When I was 14 years old my dad suffered a massive heart attack. 60 percent of his heart was destroyed. My dad worked faithfully for same job for over 30 years and was a WW2 vet but several Drs told my dad his days working were over. There was my mom, my dad and four of us kids still living at home. SS disability repeatedly denyed my dad and for 2 years we barely survived. I thought the stress alone was going to kill my dad. We had no food , no utilities. If it wasnt for Catholic charities and salvation army we would never had made it. Dad suffered from horrible angina attacks and depression during that period. I am 48 years old and learned from an early age the corruption and disregard for people the government and judges have. Thank God he finally won his case only to find out a couple years later he had terminal colon cancer. I lost any and all respect for judges and the government after how badly we suffered and still consider that period of my childhood horribly traumatic.

Unfortunately people deal with this everyday and the government doesn't care and it all depends but you literally got to fight tooth and nail and it's a long drawn out process sometimes when it shouldn't be that way because everyone's case and disabilities are different. We had same problem when I was 8 year-old an I had 4 brother from 15 to 3 year old thank god for good neighbors for food they would put food on porch for us this was back in 1968. Great people never forgot them. That was in Herrington ks.

My hearing which went great was 10 weeks ago, still haven't received my written decision, after around 2 1/2 years of this ridiculous process it's extremely frustrating this is how you're treated after working hard your entire life paying into the system that's supposed to be there for you when an unfortunate medical tragedy strikes. we could do better.

I agree. I just read today that the average wait time for a decision is 78 days, up from 56 days just a few years ago. The judge sends the file to a writer out of state, who drafts the decision and sends it back . Seems like an inefficient system to me.

Get registered at the My Social Security website because subtitles seem to show up first there. Your lawyer may also know first since SSA seems to contact them first. However, lawyers’ offices WERE/are closed due to COVID and many lawyers are working from home. So you may know something before your lawyer does. Also, the US Mail has been slow due to COVID, but you may see small changes on-line at MY SOCIAL SECURITY that hint that something is happening. For example, it may say they have received your info and are reviewing your request for disability benefits and then you may see a date for funds to be deposited, etc. one guy I know woke up one morning and checked his bank account as usual. The SSA had deposited thousands in his account...then he checked MY SOCIAL SECURITY and saw he had become eligible for disability benefits and Medicare with a Medicare number given him to use with a retroactive date for MEDICARE Benefits.

My hearing was September 28. I was prepared to spend 45 minutes with the Judge but it was over and finished in just over 10 minutes. I'm so anxious it's difficult to focus on anything. Is it favorable or a disaster that I was in and out so quickly? The Vocational Expert did state that I wasn't able to perform work I'd previously done in the past 15 years. I had prepped for over an hour with questions I would be asked by the Judge but that didn't happen. I'm stressing and that makes my condition (COPD) worse. I need prayer...

Elise White that is exactly how my attorney worked with me. Every communication was through the paralegal, I spoke with my attorney for 25 minutes the day before the hearing, and I finally met him face to face 10 minutes before facing the judge. I wonder how much his fee will be, I'm sure there are hours of work obtaining medical records, communication time with the paralegal (maybe 5 - 7 hrs) over 18 months and the 50 minutes at the court hearing...good luck Elise

The government doesn't care what you loose or how you survive, not trying to be mean but so many people have lost there homes and they're belongings and i wish i was wrong but I've heard so many stories and so many people are in need and in the same situation so they just don't care because they say they don't have the resources to help everyone and it's really sad what people go through it really is. My ex husband fought with social security for years because he had strokes and other health issues and he was able to go to his hearing but the sad part is by the time he found out he won he passed away and that's just not right at all.

Iam 39 years old and have had 10 surgeries in 10 years. 6 surgeries on my stomach total. As far as my medical records is concerned my disability is undeniable. I went to my hearing and the judge immediately interrogated me about marijuana use which Iam not a smoker. He said he saw on my files that I said I smoked daily. This interrogation process went on for about ten minutes. His demeanor was very aggressive which threw me off because I was not expecting this. Although I've been through alot medically my physique looks athletic because for years I was a powerlifter prior to my pathology. The vocational expert said I could no longer work at jobs Iam accustomed to but I can be something like a mail clerk. My lawyer then stated that I would miss considerable time at work and would be subsequently terminated and the expert agreed. Is this a good sighn?

Your lawyer will always ask questions that elicit a "no jobs" response from the VE. The question is - what is the judge thinking.

HI I received my unfavorable decision on Aug 3, 2018. Hearing was Apr 26, 2018. 3rd denial, same judge and same attorney as before. I don't know what to do besides file another appeal. If I'm granted another appeal I will probably have the same judge. My attorney didn't tell me I was turned down and have not returned my calls. I don't know where to turn. I was told that Georgia is the toughest on disability claims. I do know there are long waiting period. Don't wanna put my health on KZbin. However I still feel I'm being judged roughly due to my high level of education and my age (46) oh and my damn good build and looks. I use my cane because I'm afraid of falling. Well just a couple of my issues are hypoglycemia and diabetes neuropathy my left leg and foot swells a lot because most of my weight goes on that side because of my right side. I'm still not believing this I'm swole now and definitely in pain now worse because of my results. Please help me if you will and give me some insight because I don't know which way to turn. Thank you

Judges don't actually write the decisions. The written decision in your case will be written by a Social Security staff lawyer in a central location near Washington. Once the draft decision is written, it will be sent to the judge for review. Assuming no revisions, that process can take 1 to 4 months. Frustrating for all.

I don't know what all that means. You do have 60 days from the date you receive your denial to file an appeal. If you lost at the hearing your next appeal would be to the Appeals Council (or you can start over). If you can't get your lawyer on the phone, I would reach out in writing - either email or letter. 60 days is not a very long time.

It means that the judge felt like he or she needed more evidence to decide your case. THis is not inherently a good or bad thing. It depends on what the evidence shows.

If you are pursuing disabled widower's benefits the evidence needs to show that you became disabled as of the date you turned 50 and that your disability began within 7 years of your spouse's death. These are the technical "non-medical" factors.

I have not seen any statistics to back this up but I do suspect that it is easier for the decision writer to draft a favorable decision than an unfavorable one.

Tj Wakefield that's not true it took 3yrs to for my husband's SSDI to finally get approved. He lost his hand on July 4th 2014 and has mental illness he was denied February 2015, his attorney appealed then they sent him a letter for a video monitor hearing his attorney turned it down she knew what was best for his case. Then in November 2016 we seen a judge his attorney never met him so she was unsure of the questions he'd ask she said he's new and he's a tough judge his ratings for approval is 20% favorable. I think attorneys know how the outcome would be based on what questions? It took another year for the judge to make a decision and today we found out he was approved. God is so good faith and praying always favors you!

The initial application and first appeal (request for reconsideration) are decided by non-judges - employees of the state agency of your state government. If denied at recon, you would request a hearing and go before a federal administrative law judge. About 1/3 of claims are approved at the initial application. Those that file a recon appeal have about a 10% chance of winning and those who appeal and go to a hearing are approved at about 46%.

I was denied in the first time because I had over 2 grand in the bank - on the hearing over phone they told me I was denied because had too much money in the bank is that normal / then after a year was appealed and they told me if I have more than two grand in savings account / I had less than 2 grand this time and they told me I have a good chance of getting it - they wanted to check my medical before they made a final decision? In an SSI case your income and resources can disqualify you. In an SSDI case, your bank account balance has no bearing on anything.

Jeffery, understand that the VE is only answering questions posed to him/her by the judge. Some of those questions include only mild limitations and will result in answers that identify jobs. Other questions include a more severe level of limitations and will result in testimony that there are no jobs. If the judge asks only one question and the answer is "here are 3 jobs" that is not a good sign. But judges rarely do that. The better question to ask: which of the judge's hypothetical questions represents what the judge is really thinking?"

My hearing was December 4th I received my written decision fully favorable December 11th my lawyer said it should be a few until social security sends me a letter then I'll have to contact them so I can give them my bank info

The judge asked the VE just two question both the Ve said NO! about me working my old job or any job. My lawyer didnt say much after that he seem very pleased...That was two weeks ago in Atl. The hearing office siad the judge already made a decision to my case is that a good sign or bad? i mean i been praying for a shift yes but yikes that was fast! please give me your input

I filed for ssdi and ssi my hearing was 8/25/2017 I had my 3rd heart attack 8/28/2017 online it says ssi denied. And for ssdi it says under review a medical decision was made...what does this mean

Social Security Disability videos it says appeal under review a medical decision was made and we are working to process your decision and a rep may contact me for additional information. Dated 1/23/18. I applied after my 1st heart attack 12/2015,denied 5/16 appealed second heart attack 1/2017 denied reconsideration,6/17 appealed got hearing date 8/2017 judge got all my records had to 3rd heart attack 3 days later, notified them and turned in records . I'm confused. Does this mean I will be denied ssdi also

What happens when the Vocational worker, finds two jobs? Then when the judge asks the hypothetical question the Vocational worker says, no there wouldn't be.

Some judges ask a series of hypothetical questions to the VE. Depending on the question the VE may find one or more jobs. One of the questions that the judge asks will represent what the judge is thinking regarding the claimant. The problem is that we don't necessarily know which one. I will also tell you that many judges will ask a question that assumes all the limitations set out in testimony (in other words "if I believe everything you said"). That question may or may not reflect what the judge has concluded. Bottom line: you want the answer "no jobs" but I feel most comfortable when several of the judge's questions result in "no jobs" testimony.

It means that SSA has reviewed the medical information in your file and made a decision about whether your impairments prevent you from working. Now they are looking at the non-medical factors - do you have enough credits? are there any offsets (in an SSI claim)

@@ssdattorney i know but im 54 worked over 25 years ...been in nursing since 1985 lord have mercy my body is done i been diabetic since 1989 a host of other stuff and now my back is so damaged from lifting i have central severe stenosis degenerative disc disease and herniated disc with neuropathy severe and radiculopathy in right leg lord i want to work so bad made good $$$ but my dr says no more ...i fall from lack of balance so depressed im praying i get what i deserve cuz i did work alot the last 20 years at the same place ...
