Actually no. He had every right to confirm you had a license. In Texas in order to carry open at the time he made this video you have to have a concealed weapon permit. It's an "exception"...so the Officer had every right to confirm you were obeying the law. I'm just glad Virginia doesn't have that stupid exception. We have open carry here. Having said that if you go onto private property and the property owner or people given the authority to manage the property ask you to leave no matter if it's due to your pink hair or you are carrying a firearm you have to leave.

Thank you! I am tired of reading "If you are open carrying in Texas you have no legal obligation to show your LTC" that's just not true. Originally, before the bill passed the verbiage said a cop could not detain or ID just for open carrying a handgun. But that part didn't make it into the passed bill. So, in Texas if you are open carrying a cop has every right to ask for your LTC to make sure you are carrying legally. That doesn't mean I agree with it. But, it is the law.

In the video you are arguing with him about whether or not there is a sign. At that point, he's asked you to leave, so it's irrelevant whether there is a sign or not. Him asking you to leave is enough, and at that point, if you don't leave immediately, you are trespassing. He doesn't need to give you a reason. I open carry all the time, but you have to respect private property rights. Arguing about whether there is a sign or not, is not respecting the private property. Just say ok and leave, then take it up with Walmart Corporate later.

You clarify whether or not he is detaining you (for which he would need probable cause) and he says no (because he doesn't). Then you go on your way. Strange that this happened in Texas. I live in VA and I open carry all the time with no issue. I've only been asked to remove my firearm once and that was at a Greene Turtle restaurant, and I did so because I was with some friends from jiu-jitsu training and we didn't want to have to leave. Other than that, no one ever bothers me about it, either they don't notice or don't care.

Wrong. In the state of Texas they can place a 30.07 sign in the front of the store which essentially means "if you show up with an openly carried handgun, you are trespassing". No 30.07 sign = open carry is legal and welcomed. If they want to restrict firearms from their store then they need to post 30.06 and 30.07 signs

Patrick McCreight. I And my son were in a bad truck wreck a few months ago. I have a permit and was carrying concealed. I had broken bones and was bleeding. The paramedics wanted to treat Mr on the scene. I walked over to a county cop on scene and told him I had a permit and was carrying and was going to hand my pistol over to my son and that he had a permit also. I didn't want to just pull it out and freak them all out. Even though I was bleeding all over a d barely standing and had told him about the gun and both myself and son had permits he asked to see mine. I thought this was silly. Taking time to check my permit in the shape I was in. If I was trying to hide It from him because I did not have a permit I sure wouldn't have told him about it. He barely glanced at my permit when I got it out and didn't even check my son. He did seem almost embarrassed about asking to see it afterwards. I just thought it odd to ask in that situation after I had been so upfront and honest about the situation.

In Texas a store needs the 30.06 for concealed and 30.07 for open carry. But..... also in Texas any store has the right to tell you to leave. Trespassing and what not. Those are Texas Penal Code carry statutes. 30.06 states that concealed carry on the premises with such a sign is prohibited. 30.07 came about after open carry was passed by the state legislature, and states that open carry is prohibited. Basically, both signs means no guns, some places only display 30.07 signs prohibiting open carry only, but permitting concealed carry. Personally, I have never seen a place where open carry was prohibited, but concealed was ok. Usually its either yes or no as far as carrying is concerned.

Not sure where this happened Jake Jones, but here in good ole WV I have bought a few guns at wal mart and ammo to go with them. Their only policy is that they have to walk the gun as far as the door before handing it over. On another note we have been an open carry state for a long time and are now a constitutional carry state, meaning we can carry concealed without a permit, and I have seen many people dong this with no problems.

Last I checked Walmart is a business...on private property. They don't have to have a reason to kick you out, they can tell you to leave or ban you with or without reason, right? It's open to the public, but it's not public property.

I'm not privy to the store managers handbook or corporate policy, but I can guarantee you, it will say something to effect of if you are going to throw someone out of the store, they have to be breaking some sort of rule. Or causing some sort of problem. Following posted rules by definition, is neither of those things.

You were simply shopping and the staff failed to follow corporate policy. Keep open carrying and contact corporate. They have a good track record of correcting the issue.

I see alot of debate on these comments (some more civil than others) about this issue and if these managers handled the situation properly but no real inside information from someone who has actually worked at Walmart. I worked at Walmart for 5 years as a store manager it was the first job I got right out of college. First off let me say that Walmart is definitely a publicly traded corporation my husband and I were very fortunate to own several shares when they took over Sam's Club and sold out to a very nice profit. I also want to point out that being a publicly traded company means that no one person owns Walmart out right. That being said the Walton family is still the controlling party owning 51% of the company.Every Walmart nation wide operates to the same policies as passed down by the board of directors. My understanding is that this took place in Texas and to my knowledge state law allows open carry. It has stated in Walmart policy as long as I worked there that store will comply to all state laws regarding customers constitutional rights. Basically if your state says you may open carry your Walmart does (or at least they should) I don't know what happened prior to the man filming and if he did anything for any moment to make an associate uncomfortable they he would have been asked to leave. Judging from the context that does not seem the case. Walmart is very accommodating to Military families for Active duty/Veterans and there spouses. For instance my husband is in the Army and when he left Fort Hood to Fort Carson my job was able to transfer and it made things incredibly easy on us. In this instance I honestly think it may have been a new manager possibly from another state that did not have an open carry law. If that is the case I don't think the man was out of line he asked a direct question that could have been answered and the fact it was not leads me to believe they did not know the answer and did not want to make them selves liable to corporate. If the man indeed contacted corporate I know that they sent in a District Manager to have a training session and possibly issue a private apology to the customer if even possible. So to conclude, in my opinion, the customer should not have been treated in such a way. It is told to our associate that when our doors are open we are open to everyone and everyone will be treated the same with the upmost respect. Being a publicly traded company means we are just as much a public space as a park. this is why they cannot refuse service to anyone with out a valid reason. Also why you see folks wearing what ever in the hell they want as long as it isn't exposing them selves as defined by law. Same reason I personal saw over 10 people come into the store late at night after having to much to drink and when police show up they do not ask a manager if they want to press charges it is automatically a public intoxication charge. I also want to point out as a firearm owner and concealed carrier I want to say it is always best to simply say yes sir and walk away upon the first time it is even hinted. And in direct response to the top comment from AR556NATO a manager absolutely under no circumstance can a manger ask a customer to leave for no reason what so ever. In fact I know of someone who lost their job for making an ex leave a store under claims that she was a shop lifter when in fact she had never had a single criminal charge in her life, they had no surveillance footage of her acting suspicious, and he never even let loss prevention know anything about her he just say her in an isle as she was shopping with a full cart of groceries and her new boyfriend. The store was sued, she of course won and ever since it has been a cautionary tale passed down from District Managers to Managers "if you make a customer leave you better have concrete justification and be able to cite directly where it says you followed procedure"

I kick people out all the time. And only half are ever given reasons. I'm not going to make one up, and get in trouble like that. It really is, because I don't like person or how they spoke to me. Most of the time, I kick you out. Your reason is "Because it's my store, and I fucking say so". Doesn't happen often, or for no reason. And it really doesn't matter if you agree with my reason or not. Because, my store. So, if a manager removes someone and gets in trouble for it. It's because the oversight doesn't agree with the method or the reason. But it doesn't make him wrong. It makes him at odds with his boss. Police will still enforce a no tresspass, without waiting for co-operate. I've been advised to ask first, but that's all.

Means I don't trust that the kid is actually mature enough to be running around with a weapon. He's still at the age where he does it to be cool, show off, and as the video proves, to get attention. but policy does not trump law, their policies have to comply with the various state and federal laws. They can get away with the video thing because it as you say and i agree it is private property and not public. The open/conceal carry "policy" they have has to comply with the appropriate gun laws, and since their sign was vague he was not at fault, its a technicality for sure but he was still in the right and the officer at the end knew that and did not pursue the matter. Its just like the hospital i work at part time, as a LEO i can not just kick someone out, they have to have broken the law, or been discharged by the staff and refusing to leave which is trespass. Policy does not trump law is the bottom line

Not on private property. You can record private property from public space... that is what is seeable from public space. But, some states have different definitions. There is a movement in our country to change what can be done or controlled on private property, but not successful yet. I have managed and now own a private famous business in CA AZ UT CO for 45 years and that's just how it is.

I've been in Walmart in several states and pretty much every one within 30 miles from where I live. I have never, I mean NEVER, seen the "proper" legal signage at any of them that hinders legal carry, either concealed or open, posted at any of their entrances. Secondly, they can't tell you to stop recording as their stores are considered a public space and they have cameras everywhere, so there is absolutely no expectation of privacy. And if you noticed the cop let him go without a single word to challenge him because the cop knew he had absolutely no lawful reason to detain him.

You are only partially correct. Yes, Wal-Mart is an essentially "privately" owned business, but many of the "private business" perks went out the window when the company began public stock offerings. Secondly, isn't Texas an open carry state? If it is, (I've had similar arguments in Florida) then Wal-Mart policies do not trump (no pun intended) state law. Many retail stores seem to be sorely lacking in understanding as to where their corporate rules stand in relation to actual LAW! Most need serious remedial training. Third, surrounding a guy with a gun just doesn't seem that smart to me. Fourth; I agree that I would rather have my weapon concealed. Kind of a surprise for anyone with nefarious ideas.

Why? He obeyed the letter and spirit of the law, as well as obeying Walmart corporate policy. He asked the managers if they were going to obey Walmart policy and the law, and when they refused to either order him out or obey their own policy he kept asking for clarification. When the store manager finally stopped dithering, made a decision and actually told him to leave, he left. Exactly as the law said he should. How is any of this a lesson on how not to behave?

I open carry in Walmart all the time, and I haven't had any issues with any management whatsoever. I've even open carried when deputies were present, and still had no issues. I live in Virginia, and we are an open carry state. I also have my CHL, so it wouldn't be a problem if I needed to carry concealed. I was talking to the manager one day in sporting goods, and we got into a discussion about guns because he was looking at getting a new handgun, all while I was open carrying. He did mention that he appreciated me carrying because he felt it was a deterrent to someone willing to do something stupid. Like he said, it is just Walmart management that doesn't know anything about their own stores policies.

I love and respect people who open carry. A few days before Christmas 2018, we saw a man at our local Walmart, also in Texas, carrying a visable handgun on his waist. I was astonished by seeing this because we're in a small town. I realized Texas is now an open carry state. Made me happy to see someone exercising their right to do so. Once again, much love and respect to all law abiding open carriers!

Larry Archer yes they can. Walmart being private property has every right to ask him to leave with his firearm. Walmart has every right to ask any person or group to leave and really doesn't ever need a reason to do so. My local sore doesn't approach people carrying open but we are in a very low crime rate area. San Antonio is however a different story. If another customer complains about it being visible Walmart will ask you to conceal or leave. I'm starting to think people are going to places like this to get videos like this. It's sad really.

Dustin Serio ok you didn't read what I said, by company policy no they cannot. I used to be AP there and am far more familiar with policy than you or even most managers and dam near 100% more associates. The first part of AP training is a month of studying policy. The average store associate can't even approach shoplifters and management is frowned upon for doing it. Now that said, THEY CANNOT APPROACH YOU BY POLICY IF YOUR CARRYING A GUN. By law they can ask you to leave but they will be breaking policy by doing it so therefore if they ask you to leave tell them np but you will be calling coorporate and reporting them by name for breaking policy and harrassing an innocent shopper who will no longer be spending money in their store. The person who approached you will probably lose their job.

Whatever you say boss. Side note Walmart policies have changes almost weekly so your "used to" bit is worthless. Also corporate is just going to kick it over to the market manager or market HR manager. All it takes it one customer to complain and there is no breach in policy. Probably had the customer with the complaint write a statement and give contact info and that will be all they need to cover anyone's ass involved. Store managers discretion has a lot to do with it too. But your former asset protection experience would be all the information anyone ever needs.

Im all for 2nd amendment, open carry. What tipped me off this guy was more concerned about making a video and not someone who for no reason had his rights stripped and was oppressed by authorities for minding his own business. Was when he started stating legal code to the employee. Asking him if they were referring to 30.07, then saying well their wasn't any signs about firearm restrictions, which after checking the manager said yes on all 3 entrances, which he then said oh those, well the verbage wasn't correct in regards to code 30.07. I mean these people are walmart employees, not cops and lawyer's. To argue with them citing federal statute code is asinine. The fact he saw the signs and deciding to ignore them or thought it didn't pertain to his situation or circumstances of how he was carrying is just being an ass and proves his intentions were more concerned with conflict. It'd be like acting surprised when asked to leave the store for carrying a firearm and saying "well the sign said no guns or firearms allowed, and technically this grenade launcher is classified by the government and ATF as an explosive projectile weapon not a gun or firearm" it's people like this more concerned about publicity than exercising their rights, that end up doing more harm than good for 2nd amendment

@E Dublin How wrong you are. Wording is everything. Some years back. A man in my state got pulled over in a pickup truck for not wearing a seat belt. The man argued receiving a ticket because state law required a seat belt be worn while "operating a car". Now everyone knows all vehicles require a seat belt to be worn but a pickup truck is not a car and the law clearly stated "car". The case went all the way to the state Supreme Court and the man one. From that point on, only passengers in cars had to wear seat belts until the wording of the law was changed. If walmart wants to have policies on not allowing open carry. Then they need to be precise with no grey area. The purpose of the video was so walmart could be held accountable for any misinformation they gave this man whether it be or purpose or on accident. Video is also how companies get exposed for this sort of thing.

That is, for public property, the government has no right to have you leave if it allows similarly situated persons to remain. Not so with any "private" property (regardless of the number of owners)

You just give yourself attention you don’t need and if there is a criminal in the store they will take you out because they know your a potential threat to the criminal so that’s why it’s safer and smarter to conceal carry.

I'm a LEO, and I can't tell you the number of MWAG calls I've responded to at walmart. It got so bad that while with a citizen carrying legally and the manager on duty challenging him, I took the time to get on my phone and call corporate for their policy. Walmart's policy, as told to me, was that in order to remain as neutral as possible on the firearms issue, that stores should simply follow whatever state law permits in the state that particular store happens to be in.

rico Pasi Texas requires a specific sign in both English and Spanish to stop open carry by a licensed to carry holder under 30.07, but they can obviously ask you to leave via a verbal request at any time for any reason. If they don't want people open carrying, they simply need to post the 30.07 signs as required by law and it would be illegal for him to enter the store in an open carry condition. I.e., the cop would have been able to charge him with a class c misdemeanor.

Did you even watch the video? The store didn't have 30.07 signs posted so the store manager has no reason to say "it's supposed to be concealed". No 30.07 sign = open carry is allowed. Why are they harassing him for open carrying?

OHIO IS an open carry state as of this notice on January 6th, 2019. Just letting y'all know. But if you carry concealed you MUST have a concealed carry permit...AND there's stipulations as to where you can open carry as well.

Brandon Page you misunderstand what I am saying. he was asked to leave the store by a member of the management staff at that point he needs to say ok and leave. NOT pull what he did. he could have gotten arrested for trespassing had the police officer wanted because a Walmart manager requested he leave and he decides to argue instead of cooperating. let the public see what a childish person he is. this is why police have such a hard time enforcing and protecting.

He did leave. If you go into a business open to the public and are asked to leave, you don't have to drop everything and go into a dead sprint out the door. He did not refuse to leave he only asked for clarification as to why.

BuckGreywolfe. here in ga. we have are reauired to have a license (which is fine by me) but your right i never get a second look and it isnt a problem .... however here in ga the business owner or a representative of the owner are legally entitled to allow or disallow the carry of firearms on there property...they however cannot dictate open or concealed carry ..the aforementioned also applys to homeowners ...be cool and keep carrying it may save your life someday...
