She was so brave to have an open casket which I think woke a lot of white people up to the realities of what was really going on in the south at that time. I keep wondering. Knowing that murder has always been illegal, knowing that the last documented lynching was over 40 years ago, is there any real, practical difference in this law? Lynching is a very explicit definition in terms of legal definition so technically lynching could be considered murder but lynching in the legal definition is considered extrajudicial killing so technically people who have committed lynching technically doesn’t get arrested or sent to jail like it sounds absurd but it’s true so having a explicit definition that says lynching is murder and ensuring that it is on the federal books would make prosecuting lynching much easier since they would be convicted of murder anyhow but killing someone without judicial proceedings is still illegal.
