ATF has no legal authority to change laws. In this case a receiver has a legal definition. SCOTUS has already slapped some of the other alphabet agencies for trying to go outside their power. I don’t think this would pass legal muster but if the ATF tries enforcing their changes it will take years to go through the courts.

Congress makes laws. Courts interpret laws. Government agencies implement laws. This is a republic, not a DEMOCRACY. You do not have a VOTE on what a receiver is to be interpreted as. PERIOD. There are no referendums to inject common sense into laws.

If you've got the skills, tools, and assorted "know-how" required to turn a hunk of plastic (or aluminum) into a functional thunder-stick, you've got the skills, tools, and know-how to keep it operational. the real question is are you willing to sit in jail until it is resolved in the courts? are you willing to be the test case? because until it is struck down, these "laws" which are really just administrative rules, can still land you in prison, and even if it gets struck down later , you would still have to sue to get your potential conviction overturned. 💸💸💸💸💸💸 so there's being brave and being brave once you understand the entire picture. you can be 100% right and still languishing in prison.

From what I understand california actually has the same clause for anything manufactured before November 2019, you are required to properly serialize your ghost gun BUT you don't actually have to ask the government for that number it just needs to be unique and in the correct format.

In regards to ATF Rule 2021R-05F, the ATF cannot up and change rules (laws) willy-nilly without authority or explanation. The ATF has already previously ruled that an 80% is NOT a firearm if there is no jig or kit included. (See ECF 133 at 22-25). Now, they are trying to argue that manufacturing is "converting", when they previously argued it was not. This is a complete reversal. Under Vanderstock: A court cannot uphold an administrative agency's decision that amounts to an unexplained reversal of policy. State Farm, 463 US. at 57, "an agency changing it's course must supply reasoned analysis". It is established administrative law that if the agency fails to acknowledge a change [in it's position] and adequately explain it, the change will be afforded no deference in litigation under Chevron deference. The ATF does not have the authority to language from 18 USC 921 (a)(3)(A) to 18 USC 921 (a)(3)(B), end around congress.

However, what I was speaking to is that there are 80% AR lowers that cost more than finished lowers so what is the point in machining out the fire control pocket of a serialized 80% lower if you can buy one already finished, and at lower cost? Basically, this will eliminate the 80% pistol market as we have known is it will nullify the primary reason for finishing, that is, keeping existence of your property private.

I do not want nor own one of these. I cannot even get glue to set right, much less make guns, but no weapons should be tracked in any manner. If they were serious about tracking guns, they would only serialize barrels. For sane law-abiding citizens this law is absurd, arbitrary, ambiguous, and abusive. If the government wants to do a background check, THEY should pay for it. It is NOT a benefit to ME.

I have a question for you, I haven't heard you says anything about this. If I were to purchase one of those scarry pew pews that looks like the rifles in those Hollywood movies and it has a serial number and cartridge identified on the lower part of the pew pew as 5.56 or .223 , and because the rifles are modular and comes with accessories that can just be snapped into place like a .300 blackout upper installed onto the lower or any other caliber, is the rifle against the law to swap uppers on a lower or add another barrel? The modularity of the AR style rifles allow for simple upper and lower swapping, is it against the law to do the swapping of components that changes the caliber of the pew pew?

I'm guessing there is no problem swapping our one upper for a different one in a different caliber, but to be safe, invest in go, nogo, and field headspace gauges to make sure you are good on safe pressures.

It is against the law to put a pistol upper on a rifled lower. But it's not against the law to put a rifle upper on a pistol lower. If you bought one with a serial number on it . If you buy lowers only. When you fill out the 4473 you have three classifications. Rifle, pistol, other. Always have them marked on a 4473 as other. That way you can interchange and swap anything you want. They just don't want pistol uppers on rifled lower

They don't sell them anymore. The websites that sold Polymer 80's and the Polymer 80 "completion kits" (The jig to drill the frame, drills and parts.) stopped selling them when the "Letter" was released. Is it possible someone had a bunch of these, doesn't really understand what they actually are, not a gun dealer, and still has them for sale? Yes but unlikely. All the folks "in the know" have stopped selling them except as guns, who need to be transfered via FFL and you need to get the background checks and fill out a 4473 on it too. No one is selling them now as just frames essentially. Polymer 80 sends you to a FFL you can have ship it to your chosen FFL after you pay them.

If the 80% frames that many have are now "firearms" all of a sudden, then would that not make it legal for friends to assist hands on in the transition from 80% operational to 100% operational? | know it previously was illegal to make and transfer a firearm at a "build party" but I can't find any verbiage where it's illegal for one person to help another person work on a firearm if the owner is present. Obviously "gunsmith" laws take effect if the firearm is left more than 24 hours or if someone is in the business of modifying firearms... but that wouldn't seem to be the case if someone dropped off a few lowers to be made operational at a friends, and then picked them up later in the day.

IF ATF's new frames and receivers rule is upheld, then Polymer80 and similar companies will be driven out of business entirely. If you have to fill out a 4473, why not just buy the fully built firearm? I sincerely hope the lawsuits will follow fast and furious, and I for one will be donating to GOA, FPC, 2nd Amen. I’ve never bought one of these kits. I have built a lot of ARs over the years. Buying a $50 to $100 lower is a sure thing, as milling out a lower always seemed risky to me because if you mess it up, you have a paper weight. So, down the road after they serialize these 80% lowers, what happens if I buy one and go to machining it and screw it up???? Does that number live on and have to be kept around to remind me of my mistakes till the day I die, or can I throw it away and get another? Can I get another with the same number or is the consumer screwed by having to get repeated background check for every oops???

I would assume like all firearms if an individual made an irreparable mistake during the manufacture it could be destroyed or forfeit. seeing as every "partial" receiver will be treated as a functional firearm another background check/transfer/etc would be necessary. it seems to me that the purpose of these rulings is to make partially completed parts obsolete by forcing law abiding entities like manufacturers and businesses to create a paper trail for the products. Like you pointed out, if someone were to go through the process of paying for a background check and transfer, aside from curiosity there is no point in purchasing a "partially completed" frame or receiver because they are now considered complete but with extra steps and expense for a layperson.

Concerning the Washington law. Keep in mind the date of release of each model. While the “space gun” version one was released earlier, the pf45 and the single stack versions were released later. I don’t know the dates, a cop on the street might not know the dates, but a prosecutor likely will. Your purchase records could reflect the possible timeframe of the build. That social media post when you were living in Texas during 2020, “just got my p80 today” and then you moved to Washington in 2021 with the same gun, may affect your legal requirements. I’m not an attorney, nor have I ever been to Washington so this isn’t legal advice, just my thoughts on the matter.🤔

What is required to serialize a frame? Is it just attaching (riveting) a metal plate to the frame with a number, like "ABC000001", that you make up or do you have to apply to ATF and be assigned a number.

As the manufacturer, you come up with your own serial number.

How much extra cost is it going to burden the consumer to have an FFL serialize these 80% kits and do all the paperwork related to that plus the background check? It seems to me it may easily more than double the cost for some of the cheapest bare-bone versions of these kits.

I’ve been hearing $50+ to engrave SN and &25 to $35 for background check and who knows what they will charge for the SN itself! Cheaper to loose it in a boating accident!

ATF does have authority to promulgate rules. Those rules must be consistent with the statute Congress passed, including the rule-making authority Congress delegated to the agency. Rules that meet those requirements are law. Rules that don't meet those requirements may be successfully challenged in court.
