No when she said she wanted her lawyer. The officer said no she can't have one. He screwed up big time. As soon as some says they want a lawyer the questioning is to stop immediately. There are no ands if or buts. He violated her constitutional rights under the 6th. The right to have an attorney while being questioned.

@@willyluciano9036 Not sure where you get your information. But yes on any arrest you can have a lawyer under the 6th Amendment and the US Supreme Court rulings. Any time anyone is arrested they are given that right to have a lawyer. There are no state or federal laws that says anyone who is arrested for DUI cannot have a lawyer. That is a violation of Constitutional rights. That is part of the Miranda rights. You have the right to remain silent. You have the right to HAVE A LAWYER PRESENT DURING ANY QUESTIONING. The Miranda rights came out of a US Supreme Court ruling.. So don't quote something when you don't know the law or federal court rulings as well the US Supreme Court rulings on these matters. By the police saying you don't have a right for a lawyer, just gave cause to the defence attorney to get the arrest and charges tossed on violation of 6th Constitutional violation and she was not read her Mirada rights and she will have a federal lawsuit on constitutional violations rights.

@@nonyadamnbusiness9887 - Actually, they do, dickweed. Edwards vs. Arizona settled that in the Supreme Court. Once you have requested a lawyer, they are legally required to stop questioning you with unless you initiate conversation OR if there is an outstanding public safety threat, such as they believe you know the location of a missing person or you are believed to have information regarding a bomb, etc. While she should have stopped answering their questions, their questions were illegal and anything she had answered after requesting a lawyer and being denied one would not have been admissible in court.

all she got was delayed. the lawyers got most of anything she collected she may have got somewhere around 48% of it MAYBE after all other expenditures have been taken into account including lawyers fees

The Civil Rights lawyer channel explained why they settle cases and usually it has difficulty in proving the case and proving harm that needed to be compensated. Usually lawyers fees are separate from the settlement.

Makes one wonder just how many innocent people are sitting in jail because of corrupt/incompetent cops. Some basic police work would have cleared this up long before she was charged, but that one cop in particular was 100% convinced she was guilty and noting was going to change his mind.

Less US soldiers died in Afghanistan during the 21-year invasion than 'mercian people die on American soil k1ll3d by LEO and alphabet agencies EVERY YEAR. Also, more people in America have criminal record than higher education. I always ask them - who is a real t3rr0rist here? For as long as they will be allowed to investigate themselves and find no wrongdoing, for as long as the judges will be buddies with pigs and for as long as the taxpayer will pay for their legal defense and the compensations to their victims, there will be no changes in America.

Invoke your 5th & demand a lawyer immediately & his alleged investigation has to end without a lawyer present. Oh absolutely love for them to explain how she was involved in a hit-and-run in detail I seriously thought they were actually suspended and if they were it was just a free paid vacation Basically the chief of saying-"we have investigated ourselves and found no wrongdoing" They were trying to tie up other cases as quickly as they could connect dots that don't exist. I would love to see the deposition of her lawyer asking them questions about how she's not entitled to a lawyer or how they came to the conclusion that she was involved in a hit & run This was all about power of authority. Nothing's going to happen to them they know that Fabricated charges, unlawful arrest, violation of civil rights. They already made up their minds the second they saw the windshield. They HAD footage AVAILABLE, yes. But as the video showed when the officer was there, he likely didn't ask for long enough back to prove that she drove it there and did not come back to it; Or when the person vandalized it. They probably just looked JUST far enough to potentially see if, at the time of the hit and run, it was present in the lot. Because she parked close to the entrance, and the camera DID pan, that particular time stamp likely wasn't viewing the spot she was in, and could not prove if she was already parked, or had left/returned, or just pulled in post-hit-and-run. It would have been much further back, that proved her car was vandalized, based on the time stamps.

Blacks have been telling the public how deadly wicked law inforcement was for centuries. Yesterday's slave catchers are the cops of today(less deadly), funny we're all in agreement now that it's filmed repeatedly. Yet blacks are still overpoliced, arrested & killed though innocent, atleast 5x as much as the majority community. Cop audit videos still garner more outcry than innocent blacks of all ages loosing their lives behind gun happy cops. The only reason George Floyd hit so hard is because everyone was home behind Covid shutdown. So his murder was seen on a loop in slow motion. Humanity, a humane response was finally shown by the majority of Americans. But far too many young blacks have died worst deaths before & since, that have gone ignored. America will only be as strong as its most oppressed or victimized citizenry. Imagine how honorable officers would be today if over 160 plus years ago, its most ignored, abused, ostracized & aggressively controlled citizens would have been given an ounce of EMPATHY from their fellow citizens. Yet the majority mass response was of aloofness and/or the dismissive blame of practiced privelage from those who benefited from its SUPREMACY🤨

We have to get qualified immunity abolished completely and these officers have to be held accountable the same way we would if we done the same bs they do. If you aren't in custody, you're free to leave. No one has to talk to anyone without an attorney if they don't want to. This is such a simple concept. If a cop doesn't know this, he shouldn't be a cop. If a cop knows this and ignores it, he should be prosecuted.

Then there is the time attending court & meetings with lawyers. Sutch protracted legal action would be determental to your employment. There is plenty of evidence that city's & their police/legal departments will use all maner of legal & not so legal action to defeat suits.

You're not a lawyer(No offense, please don't take offense) and you don't have to invoke rights for them to be valid, best to say to any and all law enforcement "I'm more then willing to answer any and all law enforcements questions but not without legal representation that if I can't afford the courts will afford for me" and remain silent. remember you're not a lawyer, cops are NOT lawyers,.... and they are NOT your lawyer, the problem here is, she called them for help and they decided to BRAKE the law instead and double victimized her, they should be charged for falsifying evidence, conspiracy to commit fraud, false imprisonment and dereliction of duty at the least. They not only, violated her 1st, 2nd and 5th amendments but also the 14th and logically the whole bill of rights 1-10 and the constitution as a whole. don't talk to cops is your best bet, if you need their help, just point and mime.

Though I agree that would be preferable, they know how to drag things out and ware people down. They push and push till the only thing in your life is this. You can not work, you are harassed. In my experence, police pull you over every time you leave your driveway. Then they offer you a large sum and promise it all will stop. Easy to be tempted.

Slightly incorrect. While she is allowed to speak to a lawyer at any time (because she is allowed to speak to anyone at any time), the gov't is not required to stop questioning you and get your lawyer to you unless you are first under arrest AND then you demand your lawyer after arrest. Judges have declared that demanding a lawyer during a detention is meaningless. This is why cops will usually wait to move to an arrest... cause they are given much more leeway to question people during an investigatory stop before the arrest. They want to keep you 'merely detained' for as long as possible so they can keep questioning you as long as possible. Sadly this incident is much more egregious than people think, and NOT for the lawyer angle. Cops have ZERO requirement to do any investigation before an arrest. Yes you read that correctly. Once they feel that have Probable Cause they can make the arrest and then stop investigating and gathering evidence. When this lady sued over this incident the Judge declared that cops are not required to investigate her story to see if her alibi was valid and to prove she was innocent before arresting her, therefore her arrest was legal (according to the judge). They had their "albeit made up in their heads' story that she was a hit and run driver and the judge said that was perfectly reasonable to assume that bazsed on the evidence before them and the cops have no obligation to verify her side of things.

I agree, but in the real world it takes a scholar 4 years just to learn the basics of law and you will still only know about 10% of it. You would pay a mighty high price to go to college and would expect a much higher salary. The public just doesn't want to pay cops $250k a year to walk a beat when they can just get a HS grad who went through the academy for $80k a year. The only way to educate cops is by suing the shit out of them every time they screw up. Formal education is too expensive, but perhaps they could do home study for certificates in certain aspects of the law and once they have enough certificates they get a promotion, dunno its not an easy fix.

The police chief saying they "violated policy" left out the fact they violated the law and her rights. They always put policy up as a red herring to change the standard by which something should be viewed. I'm guessing they have a "policy" that says you cannot violate the law or peoples rights while on duty, so they can just call it a violation of "policy".

The officer actually told her "you cant call an attorney because you have not been arrested, only being investigated" - The police may deceive or threaten you into answering their questions - don't fall into their trap. You have the right to an attorney as soon as the questioning starts and, if you clearly assert this right, the questioning must stop. -- what's really messed up is the training police are taught such as diversion, skirting etc

Way too many people running around thinking and believing this would never happen to them so they either ignore or "attack" anyone trying to warn others about it. I learned young, I was arrest by police to be used as bait... I am not joking. I was going to go to jail on entirely falsified charges if another family member didn't turn themselves in. I was under the age of 18 too at the time.

This kind of policing is horrifying to me. If I even get arrested on bogus charges it affects my employment because I am a merchant mariner and sail into Canada regularly. If I got a dui or dwi I automatically loose my credentials from the coast guard for a year. So even if it’s thrown out it would still potentially cost me and my family a year of income.

Granted it was actually a coincidence, which rarely happens, they didn’t do any kind of legitimate investigation, which 100% PROVED her story correct and verifiable. And verifiable AT THE SCENE. They lied saying the footage was inconclusive. Bull shit, they had multiple eye witnesses to her whereabouts and security footage of the car never leaving or returning. The right to be presumed innocent until proven guilty is a universal human right, the fact that a supervisor came up and just flat out stated that he "knows" she's guilty is dispicable and a human rights violation, 200 grand is chump change compared to what she should have been awarded.

Here's the best part, when she was being arrested they had reviewed the security cam footage that showed the car parked undamaged, and remained there till the cops arrived. So the cops knew and arrested her anyway. So not being able to speak to a lawyer is the least of their eff ups. They lied and had to conspire to arrest her over charges they knew were false.

So, the cop reads her her Miranda rights, which explicitly states that you have the right to an attorney, and then denies access to that attorney straight after reading them? Why is training in the constitution and citizens rights not mandatory learning for cops at the academy? Why isn't there a test on constitutional rights before you can become a cop? I mean, even looking at it from the police department's and their superiors perspective, wouldn't it be worth it just to save huge amounts of money in lawsuits?

As an attorney I can tell you in every single state once you invoke your right to silence under the fifth amendment all questioning must stop. They may ask you to identify yourself if they have reasonable suspicion of a crime or after arrest. But the investigative questioning must stop.

Houston Division case: Not until shortly after Petitioner filed in the Supreme Court did Petitioner discover the obscure artifice used by the district judge to justify pretending that Petitioner is a resident of the geographic area in which the United States District Court for the Southern District of Texas, Houston Division is authorized to exercise jurisdiction: the District of Columbia. You did not misunderstand the previous sentence. The only geographic area in which any contemporary United States District Court in America has jurisdiction is the District of Columbia. Petitioner had the Houston Division case won following Petitioner’s initial March 19, 2014, motion to dismiss for lack of jurisdiction (Houston Docket #18)-because there was no evidence in the record that Petitioner was a resident of the only statutory “State” of the statutory “United States” whose residents are liable to tax under Title 26 U.S.C.: the District of Columbia. @@Marcuswelby-nx2te The same reason they ask how you're doing, about the weather, about the game last night; the idea is to get you talking with softball questions before you've thought about invoking any protective rights. Once they've got the conversation flowing, they can steer it toward the incriminating questions. Once you've properly invoked your 5th amendment, you can ignore the small talk questions. If they persist, inform them you will not answer questions without an attorney present. I said properly invoked above after reading @Dirk_the_Daring commenting about a US Supreme Court ruling finding that simply saying you "don't answer questions" is not sufficient to invoke the 5th. Phrase it however you like, but I highly recommend including the words and phrases, "silent", "attorney", "5th amendment", and "6th amendment" I haven't heard anything about the phrase, "I don't consent to searches" but one never knows. I only mention the 1st if they bitch about the cameras. More long-winded than I intended, hope it's helpful. :)

Why is it that in the US your life is halfway ruined when you get arrested _before_ you go to trial? That seems especially problematic with such incompetent cops. When you get wrongfully arrested here, it still is a pain, but your mugshot isn't blasted on the internet, you don't lose your job, etc. It seems the US cares very little about the presumption of innocence.

The officers should have all been charged with violating her rights because they denied her a lawyer even after they told her she had the right to a lawyer. I would think she had grounds to sue them even though the car against the department was settled. At to that, they saw the video showing not only that she never moved her car but that a random guy vandalized it and still arrested her, she should get more from the officers for false arrest/imprisonment.

They wanted to arrest her & knew she was innocent but they still chose to treat her like trash she should have gotten millions. This was a deliberate act by pos cops that knew she was innocent. Makes trusting police harder & harder when they hire these kind of men & then protect them & destroy innocent peoples lives. They all have no business in law enforcement how can they uphold the law when they don't follow the law & are criminals themselves. Truly disgraceful they were willing to send a woman to prison for something they knew she didn't do. They should all serve the time they were so eager to make her serve.

"Anything you say can and WILL be used against you in a court of law." They had already read her her rights. If that happens then you absolutely stop talking. Thankfully she was able to get the video and prove her innocence.

She is read her Miranda rights but tells her she is not in custody? And she cannot leave, and she cannot speak to a lawyer while they are conducting an interrogation not an investigation. The police are wrong for how they conducted themselves. Sue them for wrongful detention. It goes against the 4th amendment for wrongful search and seizure, assault and battery, criminal negligence, as well as the right against self-incrimination. And the right to counsel, and a few other broken laws as well. If they read her Miranda rights, then she is under arrest and does have the right to speak to a lawyer in which the police denied her that right under Miranda. ^you have the right to remain silent, anything you say can and will be used against in a court of law. you, you have the right to an attorney, and if you cannot afford one, one will be assigned to you. Do you understand these rights. Do you waive these rights to remain silent? ^ The kicker to the story is that these cops received a very, very light slap on their and for wat they did, which is outrageous!!

Don't forget she travelled 1/3 of a mile there to hit the person and 1/3 of a mile back before the camera panned back. That means she would have average 80 MPH to do that. In a busy city street while intoxicated without doing any other damage to her vehicle or other property? Get real officers.

And instead of the police trying to piece the evidence together, they just throw the first person they see in jail. Policing for profit rearing its ugly head. And this is another reason why it’s important to know your rights. She thought she was giving a report about her vandalized car but instead these cops are investigating her for a hit and run. And then tell her she can’t have a lawyer. Everyone should know that when the police are investigating you, you should immediately clam up. And you are always entitled to a lawyer.
