Before marriage , the parents should disown his son and also son should transfer all his property to his parents , and also son should enter into a rent agreement with his parents for residing in home, and also son should sign a debt instrument highlighting that he had taken loan of any amount for his education from his parents ( write very heft amount bcoz more the amount less the wealth less the alimony ) , so that in case of divorce and alimony proceedings the son will have to give much less to wife , as legally he has nothing but salary also he is in debt legally , and also wife can't claim the right to reside in alleged matrimonial home , since it is not matrimonial home legally its just a rented accomodation , also after all legal proceedings came to end like that of alimony divorce etc then after some time parents can make a will transfering all their property to either son or daughter , I think this might be a solution . Moreover , Prevention is better than cure . In this way the son can avoid such arbitrary matrimonial obligation which treats man as nothing but a atm machine

Amish what can you suggest me. I got scammed by someone who was impersonating as an army officer on 99acres. He talked me in a very hypnotic manner and my mind was all bloked. He said he was sending me rent for 2 months and it debited from my account. After this I realised what a big mistake I have done. I approached bank and told them story but I don't know what to do now. I am suffering mentally because my ego is now hurt. I am not an easy man who can be tricked but 😭

It all depends on the magistrate. The son changed the parents property to his name and sent them out of the house. The magistrate in my city (Pondicherry) requested the son to take them back, but he refused, so the magistrate changed the ownership of the property back to the parents.

One question...motherin law died without will(self😅 acquired). Fatherinlaw and husband will get equal share on house. Now if the son has dispute with wife and maintenance case is filled and after that can husband give his share to his family members like his cousin inorder to not pay the maintenance and how court will take this up

Hi Ameesh I agree that a newspaper notice per se may not have the effect of disowning, however how about a notice (newspaper) in addition to a suit to the affect between parent and son!! Will that not impact the claim to the right to matrimonial home or property just as the will limiting the son’s share when a maintinance proceeding is also lying in the court?

If the son chooses to marry a girl against his parents wishes, disowning him and thereby indirectly his future wife, right before marriage, will in all probabililty help the parents refuse entry to the boy and his wife to their personal home which instead might save them from getting involved in future marital disagreements, hassles and litigation between the boy and girl , keeping the old couple away from legal harrasment from slow indian courts. I am no legal expert but i have personally seen this being used effectively in one case from very close quarters. Thanks for the good work Amish. Hope you read and respond to my comment

Getting so many ideas for how to save the property of parents it's really bad. First of all finish the root cause of these disputes. Your son or daughter both are damn adults ask them to step out of the house and make ur own life stop depending on them and be a burden on parents. Parents property is something in my opinion is bonus for a child not a only option. I have seen so many people around me who are not ready to develop or make anything for themselves by saying why should I make my own house since my parents already have house and money. A damn 30 year man is dependent on his parents and same goes with a women who is getting depends on either father or husband is pathetic. Make ur own damn life be stable and then talk about marriage 🙄

Interesting.! As you said, even I don't see how disowning the son in the middle of his dispute with wife would help. About doing a well before any of that happens, that would depend. If the son continues to live with them even after they post that ad, well then that's of no use. But if he lives away and has absolutely no or just a for the sake of it relation with them, then it might help. Anyway, how the magistrate looks at it is beyond anyone's imagination. While opposing a ln Anticipatory Bail plea in a 498A matter, I saw the Sessions Judge's demeanour change multiple times during the proceedings.

Are you 'quite certain' or are you (backed by legal jurisprudence) '100% sure' that a living parent would still be liable to add to the 'networth' of the 'allegedly' disowned child? . And if so, does 'only' property (assets) get devolved¿ or logically speaking, the liabilities too pass on to the.. (for the lack of a better term) heir? . . And what if the child denounced the family/HUF/monarchy? What happens then? Like that British grandson of some/present Monarch .. i think he and his then recently wedded wife had declared themselves as separated from the financial and property aspects of the monarchy. . So are you implying that if (hypothetically) the Criwn pays reparations to its previously occupied colonies... would this prince or whatever.. still be as much liable to the stakeholders? Would the disassociation declared by the child .. from her or his family still make the person's opponents (plaintiff) set claim to/ have legal remedy to the property (assets)?

You are wrong, read laws she can get all the things if her parents died and she had no brother. Second what you are saying is will, in my case my grandfather has 3 sons no daughter. What he did was he made a will that my father and one of my uncle will get money and my other uncle will not get even a single penny so that thing depend on your relationship with your parents. Third why should women get any property from husband like why, she should get alimony, child support and house. When you divorce someone you have to leave all or most luxury, this notion that men have to maintain the same luxury is total bs. If you leave a job you don't get benefit all your life.
