Both parties appear to be quite daft. As Judge Judy rightly said, it's absolutely ridiculous for Plaintiff to spend money on the car BEFORE receiving a Title to the car, and it is equally ridiculous for Defendant to sell a car that she didn't have a Title to, and then expect the Plaintiff to do the work to get the joint owner's ex-wife to sign over her share of the car.

JJ's judgement was awarding the defendants with a running car with work done on it worth 2,500 approx. ( as JJ awarded that to the plaintiff). They already got $500 from the plaintiff for the sale of the car. JJ said that the woman scammed the guy by selling a car that was not hers. So why did JJ give the scammer a car worth 2,500, felt like it was a reward for her scam. I think JJ should have asked the plaintiff to take out the new engine ( worth $1800 or whatever) and return the car with old engine to defendant . He is in the business of fixing cars so he can use it in the future or sell it. This way, the defendant would not be getting too much benefit from her scam. Plaintiff should have been awarded $500 he paid for the car and another say $600 for additional work and labor he put in that car. Any other loss he incurred, he would have to eat it for he started work on car before he got the title.

JJ doesn't understand the realities that working people face, which is why her ruling was as it was. The plaintiff found what he believed to be a really good deal on a non-working car whose body and frame were in good condition, and he knew that he could get it running again at a total cost to him of less than Blue Book value. Since used car dealerships sell cars at well above BBV, from his POV, he made the correct purchasing option.

He can always choose to take off the parts he put into it and tow it off his property. Then he can resell the parts car he claims he spent over $3000 for. The defendants or the actual title owner can deal with the abandoned nonrunning car. If he had waited to get the title before doing anything else, which is what a reasonable person would do, he could have returned the car, gotten back his initial $500 and wouldn't be out anything.

Because the defendants admitted that they couldn’t get both of the legal owners to sign over the title. Their cousin’s ex wife is incommunicado.
@brt5273
@brt5273 2 жыл бұрын
Because that $3225 is actually coming out of her show's pocket. That would mean that she would be paying him $3200 for being stupid and putting that work into a car before he had the title in his name, and the actual title owner would end up with the now running car because they were never party to this deal. If he had waited like he should have he would just be dealing with recouping his $500 and that would be that.

She can't order the title transfer since none of the party present owns the car. She can't force the owner (which is not them) to agree to their deal. And maybe he should have waited for a title. But if she making him return the car because he cant get a title then the. Defendant should pay the full price of what he had into the car! He's not trying to charge for labour he's trying to charge for the parts. So the Defender gets a new running car for $2,500. Plaintiff should have ask JJ to ammend his complaint to return it exactly as he bought it especially if she wasn't willing to award him what he put into it. He could have taken his engine out and put the old engine back in and told JJ just to give him back his $500 and for them to come and pick up the vehicle in the condition he bought it, eating the cost of the fixed scratch and his time. Then he could have turned around and sold the engine for closer to what he paid for it then what she was willing to give. Because giving them back a now RUNNING vehicle makes it worth more and the defendants are getting out ahead and they can turn around and sell it at a much higher value because it's no longer in poor condition. This is one of the few times I disagree with JJ's assessment of the situation.

This is what the law has become - a distortion of facts through legal 'opinion'. Consequences occur due to being shady, as fully demonstrated by the defendants, and rewarding them by opting him money that HE has to swallow penalized him. And this is considered fair. No this kind of fair encourages more scamming, especially by those who now leave the court with a form of permission because of WEAK justice. It was a set-up, and Judy helped these criminals.
