Our teacher played this at school to twenty of us explaining just how little about the law police know. We went through the sections and had to guess how much compensation the bad officers would cost the tax payer. There was an apology from their boss the next day but it hit home to us in class that the police don’t follow rules and don’t actually understand a lot of their powers. We later looked at how little resource is place on actual crimes and how much on petty fines and bits of rubbish. The teacher was an ex cop and he said cops like this is the norm.

@@DG-yb4wc the whole school watched this when it came out. The form tutor went through the legislation and then we watch the apology. It’s was a life lesson most of us thought the police knew what they were doing but now everyone just keeps as far away from them as possible. Just for our safety.

If you're really a school student then you have a very impressive mature outlook 👏👏👏. Correct about the resources being used on petty infringements and not real crime. Have you ever considered that maybe this is not an accident, but the true purpose of the police? To incriminate and therefore restrict as many peoples lives as possible? With all the technology and surveillance laws the police now have access to, they could eradicate all crime if they wanted to. But they don't? Could it be be, because if all crime was eradicated, the police would invalidate their own existence, and it would no longer be justified to use all the surveillance and tech to spy on the entire public?

Whilst it's not the job of the custody sergeant to correct the arresting officer, he should have made more of a point of identifying under what circumstances the arrest was made. Simply saying 'The Terrorism Act' is as meaningless as saying 'under the policing law'. The custody sergeant isn't there to vet whether arrests are legit, he's there to run the custody suite, but the custody sergeant is always the bloke you ask if you don't know what the law is. That he never asked what section of the Terrorism Act is lazy at best. That she said she didn't know and the custody sergeant just sort of metaphorically shrugged and went 'well....whatever...' shows that the incompetence runs right through the whole of that nick.

The thing I do not understand is, the Desk Sergeant has the power to either approve the arrest (after hearing the arresting officer) or to de-arrest (i.e. for lack of grounds). So it baffles me after hearing Insp. Bills explain that AB was filming on the pavement (= legal), filming cars (= legal), filming the station (= legal) and since no offence was committed AB did NOT have to identify (not even under S43) the desk sgt did not stop this. Must be a thin blue line thing.

Well said. I'm glad that I'm not the only one who could see that, it was so glaringly obvious that they are... well stupid. She (and her colleagues) came across as being a long way from bright. The very fact that she didn't think it necessary to quote the section which she was using to detain you but instead muttered some rubbish about the "policing law". And, if the other guy had two brain cells to rub together he would have interjected at that point and clarified which law/section she was detaining you under. "The police law"..... This is like something that the thickest lad in the class would answer on the first day of Police School, you know the guy, the chap that would go to the toilet and get lost on his way back. Its easy to laugh at their obvious low levels of IQ but you are right, this isn't good enough and does indeed lead to them believing that they are not stupid which results in corruption, tyranny and abuses of powers. What's the bet that these Wally's are still in the Police force.

Thanks for the long awaited update AB and hope you had a lovely holiday. I must say I am shocked at the payout for what they did to you, the contempt they showed you was disgusting. They all conspired and perverted the course of justice by lying to lock you up for 5 hours and they simply get away with it and give you a pathetic payout. No doubt all the Officers involved in this have now been promoted. I do hope that these savages we call the Police are reading these comments and understand the public do not support or respect you. More shocking in all of this was the custody Sergeant he should know better.

Yeah I'm glad it wasn't just me that thought this payout was a bit on the low side considering what AB went through. By contrast, a barrister illegally arrested at a picket line in London in 2020 then dearrested four minutes later without being taken to custody got £3,000 from the Met.

“Acting suspiciously” is NOT a legal ground to even ENGAGE with somebody, let alone arrest a Member of the Public under Section 43… What a disgrace those tyrants are. They need a good spanking from their mothers.

@@MetalFan10101 False. The requirement is ‘reasonable suspicion that a person is about to commit a crime, has committed a crime and/or intending to commit a crime’. All she needed to articulate was the specific crime she thought his ‘acting suspiciously’ indicated. This is very clear from case law precedent decisions and the Policies/Procedures/Ethical documentation available to the Public.

@@Bruce4lmightyas far as I'm aware the police have the same rights as any member of the public to ask you questions or just say "hello" but they are also required as any member of the public to stop interacting if you let them know it's unwelcome or it may be considered harassment, at least theoretically. On the other side of it you are not required to answer their questions except to identify yourself if the cop has a reasonable, articuable suspicion of having committed an offence. I'd think that any rule that the Police can interact with you only if you've committed an offence to be somewhat against the Peelian principles as it would hinder the Police's ability to obtain the consent and cooperation of the public through a friendly demeanour although I would admit that many cops nowadays consider friendliness to constitute gross misconduct.

Well done AB! Those officers didn’t have a clue. Under S43 they must have received information or intelligence that you are in possession of “the object” but they detained you under that section because in their eyes you acted suspiciously, so there was no object. I would send a letter to that DC thanking her for her total lack of policing knowledge regarding this act and section, and also thanking her for the £2000+ compensation.

I was a cop in the 80s. Its possible to get things wrong. However, the person responsible for locking you up is the custody sergeant. I remember the custody sergeant had a load of books regarding the law back then. He's the one who should have pointed out to female cop that she had made a mistake. Its a learning curve for the young male cop who was lead by the DC.

" the person responsible for locking you up is the custody sergeant" - correct. At first he was doing well and asking pointed questions to the DC but nonetheless, he fell into the trap. Myself, I don't agree with this payout, I feel it's cheap to be fair and AB should have taken this all the way to push the point. Furthermore, in AB's arsenal to push the point, he had a public apology from the superintendent who's clearly stating they, her force, were wrong. AB's quest is to audit public officials and if they're get out of line, bring attention to it however, in this case, I feel it needed to go further than a payout. The DC and the custody sergeant are senior and should know better and therefore, should be demoted or fired. An example should be made for the tax paying public to feel confident. That DC was way out of control and depth and yet, she's more than likely still in her position... scary.

This is amazing how even the custody sergeant seems confused as to why you were arrested and then conspires to start making it up as he goes along. I'm shocked! We need to be worried as this seems to be standard behavior by the police. The statement from the Superintendent should also take a good look at her own department. I would be thoroughly embarrassed. The costs should be deducted from the Superintendent's and the arresting constables salaries, they will then think twice in the future...

Rebecca love refused to take my calls after I was arrested twice for “malicious communications”for just telling my mom I felt suicidal and needed some help. My mom complained and got me a solicitor and 4 years later it’s not in court because they delayed everything. An internal investigation took them 3 years! They are horrible people

That apology was given through gritted teeth, I was practically in tears just picturing a police lawyer standing behind the camera with prompt boards with “ Smile now”, “ Look sincere”, “ Pretend your cat died”🤣 The Superintendent looked pissed having to issue that half hearted apology, she reminded me of Terminator 2 when young John Connor tried to teach Arnies Terminator how to smile🤣🤣
