I have pre-paid legal service. If I encounter the police I just call the emergency number and get an attorney on the phone. Then the cop gets to deal with the attorney. I've had to use it a couple of times and it's amazing how the cops back off when they realize you aren't venerable and powerless because you can throw a lawyer at them.

As a police officer I can say is I like these videos. All I want is cooperation when I stop someone. I don't start off with a bad attitude and as long as the person is polite and lets me do my job, goodbye with a warning, unless you have a warrant. Know your rights and just let the cop do what he has to do. Just please don't ever argue, it NEVER works out for you.

***** it's true. They will pull you over for nothing sometimes and make up some bogus excuse. They pulled my sister over saying she was speeding, when she wasn't, then kept her there for an hour and then without her consent searched her car. I'm not saying all are like that but the majority of them yes.

One of the biggest cop outs I hate to hear from people is "I have nothing to hide, so I don't mind letting them search my property or talking to the police" Okay, great. You're a law abiding citizen with nothing to hide. That's perfect, but it's still not an excuse to let other trample all over your rights as an American citizen. Stand up for yourself and be assertive.

You are partially correct. The Supreme Court ruled, in a 5-4 decision, that the use of a dog to search your property requires a warrant or, otherwise, it's considered trespass Cars are not, though, as inviolate as a home is.

I would be interested in knowing if refusing searches and refusing to answer questions will increase or decrease the probability of receiving a moving traffic violation citation as opposed to just receiving a warning.

I am not an attorney, so this is just based on what I've heard and on my experience... It all depends..Indeed it is up to the officer to issue a citation, but i know (at least in most states) he can't use consenting to a search as a "this for that" kind of bargaining chip. Personally, it all depends. I've never been (except once) outright rude to a cop on the 5 times I've been pulled over, and to date I've only got one non-moving citation. But don't mistake for me not looking out for my rights.

I think it is also really important to remember that cops are people too. There are good ones and bad ones. Most of them are just trying to do their job. If they are being cool then don't give them a hard time just because you can. That being said everyone should know your rights and how to protect them.

@TankBeefy same thing applies. They need probable cause to search your stuff. But if they have it they are not going to ask you. If they have to ask then they probabaly dont have probably cause and you can refuse. In fact verbally refuse in all situations just to be safe.

i don't drive a lot as a matter of fact i don't even have a car xD but when i go out with my brother or my sister and we get stopped by the police they are always polite and nice, and ask questions nicely if they are not nice with you and keep asking question that means you are not being helpful, or there is something suspicious and if you argue with them you'll just make it worse, unless you have all the time on you can spend with them, and the court.

Once while resting at a REST AREA, a couple of cops tried to get me to let them search my van and trailer. I said no and one cop said, "If you have nothing to hide why would you mind." I said: "I'll tell you what, let's go over to your house and have a look around. If you have nothing to hide, why would you mind, right?" The other cop started laughing and they both left.

Due to a recent Supreme Court decision you can't just remain silent during a police encounter anymore. Now you have to specifically invoke the 5th Amendment before you remain silent. If you just remain silent your silence can be used to incriminate you in court.

@StevenE1972 Have you read the whole conversation? I am having trouble figuring out what part of it you are talking about because I explain that you let the cops do want they feel they have to. Then in court you settle the problem by not tagging the car your not give ownership to the state and no license means no contract in court if you have no legal binding document then they have no case. They get you by registering witch transfers ownership to the state then you have to contract to drive

There's quality on Fox, like Judge Napolitano and John Stossel, but there are exceptions, like Gretchen Carlson saying emphatically with a straight face, "If you have nothing the hide, you shouldn't have any problems with any searches."

@TheBb1233 No, it does work. I've seen video's on youtube, and you can always bring it up in court that the cops detained you without cause and you might have a charge thrown out completely cause of it.

I drive a red 89 red ZR-1 corvette. I didn't even know about this video when this happened to me, but I was pulled over for my headlight being out. He didn't say that at first he asked me "why did I pull you over". I asked him if I looked like I worked for the psychic friend network, you tell me why!!! He asked if I had any drinks tonight, I replied I am not at liberty to discuss that at this time, and he got pissed off at me.. His face turned red and he just walked back to his car...

I had a New York State trooper pull me over because of a missing front plate, he asked if he could check my car, I simply said no and that I have the right to amuse he has no right to check my car. He actually got testy with me and wore my patience thin. He replied that he thinks I might have drugs in the car, I replied I think you might have crabs, but it doesn't mean you do. He flipped out, but knew I was way too smart for his tricks and let me go.

@TheBb1233 Not sure what kind of encounters you've had bro, but I've always had quite polite encounters with police, even going excessive speeds (15+ over speed limit). The trick I've found is simply staying calm and treating the police officer as though he's an equal. You won't believe how many "warnings" I've received when answering an officer's "Do you know how fast you were going?" with "I was going 47mph. Is that an unsafe speed for this road?" Pt 1

after educating myself I won't even give my license w/o asking if it's a request or demand. If request I respectfully decline. If demand I say "ok but only under protest and duress" that way there is no joiner and no contract which can help when fighting the ticket. Thinking about getting an IDP and foregoing DL all together. Yeah Buddy!

If asked to exit your vehicle, be certain all windows are up and LOCK THE DOORS. If you are pressed to allow a search, just say, "I've heard horror stories about police dumping stuff out and making a mess. No thank you, I don't want anyone messing up my stuff. No search."

@TankBeefy Cops can ONLY do a pat down to determine if you have a weapon, that's it. They might seperate you from your backpack during the interview, but they're not allowed to search it unless you let them. Just remember these words "I do not consent to a search. I do not answer questions without a lawyer present. Am I free to go. Am I being detained". Anything else, even yes and no questions could implicate you in a crime you have no knowledge about.

Plus in the event that the cops do find contraband.. the judge will usually side with the police. Judges arent going to say.."here have you drugs back -- you didnt consent to a search""

@18wheeler76 I only know of what people say they have done, but when My tag runs out on my car I plan on giving it a try still doing a lot of research on it to make sure I have all my bases covered, Like the fact that we don't have a real title to it if you look close at the little dot on it you see it has VOID in 4 or 5 places plus it is a Certificate witch is a copy not the real thing and the state issues bonds against the real title then charges us tax (rent) on the use it is crazy :)

The thug called for back up because he felt like I would be a problem. Over a small light over my plate. I would be a problem was the excuse. I am 56 years old was 52 then. I refused a search I was trying to go Home. I got a ticket for speeding, crossing lanes, and never for the light. I have since been stopped a few times over the past few years and have never had a respectful encounter from any officer. If we go to war it will be open season!

I dont mind people smoking weed or "harmless" drugs, its offen their own choise, but it ends up ruining their own lifes. Weed is a huge business, and people DOES get hurt behind the scene, so even if you think you dont do anything wrong by this "little weed" its probably hurting as collateral damage elsewhere, that does make it wrong. Sometimes I drive a bit faster, does it harm anyone? - not really, but the chances for a crash and killing people with the car is higher, so its illegal.

By getting a driver license and driving you are saying in the eyes of the law you are in a commercial business but if you are traveling in your automobile that are a private thing and they do not have a right granted to them by any law to stop you period.

Know your rights! If you've done nothing wrong you will (probably) be OK. At least give your lawyer something to work with. If you consent to a search, without protest, your lawyer cannot even try to throw out the evidence. If they need to ask they don't have probable cause. If they HAVE probable cause they are going to search without asking. Know the difference, know the 4th amendment. ALWAYS be polite, but say NO if asked...

Here is why. The founding fathers knew the government would, as soon as it could garner the power, start making thing after thing illegal. Anything that could be converted into a commercial crime instead of taxing, they recover the taxes by arresting you for the non-crime it makes more money. The reason for the right to privacy, is that you can do ANYTHING you want, illegal or not, as long as it doesn't bother anyone. As long as you are civilized and don't provide probable cause. Think about it.

when a cop pulls you over you need to get out of the car and touch him on the chest to show him you aren't afraid. if the cop gets upset don't be afraid to yell to show the officer you know your rights and won't be stepped on.

Just remember how much easier things could be if people just said "ok, take a look" and shows there isnt any reason to worry about bombs or 20kg kocain in the trunk. and off you go with your life and the officer is happy that you cooperated.

@chaseme81871 There is absolutely nothing illegal about the police using a K-9 on _ANY_ car, as it is neither a search, nor a seizure. Any scents or smells that are leaving your car are not subject to privacy. The same thing applies with anything that the cops can readily see in your car (in apparent view). The exception is, that holding you there until a k-9 unit arrives requires them to respect the rules on detainment.

"You don't speak unless I ask a question" -- probably the only smart thing a cop has ever said. You NEVER volunteer information to a cop. Answer yes and no, and that's it. (most people say "yes, sir" and "no, sir" but I refuse to give them any sort of respect, as they're just bullies)

@18wheeler76 ok in court first no tag means they don't own it and the license means there was no contract saying you would follow their stupid rules. all you have to do is prove to the court you had no contract with the state to follow their rules and that the state does not own your car and you take away any power they have to enforce the rules on you.

For exmaple if a cop is giving you a ticket -- that isnt an arrestable offence. however you are being detained because you arent free to go until the officer has finshed writting the ticket. And of course they semply need proable cause -- they dont need to prove beyond reasonable doubt before arresting someone

Police only need probable cause to search a car -- they do NOT need a search warrant. ( unlike searching your house) Otherwise as you pointed out -- if they really needed a warrent to search.. you would be detained until the cps could get a warrent which could take hours..

I KNOW there should be a limit for what they can ask, any request must be in respectable limits. But popping the trunk an let them glaze for a moment, is really not something that will destroy our lives. Turm it around, I think anyone who reject a minor search like popping the trunk or showing the police their ID, is, by doing that. being suspicious. Like small chieldren, ask them what they are doing, if they reply : "Nothing" then they usually are up to somehing bad or wrong. then you go look

But back to earth, the police´s requests should be fair, and people should just comply with a smile knowing that they make it easier and does make the tropper happy, and you know you did a good thing today. Ive been stopped 5 times for minor traffic violations, but being polite and cooperative, I did not get any tickets. I guess someone being a jerk would get the ticket, but he was lucky that he could refuse a search of his emty trunk.. stupid right?

Am I being detained? Am I free to go? I am invoking my 5th amendment right, I am invoking my 4th amendment rights, am I being detained ? If free to go, leave. If not, I invoke my 6th amendment right and repeat 5th and 4th as needed adding other amendments in necessary, And most importantly say NOTHING ELSE, speak ONLY to a LAWYER.

A traffic citation is considered an arrest, even if you're not taken downtown. "Detained" is an impediment to your progress or movement which is still a violation of the Constitution. Also, cops writing tickets is an invitation to contract, decline, tell them you're not for hire, and hopefully present them w/ an affidavit that affirms yr right to travel unmolested anywhere as long as you don't harm anyone else. Cops are revenue generators, NOT peace officers.

Ok, I see you really still didn't understand. Let's say I'm not opening the trunk because it's full of weed and I plan to sell and use it privately. Not publicly, which would be commerce...(IE advertize and make available to the general public), but privately which isn't commerce. So I'm not opening my trunk. It's stupid to prosecute weed offenders. It's only done to boost the pharmacutical industry, who sell poison. SInce I'm not breaching peace, or causing complaints, I'm NOT a criminal.
