@@user-cs3zs6jn1dYou're not wrong, but we're only hearing the side of the aggrieved. (and second hand, from her family member to boot) It is unlikely but not impossible she's slightly or entirely (accidentally or on purpose) misrepresenting what happened. (IE. She hired someone to knock down 551A and their subcontractor knocked down 551A-1.) It's not considered a crime because it's not "malicious". When we start protecting people that cause serious harm just because they are lazy and incompetent.. then we are in trouble. The US seems to think the civil courts can fix all these issues. No. Companies have deep pockets to stall legal proceedings... while the individuals harmed must scramble to just try and live with what they caused while also finding legal representation willing to take the case. When these companies realize they screwed up.. they just pack up and leave. They make no effort to communicate with the owner of the home they "accidentally" destroyed, leaving the home owner to scramble to find out who and why. One thing that would fix this would be Federal Law that allows a plaintiff to collect Legal Fees if they win a lawsuit. Then companies would be //////way////// more concerned with limiting the legal costs of their victims before making them whole.

I am the third generation owner of our family home. People don’t realize that this is not just a home, it was a place where family memories were made for years and years. A new home would not BEGIN to replace that! That company definitely owes the woman, a new home, and for the old debris to be hauled away as they say they do. A simple apology would have been so good, and a vow to make things right. If they done that, the woman would not have been on the news, and their company would not be getting all the bad rep! I think they generally do. You have to look into the company that did this though as there were probably some mis-steps (obviously) in that process. In fact I have a friend who does construction work on houses and refuses to work on someone's house unless they are home at the beginning when he starts the construction so they are aware of the process (with some exceptions -- like the person cannot live in the home during the construction work, and then they sign a document stating that he was doing the work and the work he is doing). I’ve heard of tree removal companies rolling up and removing the wrong person’s tree before which is insane also. With any removal/ demo, there should be a requirement that the homeowner is present and consulted before work begins. And if the home is condemned, the appropriate rep should be there to confirm prior to anything being torn down.

If a house is set to be demolished, they should be able to tell, because there'd surely be notices everywhere, including on the front door, the letter box and water mains connection. The electrical switchboard would also be tagged to say it's been disconnected. It must also be a legal requirement to check those things before commencing a demolition.

@@Max-Headroom- It does matter. The value of the house was in no way worth a new house. Someone posted the address of the house. There is a reason the News didn't show a picture of what it looked like, but if you looked at the rubble, you would be able to tell it was a half rotten house. From the street view on Google maps, the house was in terrible condition and the roof looked like it was about to cave in. They were not keeping it in good condition and it looked like it was currently unlivable. She definitely wouldn't win a new house by any means. The value of that house was probably no more than a few thousand, and that's being generous. Not to mention, since it was an abandoned house, it had no valuables in it because no one lived in it. It was just an empty house falling apart. And saying lost income due to emotional distress over a house that was about to fall apart by itself is a bit of a stretch. XD They could easily fight that in court by saying if she really cared about the house and it meant so much to her (sentimental value, and not it's actual value), that she wouldn't have left it to rot and start falling apart. They could probably also fight and say it was already a health hazard (the roof was about to cave in), should have been considered condemned, and that it needed to be demolished anyway. Worst case would be them getting the city to agree that it should have been demolished for being a health hazard and make her pay the company that demolished it. (I don't know the exact laws and how you can apply them afterwards, so I'm just giving my unprofessional thoughts here of possibly ways it could play out.) So I don't think she'll be getting much if she tried to take it to court to get lots of money. My opinion though, as a lot of judges are idiots/ can easily be paid off and you never know what you might win. lol

@FelonDog
@FelonDog 8 ай бұрын
@@inksday My comment was literally relevant. Based on how laws normally work, the replacement would be the VALUE the house was currently at. And I did not say anything about anyone being able to knock down anyone's property just because of how it looks, so YOUR comment to me was irrelevant. If someone crashes into your car and totals it, will they have to buy you a brand new car? No. They will only be ordered to pay you the current VALUE your car was worth before it was totaled and that payment would go toward you buying another car yourself and footing the rest of the bill. You don't just get a brand new car replacement worth more than your car was worth. Just doesn't work like that. They aren't going to get a brand new house built. The most they would get would be the value of the house. Which once again, would hardly be anything. Perhaps the company would have to pay a fine for the mistake they did as punishment, but the homeowner won't see a cent of that. I'm just being realistic here. And what I said was completely relevant. Just because you FEEL like they should get a brand new house built doesn't mean anything when discussing what WILL happen based on how laws work.
