Probable cause affidavits almost NEVER have all the information the police and DAs office. It’s bare minimum to get an arrest warrant. I’d be absolutely shocked if that was ALL the police had on him.

Actually, I was told by a defense attorney with a couple decades of experience under his belt, that most, if not all of the cases he has been involved in, the prosecution does, in fact, put the strongest/all of their good evidence into a PCA. They need this not only to secure an arrest, but because this is usually the first document available to the public. The PCA, in a lot of cases is the only narrative available to the public for sometimes YEARS until a trial, and many times will remain uncontested until said trial. This inevitably benefits the prosecution to have a strong "story" of why they arrested and charged the defendant.

One male seen on the trail. RA admits to being there at the time, admits to wearing the exact same clothes as bridge guy. Admits to encountering others on the trail. He describes them. They describe bridge guy heading towards the scene. The girls happen to record a male wearing exactly what RA says he wore that day. Person on the video looks a lot like RA. One possible explanation for the manually ejected .40 shell is that the killer racked the slide of his pistol to intimidate his victims into compliance (even though there was already a round in the chamber). People do this in movies a lot. What I find inexplicable is that the Delphi police has been unwilling to release the full video of the man on the bridge to the public. Wouldn't that make him much easier to identify by someone who knows him? Thanks for the excellent update, Dr. G.

Apparently one of the girls could be heard mentioning that he had a gun. In the still shot or the short video clip that was released that’s not obvious. Somehow the girls realized he had a gun maybe in the clip he pulls it out. If the bullet is one the keys to the case the police didn’t want the killer to know that there was reason to believe he had a gun for fear he would toss it.

@@Ims18 Exactly, if the killer knew the police had evidence a gun was used in the crime then they’d toss it immediately. If he’s guilty, he probably assumed because he didn’t fire the gun there was no evidence of a gun being present and therefore no need to dispose of it. Although if he did dispose of a gun he’s owned since 2001 that would make people around him suspicious so that might be why he kept it 🤷‍♂️

I really think they have much more evidence than they've released. I think the first thing they would have done since he admitted to being on the bridge and owning a gun is get a warrant to compare the bullet to his gun like years ago right when it first happened. Maybe they did and they found it match so they've been keeping him under surveillance and doing whatever they can to collect more evidence on him. It's possible they do have some type of DNA evidence. It's possible Kline implicated him by saying yes I let him use this account for catfishing and provided evidence to back it up. Like being able to prove Allen sent him pictures of the crime or something along those lines. If what is listed was the ONLY evidence I can see how people would be nervous and suspicious that Alan isn't the right person. But I guarantee the police have much much more evidence than was released. I really think once he goes to trial everyone will see that there's much more evidence that ties him to the crime. They literally cannot keep this trial sealed. If they do the public will be forced to assume they didn't have that much evidence against Allen and that they're trying to hide how flimsy their case against him was. This trial needs to be public so the public can be sure and hear the evidence against him for themselves. Don't sign any petition asking the judge to keep his trial quiet you won't be helping anyone.

I really think Keegan (the child predator they arrested a while back) has to have some involvement in this. He was talking to Libby through Instagram and they were supposed to meet on the same bridge at the same time the two girls were slain. What are the odds that Libby went to go meet with one predator and just happens to run into a totally unrelated predator? Keegan also was shown to have deleted a bunch of posts on Instagram after the girls were killed and I think he even left town. If Richard is shown to have had contact with Keegan then there's the connection, for me, but if he doesn't even know Keegan, then that just doesn't add up for me.

While I agree they bungled it, and Allen should have been on their top suspect list early on, it's not at all uncommon for a suspect to be overlooked and reinterviewed years later. Especially when it's a high profile case and they receive tens of thousands of tips. Personally, I think the incompotence stems from law enforcement trying too hard to keep everything secret, to the tiniest little detail. While keeping some information under seal is always wise, keeping everything can stifle progress. In this case, they told everyone (including field agents doing follow-ups and interviews) not to speak a word to anyone, including other investigators...just file your report and be assured it will get to the right person. This was a horrible mistake. With that said, I think the evidence (we know of so far) shows that Richard Allen and only Richard Allen was the killer. You have to really dig into the witness statements and then a timeline of who was on the trails and when, to conclude he HAD to be the guy. It's hard without a visual, but it's like this....a witness see's Allen standing on the platform at the north side of the bridge, and Allen admits that he was, in fact, standing on that platform at about this time. This witness turns around to return to her car, and crosses paths with Abby and Libby (the victims) who are just a minute or so from the bridge. While Allen admits to being on the platform, he claims he never saw the two girls. That's virtually impossible. some 15 minutes later, we know Abby & Libby reached the south end of the bridge, because we see the infamous "bridge guy" video. Depsite several witnesses seeing Allen on the trails BEFORE the murders, no one see's him after. There WERE others on the trails that day. And he has no alibi for almost 2 hours after the last witness saw him on the platform. He claims he walked back to his car and sat on the bench. But it's a 15-20 minute walk at most. There were other people walking the trails. No one saw him. We know he wasn't invisible...people saw him before, but not after. Now add that a bullet was found at the scene (excuse me, a 'cartridge') and he just happens to own the same caliber gun? It's a poplular size, but other brands and models wouldn't make the same marks...even if you can't claim it matches his gun specifically. Now add that no other males even remotely fitting his description were seen that day. The circumstancial evidence is overwhelming and is going to be hard to explain away when you put it all together. The most damning, in my opinion, is the timeline of events. He HAD to have seen the two victims on the trail, and he most certainly would have been seen in the 2 hours it took him to get back to his car. Considering there would not be too many people on the trails and Richard Allen admitted he was there wearing the same clothing as BG with a similar build, a cartridge matching a gun he owned-possible same ejection markings- with a partial fingerprint, and is an avid hiker living within a mile of the murder site, as the Crow flies. At the time of the murders, he had a wide mustache that looked reddish-brown with a salt and pepper goatee. His mustache may have been colored since it had the odd reddish tint. I think that is why people said BG might have had reddish-brown hair. Later he will have a thinner mustache that is salt and pepper along with a salt and pepper goatee. Out of all the persons of interest who were too tall, too fat, or too old, Richard Allen is in the Goldilock zone of being just right. Remember If it looks like a duck, walks like a duck, it is a duck.

He admitted he was there. Not sure he admitted to wearing the same clothing. In fact, the eyewitnesses don't agree on the clothes - one says the suspect was wearing blue jeans and a "really light blue jacket", another said he was wearing wearing all black: black hoodie, black jeans and black boots! Although one of the eyewitnesses said he was wearing a "duck canvas type jacket", that doesn't make him a duck! I remember that other suspects in the past also looked like the bridge guy and the police sketch - then they were ruled out.

Thanks for this summary Dr. Grande. One of the problems is that there is an appetite ( on the public's part, myself included) to want to make a judgment on a crime with only small pieces of evidence to go on. It seems we all ( myself included) find it hard to suspend judgement nowadays. We can't possibly know if he is guilty or not at this juncture. If he is innocent ( innocent till proven guitly) then there is already an immense amount of harm done to him financially, his reputation etc. If the police do have more then it will all come out in the trial. As it stands ,as you righly said there is no way that the amount of evidence would stand up to scrutiny in court to prove guilty "beyond reasonable doubt".

Hey, Dr. Grande. Love the videos and this analysis. I was wondering if you’ve heard the theory connecting Richard Allen and Kegan Klein? Apparently, Kegan Klein’s mother owns a purple PT Cruiser & it was (allegedly) seen on CCTV cameras at a gas station near the bridge. It makes me curious to know if the two worked together in some capacity. Kegan Klein is known to have been in charge of the Anthony Shots account, which the girls were in contact with. I’m leaning towards a path where the contents of the account were being shared with Richard Allen and the two conspired to kidnap and/or murder the girls. I’d love to hear your thoughts about this.

What else was handled incorrectly or sloppily that took 5 years to correct? Was RA even a suspect on their radar, what about the other people of interest, how well have they been ruled out? I agree with you completely. As someone who has submitted affidavits for arrest warrants, the supporting probable cause statement in this case is weak at best and am surprised a judge signed off on this. First, there may have been a hundred individuals, to include law enforcement and others armed, that could have dropped said bullet; I've done this myself while in precarious situations I would rack my weapon to make sure I had a bullet in the chamber only to have one eject. Off duty I did not have one in the chamber for safety reasons, but while working I would. I even have a .40 Sig myself. Second, why would the affiant add a vehicle that did not match one used by the suspect or even connect it to him, I have no idea, not to mention that a PT Cruiser and a Smart car look nothing like a Focus. Third, the witness that saw the suspect from the road while driving stated that the suspect had mud and blood on his clothing? Now, how could they distinguish mud, wet clothing and blood from the road, and not even close up while the suspect was in motion? Fourth, if the suspect was seen by a witness from the road, why would he not have been captured by CCTV passing in front of the building with the only camera? Fifth, but still not last, why would LE not provide a photo line up of the suspect to the witnesses if indeed it was Allen? They saw him close up when they passed each other on the trail, so why would that information not be in the PC? Well, that is criminal investigations 101, to get the suspect ID'd via line up to get your warrant. Unless of course they did and the witnesses could not ID him. Hmm. I could go on and on, but it seems to me that not one of us wants to be arrested for a crime where there is not enough evidence for an arrest, not to mention to be convicted. Anywhoo, Thanks for your thorough analysis, as always, Dr. Grande. :)

Minor detail, not a race horse but a Belgiun draft mare, barren and three other colts, all insured. I live in the county where his wife was murdered. Never a police investigation when it happened but the wifes family came in the following day. Filmed it and collected all the evidence. It wouldnt have mattered if the sheriff did investigate because they were (and still are) incompetant. The wifes murder happened about 20 years ago. We have a culture of the worst LE you could imagine. If there is a good one who accidently gets hired, they leave or get fired pronto . Majority of deputies just got out of 1st grade cop school. If the NY LE hadnt followed this up. He would never have been convicted for the wifes murder. Too bad there is no oversight for the incompetant and negligent cops we have always had. Small inbred county, the good old boys always rule because they breed like pigs, continuous multiple litters and it doesnt take long for a good cop to get a whiff and get out. The victims family came in the day after and filmed the crime scene. The only other investigatiors were volunteer fire fighters. I appreciate their hard work but when a house burns, the tiny bathroom window boarded up with over 17 nails, the door jammed from the outside, the dad and two kids escape, standing outside listening to her scream but daddy never goes back in to try to help. The wifes family tried to get it investigated but the cops refused so they did it themselves. The cops around here ALWAYS take the side of the man, laugh and say the woman deserved it. The DA is no better even though the crime took place about 20 years ago. The negligence here is criminal but as i say, the small town inbreeding rules the day. The current wife told the NY cops he admitted to killing her, he had a history of collecting insurance on fires, they were the guys who reopened the case from across the opposite side of the country. BRAVO, I LOVE THE POLICE but only when they do their job. They need training, professionalism and weed out the bad ones. No different than any other critical profession. Part of the LE problems we have today, need better vetting, training, upskilling, mentoring, support, etc. They are an important componant of public safety. You cant just hire any bum off the street. Around here they are elected but certain criteria must be met. Thank you Todd, well done. I agree...I am always very vague when questioned by the police for instance during a traffic stop. I'll even question them back politely. They are there to prosecute... nothing else. No sense in helping them investigate yourself. They are still flawed humans many in which have an ego issue. I'm very torn about this case. I'm wondering how much was left out of the affidavit. I believe it's possible Richards print or a partial print is on the cartridge/casing. Possibly DNA... As well as unknown "fibers" left at crime scene that connect to a pet of Richards. These are just rumors I have heard. Also, none of the evidence taken from Allens home or burn pit is mentioned in the probable cause affidavit. Yet in all this, the police are very unusually confident. Either they have nothing ..and are egotistic incompetent individuals ...or something is in the evidence we don't know.

Thank you for your analysis. I agree it’s not a very solid piece of evidence, in fact it’s questionable that even a spent bullet cannot ALWAYS be proven to match a certain weapon. I can only hope they have more evidence against him that has not been disclosed if he is the killer. Personally, I believe the police investigators screwed up this case from the very beginning. The confusing sketches and chasing other suspects. In fact in the beginning they said they had DNA evidence and later redacted that statement. Perhaps if they had played more of the audio someone might have recognized the voice. I believe they withheld too much information that might have been used by the public to help illicit more information instead of withholding SO MUCH nothing was solved. Delphi is a tiny town with a population of less than 3000 people. I believe the investigators dropped the ball. The case should have been handed over to a more experienced investigative team. I felt as though their department did not take full advantage of other resources wanting credit for solving the case themselves rather than justice for those two little girls. This case has troubled me for years because one of the girls had the insight to video and audio the perpetrator and hand over a suspect to them on a silver platter. I’m fearful of Moscow in the same way but hope they are more concerned about getting justice that taking on something they can’t handle. Thank you for your detailed analysis which is continually well organized, clear, concise and detailed factually.

‼️Yes I agree with you 10,000%! The police really dropped the ball. This trial needs to be public because if it isn't, the public will be forced to assume the police don't have that much against him and the case against Allen is really flimsy. I've always said all along that they needed to release all of it for the public. It's completely ridiculous that the girls literally got video footage of the killer and the police still dropped the ball so badly they couldn't arrest him the next day. I know it's because the girls were most likely SA (we all know a grown man doesn't threaten two preteens to get them alone for no reason) and the family doesn't want that released. The police are deferring to the family way too much because they're so close to the situation. They probably know these families they probably feel bad for these families. But the girls families aren't crime experts. They don't know the best way to solve the crime. They listened to the girl's families to the cases detriment. And their giant egos refused to let the FBI handle it. I can't help but think if the police had let the FBI handle it from the start we would already have the killer convicted and on death row for it.

Except they involved the FBI from the very beginning. Many think the FBI actually bungled the case and the state police finally got it back on track. Also this idea that the family wants things covered is ludicrous--they have been saying as much as they feel they possibly can all along, sometimes being reined back in by police after the fact. The family is walking a fine line of wanting justice and wanting to support the police to solve the case. I don't mind conjecture, but this isn't even supported by historical record.

The gun was cocked and ready to fire. It is heard on the recording. That's been known since the recording was released. The girls were not shot. Remember that. So RA directs them, at gunpoint, to the location. At some point he's got to dis-arm the gun or risk a fatal accident, so he ejects the un-spent bullet at the scene. Remember the victims were not shot, and no gunfire was heard. At the big news conference, if you remember, Carter plainly says "you made a mistake". Ejecting the un-spent bullet at the crime scene, was, in my opinion, that "mistake". They have one of the girls saying "he has a gun", they have a recording of that "gun being cocked", they have recording of bridge guy kidnapping them at gunpoint and forcing them to kill site. They have RA's gun. They have an un- spent bullet from RA's gun FROM THE MURDER SCENE. What more could you possibly need here?

I was raised in Clinton county, which is just south of the county Delphi is in, Carroll county. And let me tell you with 100% certainty. In small places like this you can be the most normal guy ever and still have a horrifying history of hurting and abusing people. The police are incompetent, everyone is incompetent. Everyone knows each other, everyone's dad grandfather and great-grandfather Usher in the next generation of lawyers, policemen, teachers, mayors. I know there's usually a profile, and more often than not Killers fit this profile. But I know, and I have seen with my own eyes and witnessed people, family men, upstanding people with jobs, do things that I wouldn't wish on anyone. Arson, rape, even exploiting my friends and I as minors. At this point, killer profile means nothing when you are raised around people you would never suspect. Romantic relationship means nothing. It doesn't have to be proof of guilt, that is to come during the trial. This was just to prove that there was enough evidence to search his home/arrest him. In this case it was to arrest him. I don't agree with people saying he is guilty either, not at this point. He doesn't have to be guilty to be arrested, they just need enough evidence to point toward potential guilt. If the prosecutor thinks there is enough evidence to try them, then we will hear the rest of the evidence during the trial. We will be able to understand what we think the truth is then. I can think of several reasons why more information isn’t being released. It could be the DA who wants the info protected, because the investigation is still going on. On this serious of a case, the DA’s office would be heavily involved, as they should be. The agency would’ve consulted with the him/her regarding evidence and pc before an for arrest was made. It’s possible that the DA doesn’t want the defendant to have grounds for a change of venue due to pre-trial publicity resulting in too much anti-defendant sentiment among potential jurors. The agency could also possibly believe Allen is not the only one involved and they don’t want to tip them off, or it’s “hold-back” info that only an involved person or credible witness would know, so they can rule out any nut jobs who want to confess, nut jobs who say they’re a witness of some sort or inmates who say they have info because they’re looking for a deal.

In France, the jury MUST ACQUIT for the benefit of the doubt. This is called the presumption of innocence and ABOVE ALL, it is not up to the accused to prove that he is innocent, it is up to the police, managed by the investigating judge, to the justice to prove that he is guilty.
