Lot of it is by ear, but as far as scales, it would be the E blues scale (E, G, A, B, D) with the b5 (Bb) and the 9th (F#) thrown in for good measure. Maybe an Em9 scale?

Ever since I started to get into country music about five years ago I've been in love with mandolin and I even got one about two years ago. Anyway, your videos--which I just came across when looking for covers of Freddie King's "Hideaway"--are just outstanding!
