problem. I'm a first generation university graduate thanks to the GI bill. I grew up in a broken and abusive home in a bad neighborhood. I did poorly in k through 12 education, and had kids early. I now have two bachelors, one in physics and one in psychology with minors in philosophy and mathematics. I didn't know the university system, did what I found interesting instead of what would net me a career, started late, worked as a diesel technician through university, and my 3 kids were teenagers by the time I graduated, so graduate school wasn't in the cards for me. I now work in management for Amazon (not exactly my dream job, but a good job all things considered). Importantly, my children have witnessed this journey, and as a result are crushing school, and have my wife and I to advise and support them through their early adulthood. It takes generations to correct the "sins of the father."

Second, its cheaper to keep her; the government or even these corporations could open schools/programs solely dedicated to learning software programming and coding since theyre already subsidizing foreigners. This is about control, not getting the best. I'm a naturalized US citizen. I don't agree with Pat's assessment since he has never went to college. I have two degrees in electrical engineering. I absolutely against H1B and I'm in full support of abolishing it completely. I witnessed how IBM screwed over 25,000 US employees 27 years ago right before my very own eyes. They had them trained H1B, then lay them off. Then IBM shipped H1B back to India and China along with blue print on how to fabricate silicon chip which resulted in IBM employing over 100,000 Indians. It's all about the $$$ folks. H1B is actually a small distraction, if you really want to solve this problem at the root then pull us out of United Nation. America is NOT a welfare nation.

I’m a cyber security engineer and I worked with a lot of Indians on H1-B visas. Some of them are extremely good to be honest. However, I’ve met a lot of them that are not as good as you would expect. Most tend to improve their skills and learn faster. My question is, if American corporations are giving them the opportunity to improve, why are they ignoring the American citizens from benefiting from that as well? It makes no sense to me. Oh well corporate greed I guess.

I was part of this discussion, and I am so glad you addressed every single one of my points. We need the Visa program in software to address the gaps in our skills. But we need to pay competitively so that entry level Americans can compete, and we need to ensure visa holders can readily switch companies so they aren't treated like indentured servants, and we need the visa program to be merit based, not lottery. My concern is not with the visa holders themselves but with the system being poorly implemented so it undercuts American entry level software developers and also mistreats/underpays the Visa holders. Fix those issues, and things will be so much better. But I should not be training my replacements or the replacements of others on my software team. If I have to teach a visa holder how to write SQL, I clearly am being replaced by someone for lower pay instead of higher skill. (I have personally never been replaced, but I have trained people who then replaced a potential entry level job posting.)

Absolutely right! Moreover, the H1B spouses who enter the country as dependent with H4 visas get EAD after their I140 is approved. They are allowed to take up any job (doesn’t have to be IT jobs) and that work force is really taking up a lot of non IT jobs. This was started during Obama administration. H4 EAD (Employment Authorization Document)is a huge problem for the country

i have no issue with this however there at back handed deals done here. Inidan guy signs up to 80K but his job broker (Indian Job Seeking Services in India) just took 10-20K as a placement fee. Indian Guy now is a salaried employee who is tasked with 60 hours of work and will do the 60, where the local American is happy to do their 40 hours and the occasional late night becase he or she has a family to get back too and raise where young Indian Guy only has a shared hotbed in a house with 30 person sausage fest he rents with.....see how we are getting screwed.

Please allow me to share 1 important clarification: Vivek NEVER said he supports H1B (You can find plenty of videos of him taking a stance against H1B, including a recent one with Charlie Kirk). If you carefully read his post, he was doing 2 things - 1: explaining WHY many tech companies typically use H1B, and 2: Vivek was advocating for Americans and encouraging us to step up so we can become more competitive to decrease the desire for the H1B. In other words, Vivek wasn't actually advocating for H1B, he was advocating for us, as Americans, to value excellence in our culture more than we currently do. In Vivek's post, he points out a major problem that we have, but he also puts forth solutions while ending his post with an inspiring and hopeful conclusion (which so many pretend isn't a part of his post). Unfortunately, SO many divisive people have blown Vivek's statement far out of context and villanized him, completely misconstruing his message. Vivek has been very vocal for a long time that the H1B program is deeply broken and needs to be dramatically overhauled. Also, Vivek talked about how America used to be just a few decades ago and Vivek elevated our pursuit of excellence in our American culture. He pointed out that we Americans have given into a culture of mediocrity, but he also said he believes in us to be able to RECOVER our true American culture of excellence (just like Vivek has ALWAYS talked about). This was no different than anyone who criticizes the left for how it has infiltrated American culture with woke ideology. It's not wrong for someone to point out that our American culture has changed over the past few decades because it's true, and it takes a lot of guts and love for Vivek to call it out. In fact, it's no different than Trump saying "Make America Great Again." Should we villainize Trump for saying America has lost our way or praise Trump for being willing to call out our decline and offer hope for our redemption? If you have a brother who is a 3-time Olympic champion who has become unhealthy and gained a tremendous amount of weight - what Vivek did was like calling out your brother in love, reminding him of the Olympian he used to be, and encouraging him to become that once more. Here's another example: I'm a Christian who takes my faith seriously, yet I criticize the American Christian culture all of the time. I do that because I love Christians and I love America, and I choose to criticize in an honest way, but also in an encouraging way. Vivek's post was truthful, honest, AND encouraging, but so many people blew it out of proportion and took his message out of context like the left always does to us.

Actually the aspects of American culture that Vivek was attacking have been prevalent since at least the early 1900s. The problem is not the long-term American culture of sports, sleepovers, and socializing like Vivek claims. It's recent neo-Marxist additions like participation trophy mentalities, radical critical theory degrees, and grade inflation. Vivek attacked none of the real issues. The things he did attack were aspects of traditional American culture that made children more well rounded and more prone to innovation than in other countries.

That won't happen for 2 reasons 1) in the US government are subservient to company interests than vice versa so immigration isn't going anywhere 2) Those immigrant workers are willing to work harder and for longer hours than Americans so even if the government mandated wage parity between immigrant workers and natives, companies will always see foreign workers as the better option.

I won't argue with that, hayden, but it's going to take years to improve our failed education systems. We can start, but we can't fix it overnight. DEI sure did not help but brought the bar down lower, much lower and is inherently racist and sexist and Anti-American!! Thankfully, it has been a disaster and, now, many companies have come to their senses and are eliminating DEI.

I appreciate the comments here because they help me understand the issue better. The H1- B Visa's are used in more than the IT industry. The nursing field comes to mind and my Mother's experience of working with nurses who were imported through that program. She had to train those nurses and they knew far less than any American trained nurse. The bottom line is that it was and is cheaper for hospitals to import nurses with less training from other countries. I guarantee this happened after all of the well qualified nurses refused the Covid shot. Very good nurses were trained in the US for years. Nursing programs are very hard to get into and the point is to weed people out, Only the best make it here, but hospital employers are allowed to use this visa program to save money. Things need to change. President Trump needs to look at every aspect of this program.

It's ironic, really. Growing up in India, I always envied how people in America had the freedom to pursue any profession they desired-whether it's law, teaching, psychology, or anything else. In India, it always seemed to be a choice between becoming a doctor or an engineer which is always been criticized but Now, it feels like the focus has shifted to STEM fields, and India is applauded for its monopoly of producing STEM graduates. While I agree that there should be a higher percentage of people pursuing STEM careers, does it mean that we should not consider professions that may pay less? It feels like a paradox-if, by 2060, only engineers and doctors are seen as the "ideal" career paths, wouldn't that disrupt the balance and equilibrium in society? and also not to forget the other side of it where we choose profession of STEM because it pays well and if there are only STEM people would companies stop paying less because end of the day its all about demand supply right?

The merit-based H-1B program benefits the US by attracting skilled talent, but the lottery-based system does not always prioritize talent or align with job market needs. The government should take into account the demand and supply of jobs, implement annual fees, and set significantly higher salary requirements to ensure that American workers, equally capable, are not disadvantaged.

Why are approximately 85% of H1B visas awarded to just two countries, India and China? I believe a cap of no more than 15% per country would help diversify the H1B visa program and provide more opportunities for STEM graduates from other countries. Plus H1B visas should be paid the same as American and green card holders.

Why does it matter that some % of Fortune 500 companies are founded by immigrants. H1B is a non-immigrant visa, and H1B can't found companies because they can't have another source of income other then their current employer and if they are laid off they have to leave the country within 60 days. And the top companies award H1B visas are Indian consulting companies.

Back in 1999 I graduated from college in the US as a Dutch foreign student and was later hired by a British company in the US who had global, multi lingual clients. Since I speak 5 languages fluently, the company arranged the H1-B visa for me and I never felt bullied by the company or in fear of being deported.

I only came here for the comments, I'm not really interested in hearing another c suite jagoff reiteration of the sales pitch the contracting company gave them. 25 + years experience in tech the industry and my ground level experience has been the same as all the others you read. You meet a handful of decent ones and I do mean a handful, but the rest are mediocre at best. In my experience, guys like PBD, Vivek and Elon really don't want to be concerned with how the sausage is made. All they are really interested in is looking at the quarterly report and seeing that number goes up, whatever needs to happen at the lower levels to MAKE that happen is not their concern just that it DOES happen and that's where the decision to go with lower paid, substandard workers whom you can beat on as hard as you like comes into play. Middle management can make up whatever story they want, so long is number goes up the CEO won't ask too many questions.

Patrick, just because you got lucky, met the right people at the right time, and rose to the top, it doesn’t mean the whole U.S. population isn’t working hard, trying their best, or struggling and working overtime to succeed. Remember, this country was built by immigrants who worked hard to come here. But with H-1B visa folks from India, you hardly see any wear on their hands. They take all these desk jobs that are supposed to be for the U.S. population , and they make India great again, not the U.S.

I believe people are conflating H-1B visas with other high-achievement immigration pathways. As a former H-1B holder, I only obtained my green card after filing and receiving approval for an EB-1A petition. Working in a STEM field, I had to demonstrate not only scholarly influence but also concrete downstream effects that improve Americans' lives. While H-1B workers may indeed compete with Americans for jobs at lower wages, the program also serves as a crucial gateway that allows people with genuine talent (like EB-1A holders) to become part of this country. In other words, both President Trump, Elon Musk, and Vivek are correct in their criticisms, and those who oppose H-1B visas also have valid points - two perspectives can be simultaneously true. PBD, you should make a clarifying post about this distinction, and I'm happy to privately explain how the EB-1A category works in relation to H-1B visas. I'm confident your audience would be very receptive to these facts.

I am for H1B visas but the holders should be able to switch to any employer once in the US. Many Americans who are very capable of doing the work are being passed over simply because the H1B workers are cheaper. If they want high skilled workers, they should pay no less than $120k adjusted for inflation. Americans are frequently being required to train their replacements and that should make every American angry.

I was with a Canadian that was here on an H1B visa. He’s a software engineer and contributes to our society and pays his taxes in the US . We are no longer together, he’s now a citizen. He went the long route and did it legally.

55% percentage! Why can’t these people do the same thing in their own country? On the other hand, if they don’t, someone else-who is American-will do the business. However, many business models are not allowed in other countries because of their social justice systems. For example, you can buy a $1 item and sell it for $10,000 in some markets, but in many countries, the government and the people consider that unethical. Creating more billionaires is not good for any country because they end up running the system. America is strong because of its small businesses and a robust middle class. A strong middle class builds a strong country. Anyone with more than a billion dollars should have their companies split up. No single person should hold more than a billion dollars-it’s actually harming the country and hurting ordinary people. America doesn’t need billionaires; we need millionaires and a strong middle class.

America is filled with people who are complainers, extremely entitled and elitist. No country can survive on its own. There are critical trade agreements between US and India and critical exports from India into the US. In exchange for this transaction, they have movement of people and business to facilitate better relations and world peace. India is just coming out of the ruins and rubble of colonization. They are doing far better at 78 years independent than any other country. Americans have this entitlement they can survive on their own and that people from other countries are a bother and least interesting. America’s economy wasn’t because of entitled Americans. It started with indentured slave labor exported from Africa. And those countries who have become recently independent are still developing and the people just want to live a better life if they can afford it. And that influx created a tech edge for America. Please open your mind and get some common sense.
