Either she goes to jail for a very long time or the government should never prosecute another fraud case. Nor should she be the last of a number of her fellow conspirators who need to be put away, not JUST to punish them, but also, and significantly, to provide the example to other potential fraudsters of just what (should) await them.

or if it goes off in the courtroom, the owner must approach the bench, turn off the phone and hand it to the judge who can place it on the edge of the railing around the judge's box. Once the session is over for the day, the owner can get the phone back. Just like in high school.

If the jury has any sense, she will be convicted. As the CEO, she is/was responsible and accountable for everything that went on inside the company. Even if there were people who influenced her or guided her in the wrong direction, she still has to take the rap. If she at least could claim that yes, she took investors' money but she plowed all of it into the company. But she took the money, and used it to finance a lavish lifestyle for herself and her boyfriend/partner in crime, and that's the most damming argument against her.

Prosecution did a mediocre job, her lawyers are the best her boyfriend's family can buy. Makes a big difference in summation. The prosecutors is really a bit lifeless from what I've been told, so the odds are slightly in her favor.

@@comdo831 Since when do juries have intellectual firepower? These decisions are often based on emotional reaction to evidence and all she needs is one single vote to make it a hung jury. That would then require the feds to decide if they want to spend the money on a redo. No one can fully read a jury in a case like this, but the prosecution make inexplicable mistakes and she knew her stuff from extensive coaching so I think the odds are slightly in her favor.

I think she will be convicted, simply because the length of time that the fraud occurred over. Cheating people out of their money is one thing, but jeopardizing other people’s lives with incorrect or misleading blood tests is another. She was CEO of Theranos from the beginning, so playing the “I had no idea card” won’t work here.

It's interesting to me that her response is "I was protecting trade secrets". If they didn't have a machine that worked, and was riddled with so many reliability flaws, what trade secret is there to hide? I feel like you should be able to keep your trade secrets, but it shouldn't entail misleading people into believing you are using those machines covered by trade secrets. The use of alternative methods or machines, not classified under trade secrets should be disclosed.

I doubt if the Edison machine could do even 12 tests to the level of accuracy needed for an accurate and comprehensive diagnosis. Finger prick tests are usually indicative only but for diagnosis of a serious condition such as diabetes, requires a standard procedure with proper laboratory calibrated instruments and procedures from the blood draw to final interpretation and reporting.

You're right in the Dan Markel murder for hire case Defendant Katie Magbanua got a hung jury because of one female juror who did not like the prosecutor mentioning that Katie got "breast-implants' possibly with the blood money. Why? Because Katie was from an ethnic background where artificial breasts are part of their culture, she mentioned in a interview that Mentour Lawyer did on YT with this Juror. This one juror ruined it for the State because there is clear and convincing evidence that Katie was the middle person between the people who hired the murderers and the hired killers. I figure this was as you say a numbskull reason.

Bear in mind that she didn't only rip off rich people. A lot of small time investors gave her money too. But her biggest crime was giving people bogus diagnoses. I get the whole fake it till you make it thing. When you invest in a technology start-up you are taking a big risk, but al lyou risk is money. But playing with people's health and lives to make an easy buck is not acceptable.

Watching from the UK I am shocked that a CEO can attempt to abdicate so much of her "DutyHoldership", I use that term as if this were the UK the CEO or Managing Director are ultimately culprible along with the CFO/FD or HSD if it involves Health and safety. There would be none of this wriggling as our law clearly lays out your responsibilities and accountabilities to be in a dutyholder position, the other question we would want satisfying is that of competence which would be based on her demonstration of formal training, attitude and experience. She is a typical Silicon Valley “fake it until you make it “person. I think she truly believed her machine was going to work at some point so she wasn’t worried about being “caught“. Since she had no scientific or biology background, she was too ignorant to think otherwise. In other words she probably thought if the other companies can make a machine like this… I can make it better and smaller without thinking the other companies would’ve had something like this already made if it could’ve been done. The problem is in healthcare you can’t fake it until you make it and it’s not acceptable to claim something works until it does work. It doesn’t matter who’s got away with this in the past including her hero Steve Jobs. I think she learned to become OK with her own lies and started to believe them because she thought her staff was going to have a working prototype before anyone discovered it wouldn’t work. She will be found guilty on 1/3 of the fraud charges, be sentenced to four years in prison which will be a country club and will be out in 18 months on good behavior.

I think she will be convicted. All of the emotional stuff related to Sunny Balwani that the defense tried to bring in may be true, but it definitely does not excuse her for the years upon years of fraud. Plus it seemed like they might have even gone too far with that. I also think her memory lapses are way too convenient and make her seem disingenuous. The governments case looks good to me so far. I really hope the jury sees it the same way.

So this whole time there has been this “will they, won’t they” put Holmes on the stand. You know, since it’s risky and most guilty people don’t defend themselves. But they did, and for 6 days. So my question is, if they hadn’t, what was the defense going to do? It sounds like they had a few very minor other witnesses on the stand. Was that all they were going to do if she hadn’t taken the stand? I also find it comical they had to call sorority sisters of hers from nearly 20 years ago to show a sign of solidarity with her. Many declined and the rest wanted to remain anonymous. Speaks volumes to her personality that she has zero supporters other than her mom and husband to stand by her side and has to call so-called “friends” she hasn’t seen since the early 2000s to fake support. Par for the course.

She’s spent years convincing people to give her hundreds of millions of dollars, probably thought it would be easy to convince 12 people that she’s naive and didn’t know what was going on and was controlled. Which I don’t think they are gonna buy it. Whether it was from good intentions or not, she knowingly lied to people to get money.

I was astonished to learn that the prosecution did not put on a rebuttal case. The last impression they leave to the jury is Miss Pretty face do-gooder. She sais specific things and put in specific emails to which the prosecution has access for rebuttal. That way the last thought for the jury would be the refutation. That -- plus Leach's incomprehensibly weird way of asking what should be leading questions has be in a state of total disbelief at how mediocre the prosecution was. Also, since the jury cannot acquit if the people she defrauded were dumb or lazy, why did the prosecutor sit through literally hours of due diligence questioning? At a lass here. And Ive practiced for 4 decades and recognize that there are different ways to do things. But not this way.

Rebuttal is when she rests her case and you put on witnesses to address/refute things she said. Prosecutors took a pass on it and just from what I know of her testimony and documents she used, there was a mother lode out there. Just a few witnesses to tell the jury what they just heard was false is all it takes.

But, if I remember right the defense was keeping the cross witnesses up there forever probably tiring out the Jurists and witnesses. I watched enough Judge Judy episodes to see how well a defense of physical abuse works when Judge Judy asked, "Can I see the Police Reports?" The only evidence Miss Holmes has provided of abuse are text messages such as, "I love you snookums", "I can't wait to see you", "How can we hold off on this test vetting our technology, my love" ..etc

I have a question... would any damages (criminal or civil) she is required to pay apply to her current assets, or to future potential assets as well? Assuming she is found guilty and given a 10-year sentence, for the sake of argument, she will leave prison still quite young, presumably poor, and without a great resume! But she might be offered a lucrative book deal. After serving her sentence, could she actually profit and/or live off of those proceeds, or would all her future potential earnings be subject to claims against her now?

So, when Ms Holmes is found guilty, there’s the question of her sentence. Since this a federal case, how much discretion will the judge have? Is it true that white-collar crimes tried in federal court typically carry significantly lesser sentences than the same crimes in state courts? What determines which court will try a given case? If so, why?

So when the Prosecutor snapped back at her last week about "trade secrets" and said "we'll get to that".... did he? Or is the fact she didn't tell anyone outside of her office the machines didn't work as advertised was the "trade secret"? Good vid- very informative. I just wish we could of watched it on TV.

The odds of a conviction in a federal case are somewhere around 90%, are they not? Nuff said? I can’t seem to summon the level of vitriol against Ms Holmes that will surely be demonstrated again after this vid.

You're doing a "base rate" analysis, which is always a really good place to start. But, I think there are a lot of factors that make me believe that "Not Guilty" is a strong possibility. 1. She's got a scapegoat in Sunni 2. She's pretty, white, young, pregnant, a women, and charismatic 3. She's got crazy money 4. She existed in a world full of "fake it till you make it" types, so it's understandable that she followed suit. Neither verdict would surprise me. Like practically everyone else following this story, I think she's guilty!

I think she may be found innocent of some charges but guilty on others. I would laugh my ass off if the jury foreman pronounced her innocent on all the charges but saved the guilty one for last. 😆😆🤣

I feel there is more to these jury dramas that has been going on since the start and the prosecution being way too soft without talking about some basic things that even comments here are pointing out.. may be since so many politicians advertised for her and such high profile ppl invested in it.. there could be some pressure on prosecution and jury to make sure to go soft on her and if possible make her walk free in few weeks looking like this "naive beautiful damsel in distress who got tricked by everyone when she tried to 'change the world' " :P

Thank you. Another interesting one. It is the same here in the UK - you usually cannot ambush the other party with a last minute document although occasionally if in the interests of justice you can. She was far far too young and inexperienced to start a company like this and not have scientists on the board. We might admire very young people who set up on their own but they just don't have the wisdom or life experience to it well in most cases.
