I had a local small town judge that kind of fixed a speeding ticket for me, he knew my father and also knew he would beat me in a bad way. I just had to work on his farm ( mucking out cow stalls for two weekends) that got me a deferred sentence. This was his form of community service back in the early eighties. While I was in the Navy a couple of years later, I found out he was disbarred for fixing tickets. I'm glad I saw him before he got caught.

@@brent5832 no way... He took some advantages but not that. His son was one of my classmates, he knew what I went through. The truant officer of our school even knew, he would give me cover whenever he could. The sheriff's office even took my side in certain issues and they never took any advantage of me.

His son was my classmate not even in my social circle ( I hung with a pretty hardcore group that wasn't the studious type) his dad ( the judge) was known as being pretty fair to all. I feel that I got proper justice, I did my payment and my father wasn't involved... I was just 18 at that time.

@@davidedgar2818 he sounds like an alright guy. It's ironic he was disbarred for being fair while many crooked or unprincipled judges are only suspended for a period of time. 🤔 That's what I've learned anyway, from Mr. Lehto.

Would love to see, "Is your client willing to swear in court that he wasn't served?" Then in court when this happens, "Your honor, I'd like to introduce this video of the defendant being served into evidence."

In some states, they can just leave it at “receptical meant for deliveries” if they have attempted to serve prior. That happened to someone I know and he found out a year later and attempted to file fraud charges on the server, which were dismissed. So he decided to try to file several $10k small claims cases and have the owners of several businesses around town served. These owners were never there, many from out of state, so just their employees were at the DBA location. After a couple of documented attempts, he instructed the server to leave the document at the mailbox, the “receptacle meant for deliveries” before business hours. As you can imagine, about half of the owners served didn’t show and for those that did, he motioned to drop the case. Several default judgments were filed and for those who later claimed “fraud”, he used the same verbiage previously used against him. The law for allowed types of service was amended not long after.

Could you serve these at the same date and time, with one being served in each time zone. Eg Noon in Rapids City, South Dakota. Then nip across the state and you get another noon.

Yes, you can sign a name of another with their approval AND YOU MUST sign your initials under the bottom right of the signature name. A standard accepted business practice. Not how this would apply to a digital signature though.... (.jpg)

I served my cousin's ex gf who he had a kid with. The case was about her current bf who had two kids with her. He was claiming my cousin's kid on his taxes and so was my cousin who had the legal right to claim him every year until he turned 18. I don't know if it was the IRS who was filing the complaint but my cousin's ex's bf had to pay money back. My cousin did nothing wrong but had to deal with this crap because of someone else.

In California there's a thing called sewer serving. Has a lawyer or an attorney to get a third party to sign a piece of paper saying they dropped it in the mail went to court

The lawyer said he was in constant communications with my mother the last past year. I objected to the courts in a very rude way and asked the judge is he at F&$$#@ medium since my mom passed away a year and a half ago so I will say this one time to you who in the f*** are you talking to.. Sewell serving is legal I found out the judge got upset at me for my language but he understood I told that super loyal that sued me for 3 years straight exactly where he lived and he backed off the judges really upset at him because he realized they didn't never servered me whatsoever... Sewer serving is allowed in California that's what's sad about the whole system

I had a process server show up on my doorstep when I lived at an apartment. I heard a knock, answered the door and the first thing they said was my name and I was like: "No." They were like "are you sure," and my response was an annoyed shake of my head with an incredulous lip curl and a "I know my own name." And then stared at him like he was an idiot. He then asked how long have I lived at the apartment and I was like "None of your damned business, but about a month and a half." Then he asked if I knew where the other tenant (me) had moved to and I was like "How the hell am I supposed to know that or why would i care?" He said "sorry" and i closed the door. I was actually more annoyed by the intrusion of privacy and the fact that he just started questioning me without introduction, like you're on my doorstep a-hole, how rude. Chances are had he just said "Hello, my name is John Smith, are you U WADE?" I would have been like "Yes, sir." Looked the case up later, it went nowhere, it was for a medical debt that was fairly small and from my employer at the time ( I worked for a major medical group). Been almost twenty years. I don't recommend trying to dodge process servers, but don't make their job any easier. These days I would more than likely accept service.

I was served once for a small claims case, which the plaintiffs lost. Just wondering if they didn’t have my name correct on it could I refused it? In this case they didn’t have my name correctly listed. It would have been easy to do research to find it from property records and the like.😢

The reason I suspected this case is it is a case about judgments and so called "sewer service" and the law firm Mel S Harris and process server Samserv, and debtor debt holding company LR Credit, that used the tactics you talk about. The Mel S Harris law firm was shut down, and lot of of the default judgments ended up being sold to Rolling Jubilee, a non-profit 501(c)(4) organization with instructions to forgive the debts they bought immediately as gifts, resulting in the debtor owing no taxes. If I remember right, over 100,000 judgments were forgiven this year. Rolling Jubilee is an organization that buys up debt like debt buyers do, but instead of collecting it they forgive it as a gift relieving the debtor of the obligation to pay it.

If you can authorise your secretary to sign your name, then can a rock star authorise someone to sign posters to boost sales? Can a writer authorise someone to autograph books to boost sales? Can an artist authorise a sweatshop worker to create paintings and sign them in their name? I suppose that's probably fraud since the signature itself has a value, whereas the signature on a document has no value beyond representation the authorisation that has already been given.

Don't these prosecutors do some investigation? How about deposing the process server the attorney is trying to blame? If it really was the process server doing the fraud, he should be thrown in jail. If the attorney is lying, throw him in jail (15 years ago). I suppose there is more to the story than the newspaper uncovered but it reads so passive.
