Or if a judge imprisons an innocent person for many years, should just get sacked? No. No. No. They have with force, taken the highest authority over us. The police (brotherhood) law is the gift that keeps on giving. “I’ll simply arrest you, no problem” - main problem here when can’t state law, section or articulate a crime. “I’m giving you enough” “You don’t need to challenge me”…just on a relentless mission or shall I call it power trip to obtain details “as simple as that”… “because I work in the building”. Alarm and distress?! I don’t think the police acting lawful under capacity of their duties can use section 5 of the public order act 1986 on themselves, please correct me if I’m wrong.

Section 5 of the Public Order Act 1986 A section 5 offence comprises two elements: A person must (a) use threatening, abusive or insulting words or behaviour, or disorderly behaviour, or (b) display any writing, sign or other visible representation which is threatening, abusive or insulting; and The words or behaviour, or writing, sign of other visible representation must be within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby. How these officers passed their GCSE's, let alone the intricate structure of sections of law for their exams in the force is something I can't fathom. They think we're all stupid. They think if they throw threats around like "you're detained under the terrorism act" then we'll fall over ourselves in fear. If a cop can't explicitly describe the particular law under which they're claiming you may have breached, they really need to hand in their badges and go work at McDonald's or something.

Agree completely bud. I too am an ex Police Officer who served for 33 years. I recently used my camera to film from the public car park and street at the rear of Blairgowrie Police Station. It was for a totally different, but lawful , reason not an audit. I was approached by two Police Scotland officers and despite giving them an explanation of why I was filming they prevented me from going about my lawful business, assaulted me ( causing injury ), Illegally detained me and threatened me. All now subject of an official complaint. Absolutely disgusting behaviour and unfortunately the few good Police Officers left out there get tarred with the same brush. They have totally lost contact with the ordinary law abiding members of the public. They do not know how to talk to them and see themselves as better and above the law. Just for info they did not lock me up and simply allowed me to walk of without me giving them my details and them allegedly suspecting me of being a terrorist.

As a reasonably seasoned ex uniformed cop (I never had enough brains to be a detective) from a land far from England I cannot help but agree with you. The two uniforms I would give a bit of slack to as they are obviously young and immature and were caught up in the group mentality/seniority thing. The PC in plains clothes didn't say much at all so that leaves the so called detective (who wasn't at all keen on identifying at first) and I think you've said it all there is to say about her. Is there some sort of selection process to become a detective in England because if there is it failed miserably in her case.

I won't say i cannot believe they actually arrested you because like i said before as A Criminal Appeals Paralegal i have seen many arrested, detained, taken to court, and in some cases special sittings held with bail refused and the person incarcerated with no evidence of what they would be accused of. The police - the greatest - but not only - evil we face right now. Sure not 100% of the police are bad. Maybe it is just 20%. Jimmy S proved the vast majority of the police are all pdf-iles themselves, assisting or knows about it. Sure, maybe only 10% of the police are pdf-iles. Maybe even 5%. Nobody is required by law to provide the Police with their details unless arrested (Rice v Connelly 1966). In fact, according to RvC1966 a person is not even obliged to talk to the Police at all. And, every court in the land has agreed that refusing to give details when not legally obliged (again, RvC1966) is not reasonable grounds for suspicion that a person has or is about to commit an offence. Even PACE section 24(5)(a) which gives an Officer powers of arrest if they believe the wrong details have been given, is presupposed on PACE section 24(1), 24(2), 24(3) and 24(4) which states that there must already be a presupposition that a person has or is about to commit an offence. The DC acted unlawfully by using a threat of arrest to procure a members of the public's details. The detainment was false imprisonment; which, is a criminal offence. Further, they commit assault under Section 39 of the Criminal Justice Act 1988 by making physical contact and cuffing AB. In conclusion, all 4 officers have very kindly provided AB with grounds for a civil case, the consequence of which will be a large compensation payout for AB.

They do have insurance covered by Police federation (like a union) established in 1919 The Insurance premiums is paid by , yes the taxpayer , but it is your local tax = council tax the costs they occur comes out the insurance but the following year the premiums will go up , so when the cost arise the following year , those higher premiums , your council will increase the council tax for policing funds to pay for those premiums My council tax in 2020 was @ 3.9% ,, 2021 increased to 6.7 % the fire authority get the a raw deal where 2020 @2 % 2021 remained same @2 % but I do agree what you say "personal liability" the only way to that is,, get rid of the Federation all the best ,,,Will

@@TheBILLANDERSON individual constables do not have insurance . The chief Constable pays the damages from the funding of the police . It would be impossible to get insurance because the premiums could never cover the payouts. If a Constable commits a criminal act he could be made to pay you compensation directly if the force dismisses him. The police federation does not hold insurance for constables in cases of misconduct. The chief constable is vicariously responsible for the constables in his force.

Oh dear me.... thats a clear breach of law on so many levels. I am ex job (28 years). The problem now is that 60% of police officers have less than 4 years service. A further 20% have less than 2 years service. An experienced skilled Custody Sergeant would have de-arrested you on the spot and taken the arresting officer aside for a quiet chat. It would have ended with a sincere apology and a tour of the police station in my day. I could cry what has happened to the job I loved so much. 😭. My advice is to issue proceedings for wrongful arrest, false inprisonment and common assault and battery. The arresting officer has also likely commited criminal offences by abusing her powers in this manner. 😳 A DC should know that taking pictures in a public place does not constitute an offence and that there must be aggravating circumstances to warrant use of s43 (your conduct and demeanour clearly did not warrant arrest). Refusing to provide details in this instance does not warrant a PACE arrest. I think her senior officers and that of the Custody Sergeant won't be at all happy with the manner you were dealt with. Keeping you locked in a cell for 5 hours is plain wrong onso many levels. It looks to me like these tyrants need a stiff lesson given. Good luck with your County Court form N1. 👍 As for lame timid officers claiming to be harrased alarmed and distressed (POA 1986), that is an affront to most serving police officers in these circumstances. Retired officers (real thief takers) will agree with my opinion here as will many serving officers. Not all are bad officers just a minority but these need taking out the equation pronto. All those officers you had the misfortune to meet that day need to rethink their career path. In my day we joined the job to lock the bad guys up, now the British policing model has changed and many officers think they are revenue collectors and tyrants. The police needs to return to its former policing model which was admired worldwide. Policing by consent isnt what happened here.

@me me : Lack of experience is not a barrier to promotion now. The "graduate entry" program means having a degree overrides everything else. Newbies can do basic training and then go straight into plain clothes work. Gone are the days when newbies had to do uniformed work for a couple of years before becoming a detective.

Where do they get these people from. 🙄. That standard of policing and their defective interpretation of the law is an utter disgrace. What is more concerning is that the Custody Sergeant failed to recognise it was a wrongful arrest on the basis no crime had been disclosed. The police do NOT possess powers to walk up to the general public in a public place without first having reasonable grounds to believe a crime has occured or is being comitted is about to occur (Criminal Law Act 1967). This kind of lame lazy use of s43 and PACE s1 is astonishingly stupid and reckless behaviour by clearly inept officers who should know better. The Police Chiefs Council has published guidelines stating clearly public photography is NOT a crime. I value your claim in excess of £10,000 when you consider you were deprived of your liberty for 5 hours. It was also an assault and battery the moment the cuffs were used. Im sure this willresult in a part 36 offer to settle once the facts are looked at closely.

This is precisely the problem with the DC: she was unable to act objectively, and instead based her decotions on an emotive premise, e.g. "He is refusing to comply with me, therefore i'm going to use force and threat to make him comply". What she forgot, is that the public are not automatically obliged to comply with the Police. In fact, Rice v Connelly 1966 states that the public do not even have to talk to the Police unless arrested. In other words, you can stand and stare blankly at the Police and not say a word... and this is all perfectly legal and cannot be used as a presupposition for an offence.

It is outrageous that the police are so willing to misuse the Terrorism Act in this way. Every one of them went along with it, four officers on scene, the Custody Sergeant and the other Sergeant that 'advised'. The abuse of power is systemic. As an x police officer, a police officer is not allowed to pull out the “harassment, alarm and distress” card for themselves unless a very high threshold is met that is beyond normal policing expectation, it applies more to the public. Otherwise police officers could arrest people constantly for harassment, alarm and distress!

Every Police station has it's own culture; e.g. some stations have a culture of engaging with the public in a positive way, and engaging in deesgalation: whilst other stations have a culture of treating the public with contempt on every occasion. The culture of a Police station is driven by those at the top; therefore, it is not the bobby on the beat to be angry at, but the senior officers who set the example for the bobby on the beat to follow.

What is disturbing is that just because certain individuals don’t like this (lawful) act they manipulate the law and abuse their powers to harass a law abiding citizen and illegally obtain personal details. In this context it’s easy to dismiss as ‘he deserved it’ but what if an officer didn’t like something you were doing or just didn’t like the look of you - would you be happy being put in handcuffs?

Every video you do AB you are doing more for your cause and making a positive change for the future of policing in this country. Its only a matter of time before they start to radically change policing training as it is clear to anyone that this is wrong and a lot have no idea what laws they are enforcing . Keep it up ✌️(If they did this to somebody so well versed on their rights only GOD knows that they would have done to the other 90% of the population whoa are’nt).

Sue them - trouble is that they were completely out of their depth and I assume they are going to arrest Google for including the police station on Streetview. Meanwhile while they spout laws they do not understand a little old lady is probably having her house burgled - but thats real crime, they cant be bothered with that.

@Stephen i was in those cells in that station in 1989 for 16 hours all because i was talking to a guy i'd lodged with, in the street at 1am. we were "routine" questioned and searched and cuz he had a bunch of old cars keys on him we were both arrested for "going equipped!. i cought scabies in the cell of the filthy infested blankets and saw made a complaint on my release for unlawful arrest, catching parasites etc. i knew very little then about any sort of complaints procedure and was fobbed of with the "1st stage of complaint a chat with the duty sargant". they also gave me an illegal beating in 1980 there, i was in for TWOC and they believed i was withholding information so they got the burly sarg in who was bitch slapping me on and off for 15 minutes. got them nowhere.

Their ignorance and arrogance are breathtaking. But more importantly, it is genuinely alarming that they treat the public with so much contempt. And then they wonder why people distrust police so much. Honestly, whenever a police officer or car is around, a lot of people feel intimidated, not feel defended or ‘safe’.

If the 🐖 s spent anytime at all on real criminals, especially Pxrvxrts and Pedo's 3 things would happen the 🐖 s would never leave the station and the vast majority of 🐖 s would be behind bars and the crime rate would fall by over seventy percent.

That's what all the new laws being motioned will be. All encompassing and vague. The police, crime and sentencing law, the online harms Bill, the CHIS law, etc. Anything the govt don't like can be stopped with these laws due to their vagueness and the police will absolutely adore the extension of power.

The arrest was so egregious in that they used made up laws and didn't even follow any procedure or policy that AB should go the whole hog and demand £10k from them. Plus retraining and demotion of the DC. She should learn that she must do her job properly and not just how she feels like it.
