Been paying for about 3months under lease-to-own condo unit in Cavite. However, hindi po namin malipatan yung unit dahil walang siguradong internet na gagamitin sana dahil work from home. Habang nakatira po ako sa bahay ay nagkaroon po ng mga issue yung bahay (katulad ng pagpasok ng tubig sa dingding/flooring dahil di po nawater proofed ng maayos, pati na rin po pagpasok ng tubig sa bintana). Hello, can i file a formal complaint po against a developer if initially yung offer nila pwede ipasok sa pag-ibig or bank but after paying the entire downpayment, ilang months after ko pa nalaman na kaya pala hindi nila ako maupdate is wala pa silang accreditation sa Pag-ibig. After series of follow-ups, sabi nila pwede ko ipasok sa bank but with higher interest rate and shorter payment term. Hindi nila ako mabigyan ng definite na sagot sa mga questions ko so i decided to get a refund. They were telling me na may mga magiging deductions, i wont get the reservation fee, bayad monthly sa agent and all, but I told them since misleading yung offer nyo, wala dapat akong maging deductions. I told them na labas ako sa usapan nyo ng agent na nag-assist sakin and ang pinirmahan kong contract is between us, buyer and developer. Now, my problem is antagal ko na po nasend yung formal request for the refund pero as usual, antagal nilang sumagot and walang mabigay na timeline kung kelan nila ako irerefund for the entire DP. Lagi lang pong sagot is nirereview pa. Ano po kayang magandang gawin sa case na to?Hope to hear from you po. Thank you in advance!

Hello maam. I would like to ask some advised from you. Last 2018, I availed a lot for installemnt basis. Fortunately, I paid the total price of the lot for just 2 yrs. But then, When I went to the office of the developer to asked some update they have told me that the subdivision lot which I bought was cancelled kasi mag problema daw sa road right of way. Now, I wanted to get my full refund but the owner and their staff is kept on ignoring me til they told me that they will pay my refund money through installment basis also for 10, 000 pesos every month, which is a big stress for myself. I didnt had any lapses only the developer. I paid my responsibility on time but they didnt even notified or gave an updates regarding the status of my lot. What are the right thing to do? Hi, most likely yung developer na napagbilhan niyo ay walang License to Sell mula sa DHSUD. Kung sinabi ng may-ari na ibabalik niya yung buong refund kahit na installment basis, I think ok po yun kaysa wala talaga. Kasi may mga ibang real estate developer walang binabalik ni isang kusing tapos nagtatago na po may-ari at mga staff. Kapag nag-miss ng balik sa inyo ng pera at hindi talaga binalik, saka niyo nalang po ireklamo sa HSAC. Gastos din sa parte niyo yung pag file ng complaint sa HSAC at pag nabaon lalo sa bayarin yung developer baka mas lalong matagalan mabalik yung perang nahulog niyo po

Hi po. Hoping to get an answer, Jan 2022 bumili kami ng foreclose property under lhoopa developer. Dec. 2022 na turn over samin yung bahay. Feb 2023 natapos kami ng payment and everything sa lhoopa. But still up to now wala pa rin kaming connection ng ilaw at tubig. yung tubig possible naman ma process. pero ung kuryente hindi tlga coz LGU's asking for building permit. Hello, opo, supposedly ready na yung utilities bago kayo mag-move in. At hindi nag-iissue ng License to Sell ang DHSUD kapag hindi nag-comply po. By the way, hindi niyo po kailangang humawak ng building permit kung ang developer ang mag-construct. Under P.D. 957, walang prescribed na interest rate. At kung walang interest rate na nakasulat sa Contract to Sell, pwedeng sundan yung legal rate sa Article 2209 ng Civil Code na 6% per annum po.

Hi Maam, paano po kapag si developer po ang nag cancel nung project and nagstart po kami magbayad ng installment since 2019, then suddenly sabi po sa amin dun sa office ng developer is cancelled daw po ung pagdevelop dun sa block na kinabibilangan ng lot namin, pwede po ba kami magdemand ng interest sa kanila kasama ng full refund at ung reservation fee na binayad namin? sana po ma notice. Hi po, medyo matagalan pa po siguro bago ko magawan kasi marami pong nakapilang content. Pero ito summary po, after pre-approval ng bank home loan, execute Deed of Absolute Sale then comply lang lahat ng list of requirements ng bank. Pag na-submit po iyon, i-release na ng bank ang loan proceeds sa seller 🙂

Hi Ma'am. Sorry po kung di connected sa video. Gusto ko lang po sana magtanong. May kinuha po kasi house & lot ang mother ko OFW, wala po sya title kaya ang nangyari ay rent to own. 1.5M po price, sa rent to own po nakapagbigay na kami ng 440k. Hinihintay nalang po ang title para makaloan kami sa bank ng kulang. Tanong ko lang po saan po ba papasok yung loan namin housing loan po ba or personal loan? Salamat po. ❤

Hello, pwede po sa housing loan kapag available na ang title nung seller. Kapag nag-personal loan po kasi kayo, mas mataas ang interest at shorter ang loan repayment period 🙂

Pwede po ba nmin.idemanda ung developer (CASIMIRO) dhil may issue po sa meralco at.maynilad (are these considered as unsound practices?) Misrepresentation?) we cannot facilitate the unit because of the problem up to now we don't have electricity and water supply. Only connected to the residential houses near the subdivision. Unfortunately, CASIMIRO developer is already hiding and office already closed. You can reach them when you have to pay mnthly amort via in-house finance. Can we file this as a complaint? Thank you..

Opo, pwede po kayong mag-file ng complaint kasi sa implementing rules and regulations ng presidential deceee no. 957, bago sila magbenta mandatory na may connection sa appropriate public water system pati sa primary source electric power supply na available sa locality po kesyo open market housing o medium cost housing po. Pati nga po drainage at sewage disposal system kasama sa plano po. Mag-file na po kayo para kung hindi talaga magamit, masoli man lang sa inyo yung nahulog niyo at bumili nalang po kayo sa mas maayos na developer

Hi po Ms Me-an! May i ask po, if a friend recently signed CTS in front of the registered sales agent. Ano pong documents ang dapat na ibigay kay buyer as proof na officially yung unit is sya na ang nagbabayad ng downpayment? Although documented naman na posted ang check payments kasi nag-email si developer attaching the receipts. Pero other than that can we have like a buyer's copy of CTS?

Hi ma'am, kumuha ako ng unit and after ma fully paid ang dp (300k) isang taon mahigit na hindi pa maturn over ang unit, and nalaman kong may hindi nila naipasa ang annotation of land title pero pinapaniwala ako ng developer na complied na nila sa pagibig, kaya nag decide na akong irefund nalang yung binayad ko. Nireklamo ko na sila sa DHSUD/HSAC pero nagmamatigas silang wag mag refund, either ipasalo ko or ituloy ang pagkuha ng unit which is imposible saken lalo yung tuloy ang pagkuha kasi kakapahintay nila saken ng refund e nawalan na ako ng work (ofw). Nakikipag deal na ako sa kanila last time na ibalik nila kahit 50% ng binayad ko para lang matapos na pero pinapanindigan nilang ang pwede ko lang gawin is ituloy ang pagkuha ng unit. Ano pa po ba ang maari kong gawin para makuha yung refund? Isang taon na po halos akong nangungulit sa kanila at super stress na ako.

Hi question lang po..need ko pa po ba bayaran ung pending fees ko po sa smdc..nagcancel kase ako ng property..and sabi nila wala na ako marefund sa mga nahulog ko…whch is okay..kse ilang buwan palang naman ako naghulog at hindi pa rin ako nkasign ng CTS…kaso c agent ko po bayaran ko daw ung hndi ko nabayaran last few months po..need ko po ba bayaran un talaga???sana po mapansin nyo…thank you…

Hello, kung hindi niyo na po itutuloy ang purchase at wala pa naman pong CTS, no need na pong bayaran lalo na kung napa-cancel niyo na po ang purchase. Hindi na po dapat kayo kulitin ng agent na magbayad po 😊

Hi po, meron po kamo hsac case against developer at nag favor sa amin ang decision at may order na sa condo developer na ayusin yung mga issue ni complaint namin. Tapos na rin kami naka file sa finality. Nag lapsed na rin yung timeline ma 6 months sa hsac order pro wala pa rin paki ang condo developer kahit 5 session na in 6 months with hsac sherrif at walang progress sa order. Umabot na 1 year since sa order. Ano po ba dapat gawin? Kasi yung hsac parang na umpluwmesyahan na..
