As per Clause 10.5 of the concession agreement EOT ( Extension of Time ) will be given only in the following scenario (a) delay in providing the Right of Way of Construction Zone, environmental clearances or approval of railway authorities, specified in Clause 3.1 (iv); (b) Change of Scope (unless an adjustment to the Scheduled Completion Date has been agreed under Article 13); (c) occurrence of a Force Majeure Event; (d) any delay, impediment or prevention caused by or attributable to the Authority, the Authority's personnel or the Authority's other contractors on the Site;

All claims can be included in the monthly IPA's. EOT is usually a part of final account.

Sir, Can you tell us when is the right time to submit the EOT claim? is it just after the delay or just before the end of the project completion date? and what if eot is granted but than again another delay occurs will we apply again for the EOT?

Any claim should be submitted at the earliest, after the effect is known, a claim whose effect is of continuing nature must be submitted with a cut off date
