The purpose of this video is to warn anyone who posts their videos to social media that right now we're getting conflicting information from National Park Service law enforcement concerning whether or not we need to have a permit for taking videos in areas controlled by the NPS. This is the information that I've been able to gather most recently.
It's time to start planning your summer vacation and if you plan on going to one of our nation's beautiful National Parks or Monuments, you better beware of this potential pitfall. Most of us today enjoying sharing our travels on social media, of one form or another, and this is where the potential problem lies. Watch this video to see what you need to do to be legal while videoing in National Parks, Monuments and other NPS areas.

Yes! The Government is out of control. It got way too big and wasted Trillions of the tax payers dollars. If you only knew how much of your dollar goes too taxes. Income tax, road tax, import tax, export tax, sales tax, a fee for this and a fee for that. Completely out of control. And they want more and more and more.

It should definitely be revisited. Requiring permits for commercial activities that would disrupt the park for others and / or extract significant income from it is fair. But fining some KZbinr who makes a short video with no impact to anyone or anything and makes a few hundred bucks or even a few thousand - it's just not in the spirit of what the parks were intended for. If anything such videos do way more promote the parks system and more visitors and revenue to the parks than anything negative. But these laws against unpermitted commercial activities have been there for ages - maybe it is time for KZbinrs to petition to get them changed or relaxed? Regardless of what fines do exist, at the very least they should offer a no-foul warning procedure for misdemeanors because just like all those multi-page long "customer service agreements" we all click-through on the web, no one reads up on all the National Park laws before busting out their phone to make a video there. Or at least let you pay on the spot or retroactively with no-foul. The current procedures just seem to create negative sentiment against parks and rangers and do a disservice to the National Park system. For whatever reason National Park rangers seem to have a lowest tolerance for anything, there's no excuses. Perhaps it's because of the shenanigans and stupidity they have to deal with on a daily basis. Or maybe the job attracts folks with an extremely tight sphincter. Or maybe they are reward for number of tickets issued and that's how you become head ranger at the end of your career?

Government property = public property. As far as I know filming public property while on public property is protected by the 1st amendment to the constitution. This overreach by the government needs to be taken down by massive noncompliance.

I just checked out the NPS gov website, you do need a permit for any commercial video but on the Q&A What fees will I pay section it states 1-2 people, camera & tripod only - $0/day. Pack light and the permit is free.

Maybe I'm paranoid but I would take a screen shot of that info w/date-time stamp and then if you do video an area take pictures of your set up also w/a date-time stamp. This way if you get a call from the gov. you have some video proof of what & how you filmed.

The money grubbers are the social influencers that want to use public lands to make money and not pay the civic rent. Loggers can't go into the national forests, cut the trees down for a profit, and not pay the public (think taxpayers) for the privilege to make their money. Or, think of it as money that will be used to keep the national parks and public lands open to everyone.

No, it is NOT the government! We need to be precise here, please. It is the National Park Service. Someone thought it is ok to come up with this rule without knowing anything about the First Amendment. Anybody can take photos, or videos, or any recording in public spaces freely without needing a permission.

@@tman8939 Please be precise. The NPS is governed by the Department of the interior, which is a department of the Federal Government. The NPS is just one part of this Department of the Interior. The NPS is NOT the Government. Your household is not governed by the NPS. Your financials are not governed by the NPS, your job, your housing, your taxes, your community, etc is NOT governed by the NPS. What is governed by the NPS are the 50+ National Parks. Every one of them is public, like every post office is public, like every town hall is public, like every public place in the US is public. In all of these public places every one of us has the right to perform recordings of any kind. We even can and are allowed to record public officials, like rangers, like police officers, like representatives in public offices. This all is covered and protected by the First Amendment of the Constitution of the US.

One can talk to the south end of an ass, going north, for as long as one's willing to step in shiet, and get nowhere, but the need to be cleansed ... IT'S truly, a sad state of affairs when the court needs to be involved, at great expense, to explain to a truly ignorant public employee(who usually thinks he/she, is really is really truly smart), with some degree of power to make completely contrary decisions that affect people's rights. The person that made this decision is nothing more that an educated, power monger, simpleton.

If you are given verbal permission always get the person's name and station. An affirmative defense is called "Entrapment by estoppel." From the DoJ Archives: "The last of the possible government authority defenses is "entrapment by estoppel," which is somewhat similar to public authority. In the defense of public authority, it is the defendant whose mistake leads to the commission of the crime; with "entrapment by estoppel," a government official commits an error and, in reliance thereon, the defendant thereby violates the law."

I follow your channel because of all the cool and hidden gems you explore outside the NPS. We all know how beautiful Yellowstone, Glacier, Zion, and the Grand Canyon are. You and Linda show us the fun we can have in the ghost towns, state parks, and forests. Also lets not forget where to find the best pie in every small town inthe western US. (It would be a great service to all of us weary travelers if you would keep a pie map for your loyal fans)

​@@gonagainIt seems Public Law 106-206, as amended in 2007 and 2013 in the Federal Register at 78 FR 52087, has gone astray of its intent. I would like to call "my guy" in DC and I would need a bit more detail. Such as just you or others, how much gear or just camera only, were you in open areas or restricted, etc. Remember, NPS issues permits based on "commercial" environmental impact (rolling my eyes here), and intended use, not the content being recorded. If filming for KZbin, NPS would not know that unless told. And most folks filming casually may not know they would upload in the future.

Guess a lot of us will be avoiding the parks and just going where you don't have to worry about someone looking over your shoulder. Wouldn't want to get accused to taking a picture and have it show up on FB and get stuck in a legal SNAFU.. best to just go around the place and forget it.

You might do that, but they'll catch on and limit those lands, too. Many areas are already closed from COVID and have never re-opened. Rabid enviro commies don't want any human footprint in wild places. Big Left never wastes an opportunity to increase control.

It's just down right sad how Money Hungry our country has become. We went to Estes Park, CO for over 20yrs and really enjoyed it. But now that you are required to have "reservations" to get in........that has taken the "fun and adventure" out of the place. We now travel in our Travel trailer and go to the "forgotten" places that you and Linda visit. .........Safe Travels, where ever they shall lead you.

The money hungry country got that way because the congressional politicians won't adequately fund our national parks and public lands. Hell, some of those politicians want to turn the public parks and lands over to private developers to create more of an amusement park experience.

Yankee in the South and Park Junkie were two GREAT channels that i used to watch. Park Junkie had great NP news and updates and showcased great hikes in places that I have been and places I want to visit. Yankee in the South exposed me to great places in the GSMNP, a place that is now more accessible to me from living just a couple of hours away. Freedom of speech is plainly the issue... the govt is now treating us as if we are corporate entiities instead of individual CITIZENS with rights.

They only do this because no one has challenged them. The US Constitution is the supreme law of the land. Photography in any form is protected by the first amendment. Your permit is the US Constitution Bill of Rights.

A bit bloody stupid of them. I’d write a letter (nicely worded) to the Chief Ranger of the 7 divisions, explaining what you do, and ask politely for clarification of their districts. Verbal permission for such things is never good enough, but a written response can be used as permission (hopefully) if things get rough. To push boundaries a bit, video parts of the national park from just outside the boundary with gps coordinates. These people are using the old “one shoe fits all” approach which, imo, is disgraceful behaviour. Also, take it up with your local Congressperson as a matter urgency, explaining the lack of clarity between the different areas and don’t let it rest, keep at them, be a PITA - Pain In Their A**, because legal clarity is very important. The Forest Service is anti-citizen. Where I live they are purposefully allowing fire roads, camp sites, and trails to fall into dire states of disrepair and/or trying to disallow access to private citizens completely.

That is a Free Speech Tax. The utility is not being burdened by the free speech. Certainly it's not about the communication on media or even profit. It's about room for others to access the same park. Inalienable Rights are on the table for this discussion ❤.

Thanks for the update. If the NPS regulations on video production in parks & advertising revenue causing causing a violation were taken to their logical conclusion, then a TV news crew go out & film a news story that ends up on the evening news & the station runs a commercial during the news cast, then the TV crew is in violation. Such a result clearly violates the 1st Amendment.

No, the regulations specifically allow journalists to shoot video on federal lands, but it is limited to journalist employed by news organizations (TV stations, etc.).

@@OregonMike Yeah I’m willing to bet the parks would be forced to change the law because it isn’t constitutional if this were taken to a federal court. People should be allowed to film on public land. The government should not be able to decide who is and is not a journalist. This needs to be a project for 1st amendment auditors and organizations such as the ACLU and IJ.

I feel the reason they do this is maybe because sooo many people do not respect the parks, the animals, or the laws, more visitors means more maintenance and a lot of parks are hurting for funding. I may be real off-base here, but there are just a lot of people that don’t care and of course the rules are for the lowest common denominator and those of us who do behave in the parks suffer because of those who don’t.

We can see that the once-reasonable law was intended to collect income from commercial film companies to offset disruption and costs to the national parks. Some government bean counters saw an opportunity to collect big fees from individuals posting videos on social media. Another income stream! Writers of legislation rewrote or reinterpreted the language of regulations with the intention to gouge "video permit fee" money from individual park and other federal land users. It was enacted with the cooperation of your elected legislators. It's all about the money and no one is advocating for us, we're just potential income sources.

I really appreciate what you said about the difficulties of timing/scheduling your national park filming permit during a long road trip that usually leads to unexpected delays, often due to weather. I could never be sure of making it to the park at the exact time I booked a filming permit, so I would not do it for that reason alone. I think you also have to book the filming permits far in advance, and you could not know if the weather at the time would actually give you the filming conditions or even safe road access you need. Many of the parks have high risk of dangerous flash floods or severe winter storm conditions much of the year.

So let me get this straight. We pay taxes so that we can buy the land for the parks, we pay to maintain the parks, we pay the wages of everyone that maintains and takes care of the parks, and we cannot take photos of each other in those parks? I thought I was in AMerica!

Hearsay is not the law. Read the actual law on photographing in the national parks and see that you are free to make photos.

We should end the policy of fees, admissions, tickets and permits which are designed to pay for America's greatest idea, in place of taxes. Everytime you hang your "Adventue Pass" in the window, remember as a common American it is so some rich people and companies don't have to pay their fair share. Why not taxes for public goods instead of corporate welfare for share holders who are not even all Americans?

I study science as a hobby, take a week long backpack trip every summer and want to protect nature. It says alot when someone like me voted against the most recent expansion of Olympic National Park and would vote against the creation of future National Parks. My issues with the park service are as follows 1) They make it too hard to access the park, most of my hikes are in National Forest land because there is so much less red tape. I was extremely disappointed when the Parks were closed for months at a time during COVID when it was obvious to anyone who understood alittle bit of science that spending time outside was good. I get that certain parts of the park were overcrowded but shutting down the entire park was not the answer maybe close the most popular buildings and limit parking in the busiest areas but don't stop people from enjoying nature. I get that the park service doesn't always have the staff to rescue stupid tourists that got in over their head, but let me enter the park at my own risk, I enter the National Forest at my own risk all the time. No one wants a tradjety in the park but unfortunately I think a Darwin award or two is the only way some of these tourists will learn to act responsibly. 2) The park service is becoming just as money grubbing as every other part of the government as park entry fees skyrocket we get less and less services and now their are all these additional fees on top of the entry fee. Costs have risen to the point where poor people can no longer afford to visit the park and I don't want the Park Service to get any of my tax dollars if only wealthier people can use the parks. 3) Some of the park's rules have gotten ridicoulous. For example I was recently questioned for having the wrong bear canister, the ranger wanted me to buy a heavier more expensive canister. I'm all about keeping food out of reach of bears but I;ve been using this bear canister for 20 years without a problem, my pack is heavy enough and in this era of inflation I don't need to be spending money on things I already have. Mt Rainier has also implemented a you can only camp in designated sites. A big part of the fun of a backpacking trip is to not have to stick to schedule to pitch you're tent wherever you feel like it. I get that camping in meadows and right next to creeks is bad and the Park Service should hire a few more rangers so they can ticket the people camping in meadows but don't tell us rule abiding backpackers that he we have to camp exactly where you say and pay a big fee. I get that the Park Service doesn't want a full length movie filmed in the park without their permission but a short family video posted on facebook so a few friends can see it is not the same thing common how stupid are these park officials. .The park is always preaching don't take rocks, pine cones but now we can't take pictures are you ($&(#*$# kidding me? I'm not against big government but I'm against corrupt incompetent government and the Park Service needs to clean up their act if they want any support from me in the future.

Seems like a classic case of the spirit of the law vs the letter of it. The ranger is speaking to the spirit/intention of the law, but the enforcement arm is going by the letter.

I suspect that there's a bureaucrat somewhere who is able to send out fines even though people haven't violated the law. Until someone makes a big enough complaint, that bureaucrat will get away with sending out the fines. I also suspect that this bureaucrat is applying the law inconsistently and prejudicially. If the right person were to learn of this situation, maybe that bureaucrat will be fired and sued. That's what needs to happen. The other needed reform is for people who report national park videos to be sued for harassment. We have to get back to a time when "karens" have to pay a high price for being "karens." When that day comes, our society will start to get better.

As others have alluded to, the park service is no longer about oublic acces. Much of the overcrowding is allowed on purpose to focus on the 'overwhelming' impact of visitation. My home park is GSMNP - they always tout as the most visited park i the nation. Ive seen bear jams that the rangers could clear but refuse. Also, there are huge easily accesses areas of the park that no one visits. They only ever show the crowds and traffic jams. The new parking system is designed to frustrate people so the park can claim too many people again. It saddens me to see what has happened to what was once a great system now full of bureaucrats.

Thanks for sharing your observations. We've come across problems with long term campers in our National Forests, but are told that they don't have the manpower to do anything about it. Instead they just close down more access.

I think a written permission in email form would also suffice. Apply under FIrst Amendment use (see the application itself) to avoid having to submit the permit fee. They likely will reply in email that you don't need a permit. Then you have proof you were given permission. I'm going to try doing this,

While it may not be intuitive to treat KZbinrs like commercial operators, I'm all for it. The parks are being overwhelmed by visitors. Thanks to social media, visitors now have to reserve a time slot just to enter some parks. The Park Service doesn't need more views and more visitors. They need fewer views and fewer visitors. If this permit requirement helps reduce visitation, I'm all for it. Maybe consider just visiting the parks for your own personal enjoyment.

Thank you for sharing this issue with your viewers. I have had some experiences in this area for more than four decades in various national and several state parks in several states, Most of those issues have been related to commercial productions such as movies and commercials or as a local television news team covering a newsworthy incident in a park. In most of those cases, it makes sense to me for the overseeing agency to charge a fee or even fines for impacts on human or natural resources that also had an impact on our tax dollars that support those parks. Now we are in a situation where we as individuals are inhibited from exercising free speech to share our sights and experiences in those places along with education about respecting them and leaving them as you found them. I have avoided visiting any state and national parks for four years now due to this issue. Thank you for helping me to consider to more outspoken on my own channel.

A couple of years ago, the USFS and NPS rule on filming was shot down in the courts as unconstitutional. I had a copy of the ruling but can't seem to find it right now. You should be able to find it by doing a search of case law.

Correction you can shoot video in National Parks you just cannot upload it or post it to a social media platform that monetizes it. If you wish to send it to a family member or a friend you can email it to them no problem.

I have to agree with previous responses to your video, that what you Linda show us is just as beautiful and perhaps more approachable than some of the places in the National Park. I've been to several myself, but have always enjoyed the views and places on the outside of the parks better. One question I have though, "Does this ban also include pictures a person takes with a still camera?" If it doesn't, would it be possible to visit a National Park, take still pictures and post those on a KZbin channel? I know it's not quite the same as hearing the rush of a fast moving river, or thunderous roar of a giant water fall, but pictures can paint a thousand words and stir the imagination to almost hear what you're looking at....

@@gonagain I'm not saying that you couldn't get fined for stills but it seems to be allowed Excerpt from the npc.gov faq on filming and still photography. In most cases, still photography does not require a permit. A permit is required for still photography only when: 1)the activity takes place in an area closed to the public; or 2)the activity uses a model, set, or prop; or 3)the National Park Service would incur additional administrative costs to monitor the activity. A “model” means a person or object that serves as the subject for still photography for the purpose of promoting the sale or use of a product or service. Models include, but are not limited to, individuals, animals, or inanimate objects, such as vehicles, boats, articles of clothing, and food and beverage products. Portrait subjects, such as wedding parties and high school graduates, are not considered models, if the image will not be used to promote or sell a product or service

Still photography also needs a permit in National Parks. "In addition, Federal law also requires the National Park Service to collect a location fee that provides a fair return to the United States for the use of park lands for commercial filming and for still photography requires a permit. The National Park Service uses the following fee schedules for filming and photography: Still Photography 1-10 people - $50/day 11-30 people - $150/day"

I've had four other channels report on this in the last year and it's my understanding that the fees on getting a permit to film can be in the hundreds to thousands. So yeah, I wouldn't do it either. But isn't it a shame that a family standing by the Grand Canyon can't take a picture and post it for friends and family without risking being fined!?! Really sad. And it's nuts that no one in these government agencies are on the same page!

you do get that taking a photo and filming are two different things? no one in the gov cares about the stills unless you are going out and doing a commercial model shoot. In fact if you are not sharing phone video or whatever publically you can tak e all the video you want, you are not "commercial"

A Tasmanian photographer had the same issue Parks and was very vocal about it. Now he refuses to enter any National Park. Ive been fulltime on the road for six years with my cat and dog. Thought i knew the law and never entered parks where pets were forbidden but yesterday police moved me on from State forest land cos they saw my cat, on a lead with me holding it, next to my van. New legislation brought in, police taken over from forest department and cats are now not allowed. Hits me hard especially during summer when i need shade. Another aspect, a reliable source in America speaks of hidden military units in many of your parks, ready to act in the event of an uprising. Thats why filming isnt wanted! Its a global, especially in Western countries, restricting of free movement. Freedom is an illusion, the Corporation rules.

We traveled out west from NC in 2018 for 2 months no issues of this sort then..things can change fast..no NP reservations anywhere..saw cats lots of places..no military camps in the woods if we saw trash we picked it up..in Florida a camper at a cracKer barrel had their stabilizers down slides out and Disconnected..we can not travel cross country to our destinations with our cracker barrels it's just to expensive..so if this activity grows all will be stopped and we will no longer b able to take cross county trips to see this beautiful land called American our homeland

Imagine all the folks that would buy a $100 yearly permit to any of the parks to shoot video. They can put a rule in there that it is for certain size set ups or something. The NPS would get a lot more money and much more exposure.

Are movies made before this policy was adopted grandfathered? Or does it count from the time of posting rather than production? For instance, what about the movies I have from 60 years ago of family at Gettysburg; could I post them to a potentially monetized site? Does it apply to still photography? Google's Street View camera car goes thru lots of national parks taking a succession of stills; did they need to pay? They also have contributors taking shots from scenic sites. But I don't know whether Google Maps is considered a monetized site if they have linked ads. How about aerial drone footage or stills? What if the vantage point is from outside the park?

The permit ranges from $100-$300, plus the daily fee and other possible expenses. There's a Bill making it's way through Congress right now that is supposed to address this problem and make it easier for us in the future.

Hello, I have seemingly lost track,of you guys. You said we can’t video in National wildlife refuges? My wife and I have both volunteered at the Crab Orchard National Wildlife Refuge in southern Illinois. I knew you couldn’t video in national parks but had no idea it also applied to wildlife refuges. I have belonged to the friends of crab orchard wildlife refuge photography club for many years and no one has ever mentioned that we couldn’t video. While I am a photographer and not a videographer I still very much appreciate knowing this. Thank you Vern

The answer is always NO when you ASK a government organization. These are just regulations developed and interpreted by way too powerful bureaucrats. THEY ARE NOT LAWS!. But who can afford to fight them as you point out. More bureaucrats = more regulations. (Good job security for them.) Less is more when it comes to government.

In the UK the government got hell bent on 'Revenue Generation' of publicly owned assets, including information. Someone had this bright idea of all the money that would be earned. Guess what, all that happened was denial of access, as nobody ever paid. And ultimately when I was with a company that did want to buy something, there was no mechanism for payment. In my companies case it was information or road traffic to serve to the public. The thinking in government was that the companies paid them and the public paid us. The public did not want to pay us, a private company, for information that they had already paid for (as tax payers) and that they used to have access to for free in the past. As for the high fees, I remember a parallel with a well known photo hosting website that used to be free. There were some commercial users, but the vast majority of users were just private users. The the company got the bright idea that everyone would now have pay $100 to access their photos, when before it had been free. Result, most people said FU. Many people might have been willing to pay $10 but not $100. The hosting site shot itself in the foot.

This goes back over a decade ago. I was at the National Capital and was taking a picture from one of the steps toward the mall when two Capital policemen approached me to ask what I was doing. My camera was on a tripod and I explained that I have a tremor and the tripod helped me take clear pictures. They asked me to accompany them into the bowels of the Capital (which was kinda neat, but totally unnecessary) where they examined my camera to make sure it could only shoot pictures and no ammunition. They then gave me a permit and released me to take my pictures. Thankfully, they didn't ask for a fee. Sounds ridiculous, but that's what happened to me as I was merely taking still pictures of the National Mall in Washington, DC.
