LOL, it's what brings in business. And he didn't give anything away. The real benefit is in reacting to individual cases and doing the bureaucracy. I can understand why Winston promotes the biggest firm. The boss is a foreigner, and what's the point of promoting small firms? Chinese ones will probably try to rip you off, too, and small foreigner ones might not have the reputation power to work the way the system moves. Besides, this was mainly about business startups, and you should be able to afford a good lawyer there.

These blood sucking lawyers can't suck anymore blood from the western world, too many competitions, so now they set up shops in a new unsuspecting world, CHINA!... soon every Chinese will learn and be suing McDonald and Burger King for making them fat!... suing the owners of any property because they have fallen and got hurt in the owner's property... lol... leave it to the white people to show and pave the way for the world to be a deviant.

@ 11:30... Winston, thank you for pointing out the wrong doing by these folks in China, very valuable information. You have talked about this subject, Chinese cheats and lies in many of your other videos, to make everyone aware of it. I am sure it will be very helpful to many foreigners. I absolutely agree with this idea! However, taking advantage of people can also come the other way around. What about giving advise about what the Chinese should be aware of from a foreigners in China. You lived there and saw how foreigners in China behaved, but you have never mention this, not even once in any of your videos... wouldn't it be great to have lawyers that would deals with these foreign cheaters and liars as well? Here is a story, let say... a foreign Namibian cheater who tricked and married a Chinese girl in Hong Kong, lets named her "Vodka-Girl", so he can have residency in Hong Kong. He then convince her to give up her life and career in Hong Kong and move to China so he can pursue his fun and endeavor while living off of her hard earned paychecks. As a loving wife, she gave up everything for him, found a new job in China, and does everything he wanted. One day while working in a part-time job, he then befriend another Chinese girl in China, lets named her "Natasha", who has a better career and by her external extremity is a little bit better than Vodka-Girl. So he decided to secretly pursue her and have an affair with her as his secret mistress, which is common in China. Natasha, by her deviant morality, knew he was married and it was a wrong thing to do but decided to pursue the relationship anyway. Knowing that a woman stealing another woman's husband is frown upon in the eyes of every Chinese citizens because they have names for such women... 2nd wife, lower wife, smaller wife, spousal thief, etc... So she wanted to keep it a secret as a way of "saving face" and still get what she want, just as how westerners would say "It's only cheating if you get caught". She will only come out of the hole and into the light when the coast is clear, let say after the divorce? So they decided to secretly meet often and their deviancy was discovered by Vodka-Girl. Vodka-Girl, in her anger and confusion, doesn't know what she did wrong. She loved him so much that she gave up everything for him, decided that fleeing back to Hong Kong was the only way to separate them by having him following her back to Hong Kong and save her marriage; and the vow they both made in a catholic church... for better, for worse, for richer, for poorer, in sickness and in health, until death do they part; but he didn't want non of that since he already got all that he needed from her. He wanted a divorce and she didn't. He already found his next salvation and has already has plan to marry Natasha so he can have residency in main land China. His only way of force-divorcing Vodka-Girl was to be separated from her for 2 years, as described in at 8:30, otherwise it would have been very easy for both of them to get a divorce. In the end, he feel he didn't do anything wrong because he found his salvation at the expense of Vodka-Girl, Natasha feel it was the right thing to do because she is got what she wanted and is happy with her stolen husband, and Vodka-Girl is damaged and lost everything. Western: Once a cheater, will always be a cheater. Once a thief, will always be a thief. Asia: Same heart, Same soul... Actions will repeat. Winston, wouldn't you agree that China should also have lawyers to help and deter these foreign devils?

A foreigner taking on a Chinese organization or individual in China is pretty much a hopeless battle, in China the state always gives preferential treatment to its own citizens but this is definitely one of those good to know informational videos

Marco knows Afrikaans, Chinese, Dutch, and Spanish (according to his linkedin). Pearman-Parish does sound pretty British. If he is British, he must have spent some time in South Africa. He probably studied Spanish.

Yeah never sign a contract you can’t read. They try that to me once in china, I ask for a copy of the contract and translate it in my own language, and they won’t allow me to do that, So i walked away.

sign it, but put someone else's name. if things go wrong, and when they say you sign the contract, ask them to show the contract, and when they do, tell them, that's not my name on the piece of paper.

Then you get sued for fraud and get thrown out(Of whatever you signed for) :)

well, if things go well, no one will be the wiser. if things go bad, you are already screwed, but you didn't sign the contract with your name, you are less screwed, compare to if you signed your own name. they can't sue you for fraud, because there is no evidence. you will be thrown out either way.

The signature is still made by your hand.. so they should be able to trace it... if not you upholding the contract for the time it was working and got benefits out of it.

I always like you're videos, but this one in particular was very well done! We got real incite on a big time law firm in a country where (I'm guessing) most of your watchers know nothing about the legal system. This wasn't some random mom and pop lawyer duo, this was was very legit, and I feel like I learned a lot while being entertained. Keep it up Winston!

I heard from a Taiwanese gentlemen that corruption in main land China is so bad that he was forced out of business. He speaks the language plus he has no visa complications. I would not recommend anybody who has no local connection with local officials to even try opening a business.

I wish a friend of mine would have seen this video prior to going to court for an issue that wasn't his fault. Two years ago, he got a call from a Chinese friend of his who was drunk. This friend called my friend in the middle of the night asking for help, so my friend went and got this person and brought her to his home. The next morning when he woke up, she died from alcohol poisoning. The Dongguan police confirmed that there was no foul play on the part of my friend, therefore no crime had been committed. The girl's family sued my friend and the cheap lawyer that he hired really didn't do much to help him. He ended up having to pay the family 150,000rmb, because the girl died in his home. I believe if he had a responsible lawyer, maybe things could have ended differently for him, but since he is a foreigner he really had no protection.

This is probably the most useful and unbiased information ever. It is because it comes from a lawyer who professes in the Chinese law. Having said that it is very sceptical to hear from the author especially things relating to law in Chinese.

I'm a lawyer in Ciudad Juarez, you will NEVER have those kind of problems if you open a company here, if you do a joint venture, if you hire a local company to produce your product, plus everything including labor is cheaper in Mexico than it is in China. Also what we do is we make our contracts in both english and spanish, two columns in the same page each one with a translation of the same contract, that way there is no scamming from either side.

I happen to know this, it's basically any properties bot during the marriage, does not matter who paid for it, belongs to both of them. but properties bot before marriage only belong to the person who bot it. now if you have kids, things get more complicated.

Not trying to be anti-China, but the more videos I watch (and other than the adventure of being in a radically different culture), legally speaking, there seems to be no real upside to being a foreigner living long term in China. I still would like to visit China one day, but right now, China really embodies the old adage of "A nice place to visit, but I wouldn't want to live there!" The USA may be a litigious society and have many faults, but at least one has far more in the way of legal recourse, should someone wrong you. No offense intended to any fellow Chinese subscribers, but China has a lot of maturing and catching up with the West, in that regard.

Warren S., yeah, I really wouldn't say the USA is more mature than China. Naturally they are good at hiding their immaturity to themselves and those they culturally indoctrinated. And they also benefit from their illegally amassed wealth to put themselves on a high horse. The USA, with the same mindset it has, but no imperial military conquests having happened, might look a lot more like China does now.

Depends on which way you look at it. An acquintance of mine is wanted in the US for several counts of attempted manslaughter for years. What did he do? In 1981 he drove past a bus that was parked. Turns out weird American laws state that if a schoolbus stops, kids should be able to run over the road like morons, and if you don't immediatly slam the brakes in panic and stop fully, that's the same as trying to murder ALL the children on board. Not wanting to be persecuted under such vague laws he paid a bond, fled the country and has lived normally ever since. The US filed several extradition requests, all of which were thrown out of court based on what he did not being a crime and the lack of a fair trial. What protection does he have? None. Not to mention the many circumstances in which insane murderers are allowed to attack and even murder you with full immunity from justice. China may be a lot of things, but I doubt you can walk up to a foreigner, shoot and murder him and go "Yeah, I felt a bit scared, so totally justified to kill him" and Chinese police going "Yeah, it's cool bro, you're clearly a real patriot". Chances are that a high profile killer would go for a ride in the execution van...

I use this law firm down in Xiamen for all my visa issues and company issues. A very good (excellent) firm. I highly recommend it for all Americans for any problems or questions you may have. Do not sign a contract before bringing a copy to this form (a note for all you ENGLISH teachers at EF, Meten , New Oriental and others).

Half a year ago I nearly signed a joint venture business contract. Didn't felt right so I didn't do it, I'm glad for this video clearing it up a bit. I thought that foreigners never have a chance in the chinese legal system, too. Thank you Winston keep up the great work

My employer (a university) owes me a plane ticket reimbursement from June 2017, which is worth 1.5 months of my work. Every month since September they've been like "we'll reimburse you next month..." then it's "next month," "next month,"....etc. There are 3 former teachers who ended their contracts in June 2017 and are still waiting for reimbursements. Idk what to do.

Yeah? Idk if this is a "lawyer-type" issue or if this is just an "employee-employer" relationship kinda thing. I guess I don't understand why a lawyer would be needed in a scenario where money is clearly owed and one party isn't handing over the money. I have no experience with lawyers or anything of this sort. Our contracts do not say WHEN the university should pay the reimbursement, so I have no grounds. The contract is extremely vague.

It is still unclear to me how using law to protect yourself or your hard work in China is of any value if no one really follows the law and there are seldom consequences for breaking the law. Especially with trademarks and patents. I like the coffee shop in their law office using the upside down Mercedes Benz logo.

As someone who is currently negotiating with the UKIPO on a patent pending product with registered designs, trademark etc here in the UK I had pretty much ruled out Chinese importing due to the chances of being immediately knocked off/copied. Thanks to this vid I know which firm to get in touch with to get the IP protected within the Chinese legal system should I not be able to get the products made cheaply enough here in the UK - Cheers Winston!

Make sure to have a paper that provide the house or apartment is a part of your postnuptial properties when you buy it. If the girl's family demand you to buy it first, make a prenuptial agreement for this.

I wrote my own Chinese Contract before going to work for a Chinese company right after graduating & they made almost no changes & signed it very easily. I didn't realize until I was in China that even though it was all signed & notarized that I had NO WAY of enforcing the contract. They basically laughed at me & didn't even bother to negotiate. Fortunately I had done my homework properly &was with a reputable company that took good care of me. So my advise would always be to observe & approve of the people FIRST before thinking "well I can enforce it through legal battle" - and NEVER go into business with people who are too thirsty, a fair amount of ambition but high intelligence is what I ended up with as a boss & I recommend that over someone who is extremely ambitious. LONG TERM - that's gotta be your goal.

You dont need lawyer in China you need money and you can buy your way inn and out. Pay the judge and you are good to go.

Great info. Websites for finding a " Chinese wife" suggest you never marry in China, but go through the process to document your relationship there, then apply for the lengthy Marriage or Fiance Visa (in the US). You go thru a law firm and the US Embassy to get processed, wait 6 months, she visits you in the US for 90 days and you either get married or not. That means the marriage is subject to your home country laws, not Chinese laws. As for foreigners, I would only suggest using a law firm that has foreign business relationships in your home country, so you can deal with them in either country.

There is no telling what kind of situations might arise where a lawyer is needed. Especially in China, but obviously -- even in the West. Entrepreneurs often take the easy or cheap route and it gets them into trouble. Thanks Winston, for a great video.

So...I just watched the video "what happened to beer girl?"...and because I'm kind of new to the channel, I had no clue who she even was. So I decided to dig a bit and watch some old videos you did with her, tasting beer and what not. followed by some more recent ones with your current wife, like "My Chinese Wife LOVES America!"...MAN! you are so much more happier, I can see it in your face and mannerisms!
