This! Dude sold them to GameStop. It's a pawn shop for games. They give you a tiny fraction of what it's actually worth, because they're not in business to collect games; they're in business to buy games super-cheap and resell them for a big profit. If the plaintiff had sold his games to collectors rather than pawned them like his "friend" did, he would have received a LOT more than GameStop paid. Maybe even more than GameStop re-sold them for. Judge was clueless about GameStop, so this was really not fair.

She said he’s not a “retailer” but all he meant was the customer price is the price that he has valued. I’m honestly mad I wasn’t an attorney here or something lol.

At the same time, he's clearly inflating the prices. Over 2 grand for these games? From the list she read off, they're all pretty common and can be bought on eBay for $20-30 each. The most expensive would be the Vita but even that's less than 200. At most, it'd be $600. Should have went in with a list of eBay listings to say "This'll cost x to replace" instead of "this is how much the gamestore wants". Small retro game stores are even worse than gamestop. A $15 dollar game on eBay is $25-30.

We definitely don't go there anymore my husband and my son just purchase them digitally. And if you have two PlayStations you can share one game so that's definitely a money saver

People laughing at the concept of suing over video games don't realize that vintage cartridges are collection pieces that can sell in the tens of thousands and sometimes more. A rare Super Marios Bros 3. cartridge just recently sold for $156,000 at auction. Obviously the ones in this video aren't worth that much, but ya'll get my point.

I normally agree with Judge Milian however I think she could have given him at least $500. The defendant wasn't credible/upfront abt pawning the games so I believe he borrowed more money. The plaintiff needs to stop loaning money and games that he can't chalk up as a lost.

She really thought he wouldn't get what the store owners get for collectible items? Anyone with time and an ebay account can make a LOT of money with selling collectible games. It's so unfortunate that the judge is so flippant of things she doesn't understand or know about. I've seen her call a recess for car cases and boat cases where she called companies and googled sales. But of course, she didn't think much of games so she lowballed the plaintiff terribly.

@@melosidhe779 my statement was based upon the fact that he was willing to lend them out for use- which leads me to assume they’d be sufficiently utilized over the years, therefore diminishing the value significantly. Also, the store that purchased it for resale probably had listed the games based on their best interest, so in that regard I agree he should have received more than the 350. Luckily he gets an appearance fee and pre statutory interest is usually applied. Think he did alright. Judge Doesn’t believe in unjust enrichment or “bonanzas” as she calls them. No proof= rough justice.

People like you and the judge assume an individual couldn't make retail profit off of selling games privately or that loaning the game to 1 individual significantly depreciates it. JM, the video game industry is worth more than 100 BILLION DOLLARS... that many people can't be wrong. I'm not a gamer myself, I enjoy a few, but my husband was an engineer, he now is a programmer, my son is already in college classes at 16 and they both love gaming. I insist, like anything, there needs to be a balance, but don't judge just because you don't understand. JM has admitted many a times she loves the luxury bags and shoes, I for one can't fathom dropping $3K or more on a bag, but that makes her happy. The man collecting the games may very well have that as a retirement fund

Also its game so it has its own bias of what it means to her cause its considered . . . as toy. If it was one of my collectible toys or games, I would bring as many sources I could find like Ebay postings, book value (if there is any books) and online stores selling the item to show average of what it would cost to replace. Its sad but some do not think much of collectible toys or games unless you are into it and know what the value is or can appreciate it.

Okay what the judge doesn't realize is whether you're selling a games as a individual or a retail store you're going to get the same amount. You can sell those games for the same amount on eBay then as what to do in the retail stores. Those games hold value. When you pawn them off they're not going to give you as much as what they're worth because they need to resell them too. And I think she's failing to miss that mark and understand that.

I've tried this in the past, where i've told myself i'll just forget about it. But the brain doesn't work that way, you can't just delete memories like they're computer files. You slowly start building resentment towards the person even if you're not conscious of it. You say it's how you preserve friendships, but my question is why would you want to preserve a friendship with the type of character who doesn't pay stuff back?

I get it. The judge doesn't know what the games are worth on the open market. Judges don't know everything. So she judged on what evidence of value she had. Truth be told, his lack of proof and writing is why he got so little.

He had proof she just didn’t look at it. She ignored how the market itself works everywhere. You don’t get pawn prices when you get replacement value. Because when you pawn something they give you less. Then sell it higher to make a profit. The pawn price or trade in price is not a value to base anything on. Because nobody can buy those items at those prices. They get marked up after. Trade ins are a ripoff.

As a 43 year old gamer, the verdict in this case was painful to hear. I love Judge Milian, but clearly, she does not understand video games. She always says that the plaintiff is to be made "whole." What she doesn't seem to understand here is that classic video games are not like TVs or cars: they don't depreciate in value, but they APPRECIATE in value substantially. She should have awarded the plaintiff the price to repurchase the games from the store. Those games are going to be EXPENSIVE to replace on eBay, which is where the idiot defendant should have sold them. I get the impression that the defendant has some drug or alcohol problems, especially about his comment that if he had his old phone, they wouldn't be there today for "other reasons."

Not all video games do. And if you got video games that are worth a lot of money (which many people don't have, which adds to the value) you don't loan them out. His games were not worth what he thinks they were.

@@ButtonsCasey Classic original Nintendo games? Just go look on eBay at how much they're worth to replace. I have games from the 90s for PC that are worth hundreds of dollars now, when I paid about $60 for them at the time. These are now extremely rare and difficult to buy. To replace them would cost him hundreds or thousands of dollars. As I said, older games viewed as classics appreciate in value: they do not depreciate. Judge Milian doesn't understand this arena. She is supposed to make the plaintiff whole, i.e. award him the money of the replacement titles. The defendant is an idiot who probably sold the games at GameStop to some store employee who sold them online for absurd amounts of cash. Had he sold them on eBay, he would have made a ton more. I'm thinking he's probably got a drug problem and just wanted a quick fix.

I have a PSP console that is worth $600 that I purchased for $300 brand new; Also, I recently sold a video game purchased for $20 years ago for $200; a lot of games don't decrease in value for collectors, they increase. Don't lend your collectables to anyone; not even your friends. And if you say "it's just video games".. Well, your purses are just leather; your shoes are just shoes... Why the f are you spending so much on those if they're "just clothes"? Those collectible Nike shoes? They're just tennis shoes. That 1st edition book? It's just a book, who cares... right? People have their collectibles, it's fucking stupid to bash someone's personal collection just because you, personally, don't understand or partake in it. Take that from someone whose game collection is worth more now than when I purchased them. 80% of my games are valued higher USED than their Brand New ticket purchase prices I paid for them. Years of enjoyment from them and I have a complete series set as part of my collection. Look up Namco "Tale of" series and do the math on how many games I have in that.

I love the tales series. I also have several. Not the complete collection, but a lot. I have games I paid $2 for used that are so old game stop won't even take them, but I could sell them direct for $80 at the lowest, even in used condition just because you can't get your hands on it anymore. The judge just didn't get it.

@@melosidhe779 Yea, it's crazy. It's like just because you, personally, don't understand a value of something doesn't mean its not valuable. Records, movies, purses, shoes, figures, Legos, games, cards... One person "Its just a __" are hundreds of other people's valued collectibles that sometimes get graded and put on display. I always use the Cowardly Lion costume from Wizard of Oz as an example how people don't understand value. The original costume was, quite literally, shoved into a trash bag. Now people fight over it to spend MILLIONS for it. From the trash but worth millions all because someone didn't understand what it was worth and for the person who shoved it in the bag it was just a smelly old costume.

The judge presumes (wrongly) that the purchase price of rare games and the selling price to a gaming shop, is the same. The plaintiff is a collector and therefore in order to replace them now, he would have to pay top dollar to obtain them, which is far more expensive than trading them to a gaming shop. Doesn't she understand that these are rare and collection pieces, you don't just buy them at Walmart. She was quite condescending to him about being a gamer, she should keep her petty opinion to herself and her 'rough justice' ruling of $350 was totally unfair...
