The plaintiff says the defendant was her longtime landscaper, but he damaged the side of her house with his equipment and won’t pay to fix it. She fired him, and now she’s suing him for the cost of the home repairs. The defendants say the damage was old and must have been from her previous landscaper. They offered to fix it, but the plaintiff refused and insisted on all new siding.

I disagree with this. They essentially settled a year ago with a “be careful next time.” There should definitely be an expiration date on the right to demand compensation/repair. She only had something to say after her son said something. I was totally expecting JM to hit her with the “if it was good enough for you then, it’s good enough for me now!”

Not at all. Be careful next time means Don’t do it again, not that the landscaper is off the hook. She could still want what they damaged to be repaired. That’s fair.

Vinyl siding does fade over time and it also becomes discontinued and not able to repair in some cases. However, in most cases it can be repaired and only cause a slight eyesore until it also fades and blends with the other siding eventually.

My uncle owns a landscaping business. Damage happens all of the time. Nothing major. But the equipment can be difficult to handle at times. It’s better if the landscaper is upfront about it and is willing to admit that it can happen than them trying to lie and deny it.

I think it's because the defendants were immediately willing to assume culpability based on the odds that it was probably one of their guys. I'm guessing if they had always refuted liability then the Plaintiff would have to prove it was them

I can attest to vinyl siding fading, we installed ours 33 years ago, and I look at photos back then compared to now, and it has definitely lightened up. Rocks say shooting from a lawn mower for example, will also make holes in it, especially if a panel is disconnected, which also happens from time to time as well. Putting a few new panels up are going to be an eyesore, because they won't match. That is why sometimes you see a house that looks a little two-toned!

Yes it does, we have all our extra siding in our attic from when the house was built. Had to replace a piece that was damaged this year and the replacement piece is substantially darker than the rest. Sun does bleach vinyl.

I like this defendant. It’s unreasonable to expect an entire side of the house to be replaced for a tiny bit of damage. Even her guy is saying he can’t match the siding, so what is she going to do with $1,600? I wouldn’t work for her any more. She sounds like a problem customer. The story about the worker saying they damaged the siding [a year ago] but her not getting a name or a statement from them doesn’t jive. I’d imagine the worker agreed with her to not cause a scene or English wasn’t their first language. If she didn’t notice the damage for a year that’s a problem. Moreover, she should have called immediately after it happened. If my landscaper destroys something my duty is to communicate about it ASAP. You can’t go from “I need you guys to be more careful” to “I want the whole side of my house repaired” to “I’ll see you in court”.

she wouldn't have sued if it wasn't for her son. the son wanted money, the end. vinyl siding also does fade, the side of the house that gets a lot of sunlight WILL fade.

Yeah that judgment was bullshit. To blame someone for damage that was there for years? And then do the whole side of the house. You can keep making the argument about the siding matching and say the whole house should be redone.

I disagree with the judge. The plaintiff said she knew they’d damaged her house, paid them in full for the following year and then wanted her money back AFTER her son asked why she rehired them. And yes, vinyl siding does fade. If you installed brand new siding alongside siding that’s been exposed to the sun for Seder so years, the color won’t match. But according to JM they shouldn’t have told the homeowner that. “Install it and see what happens.” 🤦🏽‍♂️

Looks like JMs retort of I'm a contractor's daughter and contractor's sister bladdy bladdy blah was useless. The fact she said she researched it and found they don't fade either is a pathetic lie or she's extremely untalented when it comes to typing into a search engine vinyl CAN be sunbleached after years of exposure to UV Rays I don't even need to look into it to know this is a true fact. She should have known better but instead she takes her uneducated guess and runs with it while calling the defendants liars. Harvey was the same acting like the whole crowd was wrong basically anything becomes sunbleached overtime that's just common sense. If you're going to make a judgement using a certain so called "fact" you should damn well be certain you have the correct information.

The judge has such double standards, if the plaintiff was happy with a 'be careful next time' attitude then how was she allowed to change her mind 3 years later and sue for the full price of making it all new again when it wasn't 'new' when it was damaged. The judge always says you should just be made whole, but this plaintiff got a brand new siding and no reduction for the fact that hers was already old AND with NO proof it was even them...

I think it's because the new vinyl wouldn't match the old vinyl, so in her mind you wouldn't be made whole with mismatching vinyl, and the defendants assumed liability for the issue as soon as the Plaintiff complained. They never refuted it wasn't them. I'm guessing if they did then she would have the burden to prove it was definitely their guy

Vinyl siding takes 10 to 15 years to fade and can be painted with latex paint. She was not a likeable plaintiff

Her son was hired to care for the landscaping and then rehired her son again. Some does not smell right in this. Her son the landscaper did notice the damage the year before and did nothing.

The judge has stated many times how her father is a contractor on she knows things. How could she not know that vinyl siding fades/oxidizes over time? Also, if you replace the old with new there will be a difference for a period of time but the new will fade and blend in. I had a similar situation a few years ago. 2 pieces of siding, old siding, got damaged. It was so old it was discontinued and there wasn’t available matches. The customer expected me to reside his entire house for free. Well needless to say we went to court and that didn’t happen. The judge allowed the price of the job I did to be waived, which was worth more than the siding that was damaged, as restitution for the damage. So the customer then posted all kinds of nasty reviews about me. I sued him for defamation and got the money for the initial job plus another 2500. Lol. How do you like me now?

This was ridiculously. Shit happens. Vinyl fades or even if you can find the same manufacturer there is a possibility they they don’t use the exact same paint or color anymore. And 3 years later when she can’t even prove it was them that damaged it. Come in judge what happened for the burden of proof. I usually tend to agree with her. Not feeling it this time.

Sunlight darkens timber but fades vinyl (plastic) and paint. It's a natural phenomenon!

Yes, vinyl does fade. When my house was built (1985), they put all the extra siding in the attic this year we had a heavy wind storm and blew my grill canopy into the side of my house breaking a piece of siding. I replaced it with the extra siding and the replacement piece is substantially darker than the rest. Sun bleaches vinyl.

Vinyl definitely fades. Went through it with the insurance company. They have experts that test samples to make sure it matches. This lady should've done the same thing. She can't prove they did the damage.

My grandparents house has some type of plastic siding. It has never faded or broke. It's over 30 years old.

Our vinyl definitely faded.. on another note we had tornado damage once and the insurance company had to replace the WHOLE house because the original vinyl wasn’t made in that color anymore and there was no way to match it up with what’s on the market now. But I can say the new vinyl has absolutely faded. Along with our deck umbrellas and deck itself 😂 the sun is BRUTAL

This was a big deal in the insurance industry a few years ago where people had one side of their houses damaged during a storm but you couldn't just replace one side without it looking funny because of fading or because the color was no longer available. But insurance companies didn't want to pay for three brand new sides that were not damaged.

Vinyl siding fades, cracks, effloresces. Furthermore even if the same siding with the same color designation were purchased the color may vary per the manufacturer.

Vinyl siding does fade! Also they have patch kits for vinyl siding that is only like $10, it is like patching drywall. I know I have used it and it works great!

The repair would have looked fine it was on the bottom side of the house a fence was five feet away where would you have to stand to take a good look to see if it didn't match. When they do the whole side you will be able to see it from the front of the house and the back for fifteen or twenty feet when the sides don't match up to the front and back. Bad decision, Judge Milian fell for the old lady with a accent and puppy dog eyes seen it a million times.

The landscapers worked for the plaintiff for 8-12 years. It’s a shame that they couldn’t work it out. Now she has to hire new landscapers.

Those pictures looks like the old metal siding considering the bend and dents. Vinyl breaks. You can't bend the edge back like that with vinyl.

I don't understand where the discrepancy was between these two litigants because clearly damage was done by the defendant's company to the plantiffs home, so why not just pay the amount requested to not have to come to court and end up paying any with a judgment at you. People try to weasel out of so many things instead of just owning up to your wrongdoings.

They wanted to only fix the bottom the defendants but the plaintiff wanted the entire siding of the house redone I believe. I feel like her son was in her ear on trying to get more out the situation and this caused more issues that I believe she could have resolved without him

I think the judge was dead wrong on this two by years in life I have put I have made final siding for several by projects building homes. You have to look at it like this say you bought the tin Man. You leave the tin Man outside in the elements for 3 years 4 years 5 years farther etc etc. Am I going to expect the tin Man to look just as brand new Justice sparkling as he was when we installed him to the house no I don't expect it the judge does it have experience is the green thumb it's somebody's construction beds or projects because she just doesn't she's a court judge I don't see her toolbox I don't see her tool belt I don't even see her coming up with a good explanation why it fades okay thank you
